Box 2947, Laredo, Texas , (361) or (361) Dear Beefmaster Breeders: You are all personally invited to our CARR and OTHERS FALL SALE on Saturday, October 27, 2012, at our Wilson County Division eight miles West of Floresville, Texas, on Highway 97 in our new cattle sales facility. We are the breeder of every live animal in our portion of this offering. Our offering is built in large part around the genetics of our two deceased Typesetter/Pacesetter herd sires, Classic Cotton (Levi X Cotton Cow) and Cornerstone (Natural Selection X Phannie Marie) and our near sixteen year old donor, Miss Dusty (Painted Tiger X Lady Jacqueline). There are still few bulls in this breed that have attained the status of both Typesetter and Pacesetter. These genetics combine very well phenotypically and as to performance. While we involve other genetics, our Classic Cotton, Cornerstone and Miss Dusty genetics continue to rise to the top in our operation. Our program involves numerous objective evaluations of our cattle and this catalog presents that information with very few other embellishments. More about our operation appears elsewhere in this catalog. With the exception of any calves on the ground from the Fall calving heifers, all of our portion of the cattle offered were born in 2010 or 2011, and approximately 80 percent of our cattle in this sale were born in the Spring of 2011 and nearly all of them on our Webb County, Texas ranch. During 2011 we had only 10 inches of rain on such ranch and only about 3 1/2 inches of that came between January and December when it was warm enough to grow grass. While most of those cattle that are in this sale came to this sale site ranch as yearlings their weaning weights, yearling weights, sonogram evaluations and pelvic measurements were all adversely impacted by their environment the first year of their lives. Those measurements on any of the cattle in this group are more meaningfully compared to others in this group rather than those on cattle that have grown to their first birthday in a more favorable environment. These cattle have grown and conceived well in view of the conditions they have faced. During 2011 such drought forced us to sell more cattle that we would not have otherwise sold than we have had to sell for any reason in over 60 years of operation and conditions on our Webb County ranch have not significantly improved this year. With such drought conditions limiting the number of quality cattle we can justify selling we are again this year involving guest consignors Hans and Mary Ann Wittenburg, Jim and Anita Dunkin, Billy and Marie Welkener, Bob and Bonnie Siddons, Tony and Karen Psencik, and for the first time, Kito and Leti Saenz, all of whom and all of whose cattle are well known and respected. Join us on Friday the 26th of October to view the cattle and donation lots; from 2:00 P.M. to 5:00 P.M. on such Friday for a THINK TANK to involve a panel discussion by breeders/board members from BBU and Mexico s Beefmaster Breeders Association of issues important to Mexico Beefmaster breeders and recommended actions to be taken by each Board in reference to these issues; Friday early evening for food and music and we will feed you before and after the sale on Saturday. 4 BEEFMASTERS A LITTLE ABOUT OUR ORATION We own and operate ranches in Webb, Wilson and Kendall Counties, Texas, aggregating well over 14,000 acres. In addition to our purebred Beefmaster cattle we maintain 300 to 400 F1 Braford females used as recipients and put Angus bulls on them, after putting a Beefmaster embryo in them or failing to qualify them, to produce a very marketable feeder calf after grown to a desirable feedlot weight on our pastures. Our purebred Beefmaster females are synchronized, and if heat detected, A.I. ed once and then broken into various groups and exposed to one bull. Our weaned, Spring born replacements are developed on oats and Bermuda grasses at our Wilson County Division and are there weighed at various stages, classified, sonogrammed and have pelvics measured. We retain ownership of and feedlot feed at least a truck load of our purebred Beefmaster steers each year obtaining feedlot performance and individual carcass data on them. Our cattle, and I think the Beefmaster breed as a whole, are very efficient in the feedlot as they gain rapidly, convert feed efficiently and provide acceptable carcasses. For feeding periods of approximately 220 days our Beefmaster steers have averaged gaining approximately 31/2 pounds per day on a 5.64 dry matter pounds of feed per pound gained. With good health, that kind of feedlot performance will usually be more profitable than selling intact culled bull calves at weaning and will provide valuable carcass information. Research has shown, and our experience has confirmed, that Beefmaster females with reasonable genetics and nutrition will have pelvic growth from yearlings to two year olds of 8 to 10 square centimeters per month and will require approximately 3 square centimeters of pelvic area per pound of calf born to avoid calving problems from pelvic size. Pelvic measurements are a factor in our breeding decisions. See the footnote for Classic Cotton semen in this catalog for more information about our approaches to meaningful data collection. 5 DONATION LOTS This year as done the past two years we are offering two donation lots with all of the proceeds of one going to the Beefmaster Education Endowment Fund (B.E.E.F.) for Beefmaster research and with all of the proceeds of the other going to the Beefmaster Cattlewomen to provide scholarships for our J.B.B.A. members. This year s donation lots are each elegantly framed, signed Giclee reproductions of paintings by Bruce Greene. Bruce Greene is a Western painter who has ridden trails and experienced the cowboy life he portrays in the very narrative images he creates. The artist is a native Texan who has reached the pinnacle of his profession through hard work and an extraordinary talent for painting the story of one of our country s most revered icons, the American cowboy. His scenes of contemporary cowboys going about their daily work are admired and collected across America. Greene was elected to membership in the prestigious Cowboy Artists of America in 1993 and served as its President in Greene s works are represented by several well known galleries in the Southwest. He has presented his art in annual shows and exhibitions such as the Cowboy Artists of America Exhibition, the Prix de West Show at the National Cowboy & Western Heritage Museum, and the Autry Museum of Western Heritage Sale, just to name a few, and other prestigious venues. At our sale last year one of our donation lots was a framed, signed Giclee reproduction of Bruce Greene s painting When Freedom Isn t Free which brought $5,000 from Lynn Struthoff for the Beefmaster Cattlewomen for J.B.B.A. Colors of Courage In the Dust of Days Past All proceeds go to the Beefmaster Education Endowment Fund (B.E.E.F.) for Beefmaster research. Wade was a proud Marine years ago. The trunk and uniform once belonged to a member of our family, Tom Carpenter. He was wounded in Vietnam and his trunk was sent back with WIA stamped across it. Tom has since died after years of struggling with complications from his injuries. This painting is my tribute to Tom and Wade and the many others who have served as well as those who are serving today. Bruce Greene This piece of art offered between a recent anniversary of 911 and a very important election should inspire the patriotism of and merit its serious consideration by all who see it. 23 CLASSIC COTTON SEMEN It is our belief that confidence in selling and buying cattle grows with the extent of existing evaluations of the genetics involved. It is with this philosophy and the meritorious nature of the numerous evaluations of Classic Cotton, out of the time tested parentage of Levi and the Cotton Cow, that we have built a significant part of our program and the offering in this production sale around him. By one year of age, his evaluations included: Birth weight: 70 lbs. 205 day adj. wt.: 673 lbs. 342 day sonogram of ribeye: 17.1 sq. in sq. in./cwt..24 in. fat cover 365 day actual wt.: 1,285 lbs. His first purebred progeny as yearlings had the following ribeye sonogram average evaluations: 8 Bulls: sq. in sq. in./cwt..16 in. fat cover 10 Heifers: 1.29 sq. in./cwt..12 in. fat cover I was so impressed with Classic Cotton as a young bull that I was determined to comprehensively evaluate him. While EPD s are widely accepted by the beef industry in evaluating cattle I don t believe there are any more meaningful evaluations than through progeny testing. Accordingly I went out and bought 50 very average F1 Braford cows, 25 very average Hereford cows, 25 very average Angus cows and 25 very average Limousin cows to use in progeny testing Classic Cotton. These breeds were selected because, other than the F1 Brafords, they had the largest registries in the industry at the time. All 125 of these cows were synchronized and bred A.I. to Classic Cotton and his purebred sons put on them after A.I. Progeny out of these matings were evaluated for several years in the Texas Ranch to Rail Program. Other tests of Classic Cotton purebred and crossbred progeny in tests conducted by Texas Tech and Texas A&M confirmed they grow rapidly and efficiently and have very acceptable carcasses. A randon sampling of 50 Classic Cotton steers out of F1 Brafords and commercial Hereford, Angus and Limousin dams fed and evaluated in the and the Texas Ranch to Rail Program had average Warner Bratzler shear force evaluation scores of 5.7 lbs. and 5.2 lbs. respectively. Readings of 10 and under are considered acceptably tender for most retail over the counter trade and of 8 and under acceptably tender for consumption in better restaurants. In a Texas A&M progeny evaluation project involving its test herd of Angus cows, semen from 15 prominent BBU sires was used. While doing well in all categories, the Classic Cotton progeny were number one in each yearling weight, ribeye area and tenderness substantiating their growth rate, muscularity and eating quality. A pen of 36 of our purebred Beefmaster steers including 26 Classic Cotton steers fed in the Nolan Ryan T.A.B. Program were harvested in August of 2001 and every one had a qualifying tenderness score and this entire group had one of the highest, if not the highest, percentage of overall qualifiers of any group withing the approximately 70,000 head, at that time, fed in the Nolan Ryan T.A.B. Program. Enough of his female progeny have been in breeding programs long enough to prove their reproductive merit. They constantly rise to the top in our program. Classic Cotton is one of the breed s earliest and few Typesetter/Pacesetter bulls. Raising cattle involves numerous risks you cannot control. Use of proven superior genetics is a means of reducing these risks. Classic Cotton is one of the most comprehensively evaluated bulls in the breed. His meritorious contributions to the breed have been established and are growing. Let him take much of the risk out of your breeding program. 29 WITTENBURG BEEFMASTERS Wittenburg Beefmasters became a member of BBU in 1968 and in two years we became a Lifetime Member. The ranch has a little over a thousand acres and we normally run 150 mother cows and retain 25 open heifers and 25 yearling bulls. Our yearly rainfall is about 40 inches. We purchase all our hay and graze the whole ranch. The pastures are divided into 40 acre plots and are rotated as needed. 33 PSENCIK BEEFMASTERS Psencik Beefmasters was established in 1987 by Tony and Karen Psencik. We bought our first Beefmaster heifers from Tommy Burgess. We started raising cattle as a hobby and a relaxing weekend project. Our love of the hobby made it grow quickly into a fulltime business and we love every minute of it. As the business continues to grow, we have seen more return customers purchasing a greater number of our Beefmaster cattle. 37 TERMS AND CONDITIONS OF SALE ADOPTED BY BEEFMASTER BREEDERS UNITED FOR BBU APPROVED SALES Effective September 10, 2010 THE FOLLOWING TERMS ARE APPLICABLE TO ALL TRANSACTIONS IN BBU APPROVED SALES: 1. BIDDING: Each animal will be sold to the highest bidder without reserve. 2. BIDDING DISPUTE: The Auctioneer in charge will settle any dispute as to bids, and his decision on such matters shall be final. 3. TERMS: Terms of the sale are cash due upon sale, unless prior credit arrangements for the sale have been agreed upon in writing between the Buyer and Seller, in which event, the terms of the written credit arrangement between the Buyer and Seller for the sale shall prevail. The failure of a member buyer to pay the appropriate party the sale amounts when due may constitute a cause for exclusion from BBU pursuant to Article I, section 9 of the By Laws of BBU. 4. PURCHASER S RISK: Each animal becomes the risk of the purchaser as soon as the auctioneer declares it sold. 5. CERTIFICATE OF BREEDING AND/OR TRANSFERS: All required paperwork will be transferred to the buyer at the seller s expense, upon settlement. 6. HEALTH: All animals will have appropriate certificates of veterinary inspection for travel to the sale site and will to the best of the seller s knowledge be eligible for interstate shipment, however, buyers need to be aware of their individual resident state s requirements for shipment of cattle. Any and all testing will have been completed within thirty (30) days of the sale date. 7. ANNOUNCEMENTS: Any changes in information of any kind will be announced from the auction box and such announcements shall take precedence. 8. BREEDING GUARANTEES: a) FEMALES: ON AND/OR EXPOSED FEMALES: Females younger than twentyfour (24) months of age can be sold as open. Open females are so guaranteed. Any female is considered a breeder if she is certified to be pregnant by a licensed veterinarian at the time of sale and/or has a nursing calf at side. Cows (including donor cows) with calves at side six (6) months or older must be certified to be pregnant by a licensed veterinarian. b) SAFE IN CALF FEMALES have been examined by a competent veterinarian and are so guaranteed. c) BULLS: Bulls eighteen (18) months or older are guaranteed to have passed a Bull Breeding Soundness Evaluation (BSE) and to have been certified a satisfactory potential breeder by a licensed veterinarian within fortyfive (45) days prior to sale date. The results of the Breeding Soundness Evaluation (BSE) must be reported on a fully completed official form and attached to the health papers required for the sale. 9. DISCLOSURE OF PRIOR PROCEDURES: If known to the seller, there must be a disclosure in the current sale catalog or from the box of any circumcision or other surgical alteration of any underline of any male or female and of any single egg or superovulation flush of any female sold in a BBU Approved Sale. 10. INHERITED DEFORMITIES GUARANTEE: All bred females are guaranteed not to produce a calf with an inherited deformity occurring in Bovine for a period of nine months following date of sale. 11. REPRESENTATIONS AND GUARANTEES: All representations and guarantees, whether set forth in sale catalogs, these Terms and Conditions of Sale or otherwise, are solely those of seller and are not those of BBU. Except for the assurances set forth in the Approved Sales Agreement that an animal does not exhibit a genetic defect and that its registry information is consistent with the information in BBU s records, BBU makes no representations, warranties, guaranties or assurances whatsoever. 12. RIGHTS AND OBLIGATIONS: The above terms and conditions of sale shall constitute a contract between buyer and seller of each animal and shall be equally binding upon both. Each sale or resale of an animal constitutes a separate transaction. Neither BBU, the sale manager, nor any other person connected with the management of the sales assumes any liability, legal or otherwise, for any subsequent resale of an animal. 13. REMEDIES : a) ON AND/OR EXPOSED FEMALES are guaranteed to be breeders by twentyfour (24) months of age except in cases of animals purchased and then fitted for show or administered any super ovulation drug. In cases of animals fitted for show or administered any super ovulation drug after purchase, the breeding guarantees, if any, shall be such as agreed upon between buyer and seller. All claims for a refund must be made in writing to the seller within six (6) months after the animal reaches twentyfour (24) months of age. Open females are so guaranteed. If within sixty (60) days after the sale date, a female sold as open proves to be with calf, the buyer may return the female to the farm of the seller, provided the female is in good condition and in compliance with the health requirements of the seller s state, and receive refund of the full purchase price. The acceptance of the refund of the full purchase price shall in any case be deemed full satisfaction and settlement of the matter. The buyer s failure to notify the seller within sixty (60) days from the date of sale and to make the election as hereinabove provided shall relieve and absolve the seller of any duty, obligation or liability to the buyer regarding the purchase of said female. The seller and buyer shall bear equally all reasonable and necessary transportation expenses that are incurred in returning the animal to seller. b) SAFE IN CALF FEMALES are guaranteed to have been examined by a licensed veterinarian. If within thirty (30) days after sale date, a female sold as safe in calf proves not to be in calf, the buyer may immediately request that the female receive service from the bull previously used, if available, or return the female to the farm of the seller, provided the female is in good condition and in compliance with the health requirements of the seller s state, for a refund of the full purchase price. The acceptance of the refund of the full purchase price shall in any case be deemed full satisfaction and settlement of the matter. The buyer s failure to notify the seller within thirty (30) days from the sale date and to make the election as hereinabove provided shall relieve and absolve to the seller of any duty, obligation or liability to the buyer regarding the purchase of said female. The seller and buyer shall bear equally all reasonable and necessary transportation expenses that are incurred in returning the animal to seller. c) FLUSHES AND TIME REQUIREMENTS: A flush consists of all viable embryos, transferred or frozen, received from a female as the result of the administration of any super ovulation drug. The sale of a flush or resulting pregnancies must specify in the sale catalog the number of pregnancies guaranteed and the disposition of any other pregnancies resulting from the flush, the disposition of any frozen embryos resulting from the flush and any additional charge for the recipient cows. The maximum time for the delivery of the guaranteed results must be specified along with a payment schedule. Nondelivery or only partial delivery by the specified time by the seller will result in a prorata refund of all monies paid by the buyer for such flush or pregnancies not delivered. d) PREGNANCY AND/OR PREGNANT RECIPIENT COW: Pregnancy and/or pregnant recipient cow is a cow of any breed that is carrying a pregnancy (guaranteed to have been examined by a licensed veterinarian as safe in calf) as the result of a flush as so stated on the certification of embryo transplant form. Such pregnancy and/or pregnant recipient cow is guaranteed to be carrying the embryo pregnancy so stated and if found not safe in calf by a licensed veterinarian within thirty (30) days of delivery of the recipient cow to the buyer, the buyer will have the same remedies as set forth in clause b) for the safe in calf females. The amount bid by the buyer for the individual pregnancy and/or pregnant recipient cow offered at a sale will be inclusive of the recipient cow. A pregnancy and/or pregnant recipient cow should be available at the sale site; however, if not available it must be delivered to the buyer, at the seller s expense, within thirty (30) days of the sale with the necessary health papers sufficient for delivery to the buyer. e) CLONES: Only BBU replication cellcloned animals shall be eligible for registration and eligible to sell in BBU Voluntary Approved Sales. Genetically modified animals shall not be eligible for registration and cannot sell in BBU Approved Sales. Cloned animals shall be guaranteed by the seller to be breeders under the same terms of the agreement for females and bulls. Any additional guarantees with respect to clones shall be by separate agreement between buyer and seller. f) BULLS: If within onehundred twenty (120) days from the date of sale, the bull has failed to pass a Breeding Soundness Evaluation ( BSE ) certified by a licensed veterinarian, buyer must send seller written notification of the failure of the test within onehundred and twenty (120) days from the date of sale and include the BSE test results. Within sixty (60) days after sellers notification of the failed BSE test, buyer and seller shall identify a mutually agreeable licensed veterinarian or technician certified by a licensed veterinarian to perform another BSE on the bull at the buyer s expense. The results of the test shall be deemed final and conclusive of this matter and binding on buyer and seller. If, in the opinion of said veterinarian or technician, the bull is unable to pass a BSE and be confirmed a satisfactory potential breeder, he shall so certify in writing to the seller and the buyer which shall include the official form used by the Society of Theriogenology or the official BBU Breeding Soundness Evaluation form. In such event the buyer may return the bull to the farm of seller, provided the bull is in good condition and in compliance with the health requirements of the seller s state, for a refund of the full purchase price. The acceptance of the refund of the full purchase price shall in any case be deemed full satisfaction and settlement of the matter. The seller and buyer shall bear equally all reasonable and necessary transportation expenses that are incurred in returning the animal to seller. A listing of industry standards for Scrotal Circumferences for bulls at various ages will be printed in the sale catalog. 38 Beefmaster Breeders United Approved Sale Agreement (For Consignors, Sale Managers and Consultants) In consideration of the permission granted by Beefmaster Breeders United ( BBU ) for the undersigned to conduct a BBU Approved Sale and the mutual agreements set forth below, I hereby agree to the following terms and conditions: 1. All cattle to be sold shall be represented by the seller as properly identified with permanent identification number. All identification numbers, branded or tattooed on an animal, and the description must match identically the identification numbers, holding brands and description listed on the Certificate of Breeding. 2. At the time of the sale, all cattle exhibiting any genetic defect that, in the opinion of the designated BBU official, would be a detriment to the breed, and all cattle that, in the opinion of the designated BBU official, would classify X under the BBU Voluntary Classification Program will be removed from the sale offering. 3. BBU s fees for services rendered in connection with an Approved Sale are available upon request from the BBU office. 4. The designated BBU official responsible for implementing the above regulations will be at the sale site in ample time to inspect the cattle and accompanying records prior to the commencement of the sale and I agree to provide such official with appropriate access and accommodations required to assure full compliance with the terms of this Agreement. 5. All cattle sold, other than First and Second Cross calves under fourteen (14) months of age and the embryo recipients, must have BBU Certificates of Breeding. All First and Second Cross calves under fourteen (14) months of age must be accompanied by a properly completed and executed Application for Certificate of Breeding. The sale management or seller must present all Certificates of Breeding (or applications when applicable) to the BBU office ten (10) business days prior to sale date. Substitute animals will be accepted provided the Certificates of Breeding (or applications) are in compliance with all applicable requirements upon arrival at the sale site. 6. All semen and frozen embryos sold at a BBU Approved Sale must have a completed BBU AI Certificate Form or Embryo Bill of Sale provided at the time of the sale. The BBU AI Certificate Form or Embryo Bill of Sale shall include, if applicable, the Blood Typing Case # and DNA Genotype Case # of the bull whose semen is sold, or the sire and dam of the embryos being sold. All A I Sires and Donor Dams must have a DNA Profile on file (or Blood Typing, if applicable) at BBU prior to the approved sale date. BBU approved sale catalogs must include the blood type case number and DNA genotype case number of all animals selling that have been typed; and include the blood type case number and DNA genotype case number of the sire and dam (if typed) of all animals selling. The PV designation for Parent Verified must also be included in the BBU Approved Sale catalog on each animal to which it is applicable. 7. BBU Certificate of Breeding number of each service sire of a bred female must be indicated in the sale catalog. 8. If an animal is classified, such classification must be reflected in the catalog, as provided for below or on the pen card if applicable or announced from the box. All existing available official BBU performance information will be included in the following block, (only that portion of the block must be printed where official BBU information exists) for the display of official BBU classification and performance information. The sample block below may be used or other formats may be used but the information must be official BBU data as listed on the registration certificate. 1. In making this agreement, I agree to indemnify and hold harmless BBU, it officers, directors, employees, agents, and authorized representatives from any liabilities which may arise in connection with a BBU Approved Sale. I acknowledge that I have read and understood all of the terms of this Agreement and the currently applicable Terms and Conditions of BBU Approved Sales. FAILURE BY A MEMBER TO COMPLY WITH THIS SIGNED AGREEMENT WILL BE AUTOMATIC CAUSE FOR APARING BEFORE THE BBU ETHICS AND RULES COMMIT TEE TO SHOW CAUSE WHY HE/SHE SHOULD BE RMITTED TO RETAIN HIS/HER MEMBERSHIP IN BBU. The provisions of this Agreement only apply to a sale that has qualified to the satisfaction of BBU as a BBU Approved Sale. Such qualification shall be manifested by the certifying statement of an authorized officer, director or staff person of BBU expressed from the sale box immediately prior to the sale. All BBU Satellite Sales shall be conducted in conformance with, and subject to, the terms and conditions of this Approved Sales Agreement.
