INTRODUCTION 1.1 Carlsberg Malawi Cup is a national football competition introduced by Carlsberg Malawi Limited primarily to promote and develop the game of football and providing wholesome entertainment to soccer loving Malawians across the entire breadth of the country. 1.2 Carlsberg Malawi Cup shall be administered by Football Association of Malawi (hereinafter referred to as FAM), the governing body of football in the country, mandated by the Federation of International Football Associations (hereinafter referred to as FIFA) to organize, administer, develop and control the game of football at all levels. 1.3 The official sponsor of Carlsberg Malawi Cup is Carlsberg Malawi Limited ( The Sponsor) that has pledged to sponsor the Competition to the tune of MK 30 million for the year 2014 football season The Competition is scheduled to run approximately for a period of three (3) months starting from 14 th May to 27 th July TERMS OF REFERENCE 2.1 Carlsberg Malawi Cup shall be administered by FAM through an Organizing Committee. 2.2 The mandate of the Organising Committee is limited to the technical and administrative requirements of Carlsberg Malawi Cup. 2.3 The Organising Committee shall be appointed by FAM comprising of reputable members of the general public who are conversant with the running of football in the country. 2.4 The Organising Committee shall appoint its own Chairman, Secretary, Treasurer and other office bearers as may be determined by the Committee. 2.5 The Organising Committee through FAM shall manage and control the funds of Carlsberg Malawi Cup. The sponsorship funds will be accounted for at the end of the competition by the Organising Committee. 2

3 2.6 The competition shall be contested for by registered teams from the Leagues in the three regions of the country namely: Southern Region, Central Region and Northern Region Football Leagues having fully paid up registration fees as per clause 4.2 of the rules and regulations. As a condition to participation, all teams shall fully comply with rules and regulations of the competition. 2.7 The competition will be governed at all times by the rules and regulations of Carlsberg Malawi Cup and as well as the Statutes of FAM and those of FIFA. The competition shall be played as Association Football, regulated and controlled by the laws of the game as promulgated by the International Football Association Board (hereinafter referred to as IFAB). 3. MANAGEMENT OF TROPHY 3.1 The trophy shall be provided by Carlsberg Malawi Limited and shall remain the property of the Sponsor. 3.2 The sponsor shall present the trophy to the winning team who shall keep custody of the trophy for one season on a rotational basis. The trophy shall be returned to FAM at the launch of the following year s competition. In the event of loss of the trophy, the holders of the trophy shall be liable to pay FAM for the full cost of the trophy. 3.3 If a team wins the competition for a third time in a row, it will be entitled to keep the trophy for good. In such event, a new trophy will be supplied by the sponsor as a replacement. 3.4 If for any reason the competition will cease to be held, the trophy will be returned to the sponsor. 4. REGISTRATION OF TEAMS 4.1 Registered teams that intend to participate in the competition must register with the Regional Organising Committees in each Region. 4.2 The following shall be the registration fees for teams legible to participate in Carlsberg Malawi Cup: a) Regional level MK 10, b) National level MK 20,

4 4.3 The above mentioned fees shall be nonrefundable. Failure to pay the fees in full shall result into disqualification of the affected teams. 4.4 Participation in the competition means acceptance and compliance with the rules and regulation contained herein. 5. FORMAT OF THE COMPETITION 5.1 Carlsberg Malawi Cup competition shall be played in two phases as follows: Regional phase and National phase. 5.2 REGIONAL PHASE The teams registered with the Southern Region Football League (hereinafter referred to as SRFL), Central Region Football League (hereinafter referred to as CRFL) and Northern Region Football League (hereinafter referred to as NRFL) shall play against each other in the Regional phase in their respective regions The fixtures of the Regional phase shall be determined by a draw and the order of play shall ensure that the team drawn first plays host. The winner of the event qualifies for the next round of the competition At least seventeen (9) teams from the three regions shall qualify for the national phase of the competition as follows: a) Southern Region 3teams b) Central Region 3 teams c) Northern Region 3 teams 5.3 NATIONAL PHASE The National Phase shall comprise of fifteen (15) teams from the Super League and nine (9) teams that have qualified from the three regions making a total number of Twenty Four (24) teams These 24 teams shall play on a knock out basis. The Top 8 teams from the Super League as per first round of 2013/14 TNM Super League log table will be seeded during the draw for National phase play offs. 4

5 5.3.3 A draw shall be conducted to determine the fixtures and the order of play shall ensure that the team drawn first plays host. The winner of the event qualifies for the next round The matches shall be played in accordance with the fixtures established by the Organising Committee All the games shall be played in match venues that have been approved by the Organising Committee The matches shall take place over the weekends, during the week or during public holidays as advised from time to time by the Organising Committee. 6. ORGANISATION OF THE COMPETITION 6.1 The Organising Committee shall administer the competition through the Competitions Desk which shall coordinate management of the competition with the Regional Committees. The Competitions Desk shall comprise of members of the secretariat of FAM and other appointed members. 6.2 The Regional Committee shall directly administer the Regional Competition. The Regional Committee shall co-opt some members from the Regional League Committee to assist with the administration of the Regional Competition. 6.3 The Organising Committee through the Regional Committees shall ensure that the host venues comply with all the staging requirements of the competition. 7. PRIZE PRESENTATION AND AWARDS 7.1 Successful teams participating in the competition will receive prize money as jointly determined by the Sponsor, FAM and the Organising Committee, details of which shall be confirmed by FAM. 7.2 The Organising Committee and the Sponsor shall present the trophies, medals, prizes and awards to the excelling teams and individuals at specially arranged Ceremonies marking a successful completion of the competition at each stage of Carlsberg Malawi Cup. 5

6 7.3 Transfer of prize monies will be effected by the Organising Committee within 30 days of concluding the competition; by which time the Sponsor will have disbursed the necessary funds. 8. SCHEDULE AND CONDUCT OF MATCHES 8.1 The time and venue of the matches shall be determined by the Organising Committee as per the draw that will be conducted. 8.2 The schedule of matches once agreed shall be final and binding on all participants. Fixtures can only be changed in the case of force majeure or under exceptional circumstances as determined by the Organising Committee The matches shall be played during the day. Any matches to be played under floodlight shall be expressly approved and arranged by the Organising Committee. 8.4 The matches must be played in accordance with the Laws of the Game decided by the IFAB and promulgated by FIFA. 8.5 All teams participating in the competition shall use registration cards that they use in their respective Leagues unless the Organising Committee decides otherwise. 8.6 All the matches shall kick-off at 2.30pm unless otherwise advised by the Organising Committee. In an event of a draw after 90 minutes, the match will go straight into penalty shoot-outs. All matches shall not be replayed and shall be concluded on the same day unless otherwise stated by the Organising Committee. But in the event of unforeseen eventualities, replay matches shall be scheduled as determined by the Organising Committee. 8.7 The Regional Committees shall make sure that the following reports reach the Competitions Desk in the following time periods: The match reports and match sheets, 2 days at the latest after the match The receipt declaration forms of gate collections, 2 days at the latest after the match The Match Commissioner s match report must be sent to the Competitions Desk within 48 hours. As an alternative, the match report must be handed over to the Regional 6

7 Committee within 24 hours for onward transmission to the Competitions Desk. 9. TRANSPORT FACILITIES 9.1 The Organising Committee shall be responsible for the transport, meals and accommodation arrangements for Match Officials Applicable fees for the Match Officials shall be determined by The Organising Committee. 10. SECURITY MEASURES 10.1 The Organising Committee shall arrange for adequate security of participating teams, Match Officials and spectators Any acts of violence or hooliganism that shall threaten the successful outcome of the match shall be dealt with by the Organising Committee The Organising Committee through the Disciplinary Committee of FAM shall take any appropriate measures to deal with culprits that are deemed to have perpetrated or caused any acts of violence or hooliganism 11. DECISIONS OF THE MATCH REFEREE 11.1 The Match Referee shall be forced to stop a match in the event of the following circumstances: Impending darkness before the end of regular time Invasion of the field or aggression Refusal to continue with play by any team Force majeure 11.2 If there is an invasion of the field or aggression against either team, the Match Referee shall wait for 10 minutes before blowing the final whistle. Under such circumstances, the Organising Committee shall have the discretion to make a determination of the matter after a full assessment of the situation. The team that is responsible for the cancellation or abandonment of the match either through its players, officials or supporters 7

8 shall lose the match by two goals to zero. The Organising committee may take such disciplinary measures as it deems necessary In the event that the Match Referee is forced to stop the match due to refusal to continue with play, the responsible team shall lose the match by a margin of two goals to zero. Under such circumstances the referee shall wait for a period of 10 minutes before blowing the final whistle. The Organising committee may take such disciplinary measures as it deems necessary If the match is stopped before the end of regular time for reasons of force majeure as decided upon by the referee, the match is to be replayed within 48 hours at the same venue For night matches, if the match is interrupted because of darkness following power failure, or equipment or electrical fault, the referee shall wait for 45 minutes for the resumption of the floodlights, failing which he shall signal the end of the game. In this case, the match shall be replayed within 48 hours. 12. RESPONSIBILITIES OF THE MATCH COMMISSIONER 12.1 A Match commissioner designated by the Organising Committee must be present at each match. Upon receipt of notification of appointment, he shall confirm acceptance of his appointment to the Organising Committee The Match Commissioner is the official representative of the Competition who attends the match on behalf of the FAM. In his capacity, he is entitled to a place in the first row of the VIP Tribune If the presentation of the teams to the authorities is planned on the program, the Match Commissioner must accompany the Guest of honour. He shall present the Referee, the Assistant Referees and the Captains of the two teams to the Guest of honour and the formality of shaking hands will proceed accordingly On the eve of the match or on the morning of the day of the match, the Match Commissioner must convene a meeting of the officials of all teams with the Referee and Assistant Referees designated for each match. This will be a consultative meeting 8

9 aimed at underlining and clarifying the main points of the Rules and Regulations governing this Competition including the Laws of the Game. The Organising Committee shall ensure that such meetings take place The Match Commissioner shall ensure the fulfilment of all conditions necessary for the regularity of the matches (security services, stay of Referees and the visiting teams, proper qualification of the referees, the players identification, playing kits, etc) The Match Commissioner shall convene a pre-match meeting to inspect equipment of both teams, sensitise both teams on the Laws of the Game as well as the Rules and Regulations of the Competition. No minutes will be taken of this consultative meeting. Any protest will be noted by the Match Commissioner in his report. However in the absence of a pre-match meeting, the Match Commissioner or designated Match Referee will ensure that the match is played in conformity with the provision of the Rules and Regulations Each team must at the pre-match meeting submit a duly completed Team Sheet on the appropriate form indicating their squads and the jersey numbers allocated to each player. Once the declaration has been made, no changes will be permitted. Players must play in the jersey number stipulated on the Team Sheets. A player will be ineligible to play unless his jersey number corresponds to the declaration In the absence of the Match Commissioner, the Match Referee designated to officiate the match will preside over the meeting The Match Commissioner will attend to pre-match formalities in the dressing room. He may if he deems necessary, go back to the dressing rooms during the half-time recess or after the match The responsibility of ascertaining the regularity of the field s dimensions and of ascertaining the regular strength of the floodlights for night matches is exclusively that of the Referees. The Referees and the Assistant Referee are the only persons to control all procedures concerning the substitution of players during the match The Match Commissioner may, if he deems it necessary for the security of the Referees or the visiting team, decide not to have the match played until his conditions and instructions are carried out. But once the match is started, it is exclusively the decision of 9

10 the Referee to suspend the match for any of the reasons stipulated under the Laws of the Game (refer to Law 5) If any protest concerning one of the Articles of the Rules and Regulations is submitted by one of the two teams to the Match Commissioner, he must try to reconcile conflicting points of view within the framework of the Rules and Regulations of the competition. If however, he does not succeed, he will register the protest on the appropriate forms. In all cases, the match will be played in accordance with the provisions of the Rules according to the interpretation given by the Match Commissioner The Match Commissioner will observe the match in all its aspects in terms of performance of the referees, security and safety at the match, behaviour of the public, any other incidents etc. The match report will indicate among other things if any protest was lodged by the teams. In the event that the Match Commissioner is absent, this duty will be assigned to a Match Inspector. In the event that neither of these officials are available, the Referee will perform the requisite duties in his /her behalf If the Match Commissioner is prevented by one reason or other from attending the match, he must advise the responsible Organising Committee through any quickest means possible The Organising Committee must inform the designated Match Commissioners of the date, venue and kick-off time of the match within the time limits stipulated by the Rules and Regulations The absence of the Match Commissioner cannot constitute an obstacle to the playing of the match at the scheduled date and time. In such circumstances, the Match Inspector appointed for this match will assume all duties of the match commissioner. In the event that neither of these officials is available, the referee appointed to officiate the match will assume duties. 13. APPOINTMENT OF MATCH OFFICIALS 13.1 All Match Referees shall be appointed by the Organising Committee through the Referees Sub-Committee of FAM to take charge of each match. The Match Referees shall comprise of a Match Referee, 1 st Assistant Referee, 2 nd Assistant Referee and Fourth Official. The Organising Committee shall take cognisance of travelling distances, ease and cost of travel when making such appointments. Assigned Referees and Assistant Referees must be on the approved list of the National Referees as published by the National Referees Committee. 10

11 13.2 The procedure for the designation of Referees and Assistant Referees by the Organising will be as follows: The matches shall be officiated by a referee who is listed by the Referees Sub-Committee. He shall be assisted by two Assistant Referees who shall be listed by the Referees Sub-Committee In the case of force majeure, if the Referee is to be substituted; he shall be replaced by the Fourth Official. The 2 nd Assistant Referee will become the 1 st Assistant Referee and the fourth official becomes the 2 nd Assistant Referee. In this particular case, the Organising Committee through the Referees Sub-Committee shall designate, if possible, an Assistant Referee from the list of Assistant Referees to officiate as the fourth official for the match The Organising Committee through the Referees Sub-Committee shall inform the appointed Match Referees and Assistants of the venue, date and kick-off time of the match, within reasonable time frame before the match. It will organise the trip of the appointed match Referees and Assistant Referees In the absence of the designated Referees, the visiting team must remain at the venue of the match for up to 30 minutes from the hour scheduled for the kick-off. In such a case the Organising Committee has to secure a suitable Referee to allow the match to take place within the prescribed time If within this regulation, it has proved futile to identify and make available suitable Match Referees, the match shall be postponed and played at the same venue within 48 hours The expenses incurred in case of extension of stay of the visiting team at the venue of the match following the absence or late arrival of the Referee, shall be borne by the Organising Committee If the designated Referee is absent or becomes unfit before or during a match, he shall be replaced by the Fourth Official designated beforehand. In this case, the second Assistant Referee will be used as the first Assistant Referee and the host team will provide an Assistant as a fourth official. 14. PROTESTS 14.1 A protest against the qualification of the players who take part in the matches of the competition must be made according to the following procedures: 11

12 The protest must be preceded by a nominal and motivated protest formulated on the proper form before the match by the captain of the protesting team and communicated to the Match Commissioner countersign it. In this case, the Match Commissioner must inform the Organising Committee at the latest 48 hours after the match A protest can also be registered by the captain of the concerned team at half time to the Match Referee and confirmed in writing soon after the match Any team that refuses to continue with play or walks out of the match on the basis of such protest shall lose the game by a margin of two goals to zero. In case of the former, the Match Referee shall wait for 10 minutes before blowing the final whistle, signalling the end of the match The protest must be confirmed by a registered letter or by a telefax message sent to Organising Committee at the latest 48 hours after the match The protest fees are fixed at MK 100, nonrefundable. Any protest submitted without the protest fees will not be entertained Any other protests are to be communicated to the Organising Committee within 48 hours of the match by telegram or telex or fax. A detailed protest confirmed by registered letter, telex or fax message must reach the Desk Office three clear days from the date of the match at the latest All protests shall be referred to The Organising Committee for resolution having fully paid up protest fees as per article Any disputes arising out of the resolution made by the Organising Committee as indicated above shall then be referred to the Disciplinary Committee of FAM for resolution The decision taken by the Referee on the ground during the match relating to interpretation of the Laws of the Game shall not be subject to protest. The referee s decision will be final. Any team that walks out of the field of play in protest with a decision of the referee shall be deemed to have lost the match by a margin of two goals to zero. In such event, the Organising Committee shall not entertain the protest and the protest shall have no bearing on the outcome of the match. 12

13 14.6 No protest shall be considered after the declaration of the team having won Carlsberg Malawi Cup either at regional or national levels Any team dissatisfied with the decision of the Disciplinary Committee of FAM shall have the right to appeal to the FAM Appeals Committee on the payment of the sum of K250, non-refundable. Any appeal lodged without payment of the appeal fees shall not be entertained In accordance with FIFA regulations and subject to article 24 no dispute on football matters shall be taken to court. Teams that shall wilfully contravene this provision will be expelled from the competition and will consequently not be allowed to join any competition under the jurisdiction of FAM. 15. APPEALS 15.1 Any team dissatisfied with the decision of the Regional Organising Committee shall have the right to appeal to the Main Organising Committee upon the payment of the sum of K50, non refundable Any team dissatisfied with the decision of The Organising Committee through FAM Disciplinary Committee shall have the right to appeal to the FAM Appeals Committee upon the payment of the sum of K50, non refundable whose decision shall be final and binding upon all the parties No appeals will be entertained at any level without the requisite fees being paid. 16. SUBSTITUTION OF PLAYERS 16.1 A maximum of three players per team are permitted to be substituted at anytime during the match. A substituted player can no longer take part in the match Before the start of the game the Referee shall be notified of the names of players to play as substitutes. Substitutions will be governed by the Laws of the Game as amended from time to time. 17. QUALIFICATION OF PLAYERS 17.1 Each team shall select its representative team from players enjoying membership of its team, subject to its discretion and 13

14 qualified for selection in conformity with the provisions of Article 18 paragraph 1, 2 and 3 of the FIFA Regulations All players must present on request to the Match Commissioner their valid identification for inspection issued by any competent authority. Identification will be mandatory during the Regional and National stage of the competition. The identification must be current and may not have expired. An expired identification will disqualify a player from playing in a match If a team loses the identification of one or any of its players, the team can use that player concerned provided that they take photographs with the Match Referee or Match Commissioner before the match. These photographs shall be sent to FAM by the Referee, together with his report. In case of a protest being duly lodged, the concerned team shall present to the Organising Committee the valid identifications for comparison with the photographs taken before that match A Referee who allows a player who does not present an identification to participate in the match shall be sanctioned Every team may at its own discretion, modify the formation of its team between one match and another, even in the case of matches to be replayed, provided that the players appearing on the team list qualified under these regulations are used. Participants are obliged to furnish their team lists to the match commissioner and at least 120 (one hundred and twenty) minutes before the time specified for kick-off of the match Any player who has played a game for any of the participating teams in this competition shall not be allowed to play in another team participating in this competition because he shall be deemed to be cup tied. In the event that such player is featured, the team shall be in breach of the Rules and Regulations and shall henceforth lose the game by two goals to zero if the result was in their favour. 18. DISCIPLINARY MATTERS 18.1 Any player who accumulates 2 cautions (yellow cards) in the competition will be suspended from participating in the next match to be played by his team in the competition. The suspension shall apply to any other competition organised by FAM or any of its affiliate bodies. Where a player receives a red card in a match any yellow cards received by the player in such match will not be counted towards the accumulation of yellow cards. Teams are required to keep records of their yellow cards and 14

15 failure by the Competitions Committee to advise a team of a suspension and/or yellow card totals after any match will not absolve any team or player from disciplinary action for playing a suspended player A player expelled from the field by the Referee is automatically suspended from playing the team s subsequent match in any other Competitions Organised by FAM or any of its affiliate without prejudice to all other sanctions that FAM might impose upon him subsequently If a Referee reports a player whose behaviour has caused the interruption and/ or abandonment of a match the said player shall automatically be suspended from playing in the same edition of the competition, without prejudice to the sanctions, which might be imposed upon him subsequently If a team fields an unqualified or suspended player, this team shall automatically lose the match by two goals to zero irrespective of the actual match result. 19. DOPING 19.1 Doping is the use of substances which could have the effect of artificially improving the player s physical and/ or mental condition and so augmenting artificially his athletic performance Doping is strictly forbidden by FAM, CAF and FIFA The use of doping substances shall be severely punished by the responsible Organising Committee and FAM has the right to carry out anti-doping controls at any time Sanctions for contraventions of doping regulations shall be in accordance with FIFA regulations. 20. COLOUR OF UNIFORMS & NUMBERING 20.1 Each team shall wear its pre chosen colours. When, in the opinion of the referee the colours of the two opposing teams might lead to confusion, the visiting team must change whatever part of apparel conflicts with the host team. If the match is played at a neutral ground, a draw shall be made to determine the team having to change its playing kit. 15

16 20.2 In addition to the official playing kit, each team shall have a reserve outfit (reserve colours), which shall be noticeably different from the official playing kit If thermal shorts are used, they shall be the same colour as the main colour of the shorts Each player shall wear a number. Number must be solid colours (profile stitching is not permissible). The colour of the number must contrast clearly with the outfit (light on dark or vice versa) and shall be legible from a distance for spectators in the stadium and television viewers. Numbers shall be between 25cm and 35cm in height in the centre of the back of the shirt, between 10cm and 15cm on the front of the shirt in any position at chest level and between 90cm and 15cm in any position on the front of either leg of the shorts. None of the numbers may contain advertising features or other elements The football clubs logo may be worn as a badge on the shirt, shorts and each sock may not exceed 100 squares on the shirt, 50cm squared on each sock and may not feature any advertising or other commercial elements With the exception of the manufacturer s trademark and the Sponsor, no kind of advertising for any sponsors or third parties or slogan of a political, religious or racist nature or any slogan are permitted on any garments or equipment of outfield players and goalkeepers (shirts, vest, shorts, socks, gloves. Caps etc) within the area of the entire pitch The authorised trademark of the manufacturers may be used once as a graphic logo, or name, or graphic logo and name combined, and shall not exceed the following measurements: Shirts - 20cm squared (on the chest) Shorts - 12cm squared (on either leg) Socks - 12cm squared on either leg Thermal shorts - 12cm squared 9cm between the ankle and the top edge) Goalkeepers Wristbands - 12cm squared Tracksuits - 20cm squared (jacket); 20cm squared (shorts/trouser) 20.8 The emblem or name (or abbreviation) of the football club may also be displayed on the shirt and/ or shorts in jacquard weave provided that the colour is similar to that of the shirt or short into which it is woven and that it does not prevent the kit from being 16

17 easily distinguished from the opposing team s kit. It is not compulsory for the emblem or name (or abbreviation) on the shirt to appear in jacquard weave but it may also be printed or affixed in a similar manner provided that it does not predominate and prevent the kit from being easily distinguished from the opposition team s kit. 21. MATCHBALLS AND BALL BOYS 21.1 The Organising Committee will supply match balls for use during National stages of the competition The Organising Committee will supply youths to act as ball boys during each match. 22. EXPENSES 22.1 All legitimate expenses relating to the competition that have been reasonably incurred by the various Organising Committees at Regional and National Levels shall be settled by FAM through the National or Regional Committees as per allocated budgeted lines for each Committee Funds shall be used by the Committees in line with the allocated budgeted lines. 23. INCOME 23.1 All income derived from gate revenue shall be shared amongst stakeholders such as the, Ground Owners, Malawi Government, security and FAM and the two competing teams as applicable and determined from time to time by the Organizing Committee save for provisions detailed below. - Advertising, Signage and apparel - Television & radio Rights 23.2 All registration fees by the participating teams shall be paid to the Organising Committee. 24. GENERAL 24.1 No member, official, player or any other person subject to the FAM Constitution or the Rules and Regulations of this Competition shall be entitled to pursue any remedies in a Court of Law, be it on review or appeal or otherwise without exhausting the remedies provided in the FAM Rules & Regulations and FAM 17

18 Constitution and National Council of Sports Rules and Regulations.
