1 MISSISSIPPI DELTA DRAGON BOAT FESTIVAL Schelben Park, Greenville, Mississippi July 28 30, 2016 WAIVER OF LIABILITY, DISCHARGE, RELEASE INDEMNIFICATION AND HOLD HARMLESS AGREEMENT I, the Undersigned, for the Participant, for myself, and on behalf of my/our heirs, next of kin, assigns, representatives and agents (individually, jointly, severally, and collectively, the Undersigned ), in consideration for the Participant s participating in any acts/functions/activities or even(s) in connection with the Mississippi Delta Dragon Boat Regatta ( MDDBR ) and for the Participant s use of property and equipment in connection with any acts/functions/activities and events organized and/or run by the Dynamic Dragon Boat Racing, LLC ( Dynamic ) and/or Main Street Greenville/Greater Greenville Development Foundation, Inc. (singularly and jointly, Main Street ), including but no limited to, any events on the premises, waterways and grounds; FURTHER, I, the Undersigned, do hereby state, agree, acknowledge, confirm and affirm that the Undersigned and Participant are duly aware of the risk and hazards inherent in my participating in the sport of Dragon Boating, including but not limited to the loading, launching, docking, boarding, entering, existing, paddling, steering, drumming, and use of equipment in the sport and upon entering the premises (including the boats), waterways, in air space, and grounds used for the MDDBR; and in my sole discretion choosing/option to participate in the MDDBR activities, knowingly and fully aware that conditions may be hazardous and dangerous, that obstructions may exist, and that high winds and other watercrafts may cause rough waters and unfavorable or unexpected conditions, do hereby voluntarily willingly and freely assume any and all risks caused by the Participant, any other party, Dynamic, Main Street, or MDDBR, associated with the Participant s participation in the MDDBR; AND FURTHER, I, the Undersigned, state, acknowledge, confirm, consent, certify and affirm, for the Participant, for myself, and on behalf of my/our heirs, next of kin, assigns, representatives and agents (individually, jointly, severally, and collectively, the Undersigned ), that I/We hereby forever DISCHARGE, RELEASE, INDEMNIFY AND HOLD HARMLESS Dynamic and Main Street and MDDBR (collectively, Dynamic and Main Street and MDDBR, the Released Parties ), including such Released Parties officers, directors, officials, employees, volunteers, agents, sponsors and any other associates of such Released Parties, of all liabilities, claims, injuries, losses, damages, expenses, demands, legal actions and any causes of action whatsoever of any kind or nature arising out of or related to any such loss, damage, negligence, injuries, including death, that may be sustained by Participant, for any reason whatsoever, while in route to or from, or participating in, or upon the premises (including the boats), waterways, in air space, and grounds of the MDDBR, whether such is/are the result of negligence, act or otherwise for any other reason or cause by the Undersigned, any party, Dynamic, Main Street and/or MDDBR.
