2 Cheer Magic Allstars, LLC Competitive Team Contract I certify that I am the parent and/or legal guardian of (the Athlete ). The Athlete desires to be a team member within the Cheer Magic Allstars, LLC competitive cheerleading program for the competition season. This Competitive Team Contract (the Contract ) sets forth the terms and conditions under which the Athlete may participate as well as my binding obligations to Cheer Magic Allstars, LLC as the undersigned parent and/or legal guardian. 1. I agree that my Athlete will attend all practices, competitions and scheduled events pursuant to the terms of the Cheer Magic Allstars, LLC Cheerleading Handbook 2018 (the Handbook ) and this Contract. I agree to be bound by the terms and conditions set forth in the Handbook and this Contract. 2. I authorize and grant Cheer Magic Allstars, LLC and its employees and representatives permission to seek and give appropriate medical attention for my Athlete if needed. I understand that I will be responsible for any and all costs of medical attention and treatment for my Athlete. I confirm the Athlete is covered by medical insurance. 3. I waive, release, and forever discharge Cheer Magic Allstars, LLC and its employees and representatives from all rights and claims for damages, injury, loss, and/or liability (financial or otherwise) to any person or property which may be sustained or incurred during the Athlete's participation at Cheer Magic whether in the gym or any other premise or venue where a Cheer Magic activity takes place. 4. I understand and agree that I am responsible for my Athlete while traveling. I also understand that transportation to and from any event is solely my responsibility. I am solely responsible for all travel costs including hotel, gas, food, etc. 5. I acknowledge that I have read the Handbook. I understand that the Handbook is available for continuous view and print at I understand and agree that violations of the policies and rules of the Handbook, this Contract and the Cheer Magic Gym may result in my Athlete being dismissed from the Cheer Magic Allstars LLC competitive cheerleading program and Cheer Magic Gym. 6. I acknowledge and agree that I have read all fees, fee schedules, and tuition schedules as written in the Handbook. I agree that I am personally responsible for my Athlete s fees and tuition costs as outlined and scheduled in the Handbook and any personal fee schedule provided to me. 7. I agree that a $30.00 USASF fee is due before my Athlete will be placed on a team. I also agree that my Athlete s account must have either a zero balance or a credit owed to me before my Athlete will be placed on a team. 8. I understand all documents must be signed and turned in to Cheer Magic Allstars, LLC, as well as a valid credit card/debit card on file before team placements. 9. I acknowledge and agree that if my Athlete s account has an unpaid balance on the 5th and the 15th of each month, the credit card/debit card on file will be processed and that all transactions will be charged a 3.5% service charge. I agree that it is up to me to make sure my Athlete s account is correct before the processing dates and to notify Tiffany Endsley either in person or of any inaccuracies. 10. I authorize Cheer Magic Allstars, LLC to initiate and receive all payments through automatic credit card/debit card billing on the 1st and 15th of each month.

3 11. I agree that any returned NSF check will be subject to a $35.00 fee. I also agree that in the event my credit card/debit card is unable to be processed I will be charged a $25.00 fee immediately and each month thereafter if a valid credit card/debit card is not updated to my Athlete s account within 24 hours. 12. I acknowledge and agree that if my Athlete s account has an unpaid balance for more than 30 days, my Athlete will not be able to participate on the team until such unpaid balance is paid in full. I also agree that if my Athlete s balance remains unpaid for more than 60 days the account may be referred to a third-party for collection, and I will be responsible for all costs and fees associated with the collection, including, but not limited to all attorney s fees. 13. I agree that if the status of the Athlete changes and the Athlete is unable to remain on the team for the duration of the season, I shall remain obligated to pay all costs, fees and penalties associated with having a spot on the team. I agree that no refunds will be given if the Athlete leaves the gym for any reason or length of time. ALL money fundraised and/or paid will not be refunded and will be forfeited to Cheer Magic Allstars, LLC if the athlete leaves the gym for any reason. 14. I agree that failure to abide by the terms of this Contract, including, but not limited to the Athlete being removed from the team or quitting the team after signing this Contract, will constitute a breach of the Contract. In the event of a breach of Contract, I agree to be responsible for payment of a $ re-choreography fee as well as all remaining unpaid tuition and fees for the competition season. I agree that full payment for breach of this Contract must be paid within 30 days of the Contract breach and if not the account will be turned over to collections whereby I will be responsible for all costs and fees associated with the collection, including, but not limited to all attorney s fees. For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I agree to indemnify, release, and hold harmless Cheer Magic Allstars, LLC ( Cheer Magic ), and its members, managers, representatives, coaches, agents, employees, sponsors, advertisers, attorneys, contractors and affiliates, as well as Cheer Magic s premises, its owners and lessors (hereinafter collectively Releasees ) and Releasees heirs, successors, assigns, executors and administrators from any and all liability, whether caused by the negligence of the Releasees or otherwise for any claim, judgement, loss, liability, cost and expenses (including, without limitations, attorney s fees and costs) arising out of or connected with Cheer Magic, including, but not limited to, any claim arising out of or connected with any illness or injury (minimal, serious, catastrophic, and/or death) that I may incur or sustain, all fundraising activities, traveling to and from competitions, and the competition itself. Appearance Agreement. I understand that Cheer Magic from time to time produces promotional material relating to its programs. I understand that as a spectator, I may be included in videos, photographs, and other various media taken at Cheer Magic s premises, events and/or competitions. Therefore, without reservation or limitations, I hereby assign, transfer and grant to Cheer Magic, its successors, assignees, licensees, sponsors, any television networks, and all other commercial exhibitors the exclusive right to photograph and/or videotape me and to utilize such videotapes and photographs and my name, face, likeness, voice and appearance in advertising and promoting Cheer Magic. I further understand that neither Cheer Magic nor any third party is under any obligation to exercise any of the foregoing rights, licenses and privileges. I hereby waive any right to inspect or approve any materials related thereto as well as any right to derive compensation from such. I hereby warrant that I have read this Adult Release and Waiver Form in its entirety and fully understand its contents. I am aware that this Adult Release and Waiver Form releases Releasees from liability. I have signed this document voluntarily and of my own free will. 6 CHEER MAGIC ALLSTARS, LLC PARTICIPANT RELEASE AND WAIVER FORM Liability Release. For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I, as a parent or legal guardian of, (hereinafter Participant ), hereby grant the permission necessary to allow Participant to participate in any and all Cheer Magic Allstars, LLC ( Cheer Magic ) gymnastics, cheerleading, and/or other activities. I, in my own behalf and on behalf of Participant, further agree to indemnify, release, and hold harmless Cheer Magic, and its members, managers, officers, representatives, coaches, agents, employees, sponsors, advertisers, attorneys, contractors and affiliates, as well as Cheer Magic s premises, its owners and lessors (hereinafter collectively Releasees ) from any and all liability, whether caused by the negligence of the Releasees or otherwise for any claim, judgement, loss, liability, cost and expenses (including, without limitations, attorney s fees and costs) arising out of or connected with Cheer Magic, including, but not limited to, any claim arising out of or connected with any illness or injury (minimal, serious, catastrophic, and/or death) that Minor may incur or sustain, all activities, classes, practices, and/or tryouts associated with Cheer Magic, all fundraising activities, traveling to and from competitions, and the competition itself. I further expressly agree to indemnify, release, and hold harmless Releasees and Releasees heirs, successors, assigns, executors and administrators against loss from any further claims, demands or actions that may be brought by Participant or by any other persons on the account of damages resulting to Participant in any way from the foregoing. Medical Release. Gymnastics and cheerleading are vigorous sporting activities involving height and rotation in a unique environment, and as such, pose a significant risk of injury. Gymnastics, cheerleading and all related activities always involve certain risks, including, but not limited to, death, serious neck and spinal injuries, and serious injury to bones, joints and muscles. I, in my own behalf and on behalf of Participant, acknowledge and agree that participation in Cheer Magic s gymnastics and/or cheerleading subjects Participant to the possibility of physical illness or injury (minimal, serious, catastrophic and/or death) and that I, in my own behalf and on behalf of Participant, acknowledge that Participant is assuming the risk of such illness or injury by participating in such activities. In the event of such illness or injury, I authorize Cheer Magic to obtain necessary medical treatment of Participant, at its discretion, and hereby, in my own behalf and on behalf of Participant, release and hold harmless Releasees in the exercises of this authority. I further acknowledge and understand that I will be responsible for any and all medical and related bills that may be incurred on behalf of Participant for any illness or injury that Participant may sustain. I, in my own behalf and on behalf of Participant, am aware that this Participant Release and Waiver Form releases Releasees from liability and contains an acknowledgement of my voluntary and knowing assumption of the risk of injury or illness.
