1 Chesterfield Golf Club Buggy Policy 1 May Objective 1.1. Chesterfield Golf Club Limited (the Club) is committed to ensuring that its members and visitors are able to enjoy the pursuit of golf Due to disability (as defined under the terms of the Equality Act 2010), the Club acknowledges that some members and visitors may not be able to play golf without the use of a motorised buggy This Policy sets the criteria for safe buggy use by all golfers including golfers with disability 2. General Use of Buggies 2.1. The Club permits the use of buggies on the course by members and visitors subject to the right to impose restrictions on their use in certain conditions The Club offers for hire a limited number of buggies. It is advisable to book these in advance as there is no guarantee of availability Priority of use for available buggy hire will be allocated as follows: Disabled members Disabled visitors Members with a certificated medical condition, injury or impairment (see clause 4.1) Visitors with a certificated medical condition, injury or impairment (see clause 4.1) Other members Other visiting players 2.4. The club also permits the use of members and visitors personal buggies under the terms of this policy. 3. Golfers with disability or with a medical condition, injury or impairment who are not disabled 3.1. Disability is a physical or mental impairment that has a substantial and long-term adverse effect on a person s ability to carry out normal day to day activities (S6(1) Equality Act 2010) Any member or visitor wishing to use a buggy due to disability must produce to the Club a Medical Certificate (or a current Blue Badge in the name of the person claiming disability) evidencing their disability Any member or visitor wishing to use a buggy due to a medical condition, injury or impairment which temporarily or permanently prevents them from playing golf without the use of a ride on motorised buggy but who is not disabled must produce to the Club a Medical Certificate (or a current Blue Badge in the name of the person claiming disability) evidencing their condition A Medical Certificate for the purposes of this section 3 must be both valid and current. For members not relying on a current Blue Badge it should be in the form at Appendix 1. For visitors not relying on a current Blue Badge it must be in a form, signed by a registered medical practitioner and evidencing their condition. cgc buggy policy revised (blue badge)1.4.18exappx3.docx Page 1 of 5

The Club reserves the right to reject a Medical Certificate/Blue Badge if, in the reasonable opinion of the Club: it fails to evidence disability (as defined in 3.1) or a condition (as defined in 3.3); or for a condition defined in 3.3, it is either no longer current by reason of the time period in the Medical Certificate/Blue Badge having expired or it is more than 12 months old It is the responsibility for any person relying on a Medical Certificate or a Blue Badge for the purposes of this section 3 to ensure that it is both valid and current. 4. Restrictions and prohibitions on the general right to use buggies 4.1. The Club has a Course Manager whose responsibilities include assessing the course as to its suitability for play for the Club The general use of buggies may be restricted or prohibited by the Club in certain conditions, including (but not limited to): For reasons of health and safety. Where it is reasonably likely that excessive damage will be caused to the course by buggies in times of adverse weather or terrain conditions (e.g. water logging, surface water, frost, ice etc.) 4.3. If the Club reasonably determines that the use of any type of buggy on the course may present a health and safety risk whether to the buggy user or to others on or around the course or to property (e.g. risks of overturning, becoming bogged down, risk of impaired vehicle control including slipping or sliding) then the restriction or prohibition will apply to all buggy users without exception Where the general use of buggies is restricted or prohibited to prevent excessive damage to the course the Club may allow players with a valid and current Medical Certificate/Blue Badge to use a personal, individual motorised buggy on some or all of the course unless it is reasonably considered unsafe to do so. Any person seeking to use a buggy in these circumstances must: consent to an individual risk assessment being undertaken by the Club for that person and his/her buggy if required and to abide by the outcome of the risk assessment; and Undertake with the Club not to ride the buggy other than on the route designated by the Club from time to time Where general buggy use is prohibited and the Club permits restricted use to persons with a Medical Certificate/Blue Badge under clause 4.4 those restrictions may be communicated in one or more of the following ways: Personally to the buggy user On the course report daily telephone message On the Club s website By signage at the Clubhouse and /or on the course Any person seeking to use a buggy in these circumstances must: consent to an individual risk assessment being undertaken by the Club for that person and his/her buggy if required and to abide by the outcome of the risk assessment; and Undertake with the Club to abide by the restrictions In summary, there are four possible options: The course is open for all general buggy use Buggy use is prohibited except to players with a valid current Medical Certificate/Blue Badge who qualify for use under clause 4.4 Buggy use is generally prohibited except on a restricted basis to players with a valid current Medical Certificate/Blue Badge who qualify for use under clause 4.4 No buggies are permitted cgc buggy policy revised (blue badge)1.4.18exappx3.docx Page 2 of 5
3 5. General Golf Buggy Safety 5.1. The Club is committed to the safety and enjoyment of all users of the course (including persons using rights of way in and around the course). The topography of the course is integral to its use and enjoyment but demands reasonable care and safe handling by every buggy user, particularly in challenging weather or course conditions All buggy users must comply with the following conditions: Ride on buggies are only to be used by members, green fee paying visitors, competition entrants or other persons authorised by the Club Secretary Manager, Course Manager or Club Professional. Any person hiring a course buggy from the Club must sign the Golf Buggy Safety Policy Acknowledgement Form (see Appendix 2) available from the Club Professional. Any person wishing to use their own personal ride on motorised buggy on the course must produce and lodge with the Club Professional or Secretary Manager a valid current certificate of Indemnity Insurance for its use before using the buggy on the course. Ride on buggies must be operated with the utmost courtesy, care and consideration for the safety and convenience of others on and around the course. Pedestrians must be afforded right of way at all times. Any restrictions imposed on permitted buggy users, including signs and instructions employed on the course must be followed at all times. Buggies must be operated and parked so that they do not impede or interfere with normal pedestrian or vehicular flow on roadways, ramps, bridges or pavements. Persons in charge of any buggy are responsible for its security (including the ignition keys). The Club does not authorise and takes no responsibility for any loss or damage caused to property or any person in respect of buggies used beyond the curtilage of the course, buggy paths and car parks. All speed limits for buggies must be observed. Buggies may only be used on the course during daylight hours and in the car park area, when full street light illumination is turned on. Buggies must not be operated in any prohibited areas. Observe all signage, give way to others and proceed with due caution at all hazards, intersections and corners. Not be under the influence of alcohol or drugs and the consumption of alcohol or improper use of drugs is not permitted whilst using a ride on buggy. No person under the age of 17 may operate a hired buggy and no person under the age of 7 may be a passenger. No more than 2 persons and 2 sets of clubs are to be carried on a hired buggy. Buggy drivers must familiarise themselves with hired buggy controls and should apply the brakes gently to avoid skidding. The parking brake must always be applied when leaving a buggy. Hands and feet must be kept inside the buggy and standing on or in the buggy is prohibited whilst the buggy is in motion. Extra caution must be exercised when reversing, crossing bridges or travelling on slopes and inclines. Buggies must be kept clear of tees, bunkers, green surrounds, greens, wet areas and ground under repair. Buggies must always give way to any vehicular traffic. On completion of golf play hired buggies must be parked correctly in the area designated. The key must be returned to the Golf Professional (or Bar staff when the Golf Professional is unavailable) and all rubbish removed from the buggy into the nearest waste bin. 6. Sanctions for breach of the Buggy Policy 6.1. The Club may prohibit any person using a buggy in breach of the provisions of this Policy from using a buggy on the course A person prohibited from using a buggy may not resume use of a buggy unless application in writing for permission is made to the Club and granted. For the avoidance of doubt the Club may refuse such permission or grant permission on such terms as in its absolute discretion it shall deem reasonable. cgc buggy policy revised (blue badge)1.4.18exappx3.docx Page 3 of 5
4 APPENDIX 1 Medical Certificate Chesterfield Golf Club Limited Medical Certificate for completion by the applicant s General Practitioner (GP) in respect of an application for special dispensation to use a Motorised Buggy on the Golf Course. Name of Applicant. Address. Date of Birth. Notes to GP: The above named person has applied to the Golf Club for special dispensation (for reasons of disability) to use a ride on motorised buggy on the Golf Course, including at times when the use of motorised buggies on the course are generally prohibited. The Golf Club will make this allowance only for persons who are considered to be disabled specifically under the terms of The Equality Act 2010 (disability), previously known as the Disability Discrimination Act The general criteria for qualification under the Act is that the person has a physical or mental impairment that has a substantial and long term adverse negative effect on their ability to carry out normal daily activities of living. This may include difficulty in participating in recreational activities, but the inability to participate in recreational activities should not be considered in isolation when assessing whether a person is disabled under the terms of the Act. Could you please assess the above named person and indicate your findings by ticking the box next to the appropriate statement: In my opinion, the above named person has a disability that would be recognised under the terms of The Equality Act 2010 (Disability) and is either unable, or would have great difficulty, in playing Golf without the use of a Ride-On Motorised Buggy. In my opinion, the above named person has an injury, impairment or illness that is temporary / permanent and is either unable, or would have great difficulty, in playing Golf without the use of a Ride On Motorised Buggy. However, this would not qualify them as disabled under the terms of the Equality Act 2010 (disabled) at the present time. Name of Doctor. Doctor s Signature. Date. 5 APPENDIX 2 Golf Buggy Safety Policy Acknowledgement Golf Buggy Safety Policy Acknowledgement Form All buggy users must complete this form prior to operating a buggy Any person who operates a buggy on The Chesterfield Golf Club premises is deemed, by so doing, to have the knowledge, training and skill to safely operate the vehicle and shall be fully accountable for their actions and consequences thereof. The safe operation of Ride-on buggies requires conscientious application and adherence to the minimum standard of care prescribed in this policy. Users of golf buggies do so at their own risk. The Chesterfield Golf Club will not accept any liability for any loss or damage to the golf buggy or any other property arising from the negligence of the club or any of its servants or agents.
