4 KINGS CREEK COUNTRY CLUB, INC. I hereby apply for a Membership (the Membership ) at Kings Creek Country Club, Inc. (the Club ) as of. Date Please check one: Type of Membership Full Club Junior Full Club Sports $8,000 payable over two years (2 payments: $4,000 due at signing and 2 nd payment of $4,000 due on the 1 st year anniversary of membership). I acknowledge that I have had the right to inspect this Membership Agreement and obtain all information that I believe necessary in connection with my decision to execute this Membership Agreement. I further acknowledge that I have had the right to consult with an attorney in connection with the execution of this Membership Agreement and that I have consulted with an attorney if I believe such consultation to be necessary. By applying for the Membership, I acknowledge and agree that: (i) All rights in, and the use of, the Club facilities may only be acquired in accordance with the Club s Bylaws, and in accordance with the type of membership set forth above, and that I have no other rights in, or use of, the Club facilities; (ii) I have been provided with a schedule of the various dues, fees and costs (collectively, Fees ) that are required to be paid in connection with the Membership and will pay such Fees on a timely basis; (iii) The amount and time for payment of Fees are subject to change from time to time;

5 (iv) The Club reserves the right to raise or lower initiation fees at any time and from time to time and, in the event initiation fees are subsequently lowered or increased, I will not be entitled to a refund of any initiation fee paid by me, in the event initiation fees are lowered, or required to pay an increased initiation fee, in the event initiation fees are increased, after payment of the initiation fee set forth herein; (v) The voting rights associated with the Membership are subject to the limitations set forth in the Bylaws; and (vi) If I desire to resign my Membership: (a) my resignation will only be effective upon acceptance of my resignation by the Board of Directors of the Club, (b) until my resignation becomes effective, I will be responsible for all Fees associated with the Membership, (c) the Board of Directors of the Club is not required to accept my resignation prior to the admission of a new member that will replace me as a member and (d) upon resignation of my Membership, such resignation will not be accepted by the Board of Directors of the Club until the Board of Directors acceptance of all resignations submitted prior to the resignation of my Membership. I herby submit a check for the required initiation fee made payable to Kings Creek Country Club, Inc., along with this Membership Agreement and the Application for Membership, fully executed and completed, to the Membership Director of Kings Creek Country Club, Inc., One Kings Creek Circle, Rehoboth Beach, DE 19971, if by mail or delivery. I authorize the Club to receive such information for the investigation of my qualifications for admission as a member, as it deems appropriate, including, without limitation, my credit history. I further authorize any person or entity to disclose to the Club all information requested by the Club. 6 Kings Creek Country Club Membership Classes Full Club Membership $4,860 Annual Dues. Seven day sign-up privileges to reserve golf starting times and tennis court playing times. Not required to pay Greens Fees or tennis court fee, but shall be required to pay golf cart fees. $75: $50 Monthly Capital Assessment plus *$25 Monthly Capital Irrigation Assessment. Junior Full Club Membership $3, Annual dues. At least 21 years of age, but not more than 35 years of age Shall have the right to use all Club facilities in the same manner as Full Club Members Seven day sign-up privileges to reserve golf starting times and tennis court playing times. Not required to pay Greens Fees or tennis court fee, but shall be required to pay golf cart fees. $75: $50 Monthly Capital Assessment plus *$25 Monthly Capital Irrigation Assessment. Limited to ten (10) rounds of golf per Sports Membership from the Friday of Memorial Day weekend through Labor Day. Note: Tournament play will not count against the 10-round limit. Unlimited golf play in the off-season. Must pay Greens Fee for each round of golf. Currently $60/round ($42 golf plus $18 cart).
