3 THE WILDLIFE CONSERVATION ACT, (CAP.283) REGULATIONS (Made under sections 54(2) and 121(a), (e) and (f)) THE WILDLIFE CONSERVATION (NON-CONSUMPTIVE WILDLIFE UTILIZATION) REGULATIONS, 2016 PART I PRELIMINARY PROVISIONS Citation Application Cap. 333 Cap. 288 Interpretation Cap These Regulations may be cited as the Wildlife Conservation (Non-Consumptive Wildlife Utilization) Regulations, These Regulations shall apply to conservation areas, wildlife ranches, wildlife farms, zoo and game sanctuaries or other areas with wildlife resources for sustainable non consumptive use as shall be designated by the Director except in National Parks, the Ngorongoro Conservation Area, conservation areas established under the Antiquities Act, Marine reserve and Forest Reserves and towns as prescribed under the Local Government (Urban Authorities) Act. 3. In these Regulations unless the context otherwise requires- Act means the Wildlife Conservation Act; Authorized Officer means the Director, a Wildlife Officer, a Wildlife Warden, Wildlife Ranger or Police Officer, and includes the following: (a) an employee of the Forest and Beekeeping Division of or above the rank of Forest Ranger; 3

4 (b) an employee of National Parks of or above the rank of Park Ranger; (c) an employee of the Ngorongoro Conservation Area of or above the rank of Park Ranger; (d) an employee of the Fisheries Division of or above the rank of Fisheries Assistant; (e) an employee in Wildlife Management Area of a designation of a Village Game Scout; (f) an employee of Marine Parks and Reserves of, or above the rank of Marine Parks Ranger; (g) an employee of the Antiquities Division of the rank of or above the rank of Conservator of Antiquities; and (h) any other public officer or any person who shall be appointed in writing by the Director; conservation area means a game reserve, a game controlled area, Wildlife Management Area, a corridor area, migratory route, buffer zone, dispersal area, wildlife ranch, wildlife farm, zoo and wildlife sanctuary or any other area designated by the Director; citizen for the purpose of Part III of these Regulations means citizens of the East African Community member states; closed season means a closed period declared by the Minister under the Act; Director means the Director of Wildlife appointed under the Act; established campsite means a campsite with developed structures for purposes of provision of basic campsite services; dispersal area means an area habitually used by the wild animal species for feeding, laying, storing eggs, rearing or feeding their young and includes breeding places; filming includes the act of taking sequence of images of objects by a camera or similar device that works like a camera to provide optical illusions of continuous movement or sequence when projected into a screen; fly campsite means a campsite set temporarily for tourists away from their base or permanent campsite; game sanctuary means a place where wild animals are reared in captivity in natural state primarily for educational and recreational purposes; 4

5 guest means any person, who in return for payment of an amount of money whether such payment is made by such person or any other person, occupies or reserves for occupation, accommodation in a tourism facility for over a period of or part of twenty four hours; hunting block means an area with game animals which is delineated or set aside and approved by the Director for trophy or sport hunting; lodge means an accommodation establishment located within or near natural habitat rich in fauna and flora, in which the majority of clients are leisure seekers; migratory route means an area of a strip or zone of land used by herds of wild animals in their migratory circles or seasonal movements; Minister means the Minister responsible for wildlife; night game drive means an activity of driving a motor vehicle or boat from the time the sun sets to 22:00 hours for purposes of viewing wild animals by a tourist; non-consumptive use means the use of scenery, cultural and natural resources that does not involve taking any specimen from the scene, cultural site or the wild and includes game viewing, bird watching, walking safaris, hiking, canoeing, boating, scuba diving, mountaineering and any other similar or related activity; non-consumptive wildlife utilization permit means authorisation by the Director to carry out non-consumptive wildlife tourism activity; open area means any land with wildlife other than that in a National Park, Ngorongoro Conservation Area, Game Reserve, Game Controlled Area, Wildlife Management Area, zoo, game farm, game sanctuary, wildlife ranch; Marine Reserve, Marine park, Nature Reserve and Forest Reserve; operator means any person who owns, conducts or operates a tourism facility or activities or is responsible for its management; rafting means an outdoor leisure activity pursued by way of floating on or over a water body in a raft; special campsite means an area identified for camping with no facility used for camping; 5

6 sport fishing means fishing for recreational purposes; tented camp means accommodation establishment comprising mainly of semi permanent and, or mobile tented accommodation facilities located in an area with wildlife; tourism means activities of a person travelling to or staying at a place outside his usual environment for more than twenty four hours and less than a year and whose main purposes of travel is other than the exercise of an activity remunerated from within the place visited, and where this activity is undertaken by a resident it shall be known as domestic tourism; tourist means a person who is travelling to a place outside his usual environment for a period between twenty four hours and one year and whose purpose of travel is other than the exercise of an activity remunerated from within the place visited, and where this activity is undertaken by a resident it shall be known as domestic tourist; tour guide means a person who accompanies tourists and is capable of interpreting resources in areas where nonconsumptive wildlife tourism activity is conducted; traditional guide means a person with indigenous wildlife guiding skills, informal education or knowledge who accompanies tourists in undertaking non-consumptive wildlife tourism activity; visitor means any person whose usual place of residence is outside an area visited, for a period not exceeding one year for reasons other than employment; wildlife shall have the same meaning ascribed to it under the Act; wildlife corridor means an area of land used by wild animal species in their seasonal movements from one part of an ecosystem to another in search of basic requirements such as water, food, space and habitat; wildlife farming means intensive animal husbandry, breeding or raising of one or more wild animal species on a totally enclosed surface area that is less than 25 hectares in a manner that is intended to domesticate the animal and with a view to engage in different forms of wildlife utilization; wildlife ranch means an area of extensive multiform utilization 6

7 of species of wildlife where a wide range of complementary uses are professionally managed so as to render the animals compatible of tourist hunting, sport hunting, cropping, sale of live animals, tourism and sport fishing; and Zoo means a place where wildlife is kept in captivity for recreation, research and or educational purposes. PART II CONDITIONS AND PERMITS Nonconsumptive wildlife utilization Cap. 65 Nonconsumptive Wildlife Use Permit Cap A person shall not operate non-consumptive wildlife tourism without having a licence issued under the Tourism Act, authorizing the holder to operate a facility or any other tourism business. 5.-(1) Any person who intends to conduct nonconsumptive use shall apply for a permit to the Director. (2) An application made under this regulation shall be in a form specified in the First Schedule to these Regulations. (3) Where the Director is satisfied that an application has been duly made in accordance with the provisions of these Regulations, shall issue a permit in a form prescribed in the Second Schedule to these Regulations authorizing the applicant to conduct the activity applied for upon payment of the prescribed fees. (4) The Director may attach any condition on the permit to be issued. (5) Notwithstanding the provision of this regulation, the Director may, upon application with or without a fee, grant special permission to individuals or group of individuals to conduct nonconsumptive use for: (a) research; (b) educational purpose; (c) cultural purpose; (d) promotional activity; or (e) state visits. (6) The Director may, on application by a tour operator and upon payment of fees as determined by the Director, authorize 7

8 any form of non-consumptive use not prescribed under regulation 16(2) of these Regulations. Investment in nonconsumptive wildlife activity Cap (1) The Director shall advertise sites located in Game Reserves or Game Controlled Areas designated for investment in the form of tourism facilities such as tented camp, lodge, or similar business in non-consumptive wildlife utilization, inviting interested persons to apply. (2) The Director shall use normal tendering procedures in advertising, evaluating and awarding investment concessions in Game Reserve or a Game Controlled Area. (3) The Director shall sign a concession agreement with a successful bidder on such terms and conditions as may be specified therein. (4) The concession agreement shall contain among other things: (a) condition on how the facility should be constructed and maintained, type of facility, materials to be used in the construction, location of the proposed development and design and layout; (b) accessibility; (c) operations of the facility; (d) staff matters; (e) aesthetic qualities and considerations; (f) environmental consideration measures; (g) water, sanitation and electricity issues; (h) what happens and what cannot happen in the proposed facility; (i) security and safety measures; (j) payment of concession fees and other taxes; (k) alterations or additions to the proposed development; and (l) quality of services to be provided. (5) Subject to sub-regulation (3), no person shall operate or engage in non-consumptive wildlife business without a licence issued by the Tanzania Tourism Licensing Board under the Tourism Act. (6) Any person permitted to invest in accordance with the 8

9 provision of subregulation (1) shall: (a) ensure that the investment is completed and granted the relevant licences and permits within a period of three years from the date of signing a concession agreement; and (b) pay the concession fees as prescribed in these Regulations from the date of signing the concession agreement. (7) Any person who fails to complete the investment in the prescribed period shall on top of paying the concession fee, pay to the Director Sixty thousand United States Dollars for each delayed year: Provided that, the delayment shall not exceed two years. Nonconsumptive wildlife utilization in game sanctuary, zoo etc Criteria for designating areas for nonconsumptive use Conditions for business and investment 7.-(1) The Director may, upon application, grant permission to owners of wildlife farm, wildlife ranch, zoo and game sanctuary to conduct non-consumptive use. (2) A person who has been granted permission under subregulation (1) shall protect the surrounding environment against pollution which may endanger the ecological integrity of the area. 8. The Director shall, in designating an area for sustainable Non- consumptive uses in buffer zone, corridors, dispersal area, migratory routes and other areas with wildlife potentials consider the following criteria: (a) potentiality for wildlife recovery upon given time of investment leading to the increase in animal population; (b) diversity of animal species and habitat; (c) the boundary of the proposed area is clearly demarcated, described by physical features and or permanent visible marks as may be applicable; and (d) significance wildlife based tourism activities. 9. Subject to regulation 6, the applicant for business or investment for non-consumptive wildlife utilization shall be required to: (a) own a company dully registered in Tanzania; 9

10 (b) have a respective tourism license issued by the Tanzania Tourism Licensing Board; (c) established office premises; (d) submit a business plan relating to the proposed undertaking; (e) have capacity to carry out the business of nonconsumptive wildlife utilization; (f) comply with the General Management Plan or Resource Management Zone Plan of the area or the Land Use Plan as the case may be; (g) carry out an Environmental and Social Impact Assessment and obtain an approval from the competent authority where applicable; (h) sign an agreement with the Director on the modalities of establishing the investment or operations; (i) pay fees as prescribed under these Regulations or as prescribed by the Director; and (j) comply with any other condition as may be prescribed by the Director. Conditions of research and educational activities Non- Consumptive use in hunting blocks Change of ownership or operator without notification of the Director 10. Any person who wants to conduct research or education activity in a conservation area shall upon obtaining necessary permits from the relevant authorities, apply for the entry permit to the Director and pay the prescribed fees. 11. Non consumptive use activity shall be conducted in areas set aside as hunting block during the closed season provided that: (a) those activities are conducted by hunting company allocated that block; and (b) those activities are conducted in agreement with the hunting company allocated that block. 12.-(1) No person permitted to conduct non-consumptive wildlife utilization in form of a lodge, tented camp or similar establishment in a Game Reserve or Game Controlled Area shall transfer ownership of the lodge, tented camp or similar establishment without prior notifying the Director of such intention and obtaining his written consent. 10

11 (2) Upon receiving the Director s consent under subregulation (1), a person shall be required to pay a transfer fee of seventy thousand United States Dollars. Restriction on nonconsumptive wildlife activity without a guide No obstruction of lawful activity Non consumptive use in private land 13. A person or group of persons undertaking nonconsumptive wildlife activity shall be accompanied by a registered tour guide. 14. Any person who carries out non-consumptive wildlife utilization business or activities in any area shall ensure that his operations are carried out safely, and are not likely to prevent any other duly authorized or licensed person or any other person from passing through or conducting other lawful activities or business. 15. Any person who carries out any non-consumptive use activity in buffer zone, corridors, dispersal area, migratory routes, in a private owned and managed land shall only be required to pay wildlife activity fees prescribed in these Regulations. PART III FEES AND REVENUE SHARING Fees 16.-(1) Every non-consumptive wildlife activity conducted in conservation areas as provided for or specified under these Regulations shall be charged fees as prescribed in the Third and Fourth Schedules to these Regulations. (2) Without prejudice to sub-regulation (1), the Third and Fourth Schedules to these Regulations shall have effect in respect of activities provided for: (a) Game Reserves: (i) conservation fees (per person per day) for the period commencing at the time of arrival and ending after 24 hours on the following day or part of such period and for each following period of 24 hours or part thereof; 11

12 (ii) concession fees for the use of area; (iii) entry fee (entry, game viewing, walking safaris and bird watching); (iv) night game drive personal entry fee; (v) vehicle entry fee; (vi) camping fee; (vii) guiding fee; (viii) sport fishing fee; (ix) horse or camel riding fee; (x) cycling fee; (xi) hiking or mountaineering fee; (xii) air craft landing fee; (xiii) airstrip charges; (xiv) commercial photographing, filming and cinematography fee; (xv) motor boat entry fee; (xvi) boating fee; (xvii) rafting or canoeing fee; (xviii) balloon operation fee; (xix) balloon flight fee; and (xx) Government employed guide fee. (b) Other conservation areas: (i) conservation fee (per person per day) for the period commencing at the time of arrival and ending after 24 hours on the following day or part of such period and for each following period of 24 hours or part thereof; (ii) entry fee; (iii) night game drive fee; (iv) vehicle entry fee; (v) camping fee; (vi) Government or Authorized Association employed guide fee; (vii) aircraft landing fee; (viii) area concession fee; (ix) horse or camel riding fee; (x) cycling fee; 12

13 (xi) hiking or mountaineering fee (xii) commercial photographing, filming and cinematography fee; (xiii) balloon operation fee; and (xiv) balloon flight fee. (3) The Director shall collect the fees prescribed under these Regulations on behalf of the Authorized Associations and the Local Government Authority and such fees shall be subjected to the benefit sharing formula specified under these Regulations. (4) Any person who fails to pay fees within the prescribed time shall pay an additional ten percent of the fee due within fourteen days of notification. (5) Any person who fails to comply with the requirement of sub-regulation (3) within the prescribed time shall further be liable to pay additional thirty percent of the prescribed fee within fourteen days of notification. (6) Any person who fails to comply with the requirement provided for in sub-regulation (3) and (4), commits an offence and shall be liable upon conviction to a fine of five million shillings or to imprisonment for a term of one year or both. (7) In addition to the sentence under sub-regulation (5) the court shall order the payment of the fees due under subregulation (4). (8) Children below five years shall not be eligible to pay conservation fees. Limitation to charging extra fees Cap.65 Fees not refunded on cancellation Benefit sharing 17.-(1) Save as provided for under the Tourism Act, the fees to be charged for non-consumptive wildlife utilisation shall only be as indicated in these Regulations. (2) No Local Authority or any other Authority shall charge or establish other fees related to non consumptive wildlife utilisation except with the written permission of the Director. 18. No payment made by a client shall be refunded upon cancellation of a permit issued for conducting non-consumptive wildlife utilization activities. 19. The revenue accrued from non-consumptive wildlife utilization activities or business shall be distributed as follows: 13

14 (a) Game Controlled Areas (i) 50% shall be directed to the Director; (ii) 30% shall be directed to the District Council (s) of the respective area; and (iii) 20% shall be directed to the Village Government (s) surrounding the respective Game Controlled Area. (b) Wildlife Management Areas: (i) 70% shall be directed to the Authorized Association managing the Wildlife Management Area; (ii) 25% shall be directed to the Director; and (iii) 5% shall be directed to the District Council. (c) Other conservation areas except Game Reserves, Game Controlled Areas and Wildlife Management Areas: (i) 25% shall be directed to the Director; (ii) 15% shall be directed to the District Council of the respective area; and (iii) 60% shall be directed to the Village Government of the respective area. PART IV VARIATION, SUSPENSION OR REVOCATION OF A PERMIT Powers of Director to suspend, or revoke permit and vary conditions Permit holder to be heard 20. Subject to Part VII(e) of the Act, the Director, a wildlife officer or a licensing officer may at any time revoke or suspend any permit or vary the conditions of a permit granted to any person under these Regulations. 21.-(1) Notwithstanding the foregoing Regulation, the Director, a wildlife officer or a licensing officer shall not revoke, suspend or vary any permit or vary the conditions of any permit granted under these Regulations without giving the permit holder an opportunity to show cause why the permit should not be revoked. (2) Subject to the conditions stipulated under subregulation (1) the permit holder shall have a right to make 14

15 representation or show cause to the Director as to why his permit shall not be revoked, suspended or varied. (3) The Director upon receipt of the complaints may reconsider or reject the submission within thirty days after receiving the representation or the cause. Appeal to Minister 22.-(1) Any person who is aggrieved by the decision of the Director under regulation 21 may, within thirty days after receiving a notification from the Director, appeal to the Minister. (2) The Minister shall make a decision within thirty days from the date of receiving the appeal. PART V MISCELLANEOUS PROVISION Offence and Penalty Revocation of GN. No. 357 of Unless otherwise provided, a person who contravenes the provisions of these Regulations commits an offence and on conviction shall be liable to a fine of two million shillings or to imprisonment for a term of one year or both. 24. The Wildlife Conservation (Non-Consumptive Wildlife Utilization) Regulations, 2008 are hereby revoked. SCHEDULES 15
