2 INTRODUCTION In late 1988, then-president Ronald Reagan extended the territorial sea of the United States from three miles to 12 miles offshore. The purpose of the extension was to hinder the activities of Soviet intelligence-gathering ships. However, this extension of the territorial sea also raised the possibility that coastal states would extend their jurisdiction over activities such as fishing and mineral exploration in territorial waters up to 12 miles offshore. A variety of impacts may be felt by coastal states if state jurisdictions are extended to the limit of the new territorial sea. For example, financial impacts may be positive, in the form of increased revenue from fishing and mineral exploration, or negative,' in the form of increased management and enforcement costs. The purpose of this report is to aid in assessing the possible impacts of extending state jurisdiction over the groundfish fisheries within the territorial sea off Alaska. Toward that end, this report provides estimates of the amount of groundfish caught in the North Pacific off Alaska and the exvessel value of that catch, within three zones, including the newly-designated territorial sea off Alaska. In addition, estimates are provided of directed catch of groundfish in several select areas established primarily to control bycatch or to decrease mortality of species taken as bycatch in the groundfish fisheries. Estimates of bycatch - of species such as halibut, crab, salmon and herring, within 12 miles off shore, are beyond the scope of this report. Also, this report does not specifically discuss the additional costs of management or enforcement, or the potential benefits of increased fishing business tax revenues. METHODS The weight of landed catch of groundfish is recorded on Alaska Department of Fish and Game (ADFCG) fish tickets. Catch weights are recorded along with product type (e.g., headed and gutted, fillets) so that conversion factors can be used to convert from the recorded weights of various product types back to round weights. Catch weights contained in this report are expressed in round weight (i.e., the weight of the whole fish). The weight of landed catch is recorded by location of catch from ADF&G six-digit statistical (stat) areas. The fish ticket database system was initially capable of distinguishing landings from statistical areas that are completely within 0 to 3 miles from shore from those landings coming from completely outside the 3 mile limit. However, the fish ticket system was not capable of distinguishing those statistical areas lying entirely within the

3 zone 3 to 12 miles from shore, nor those statistical areas bisected by the new 12-mile territorial sea limit. To enable distinction among these categories of statistical areas, statistical area charts which identified the 3 mile and 12 mile limits and covering the Alaska coastline from approximately 55030t N (Dixon Entrance) to 65O N (King Island in the northern Bering Sea) were reviewed. Those statistical areas lying wholly within the 3-12 mile zone were distinguished from those bisected by the 12 mile limit. Charts covering the areas north of 65O N latitude were not reviewed, because no commercial groundfish catch occurs north of 65" N latitude. In fact, relatively little groundfish catch occurs north of 60 N latitude. This exercise allowed distinguishing groundfish catch taken from the following four categories of statistical areas: 1. completely within a zone 0 to 3 miles from shore 2. completely within a zone 3 to 12 miles from shore 3. partially within and partially beyond 12 miles from shore 4. completely outside a line 12 miles from shore, but within the United States exclusive economic zone (EEZ) which extends to 200 miles from shore. For those statistical areas bisected by the 12-mile line, it is assumed that groundfish catch was homogeneously distributed within the stat area. Therefore the groundfish catch for 12-mile stat areas was apportioned between the 3-12 mile and mile zones according to the proportion of each stat area shoreward and seaward of the 12 mile limit. The proportion of stat areas seaward and - shoreward of the 12 mile limit for individual 12-mile stat areas was visually estimated fromthe charts. Visual estimates were also used to apportion catch in selected management areas such as bycatch savings areas and the "horseshoe." The "horseshoe" refers to a roughly horseshoe-shaped bend in the 100 fathom contour in th,e Bering Sea north of Unimak Pass. Some categories of groundfish species managed under the federal groundfish fishery management plan (FMP) for the Bering Sea/Aleutian Islands (BS/AI) differ from those managed under the Gulf of Alaska (G.OA) FMP. For this report some categories from the BS/AI and th'e GOA were combined into common categories to provide more general and inclusive categories for summarizing catch in the three zones (Table 1). In addition to catches of groundfish included in the FMPs, the distribution of halibut catch within the three zones was also estimated. During the two years covered in this report, groundfish from the GOA and BS/AI were processed by domestic (DAP) and joint venture (JVP) processors. Only DAP catches are included in this report. Halibut catch data were obtained from the International Pacific Halibut Commission (IPHC) annual reports. (IPHC 1989 and 1988).

4 Exvessel values of halibut were also obtained from the IPHC (G. Williams, pers. comrn. ). RESULTS Catch and Exvessel Values for Zones 0-3, 3-12 and miles Catches and exvessel values of groundfish caught within 12 miles from shore are presented here. Further breakdowns of catches for the zones 0-3, 3-12 and miles from shore are provided in the figures and appendix tables noted in the text. Pollock Gulf of Alaska. In 1988, 78 million lbs of pollock were caught within 12' miles of shore (Fig. 1, Appendix Table 1). In 1989 the pollock catch within 12 miles decreased to 72 million lbs (Fig. 2, Appendix Table 1). These catches were approximately 62 and 37% of the total pollock catches in the EEZ for 1988 and 1989, respectively (Fig. 3, Appendix Table 1). The exvessel values of the 1988 and 1989 catches from within 12 miles were $5.9 and $5.7 million (Figs. 5 & 6, Appendix Table 2). Like the distribution of catch itself, these values represented about 62 and 37% of the total exvessel values of pollock from the Gulf of Alaska in 1988 and 1989 (Fig 7, Appendix Table 2). Bering Sea/Aleutian Islands. In the BS/AI, about 348 million lbs of pollock were caught within 12 miles of shore in 1988 (Fig. 1, Appendix Table 1). In 1989, the catch increased to almost 423 million lbs (Fig. 2, Appendix Table 1). These catches represent approximately 33 and 18% of the total pollock catches (Fig. 4, Appendix Table 1) and exvessel values (Fig. 8, Appendix Table 2) for 1988 and 1989, respectively. The exvessel value of the catch within 12 miles was $26.4 million in 1988 followed by an increase to $33.4 million in 1989 (Figs. 5 & 6, Appendix Table 2). Pacific Cod Gulf of Alaska. The 1988 and 1989 catches of Pacific cod within 12 miles from shore were approximately 34 and 50 million lbs (Figs. 1 & 2, Appendix Table 1); about 50 and 55% of the total catches for the two years (Fig. 3, Appendix Table 1). The exvessel values of the catches within 12 miles were $4.6 and $7.3 million dollars (Figs. 5 & 6, Appendix Table 2). Bering Sea/Aleutian Islands. In 1988, 89 million lbs of Pacific cod were caught in the BS/AI within 12 miles of shore. In 1989, that catch increased to almost 93 million lbs The catches within 12 miles contributed 50% and 40% of the total catches (Fig. 4,

5 Appendix Table 1) and exvessel values (Fig. 8, Appendix Table 2) of Pacific cod in the BS/AI for 1988 and 1989 respectively. The actual exvessel values of Pacific cod caught within 12 miles were $12.5 and $13.5 million dollars (Figs. 5 & 6, Appendix Table 2). Sablef ish Gulf of Alaska. Of the total catch of sablefish in,1988, 14.2% (9.3 million lbs, Figs. 1 & 3, Appendix Table 1) was taken within 12 miles of shore. In 1989, almost 14% of the catch (13.8 million lbs, Figs. 2 & 3, Appendix Table 1) was caught within 12 miles of shore. The exvessel values of sablefish from within 12 miles were $8.9 and $7.0 million dollars in 1988 and For both years this was about 14% of the total exvessel value of sablefish from the GOA EEZ (Figs. 5 & 6, Appendix Table 2). Bering Sea/Aleutian Islands. Almost 7 million lbs of sablefish were caught within 12 miles of shore in 1988 (Fig. 1, Appendix Table 1). This represented almost 40% of the BS/AI sablefish catch for that year (Fig. 4, Appendix Table 1). The next year, 1989, sablefish catch declined to 5.2 million lbs (Fig. 2, Appendix Table I), but this catch represented 48% of the total catch (Fig.4, Appendix Table 1) from the EEZ. For 1988 and 1989, the exvessel values of sablefish caught within 12 miles were $6.6 and $4.3 million dollars (Figs. 5 & 6, Appendix Table 2). Halibut Gulf of Alaska. For 1988 and 1989, 26.5 and 23.4 million lbs of halibut were caught within 12 miles of shore in the Gulf of Alaska (Figs. 1 & 2, Appendix Table 1). For each year, these catches comprised about 37% of the total halibut catch from the EEZ (Fig. 3, Appendix Table 1). The exvessel values of the catches in 1988 and 1989 from within 12 miles were $32.6 and $35.8 million (Figs 5 & 6, Appendix Table 2). Bering Sea/Aleutian Islands. Halibut catch in the BS/AI in 1988 and 1989 was markedly lower than in the Gulf of Alaska. The total catches of halibut within 12 miles of shore were 1.1 and 1.2 million lbs in 1988 and 1989, respectively (Figs. 1 & 2, Appendix Table 1). These catches represented approximately 38% of the total halibut catch from within the BS/AI EEZ (Fig. 4, Appendix Table 1). The exvessel values of these halibut catches were $1.4 and $1.9 million in 1988 and 1989 (Figs. 5 & 6, Appendix Table 2). Rockfish Gulf of Alaska. In 1988, 7.3 million lbs (Fig. 1, Appendix Table 1) or 15.2% (Fig. 3, Appendix Table I), of the total EEZ catch of

6 rockfish was taken within 12 miles of shore. The catch within 12 miles increased slightly to 7.6 million lbs for 1989 (Fig. 2, Appendix Table I), while the percent contribution to the total EEZ catch declined slightly to 14.4% (Fig. 3, Appendix Table 1). The values of these catches were $1.8 and $2.1 million in 1988 and 1989 (Figs 5 & 6, Appendix Table 2). Bering ~ea/aleutian Islands. Rockfish catches in the BS/AI within 12 miles of shore were 2.2 and 4.4 million lbs for the years 1988 and 1989 (Figs. 1 & 2, Appendix Table 1). These catches were about 23% of the total EEZ catches of rockfish in the BS/AI (Fig. 4, Appendix Table 1). The exvessel values of rockfish catches for these two years were approximately $0.5 and $1.2 million (Figs. 5 & 6, Appendix Table 2). Flatfish Gulf of Alaska. Flatfish catches within 12 miles of shore totaled 5.7 and 6.0 million lbs in 1988 and 1989, respectively (Figs. 1 & 2, Appendix Table 1). Those catches contributed approximately 31% and 27% to the total flatfish catches in the GOA EEZ (Fig. 3, Appendix Table 1). The exvessel value of the catch in 1988 totaled $0.8 million. In 1989 the value increased to $1.2 million (Figs. 5 & 6, Appendix Table 2). Bering Sea/Aleutian Islands. Flatfish catches in the BS were higher than those in the GOA. Within 12 miles of shore the 1988 catch was 25.5 million lbs (Fig. 1, Appendix Table I), about 28% of the EEZ catch (Fig. 4, Appendix Table 1). The 1989 catch increase to 32.4 million lbs (Fig. 2, Appendix Table I), or 32% of the EEZ catch (Fig. 4, Appendix Table 1). The exvessel values of the flatfish catches were $3.6 million for 1988 and $6.0 million for 1989 (Figs. 5 & 6, Appendix Table 2). Atka Mackerel Gulf of Alaska. Very little Atka mackerel was caught in the GOA in 1988 or There was no catch of Atka mackerel within 12 miles of shore in 1988, and only 0.1 million lbs in 1989 (Figs. 1 & 2, Appendix Table 1). The 1989 catch represented approximately 30% of the total catch from the GOA EEZ (Fig. 3, Appendix Table 1). The exvessel value of the catch in 1989 was less than $0.02 million (Appendix Table 2). Bering Sea/Aleutian Islands. In 1988, about 3.7 million lbs of Atka mackerel were caught within 12 miles of shore in the BS/AI (Fig. 1, Appendix Table 1). The catch increased to 16.2 million lbs in 1989 (Fig. 2, Appendix Table 1). These catches represented about 69% and 47% of the total BS EEZ catches in 1988 and 1989

7 This sub-area yielded 12.1 and 12.7% of the Pacific cod landed from the BS/AI and GOA in 1988 and 1989, respectively. In 1988, 9.5% of the flatfish came from this sub-area, and in 1989 this increased to 12.9%. The catch of pollock in 1988 and 1989 was 10.7 and 6.7%, respectively (Figs. 11 & 12, Appendix Table 3). The IPHC halibut closed area also includes the productive "horseshoe" area near Unimak Pass. Kodiak King Crab Closed Areas Amendment 15 to the GOA FMP established time and area closures in the vicinity of Kodiak Island to protect king crab (Fig. 14). Amendment 18 extended these time/area closures until The closures apply to bottom-trawling, and the duration and location of the closures were designed to promote the rebuilding of crab stocks. Initially, Amendment 15 established Type I and I1 areas. Bottom trawling is prohibited year-round in Type I areas and during the soft-shell season in Type I1 areas. Approximately 85% of the Type I and I1 areas lie within 12 miles of shore. From the area shoreward of the 12-mile limit in the GOA, approximately 4.3 and 2.9% of the Pacific cod was caught in 1988 and The percentages for pollock and flatfish during these two years were 2.1 and 0.9, and 2.5 and 1.7% (Figs. 11 & 12, Appendix Table 3). Horseshoe Area One of the principal groundfish fishing areas in the BS/AI is known as the "horseshoe" (Fig. 13). This general area was named for the "horseshoe" bend in the 100 fathom curve north of Unimak Pass. About 40% of the combined area of the stat areas recognized a,s being included in the "horseshoe" pollock fishery are within 12 miles of shore. In 1989, approximately 56% of the pollock harvested in the BS/AI came from the vicinity of the "horseshoe." In 1988 and 1989, 23.4 and 12% of the pollock caught in the BS/AI and GOA were caught shoreward of the 12 mile limit in the "horseshoe" area (Figs. 11 & 12, Appendix Table 3). For Pacific cod approximately 17 and 11% of the total catch came from within 12 miles of shore (Figs. 11 & 12, Appendix Table 3). In 1988, over 1.75 billion lbs of groundfish were harvested in the GOA and BS/AI and processed by domestic processors. Of that, almost 640 million lbs, or 37%, of the total were caught within 12 miles of shore. Of the 640 million lbs caught within 12 miles of shore, 547 million lbs (31% of total) was caught in the zone between 3 and 12 miles from shore.

8 (Fig. 4, Appendix Table 1). The exvessel values of these catches were about $0.6 and $2.5 million (Figs. 5 & 6, Appendix Table 2). Catch Distribution - Bycatch Areas and A Principal Fishing Area Special regulatory areas within the BS/AI and GOA have been established to reduce bycatch or directed catch of prohibited species such as halibut and crab. In the BS/AI these areas include Zones 1 and 2, and an area recommended by the International Pacific Halibut Commission (IPHC) where directed fishing for halibut is prohibited (Fig. 13). These areas have been identified as critical rearing areas for crab or halibut or as areas of high concentration of prohibited species, which increases the vulnerability of these species to bycatch in the groundfish fisheries. Zones 1 and 2 were established under Amendment 12A to the BS/AI FMP as zones 'which would be closed if specified prohibited species catch (PSC) limits were reached. The IPHC-recommended closed area in the BS/AI was identified as a critical rearing area for halibut. Zone 1 Based on visual estimates from charts, approximately 15% of Zone 1 lies within 12 miles of shore. Groundfish catches within the 12- mile limit of Zone 1 ranged from a high of 100 million lbs of pollock in 1989, to lows of 0.01 million lbs of Atka mackerel and rockfish in 1988 (Figs. 9 & 10, Appendix Table 3. The 100 million lbs of pollock accounted for slightly more than 4% of the total catch of pollock in the BS/AI and GOA combined in 1989 (Fig. 12). Approximately 12 and 11% of the flatfish and Pacific cod catches in the BS/AI and GOA came from within the 12 mile limit in Zone 1. Zone 2 In contrast to Zone 1, only about 3% of Zone 2 lies within 12 miles of shore. However, in million lbs of pollock were caught within the 12-mile limit in Zone 2 (Fig. 10, Appendix Table 3). This represents almost 6% of the combined pollock catch from the BS/AI and GOA in 1989 (Fig. 12). Zone 2 includes portions of the highly productive "horseshoe" area near Unimak Pass. In 1989 this area yielded approximately 56% of the total 1989 BS/AI pollock catch. IPHC Halibut Closed Area The sub-area within 12 miles of shore represents about 11% of the IPHC-recommended area that is closed to directed halibut fishing.

10 For 1989, the DAP catch in the GOA and BS/AI almost doubled, to 3.24 billion lbs Of the 3.24 billion lbs, 742 million lbs, or 23% of the total BS/AI and GOA groundfish catch came from within the newly designated territorial sea, 0 to 12 miles from shore. The lower percentage (23%) associated with a greater catch (742 million lbs) in 1989 resulted from the almost two fold increase in DAP catch (primarily pollock) in 1989 compared to Of the 3.24 billion lbs total, 21% (665 million lbs) was caught in the area between 3 and 12 miles from shore. For the two years combined, the catch from the zone 3-12 miles from shore was 1.2 billion lbs, or 24% of the total DAP groundfish catch from the entire EEZ (i.e miles from shore).
