2 CLAInter Member r Assciatin Member Transfers Sectin 18.4 CLA Operatins Manual The CLA recgnizes that all players wishing t play lacrsse in Canada have the privilege t d s prviding certain cnditins are met. This plicy nly applies t pst Bantam t (i.e. Midget and higher) aged players and abve. These cnditins are nt meant t cmpletely restrict the mvement f players between Member Assciatins/Assciate Member Assciatins (MA/AMA) hwever the CLA recgnizes that restrictins are necessary t help with the develpment f players within Members/Assciate Members Assciatins. This plicy strikes a balance between cmplete restrictin and the free mvement f players. This plicy nly gverns mvement f players bt between MA/AMA s. The CLA maintains i n authrity fr player mvement within an MA/AMA with the exceptin f rules related t the CLA Negtiatin List. Players wh d nt sign a playing card fr five years within an MA r AMA and des nt play y g p y g y p y lacrsse in any ther jurisdictin, either inside the CLA r utside, is free t mve withut a CLA Transfer. An frm the previus MA is required t verify that the player is a Member in gd standing prir t the player participating in sanctined events.

3 Transfers will nly be permitted between the first Wednesday f March and must be cmpleted by 11:59pm EST tw business days prir t July 1 st f any given calendar year. A transfer is nt cmplete until the transfer prcess as utlined in Sectin 18.4 f the CLA Operatins Manual has been cmpleted. Once a player s transfer is cmplete, lt all rights iht assciated itdwith said player bl belng t the receiving MA r AMA with the fllwing exceptin: The player can nly play at the level at which he was traded/released fr the remainder f the seasn (ie. N playing up r dwn) unless the upper level f lacrsse is nt available in the jurisdictin he is transferring frm. After the seasn is cmpleted, the player can mve freely within the MA/AMA subject t the member/assciate member s assciatin s plicies. N team shall permit a player frm anther MA/AMA t play a league r playff game within its jurisdictin unless the player has btained a cmplete transfer in accrdance with these rules. Any alleged vilatin f this rule shall be refereed t the CLA Discipline Cmmittee and a prven vilatin is subject t a fine f $5,000 t the team and the suspensin f the player and the respnsible team persnnel. Pending the decisin f the Discipline Cmmittee, upn it being determined by the VP Dmestic Cmpetitin that the player played withut a cmplete transfer, the player, the General Manager and/r the Head Cach shall be suspended.

4 A participant may mve frm ne MA/AMA s jurisdictin t anther and be eligible t play under the fllwing circumstances: The player is nt n a negtiatin list as defined in Sectin f the plicy manual) and is a member in gd standing within his current MA/AMA ie: free agent. The player must have his/her current Member Assciatin/Assciate member sign a transfer frm cnfirming that the player is in gd standing. An agreement t release the player has been reached between the team hlding the rights t the individual as indicated n a negtiatin list as defined in Sectin 18.4, f the Operatin Manual, and the team wishing t acquire thse rights. A player wh has signed a playing card fr the current seasn r is n a negtiatin list must receive a release frm the team he was signed r that placed him n a negtiatin list, as the case may be. The player changes his residence frm ne MA s r AMA s jurisdictin t anther prir t December 31 where the primary purpse r reasn fr the mve is nt t play lacrsse r the player was previusly transferred but cntinued t reside in the transferr MA/AMA while playing in the transferee MA/AMA and that cntinued residency was nt fr the primary purpse r reasn f playing lacrsse. Players may be required t prvide cnfirmatin fthe purpse rreasn reasn fr the mve rthe cntinued residency. This prf may be requested anytime during the curse f the seasn. This prf must be supplied within 7 days f request by the Transfer Review Cmmittee as defined in 18.4 f the CLA Operatins Manual. Shuld it be deemed that the mve r residency was nt legitimate, the player will be suspended fr the balance f the seasn and the incident will be referred t the CLA Discipline Cmmittee. The Transfer Review Cmmittee has directed the transfer due t exceptinal circumstances. Players under the age f 18 must have a dcument signed by their parent r guardian granting permissin fr the player t mve, if said player s parent/guardian is nt als mving. A player wh has applied fr a transfer t a team and has been denied may nt, unless that team and the MA/AMA wning the player s rights have agreed t the transfer, apply fr a transfer t the same team in the same year

5 Cnditinal Releases: Player transfers that cntain cnditins such as but nt limited t ne (1) year releases are cnsidered t have been met r cmpleted by September 30 th f the final seasn that the cnditin applies t. As f Octber 1 st, if the cnditins are met and the player is in gd standing within the MA r AMA wh he was registered with fr the seasn, his playing rights revert back t his previus MA r AMA. Negtiatin Lists: Each MA r AMA must file annually with the CLA Head Office, a list f its players requiring negtiated releases in the frmat as defined in Sectin 18.4 f the CLA Operatins Manual. The deadline fr the submissin f this list will be February 24 th f each calendar year. A draft Master List will be created and frwarded t all MAs r AMAs fr the MA r AMA viewing nly by the first Wednesday f March. A final Master List will be released fr public viewing nce all duplicatins have been reslved in cperatin with the MAs and AMAs. N player can appear n mre than ne negtiatin list at a time, regardless f level. A player wh is n a negtiatin list wh des nt sign a playing card fr the current seasn within an MA r AMA and des nt play lacrsse in any ther jurisdictin, either inside the CLA r utside, is free t mve withut negtiatin the fllwing year prvided he is a member in gd standing within the previus MA r AMA. Fr the purpse f the transfer plicy, a refusal t sign a playing card is deemed nt t be a valid reasn fr a suspensin utside f the MA r AMA.

6 Fr Senir A, a team s negtiatin list shall nt exceed thirty five(35) individuals. Fr Senir B, a team s negtiatin list shall nt exceed twenty five (25) individuals. Fr Senir C, a team s negtiatin list shall nt exceed twenty five (25) individuals. Fr Junir A, a team s negtiatin list shall nt exceed twenty five (25) individuals. Fr Junir B, a team s negtiatin list shall hllnt exceed twenty five (25) individuals. d The MA s r AMA s negtiatin lists will be submitted electrnically in Micrsft Excel, in table frmat with the fllwing fields cmpleted: Last Name, First Name, Prtected By, Cntact Inf ( f wh t enquire abut release f player), Member Assciatin, Level (Sr. A/B/C r Jr.A/B and Hldut (Sr. A nly) Failure f an MA r AMA t submit a negtiatin list by the deadline will result in players bi being cnsidered d free agents able t mve withut t negtiatin prvided d that t such players still must have their previus MA/AMA sign a transfer frm cnfirming their gd standing.

8 Limit n Imprts in Junir N team shall have n its negtiatin list r its 25 player rster mre than five (5) players in ttal wh have been acquired by an inter member assciatin r assciated member transfer with the fllwing exceptin. The limit is tw (2) imprts fr Jr. A nly. Where a player mves t anther MA r AMA s jurisdictin t play at a higher level r categry which des nt exist in the first MA r AMA, they will nt cunt twards the ttal number f imprts. Where a player wh has been transferred dis an imprt tin ne playing seasn but, withut t signing i a playing card in a subsequent seasn in the MA/AMA t which he was transferred, is transferred back t the riginal MA/AMA, that player will nt be classified as an imprt in that riginal MA/AMA. If a team wishes t have the status f a player reclassified frm an imprt t nn imprt it may apply t the Transfer Review Cmmittee by submitting an applicatin t the Transfer Review Cmmittee alng with a cheque fr $ fr each player, t the CLA Head Office. The Cmmittee may return the $ in the event f success. The Cmmittee will review and respnd t all requests within seven (7) business days upn receipt in the CLA Office. The decisin f the cmmittee may be appealed fllwing the CLA appeals plicy as defined in the CLA Operatins Manual. When a club has exercised their 5 imprt team limit n the negtiatin list they may nt drp ne f these players t add a 6 th player. The limit is 2 imprts fr Jr. A nly. Teams caught with mre than 5 imprts n their negtiatin list r rster will face the fllwing sanctins. The limit i is 2 imprts fr Jr. A nly. $1,500 fine per game that the team played; Suspensin f all imprt player(s), head cach and r general manager until such time as they cmply with the plicy. Further discipline i as determined dby the CLA Discipline i Cmmittee, such as, but nt limited i t: Frfeiture f the right t participate in CLA Natinal Champinships.

9 Limit n Imprts in Senir B N Sr. B team shall have n its 25 player rster mre than tw (2) players in ttal wh have been acquired by an inter member assciatin r assciated member transfer and wh have, in either f the previus tw seasns, played Senir A and are 35 r under with the fllwing exceptins: Where a player wh has been transferred in ne playing seasn but, withut signing a playing card in a subsequent seasn in the MA/AMA t which he was transferred, is transferred back t the riginal MA/AMA; The status f a player is reclassified frm an imprt t nn imprt by the Transfer Review Cmmittee. An applicatin may be made t the Transfer Review Cmmittee by submitting it, alng with a cheque fr $ fr each player, t the CLA Head Office. The cmmittee will review and respnd t all requests within seven (7) business days upn receipt in the CLA Office. The Cmmittee will return the $ in the event f success. The decisin f the cmmittee may be appealed fllwing the CLA appeals plicy as defined in this manual. Breach f this plicy will result in the fllwing sanctins: $1,500 fine per game that the team played; Suspensin f all imprt player(s), head cach and r general manager until such time as they cmply with the plicy. Further discipline as determined by the CLA Discipline Cmmittee.

10 Tampering Prir t the submissins f the negtiatin lists, n team r agent f the team frm any MA r AMA may cmmunicate with r allw t tryut r participate in its training camp, practises, intra squad games r exhibitin game, a player frmanther MA rama withut first having received written permissin by either r fax frm the team r league cmmissiner with which said player was last registered, prir t that player s participatin. The exceptin t this is in the case where the player initiates the cmmunicatin, in which case the team r agent f the team must advise the player that n further cmmunicatins may be had unless the written permissin has been btained and the team r agent f the team may cntact the team r league cmmissiner t request written permissin. After the submissin f the negtiatin lists, n team r agent f the team frm any MA r AMA my cmmunicate with r allw t tryut/participate in its training camp, practises, intra squad games r exhibitin game, a player frm anther MA r AMA negtiatin list withut first having received written permissin i by r fax frm the team r league cmmissiner i with which h said player was last registered as per the negtiatin list, prir t that player s participatin. The exceptin t this is in the case where the player initiates the cmmunicatin, in which case the team r agent f the team must advise the player that n further cmmunicatins may be had unless the written permissin has been btained and the team r agent f the team may cntact the team r league cmmissiner t request written permissin. Failure t cmply with this plicy will result in: An autmatic fine f ne thusand five hundred dllars ($ ) t the ffending team, payable t the CLA within 30 days f ntificatin by the CLA Office. The CLA will then frward the fine t the ffended team; and Further disciplinary actin r sanctins as determined by the CLA Disciplinary Cmmittee. These sanctins may include ne r mre f the fllwing: An additinal fine; A ten (10) game suspensin t the head cach f the ffending team; A suspensin fr a perid f up t ne (1) year t the respnsible team fficials f the ffending team

11 The charge f tampering must be filed by the ffended team within 7 days f the ffended team discvering the ccurrence f the tampering t the CLA in accrdance with the CLA Disciplinary prcedure. The burden f prf is with the team filing the tampering charge. Any charge f tampering deemed t be frivlus by the CLA Disciplinary Cmmittee will result in a penalty being assessed as per the discipline plicy. Transfer Review Cmmittee Will review and reslve all disputes as directed by the transfer plicy. The Transfer Review Cmmittee has the authrity t make rulings in the event f disputes abut which prvincial negtiatin list a player shuld be n. The Transfer Review Cmmittee will nt be used fr hearing any discipline related issues. Hwever, the cmmittee may frward n its findings t the CLA fr further actin if the cmmittee deems it apprpriate. Will cnsist f the fllwing individuals: Bx Sectr Chair (Chair f the Cmmittee) CLA VP Dmestic Cmpetitin CLA Past President Shuld any f the CLA members nt be able t sit n the cmmittee, replacements will be appinted by the CLA President. All interested parties are entitled t ntice f the meeting and may participate in said meeting. The Presidents f each MA r AMA invlved are entitled t be represented. All submissins t the cmmittee must be accmpanied with a cheque f Five Hundred dllars ($500) r, in the case f exceptinal circumstances applicatin, Tw Hundred and Fifty ($250). Shuld the Transfer Review Cmmittee rule in favur f the applicant, a refund f Five Hundred dllars ($500) will be made t the applicant and Tw Hundred dand Fifty dllars ($25) will be billed t the MA r AMA wh riginally i denied the transfer and, in the case f success n an exceptinal circumstances applicatin, the $250 may be returned.

12 The cmmittee will review and respnd t all requests within seven (7) business days upn receipt at the CLA Head Office. The decisin f the cmmittee may be appealed fllwing the CLA Appeals plicy as defined in the CLA Operatins Manual. Right f Appeal f a Denied Transfer Shuld a team r player believe there are exceptinal circumstances regarding the denial f a transfer, they can apply t the Transfer Review Cmmittee, as defined in the CLA Operatins Manual, stating the exceptinal circumstances. Grunds fr permitting the transfer under the exceptinal circumstance clause include but are nt limited t the fllwing: Players wants t play at a higher level f lacrsse that what is available within their current MA/AMA r is n a negtiatin list f a team but wants t mve t a team in anther MA/AMA with is at a higher level; Health reasns; Cmpassinate reasns The Transfer Review Cmmittee will nt determine matters f cmpensatin unless a transfer is granted under the Right f Appeal f a Denied Transfer in this Sectin and the determinatin f cmpensatin is warranted. All applicatins and fees must be received by the CLA Head Office within seven (7) business days f the ccurrence f denial.

13 PLAYER TRANSFER PROCESS Player fills ut SECTION 1 f the Player Transfer Frm n line at and MUST submit it t the CLA Head Office t start the prcess Upn receipt f the transfer, the CLA Head Office will frward via the infrmatin t the MAs r AMA s Office PROVINCIAL OFFICE wh currently wns his playing rights. The receiving MA will als be cpied n this . This will be dne within 24 hurs fr transfers submitted frm Sunday t Thursday. Transfers received Friday and Saturday may take 48 hurs t begin The MA r AMA (Prvincial) wning his rights will cmplete SECTION 2 f the transfer frm and submit it back t the CLA Head Office. The MA r AMA must submit the frm t the CLA Head Office within 10 business days f receipt. If nt submitted, it will be assumed that there are n issues and the player is free t mve t the ther MA r AMA. Upn receipt f the frm r the 10 business days have expired, the CLA Head Office will send the frm t the MA r AMA the player wishes t transfer t within 24 hurs t cmplete SECTION 3. The receiving MA r AMA will have 10 business days t cmplete SECTION 3 and return it t the CLA Head Office. Any cnditins that affect the status f the player in regard t which MA r AMA hlds his rights subsequent t the transfer must be clearly set ut n the face f the transfer frm and, if thse terms r cnditins are nt set ut n the face f the frm, the terms and cnditins are unenfrceable. If the frm is nt returned, it will be assumed that the transfer is nt accepted and the player will remain the prperty f the team he is prtected by. If the receiving MA/AMA accepts the transfer, the transfer is cmplete when the receiving MA/AMA cmmunicates their acceptance t the CLA Office. The receiving MA r AMA shall file the cmpleted transfer within 2 business days f acceptance and the CLA Head Office will then invice the receiving MA r AMA fr the transfer fee.

14 SCENARIOS THAT DO NOT FOLLOW THE TRANSFER POLICY SCENARIO 1 Can a player play in a ''new'' MA/AMA if his transfer has nt been apprved by the CLA? Example: Player Smith has initiated his transfer. He has btained his release frm his frmer team; his releasing MA/AMA, hwever, has nt finalized the verificatin f his status and has nt signed his transfer; there are six days left in the transfer prcess. But the team he is ging t, in the ther MA/AMA, badly needs him as a galtender that night. Can they play him that night with the understanding that ''the paper wrk is n its way''? SCENARIO 2 Can team managers f different MAs agree n a transfer if the transfer has nt gne thrugh the CLA prcess? Example: Player Smith has asked fr a release frm his frmer team in rder t play with his new team in anther MA/AMA. The manager f the releasing team has cntacted the manager f the new team and they have agreed, in gd faith, n a financial cmpensatin fr the transfer f player Smith. They have signed the financial dcuments pertaining t the cmpensatin. Player Smith, hwever, has nt presented the CLA with his transfer request. Can the new team nw play player Smith under the understanding that bth managers have agreed n the transfer and n the cmpensatins and that the paper wrk will fllw?

15 SCENARIO 3 Can a team play a player if they feel the cmpensatin asked fr is exaggerated? Example: Player Smith has asked fr his release and has started his transfer prcess with the CLA. His intent is t return t his riginal MA/AMA. The releasing team has cntacted the new team and is asking fr 5000$ cmpensatin. The new team assesses the situatin and feels that the cmpensatin asked fr is incredible dbl and irratinal. After all player Smith is ''returning'' t his riginal MA/AMA. Can the new team play player Smith because the cmpensatin asked fr is irratinal and intends t appeal the amunt? SCENARIO 4 Can a Senir team frm ne MA/AMA play, n a ne game release, a junir player, residing in the same city as the Senir team, but signed t anther MA/AMA? Example: Player Smith lives in Kahnawake and plays fr the Kahnawake Junir Hunters f the OLA; can he be brught up t play senir lacrsse fr Kahnawake f the QSLL (Québec Federatin) SCENARIO 5 Can an MA/AMA play a player if the releasing MA/AMA has nt signed the transfer dcuments? Example: Player Smith has sent his transfer requests t the CLA; the paper wrk is under way. The MA/AMA frm whm the player is being transferred is hlding their annual meeting that day and the signing fficer is absent frm his desk that day. Can the receiving MA/AMA play the player, that day, even if the transfer papers are nt signed, but wuld have been if the signing fficerhad been at his desk that day?
