1 University Moot Court Selections (UMCS) Organised by Moot Court Committee Dr. Ram Manohar Lohiya National Law University Lucknow Rules & Guidelines Introduction The Moot court committee shall be organising the University Moot Court Selections for the present academic session from August 22 to 24, All students enrolled in the B.A.LL.B. (Hons.) (Including the Ist year students) program are eligible to participate. The University selections would include all the Competitions with the exception of Henry Dunant Memorial Moot Court competition, 2009 which will be held separately. The last date for registration of the team for the UMCS shall be August 12, Teams which have already registered earlier need not register again. Those teams who wish to make any alterations in their team composition must inform the Convenor latest by August 12, The last date for memorial submission is August 17, Team Composition A Student can register with only one Moot Team. The team composition shall comprise only 3 members consisting of two Speakers and one Researcher. Nevertheless, a team comprising only two speakers are also allowed to participate. In case of teams selected for competitions allowing more than three members, the same shall be arranged on the decision of the respective team members after consultation with the Chairman, Moot Court Committee. Language 1

2 The official language of the UMCS is English. Implementation and interpretation of rules regarding Moot Court practice and procedures, the final decision on the interpretation and implementation of rules lies with the Chairman, Moot Court Committee. Competition Format The UMCS shall be extended to three days with the first two days reserved for preliminary rounds while the second day for quarter finals and Semi finals and the last day for the Championship Rounds. Qualifying Rounds (Memorial Round) On the basis of Memorials submitted by the participating teams top 50 teams will be selected on the basis of the marks awarded by the judges after evaluating their memorials. The written memorials submitted by participating teams shall be evaluated by an expert appointed by the organising committee and marks will be awarded for them. In case there is a tie even number of teams will be selected. Preliminary Rounds (Oral Round) The teams shall argue cases against each other; the matching of teams will be decided by a draw of lots prior to the commencement of the competition. During the preliminary rounds, each team will have the opportunity to argue from both the sides. After conclusion of the 2nd Preliminary round, the MCC will declare the list of eight (8) teams that have qualified for the Quarter Finals of the competition upon the marks awarded by the Judges during the preliminary rounds of oral presentation of the teams. Written memorials marks will not be taken into consideration during the marking of Preliminary rounds. Only the marks awarded by the judges during the oral round of presentation will be considered to select the Quarter finalists. In case that two or more teams have the same cumulative oral rounds score, then the team with the higher memorial score will be taken in to consideration.. Quarter Finals (Knock Out Round) The top eight teams qualified from the Preliminary Rounds shall argue cases against each other in the Quarter Finals of the competition; the matching of teams will be decided by a draw of lots prior to the commencement of the Quarter Finals. The arrangement of teams selected for the quarter-final rounds shall be as follows: o Those teams that have qualified for the quarterfinal will be divided in to two groups Group A, and Group B. 2

3 o Out of the top 8 teams the team that attainted the highest score in the preliminary round will compete against the team that attained the lowest score. o The team with the second highest score will compete against the team with the second lowest score. o The team with the third highest score will compete against the third lowest score. o The team with the fourth highest score will compete with the fourth lowest score. The sides to be argued by the teams will be decided by a draw of lots, prior to the commencement of the quarterfinal rounds of competition. Written memorials marks will not be taken into consideration during the marking of Quarter Finals. Only the marks awarded by the judges during the oral round of presentation will be considered to select the Semi finalists. After conclusion of the Quarter Finals, the MCC will declare the list of teams that have qualified for the Semi Finals of the competition. Semi Finals (Knock Out Round) The top four teams from the quarter-final rounds shall qualify to participate in the semifinals. Selection will be based upon the marks awarded by the Judges during the quarterfinal rounds of oral presentation of the teams. o Out of the top 4 teams the team that attainted the highest score in the quarterfinal round will compete against the team that attained the lowest score. o The team with the second highest score will compete against the team with the second lowest score. Written memorials marks will not be taken into consideration during the marking of semi final rounds. Only the marks awarded by the judges during the oral round of presentation will be considered to select the finalists. After the conclusion of the Semi Finals, MCC shall declare the finalist as well as the marks of the teams who have not qualified to the Finals. Championship Rounds The top two teams from the semi-final rounds will be selected to compete in the final round of the University Moot Court Selections. The Finalist will be given an opportunity to argue from the sides. There shall be two rounds of arguments by the final teams. The sides to be argued by the teams will be decided by a draw of lots prior to the commencement of the final round of competition. There shall be a break after the first round of arguments. After the break, the team that argued on behalf of the plaintiff in the first round will be required to argue on behalf of the respondent; the team which argued on behalf of the respondent in the first round will be required to argue on behalf of the plaintiff during the second round of the arguments. 3

4 MEMORIALS The Memorial shall consist of the following parts: Table of Contents Index of Authorities (including corresponding page numbers) Statement of Jurisdiction Identification of Issues Statement of Facts Summary of Pleadings Pleadings including the Conclusion and/or Prayer for Relief. Each Memorial shall have the following on its Cover Page (On Simple White Paper): The Team Code on the top right hand corner of the Cover Page. Name of parties & their status. Memorial Submitted To Memorial Filed on Behalf of Counsel appearing on Behalf of A Team Code shall be given to each of the participating teams. Team Code shall be provided after the registration is over. It shall be communicated to all the participants in due course of time. The team shall have to submit 3 hard copies and 1 soft copy of the memorial. All memorials shall be prepared to the following specifications: o The teams are not required to use Blue/Red Colour paper as cover page for the purpose of signifying the sides. 4

5 o The teams are instructed not to spiral bind their memorials or use plastic sheets. The submitted memorials must be neatly stapled. The use of plastic sheets or spiral bounding will draw penalties. o Memorial or counter memorial shall not be more than 15 typed pages. o Memorials must be typed and submitted on standard A4 size paper with black ink. o Font and size of the text of all parts of the memorial (excluding footnotes) must be the same and must be in either Times New Roman 12 or Arial 11 font size. o The texts of all parts of each memorial must be single spaced, with one inch margin on both sides. o The text of footnotes and headings may be single-spaced. The font size of footnotes must be 2 points less than the text font. Footnote must not be explanatory in nature. The Harvard Blue Book Style of footnoting must be followed as far as practicable. In any case, Footnoting must be uniform throughout the memorial. o Quotations of sources outside of the memorial of fifty words or more in any part of the memorial shall be block quoted. o The statement of Jurisdiction, Statement of facts, Identification of Issues, Summary of arguments, arguments including the Conclusion and/or Prayer for Relief must fall with in the prescribed page limit of 15 pages. The table of Contents, Index of Authorities and Case Titles are not included in the 15 typed pages limit. EVALUATION OF MEMORIALS Memorials will be evaluated maximum out of 100 marks (50 marks for each side). Memorials shall be evaluated on the basis of the following criteria: a) Application and appreciation of facts b) Identification and presentation of issues c) Application of legal principles d) Use of authorities and precedents d) Logical structuring & Writing skills f) Proper footnoting & formatting Penalties Penalties shall be deducted after the memorial has been evaluated late submission of memorials: 2 penalty points plus an additional 1 penalty point per day after the relevant deadline provided for by the organizer under the Official Rules. Failure to comply with page limit: 2 penalty points for every page above the limit specified. 5

6 If two or memorials are found to be substantially similar and the MCC, upon consultation with the memorial judge(s), is of the opinion that there has been copying between the two memorials, then he may impose a penalty on the total marks awarded towards memorial evaluation which may extend up to disqualification of the team. There shall be an exchange of memorials on 21st August between the respective opponent participating teams as would be placed after the draw of lots in all the rounds of the competition. No amendments can be made to the Memorials after submission. ORAL SUBMISSIONS PROCEDURE Court language shall be English only. The time limit for Preliminary Rounds shall be twelve (12) minutes for each team. This shall include the submission of both the student counsels from the team excluding the time for the rebuttals. No counsel may reserve more than Six (6) minutes for his/her individual speaking time. The team appearing from the side of Appellant will be given Three (3) minutes for rebuttal after the Respondent team completes its argument. The Respondents shall be given opportunity to rebut the arguments of the Appellant. The time allocated for sur-rebuttal will be limited to three minutes. One speaker from each team will be permitted to rebut. The teams are duly instructed not to utilise their time for rebuttals for the purpose of oral arguments. This time split must be communicated to the Court clerk prior to the beginning of the round. 6

7 There will be no extension of the time. In the event where the judges are of the opinion that a certain exigency does require an extension of time, they may extend speaking time for a team by a Maximum of three (3) minutes. There shall be no communication, oral or otherwise using chits, etc., between the counsels table and the speaker. Participants seated at the counsels table may use laptops in the courtroom but must ensure that this does not interfere with the court proceedings. The use of laptops or any electronic gadget is strictly prohibited on the podium while presentation of the arguments. EVALUATION OF ORAL ROUNDS The evaluation would be done on the following criteria; Knowledge of Law Application of Law to Facts Ingenuity and Ability to Answer Questions Evidence of original thought Application of legal principles Style, Poise, Courtesy and Demeanour Use of Authorities and Citations Time Management and Organization (Penalties may be imposed for exceeding time limit and will be subject to the judge s discretion) Effective Rebuttals DELAY IN APPEARANCE / PRESENTATION If a team scheduled to take part in a round does not appear for 5 minutes after the scheduled starting of the round, the other team shall have to submit ex-parte. The criteria of rebuttals shall not be considered in such cases for evaluation in place of which an average for the same would be given on the basis of the marks scored by such team on other criteria. SCOUTING (I) Scouting by the student counsels, researcher will lead to the disqualification of the team. (II) Scouting shall be deemed to have happened if the team is founded witnessing, hearing etc. oral rounds 7

8 (III) Reading a memorial of a team except where I. It is of the team to which he is affiliated; or II. The memorials have been obtained on account of exchange of memorials prior to a round of the team to which he is affiliated. EXCHANGE OF MEMORIALS Team Codes shall be allotted to all the teams prior to the draw of lots. The announcement of the qualifying teams for the oral rounds, draw of lots for the exchange of memorial and declaration of respective court rooms shall take place on 21st August The teams are prohibited from making any marks on the exchanged memorials. The teams are required to return the exchanged memorials to the Court Clerks of the respective round. AWARDS Best Memorial The memorials, which secure the highest marks based upon the cumulative marks of all the two memorials submitted, shall be adjudged as the Best Memorial. Best Student Advocate The Student securing the highest mark in the entire competition will be adjudged as the Best Student Advocate. Rebuttal marks awarded will not be considered to decide the Best Student Advocate. MISCELLANEOUS (I) If any one of the members of a team be notified / informed of any detail or information, it shall be deemed as if the said team as a whole has duly been notified / informed. (II) Participants are strongly advised against any outside assistance (direct or indirect) or through the University faculty for the purpose of this competition. Non adherence of this rule shall attract strict action against all the participants of the team concerned. (III) No assistance shall be provided from Room No. 101 in regard to the competition. 8

9 (II) In case of any doubt in either understanding any of the details or interpreting them, the decision taken by the Chairman, Moot Court Committee shall be final and binding. (III) Drawing of lots for the 1st Round shall take place on 21 st August Further details about the venue and time shall be duly informed and notified. (IV) Rules should be strictly adhered to. Any deviation thereof can attract penalties and maybe even disqualification. (V) The Chairman, Moot Court Committee shall resolve unanticipated or unexpected contingencies, if any, and the decision in this regard shall be final and the acceptance of any such decisions is a precondition to participation in the Competition. Important Dates 12 th August 2009: Last Date of Registration. The forms shall be available in Room No th August 2009: (Latest by 1700 hrs) - Last date for the Submission of three copies of the memorials from both the sides. 21 st August 2009 Declaration of the qualifying teams for Oral Rounds, Memorial Exchange and Draw of lots for the Preliminary Rounds. 22 nd August 2009 Preliminary Rounds 1 and rd August 2009: Quarter Final and Semi Final Rounds 24 th August 2009: Championship Rounds Ranking The final ranking shall be declared on 25 th August SELECTION FOR THE MOOT COURT COMPETITIONS After conclusion of the Final rounds, the organizing committee shall declare the overall results of the competition. The team ranking First (1st) would be asked first for its preferences. Then the team ranking Second (2nd) shall be given chance to prefer their choice which shall EXCLUDE the Moot Court Competition opted by the team ranking first. 9

10 This preference shall continue per se the rules till the exhaustion of the Moot Court Event listed. The teams not being eligible for any competition due to their lower ranking shall be deemed as disqualified, once the Moot Court Competitions included for this session (displayed in the list) are exhausted. ANY TEAM CANNOT WITHDRAW AFTER REGISTERING FOR ANY COMPETITION. THE SAME WILL ATTRACT SEVERE PENALTY WHICH MAY EXTEND UP TO THE DISQUALIFICATION OF THE TEAM MEMBERS FROM THE NEXT GRAND-INTRA BUT WILL BE SUBJECT TO THE DISCRETION OF THE CHAIRMAN, MOOT COURT COMMITTEE.
