1 CHAPTER 37 BICYCLES, PLAY VEHICLES, SKATEBOARDS AND IN-LINE SKATES BICYCLE REGISTRATION. (1) Required. It shall be unlawful for any person to ride or operate a bicycle upon any street, alley, or roadway within the City unless the bicycle is properly registered and tagged as provided herein. (2) Application. Every bicycle owned or kept by a resident of the City shall be registered with the Police Department. Each registered bicycle will receive a registration tag which will be permanently affixed to the frame of the bicycle. The tag shall be nontransferable and shall be retained upon the frame of the bicycle until the bicycle has been disposed of by gift, sale, junking or by permanent removal from the City. (3) Fee. The one-time-only registration fee for each bicycle shall be as determined in Chapter 42 of the Municipal Code. (AMENDED 8/8/95-- ORDINANCE NO. E-303; AMENDED 5/14/96--ORDINANCE NO. E-327) (4) Inspection of Bicycle. The Police Department shall inspect each bicycle presented to it for registration and shall have the authority and power to refuse to register any bicycle found to be in unsafe mechanical condition. (5) Change of Ownership. Within 10 days after any registered bicycle changes ownership or has been dismantled and taken out of operation, such information shall be reported to the Police Department by the person in whose name the bicycle has been registered. (6) Illegible Sticker; Replacement Sticker. In the event a bicycle license is lost, stolen, mutilated, defaced or is otherwise illegible, a replacement license sticker shall be obtained from the Police Department for a fee as determined in Chapter 42 of the Municipal Code. Failure to replace an illegible sticker shall be deemed a violation of Section 37.01(1) of this Chapter. (CREATED 8/8/95--ORDINANCE NO. E-303; AMENDED 6/11/96--ORDINANCE NO. E- 335) (7) Mutilation of Sticker or Serial Number. It shall be unlawful for any person to willfully or maliciously remove, destroy, mutilate or alter the serial number of any bicycle frame licensed pursuant to this Ordinance, or any license sticker. (CREATED 8/8/95--ORDINANCE NO. E- 303) RULES FOR OPERATION. Every person shall comply with the regulations imposed by Section through of the Wisconsin Statutes relating to bicycles and play vehicles, and with the following regulations. (AMENDED 10/12/87--ORDINANCE NO. E-99) A. "Bicycle" shall have the meaning of Section (5), Wisconsin Statutes. B. "Play Vehicle" shall have the meaning of (43m), Wisconsin Statutes. (1) No Riding Downtown. No person shall ride a bicycle, play vehicle or skateboard upon a sidewalk within the central business district which is defined as that area on both sides of the following streets: (AMENDED 10/12/87--ORDINANCE NO. 2 North Main Street from Sumner Street to Union Street South Main Street from Sumner Street to Kossuth Street Kossuth Street from South Main Street to South Johnson Street South Johnson Street from Kossuth Street to West Sumner Street West Sumner Street from Main Street to Rural Street North Rural Street from West Sumner Street to West State Street North Johnson Street from West Sumner Street to West Wisconsin Street West Jackson Street from North Johnson Street to North Rural Street West Wisconsin Street from North Rural Street to North Main Street West State Street from North Rural Street to North Main Street East Wisconsin Street from North Main Street to First Street East Jackson Street from North Main Street to Mill Street Mill Street from East Jackson Street to East Sumner Street East Sumner Street from Main Street to South Street (2) Operation on Sidewalk. Persons may ride a bicycle, play vehicle or skateboard on sidewalks outside of the central business district as defined in 37.02(1), provided that the operator shall, at all times, give way to and not interfere with pedestrians. (AMENDED 10/12/87--ORDINANCE NO. E-99) (3) Parking. No operator of a bicycle shall park a bicycle on any sidewalk at any time, and it shall be the duty of operators to use the parking stands for bicycles when parking them in the central business district area as defined in 37.02(1). (REPEALED AND RECREATED 8/8/95--ORDINANCE NO. E-303) (4) General Regulation for Bicyclists. a. State Laws Applicable. Every person operating a bicycle upon a public roadway shall be subject to the provisions of the Wisconsin Statutes. b. Riding Bicycle on Sidewalk or Walkway. Every person operating a bicycle upon a sidewalk or walkway, where permissible by this Ordinance, shall yield the right-of-way to any pedestrian and shall exercise due care when passing a bicycle rider or pedestrian proceeding in the same direction. c. Riding on Road. Bicycle riders are to stay on the right side of the road. d. Riding Two Abreast Prohibited. Every person when operating a bicycle upon a roadway shall ride single file only and at no time shall bicycles be operated two or more abreast. e. Clinging to Moving Vehicles Prohibited. It shall be unlawful for any person riding upon a bicycle, play vehicle, skateboard or in-line skates to cling to or attach himself/herself or the bicycle to any other moving vehicle upon a roadway. f. Passengers and Towing. No bicycle while being operated upon a roadway shall be used to carry anyone other than the operator unless equipped with a child's carrier, in which case the following conditions and regulations shall be observed. 1. The operator shall be 16 years of age or older. 2. The passenger shall be under the age of 7 and seated on the child's carrier. 3. The child's seat shall be fastened securely to the bicycle and shall be located behind the operator's seat. 37-2

3 4. Only one child's carrier shall be attached to a bicycle. In the case of a tandem bicycle, a child's carrier may be attached behind each operator. 5. For the purpose of this subsection, a child's carrier (or child's seat) shall mean a seat manufactured and designed for the purpose of attaching to a bicycle and equipped with a safety belt, arm rest, back rest, foot rest and spoke protector, to be used by children under the age of 7 years. g. Racing Prohibited. No person operating a bicycle upon a roadway shall participate in any race or speed or endurance contest with any other vehicle, except for those events which are given permission by the Common Council to operate upon a public roadway. h. Acrobatic Riding Prohibited. No rider of any bicycle shall remove both hands from the handlebars, or feet from the pedals, or practice any acrobatic or fancy riding on any public roadway, sidewalk, public parking lot, or private parking lot without the permission of the owner. i. Riders to Observe Traffic Regulations. Every person operating a bicycle upon a public roadway shall obey all arterial and automatic traffic signals. j. Turns and Signals. No person shall turn a bicycle at an intersection unless the bicycle is in proper position upon the public roadway, or turned to enter a private road or driveway unless the bicycle is in proper position on the roadway as required, or otherwise turn a bicycle upon a road, unless and until such movement can be made with reasonable safety. In the event other traffic may be affected by such movement, no person shall turn any bicycle without giving an appropriate signal continuously during not less than the last 100 feet traveled by the bicycle before turning. When given by hand and arm, such signals shall be given from the left side of the bicycle in the following manner and shall indicate as follows: 1. Left Turn - Hand and arm extended horizontally. 2. Right Turn - Hand and arm extended upward. 3. Stop or Decrease Speed - Hand and arm extended downward. k. One-Way Streets. Every person while operating a bicycle on a one-way street shall operate said bicycle single file in the direction of the one-way traffic. (REPEALED AND RECREATED 8/8/95--ORDINANCE NO. E-303) (5) Brakes. No person may operate a bicycle in the City of Hartford, upon a street, highway, bicycle lane or bicycle way unless it is equipped with a brake in good working condition, adequate to control the movement of and to stop the bicycle whenever necessary. (6) Lamps and Other Equipment on Bicycles. No person may operate a bicycle in the City of Hartford, upon a street, highway, bicycle lane or bicycle way during the hours of darkness unless such bicycle is equipped with or the operator is wearing a lamp emitting a white light visible from a distance of at least 500 feet to the front of such bicycle. Such bicycle shall also be equipped with a red reflector that has a diameter of at least 2 inches of surface area on the rear so mounted and maintained as to be visible from all distances from 50 to 500 feet to the rear when directly in front of lawful upper beams of headlands on a motor vehicle. A lamp emitting a red light visible from a distance 500 feet to the rear may be used in addition to but not in lieu of the red reflector. 37-3

4 (7) Warning Device. A bicycle shall have bell, horn or similar device for giving warning. (SECTIONS AND REPEALED AND RECREATED 5/8/01--ORDINANCE NO. E- 459) REGULATION OF PLAY VEHICLES AND IN-LINE SKATES. (1) Definitions. a. "In-Line Skates" has the meaning set forth in sec (24m), Wis. Stats. b. "Play Vehicles" has the meaning set forth in sec (43M), Wis. Stats., and does not include bicycles regulated under this Chapter. (2) Pedestrian Right-of-Way. Every person riding in or upon a play vehicle or in-line skates on a sidewalk, pedestrian way or mall shall yield the right-of-way to any pedestrian and exercise due care when passing any pedestrian. (3) Prohibited Areas for Play Vehicles and In-Line Skates. No person shall ride in or upon a play vehicle or in-line skates in the following areas: a. On any portion of any street, alley, sidewalk, pedestrian way or mall located within the Central Business District area as defined in 37.02(1). b. In addition to the prohibited areas under secs and (17), Wis. Stats., on the roadways of East and West Sumner Streets, North and South Main Streets, Cedar Street, Branch Street, Union Street, and West State Street except while crossing a roadway at a crosswalk. c. On any parking lot owned by the City of Hartford or on any private property posted by means of a sign or signs prohibiting the riding of play vehicles or in-line skates, unless with the expressed permission of the owner or occupant in charge of said property. (SECTION CREATED 8/8/95--ORDINANCE NO. E-303) GENERAL REGULATIONS FOR USE OF IN-LINE SKATES. (1) State Laws Applicable. Every person using in-line skates upon a public roadway shall be subject to the provisions of all ordinances and State laws applicable to the operator of any vehicle, except those provisions with reference to equipment of vehicle and except those provisions which by their nature have no application. (2) Sidewalks or Walkways. Every person using in-line skates upon a sidewalk or walkway, where permitted, shall yield the right-of-way to any pedestrian and shall exercise due care when passing any other person proceeding in the same direction. (3) In-Line Skaters to Stay on Right Side of Road. Every person using in-line skates on a public roadway shall keep as close to the right hand curb as possible. (4) Clinging to Moving Vehicles Prohibited. It shall be unlawful for any person using inline skates to cling to or attach to any bicycle or other moving vehicle upon a public roadway or sidewalk. (5) Observance of Traffic Regulations. Every person using in-line skates upon a public roadway shall stop for all arterial and automatic traffic signals. 37-4

5 (6) One-Way Streets. Every person using in-line skates upon a one-way street shall proceed in the direction of the one-way traffic. (7) Operating Two (2) Abreast Prohibited. Every person(s) when using in-line skates upon a public roadway shall proceed in single file only. (8) Yielding to Traffic. The operator of a vehicle shall yield the right-of-way to a user of in-line skates in the same manner as for bicyclists and pedestrians under sections , , and of the Wisconsin Statutes. Every person when using in-line skates shall, upon entering a public roadway, yield the right-of-way to motor vehicles, except that a person using in-line skates shall be subject to the same regulations as bicyclists and pedestrians under sections , , and of the Wisconsin Statutes.
