Dave Cleary Receives 2006 ODFW Partnership Award NEWPORT Oregon State Police Lt. David Cleary received the 2006 Partnership Award from the Oregon Department of Fish and Wildlife s (ODFW) Marine Resources Program as a part of an annual recognition event on January 19, Since 2003, the ODFW Marine Resources Program (MRP) staff selects someone who exemplifies the partnership and cooperation that is the ideal when working with Oregon s marine resources community. For each year we ve had the award Lt. Cleary has always been a nominee, said Patty Burke, program manager. His many years of dedication to our program and his close partnership with us on every marine fishery issue are a tribute to Dave s commitment to collaborative work with our agency and the public we serve. He has improved our understanding of the challenges that enforcement has and proactively helped prevent implementation problems with new regulations. Burke said that Cleary always was proactive, informed and generous in his advice to MRP staff on the best way to design regulations so that enforcement was feasible and efficient. He knows the ocean commercial and sport fisheries intimately. Citizens and fishing industry participants along the entire coast know Dave as the face of Marine enforcement, Burke said. Fishermen felt free to call Dave with questions and Dave was always extremely timely and responsive in getting back to them and to ODFW staff. Cleary, 50, has been with OSP since October His dad served as a wildlife biologist for ODFW and he is an Oregon native. He began his career in the patrol division in Hermiston, and transferred to the Fish and Wildlife Division in 1982, working in Coos Bay. In 1999, Cleary was transferred to OSP Headquarters as a sergeant in the Fish and Wildlife Division. He was promoted to lieutenant in March Previous recipients of the MRP s Partnership Award are: Jim Markee and Bob Jacobson, for their work in the passage of the sport shellfish license; Ginny Goblirsh, for her many years of partnership with ODFW as the Oregon Sea Grant Extension agent, and Nick Furman, the past executive director of the Oregon Dungeness Crab Commission. 2 P AGE 2 O REGON STATE POLICE FISH & WILDLIFE NEWSLETTER Arizona Resident Faces Charges in Several States Including Oregon On January 5, after consultation with the Lane County District Attorney s office, Arizona Game and Fish officers served 3 citations to an Arizona resident at the request of Sergeant Hulett (Springfield) for violations the subject committed on the last day of deer muzzle loader season in December, near Eugene. He was cited for: Taking Elk Closed Season (1) and Possession of Falsely Applied-for Licenses (2). The investigation on the suspect will continue in New Mexico, Oklahoma and California for similar violations of residency rules. New Mexico turned up an associate of the individual who was applying for licenses in that state using the same Arizona, New Mexico and Oklahoma addresses. The second suspect has Oregon ties and has applied for Oregon resident licenses and tags also. The investigation continues. Staged Photo changes Cow to Bull Elk Trooper Gardner (Hermiston) and Sergeant Heider (Salem) investigated a local Tillamook County resident after receiving information of exceeding bag limit of elk. The subject had archery hunted and killed a cow elk on opening day. The subject was aware that his neighbor had a set of shed branch bull antlers. The subject and the neighbor staged photographs by holding the shed antlers on the cow elk s head. The subject then was telling everyone that he killed a branch bull and was showing the staged photograph. It was determined that the cow elk was lawfully harvested. During the investigation it was however, determined that the subject had killed a 3x4 black tail deer which was tagged unlawfully by his young son. The subject was cited for Borrowing Another's Deer Tag. Hunter Exceeds Limit on Bobcats Senior Trooper Caldwell (Burns), Trooper Duncan (Baker City), and Sergeant Newman (Ontario) conducted patrols in southern Harney and Malheur Counties in search of trapping activity. Several traps were located and found to be in violation. The owner was located and found to have 14 bobcats in possession. Four of the bobcats were recorded on his bobcat record card. Seven bobcats were seized and the suspect was cited criminally for Exceeding the Bag Limit Eastern Oregon Bobcat. Wildlife/Hunting 3 Suspects Numerous Violations On January 20, Trooper Maher (Springfield) contacted 2 subjects in Springfield regarding information about an illegally taken deer. The suspect was involved in shooting 2 bucks in the Crow area on December 12. The suspect was also involved with another deer shot by a friend on the same night. A consent search revealed a camera containing photos of the illegal activity. Also found were 4 Pintail ducks stuffed into a backpack. The suspects handed over a.22 rifle used in the activity, they took Tpr. Maher to a residence in Springfield where the deer meat was found in a freezer. At this residence, a turkey tail fan and legs were found which had been illegally taken by a third suspect. On January 22, Trooper Maher contacted the third suspect. Two sets of antlers were seized and this subject was cited (see below). Later in the afternoon Tpr. Maher and Sr. Tpr. Maher arrived at the suspects' apartment complex where they observed 2 subjects walking away holding 3 large sets of deer antlers. These subjects had found the antlers under some brush near a dumpster across from the suspects' apartment. Tpr. Maher then re-contacted the suspects. A total of 7 bucks had been illegally shot, all at night, using a.22 cal rifle and a.270 rifle (which was reported stolen out of Florida). A further investigation revealed that the suspects were also responsible for a headless deer reported in December of 2006, which was investigated on Vaughn Road west of Veneta. One more suspect is yet to be interviewed and cited. All but one set of the illegally taken deer antler sets have been recovered and seized. Included in the sets of antlers were a large 3x4, a 5x5, and a 4x6 which were all killed in within 3 consecutive days. The following is a list of charges. Suspect #1: Aid in a Game Violation-Take Deer with the Aid of Artificial Light, Waste of a Game Mammal-Deer (x2), Aid in a Game Violation Take Deer with the Aid of Artificial Light, Take Deer with the Aid of Artificial Light (x2), Hunt with the Aid of Artificial Light (x2), Take Deer Closed Season (x4), Exceed Bag Limit-Pintail. Suspect #2: Take Deer Closed Season, Attempt to Take Deer Closed Season, Waste of Game Mammal- Deer (x2), Aid in a Game Violation-Take Deer Closed Season (x2), Aid in a Game Violation-Hunt with the Aid of Artificial Light (x3), Take Deer with the Aid of Artificial Light. Suspect #3: Aid in a Game Violation-Take Deer Closed Season, Unlawful Possession of Deer Parts, No Written Record of Transfer-Deer Parts, Unlawful Taking of Turkey-No Turkey Tag, Take Turkey Prohibited Method-.22 Cal Rifle. OSP F&W Seized Interlocking Antlers La Grande Trappers Cited Senior Troopers Chandler and Griffin (both La Grande) investigated unlawful trapping activities in 2 different Union County locations. The first trapper was cited for Trapping Prohibited Method-Sight Bait within Fifteen Feet of Traps. The second trapper was cited for Trapping Prohibited Method - Sight Bait within Fifteen Feet of Traps and Unlawful Use of Game Birds for Bait. Boot Tracks Prove Suspects Wrong Trp s Frerichs and Gorman (both Roseburg) contacted an adult and two juveniles hunting elk. The suspects were off the road in an opening. Two of the suspects had cow elk tags and said they had two cow elk down. Officers searched the area and found tracks in the snow leading away from the two dead cow elk down over the hillside. They then found a blood trail that lead to a third cow elk that had been shot. When questioned, the suspects first denied shooting another elk but when advised their boot tracks matched the ones leading to the other elk, the adult admitted to shooting 2 of the 3 they shot. The adult was cited for Exceeding Bag Limit Cow Elk and Fail to Validate Big Game Tag. The extra elk was salvaged. Waterfowl and Trapper Hunters Checked Senior Trooper Marshall Maher (Oakridge) and Trooper Martin Maher (Springfield) conducted a jet boat patrol on the Lower McKenzie and Willamette River for waterfowl hunters and trappers. The following are the stats from the patrol. Waterfowl Hunters Checked: 16; Trappers Checked: 3; Boats Checked: 8; Citations Issued: No Resident Waterfowl Validation (1), No 2007 Hunting License in Possession (1), Expired Boat Registration (1); Warnings: Fail to Sign Federal Waterfowl Stamp (1), Boat Violation Warnings (2).

3 P AGE 3 Waterfowl Hunters at it Again Senior Troopers Madison (Prineville) and Prodzinski (Madras) contacted several waterfowl hunters on the Crooked River near Prineville. They issued citations for Hunting Prohibited Method - Shotgun Capable of Holding More Than Three Rounds (3), No Hunting License (3), and No Waterfowl Validation (1). 12 Anglers Contacted Few Citations Senior Trooper Maher (Oakridge) and Trooper Martin Maher (Springfield) worked together in the McKenzie River area, 12 anglers were contacted. The following angling citations were issued for violations: No Angling License (2), Angling Prohibited Method - Two Lines (1), Angling with Bait when Prohibited (5). Steelhead or Trout Angling? Trooper Stone (Coos Bay) contacted 2 anglers on the E Fork Millicoma River, both were steelhead angling. When contacted, one subject stated that he wasn't angling, and then said he was trout angling. His buddy admitted he was actually steelhead fishing. The first subject was cited for No Angling License. The second subject had 2 Mallard Drakes in the pickup bed. He was cited for No 2007 Hunting License and warned for no Federal Waterfowl Stamp. Both ducks were seized and donated to charity. ATV ers Caught Trp. Bennett (Grants Pass) has been receiving reports of a group of suspects riding into a remote/roadless area on ATV s in the Illinios River drainage where suspects were catching/keeping wild steelhead. Trp Bennett located the suspects vehicles at a trail head and observed ATV tracks heading down the trail. Trp Bennett later contacted the suspects as they were riding out of the area on their ATV s. The suspect s thought it was ok for them to ride ATV s in the roadless area as they were grandfathered in? Upon investigation, they denied angling with bait or catching anything, although their hands and fishing vests were covered with fish egg dye. Trp Bennett had also observed one of the suspect s drop a back-pack bag behind a tree as he approached. A consent search of that bag revealed 2 wild steelhead. The suspects were cited for Using Bait in artificial lure area and Unlawful Take Wild Steelhead. Unlawful Motorized travel is being referred to USFS. Wildlife/Hunting Hunting Cougar with Dogs is Illegal Senior Trooper Johnson (John Day) inspected a suspicious cougar kill checked in at ODFW in Canyon City. It was determined that the cat was taken with the aid of dogs. The hunter was cited for Taking Cougar with Aid of Dogs. The hunter's helper was cited for Aiding in a Wildlife Violation. Angling Guide Cited-Improper Validating Tpr. Frerichs (Roseburg) checked a guide boat with 2 anglers and 4 kept fish, they were 2 wild and 2 fin-clipped steelhead. When the licenses/tags were checked, the guide had only put an H and W down for the fish. The guide was cited for Aiding in Game Violation- Improper Validating. ODFW Plants Steelhead ODFW planted over 100 steelhead in the expo ponds in Central Point. The excess steelhead had returned to Cole River s hatchery. It was advertised in the paper that the steelhead were being planted. Though daytime temperatures hovered near the freezing point, many people were out attempting to catch a steelhead, an angling license was needed, but because they were in a lake, an angler did not need to tag the fish on their angling harvest tag. No fish were checked, but several of the anglers had no 2007 angling license, citations issued for: No Valid 2007Angling License (7). Observation & Citations Trooper Lea and Senior Trooper Salisbury (both Florence) and Senior Trooper Ashenfelter (Springfield) conducted a boat patrol on the Siuslaw River from Linslaw County Park. They checked one boat after observing one angler land and kill a steelhead. They contacted the boat as a second angler continued fishing. The boat operator said they had four fish onboard. The Troopers inspected tags and found 2 fish entered on each tag. A consent search of the boat turned up an additional 4 steelhead in the fish box. One angler was cited for Exceeding the Bag Limit Steelhead (x3) and Continuing to Angle after Retaining Bag Limit. The other angler was cited for Exceeding the Bag Limit on Steelhead and Continuing to Angle after Retaining Bag Limit. Anglers Checked-Finds Wanted Man Trooper Schwartz (St. Helens) checked several anglers along the Columbia River. He contacted 2 individuals who were fishing for steelhead but didn't have valid combined angling tags. A check in LEDS/NCIC revealed that one subject was wanted on an outstanding felony warrant. Tpr. Schwartz arrested the wanted suspect on the warrant. During the investigation a plastic baggy with meth was located in the wanted suspect s shoe. Tpr. Schwartz cited the other angler for No Valid 2007 Combined Angling Tag. Tpr. Schwartz transported the wanted man to the Columbia County Jail where he was cited for No Valid 2007 Angling Tag, cited and released for Unlawful Possession of Methamphetamine and booked on the felony warrant. 4 P AGE 4 OREGON STATE POLICE FISH & WILDLIFE NEWSLETTER Environment/Habitat Steelhead Carcasses Enrich Rogue River Trooper Collom (Central Point) assisted ODFW Biologist Jay Doino and the Rogue River Steelheader s club in depositing fish carcasses from the Cole Rivers Fish Hatchery into the Rogue River in order to enrich the habitat. The excess fish carcasses were frozen together and had to be chopped up to be placed in the river at various locations. Suspended Driver Caught Driving Again Senior Trooper Gardner (Hermiston) was returning from the Three Mile Canyon area when he stopped a vehicle near Boardman for failing to use headlights. The driver was found to be suspended, uninsured and wanted on: 2004 Theft 1 and Criminal Mischief 2 warrants. The driver was lodged at the Umatilla County Jail. Suspect with Stolen Car Sergeant Hulett (Springfield) watched an individual who had backed his vehicle against a locked gate at Armitage Park. The car had been recently spray painted blue. The individual took a bag of trash out of the back of the car and threw it on the ground. He closed up the car and drove away. Sergeant Hulett stopped the driver for Depositing Litter Within 100 Yards of a River. The driver was suspended and had no insurance. The vehicle was stolen out of Junction City. The driver was taken into custody for an unrelated warrant and UUMV by Sergeant Hulett and Recruit Hockema (Patrol). The suspect was additionally cited for Depositing Litter, Driving While Suspended and Driving Uninsured. The car owner came and recovered the car. She had not authorized the new blue paint job. Suspects Wanted for Murder Trooper Schwartz and Sr. Trooper May (both St. Helens) responded to Goble to assist with a canine pursuit of two armed suspects who were wanted for Attempted Murder. A perimeter was established and one suspect was captured by OSP Sr. Trooper Dickerson during the pursuit, and the second suspect later turned himself in. General Law 11 ATV Riders Receive Citations Senior Trooper May (St. Helens) was dispatched to an ATV crash on private timberland. While a 911 caller was talking with the local 911 center the caller became uncooperative and wanted medics to disregard. The caller had given a general area and about an hour later Sr. Tpr. May located 8 ATV's illegally riding across Longview Fibre Timber property and then onto Hancock Timber Property where Sr. Tpr. May was waiting for them. The injured rider was checked out by medics who were still in the area, but denied medical attention. Both timber company security officers arrived on scene and wanted the 8 ATV riders cited for Criminal Trespass. As Sr. Tpr. May was writing out citations, the Hancock security officer caught 3 more ATV riders coming across a freshly planted clear cut about a 1/4 mile from the 1st group. Those 3 ATV riders were also sent to Sr. Tpr. May's location, they also received citations for Criminal Trespass. Commercial Fish Suspect s Use Deckhand s ID Senior Trooper Canfield (Newport) and Special Agent Pena were monitoring the crab offload of a local crabbing vessel. Sr. Trooper Canfield received a complaint from a deckhand on the vessel. The deckhand stated that he just had $800 charged on his Englund Marine account. The deckhand provided names of the suspects. Sr. Trooper Canfield contacted Englund Marine and Newport PD. Sr. Trooper Canfield located the 4 suspects walking off of Port Dock 5. The investigation resulted in one person being lodged by Newport PD for ID Theft, Theft I, and Forgery I. The other three suspects were cited for Theft II. Traffic Stop Leads to Child Endangerment Senior Trooper Hawkins and Trooper Duncan (both Baker City) conducted a traffic stop and followed the operator into his driveway. The operator did not have a license and was not the owner of the vehicle. Checking the residence for the owner of the vehicle (girlfriend), Sr. Tpr. Duncan and Tpr Hawkins saw drug paraphernalia in plain sight. A consent search revealed a small amount of methamphetamine and marijuana within close proximity of a twoyear-old child. Protective Services were called. The 2 were charged with Possession of a Controlled Substance and Child Endangerment. Vehicle Crash While returning from checking anglers on the South Fork of the Coquille River, Trooper Davis (Coos Bay) came upon a single vehicle crash. The operator was arrested for DUII and transported to the Coos County Jail where he provided a breath sample of.13% BAC. 19 Year Old Arrested for Concealed Weapon Troopers Howell and Thomas (both Tillamook) were working night sport crabbers on Netarts Bay. On their return to the office a vehicle passed them and then passed another vehicle in a no pass area. The troopers stopped the vehicle. The vehicle contained the operator, the operator's son (who is 15) and a 19 year old. The operator failed FSTs and was arrested for DUII. The 19 year old took off running and was caught by Trooper Thomas. He was in possession of 1 ½ ounces of marijuana and brass knuckles. He was arrested for Unlawful Possession of Marijuana and Carrying a Concealed Weapon. The son also took off running. He was in possession of less than one ounce of marijuana. When the operator was being booked, a baggy with white powder was found in his sock and shoe. The white powder appeared to be methamphetamine and has been forwarded to the crime lab for analysis. Sex Offender Caught Out of Compliance Recruit Carothers (Fossil) was given information from a criminal detective that a suspect in Biggs was out of compliance on his sex offender registration. Recruit Carothers located, arrested and transported him to NORCOR.

5 P AGE 5 General Law 2 Suspects Fled Traffic Stop Only to be Caught Later by K9 Unit Senior Trooper Hayes (Bend) stopped a vehicle for minor traffic violations in LaPine. While investigating the operator for a possible sex offender registration violation, the operator fled the area with his girlfriend. While attempting to locate this suspect, Sr. Tpr. Hayes contacted a subject with a similar appearance. This was not the same suspect, but he did have an outstanding warrant for his arrest. This subject was transported to jail and lodged. While enroute back to the LaPine area, Sr. Tpr. Hayes observed the original suspect and his girlfriend on US 97 heading towards Bend. When Sr. Tpr. Hayes attempted to stop them a vehicle pursuit ensued. Bend PD Officers and Deschutes County Deputies set up a spike strip and deflated the vehicle s tires while OSP Troopers conducted the pursuit which was discontinued a short time later. The vehicle was later found along Highway 20 east of Bend. A K-9 unit was called in and the suspects were taken into custody and lodged on the following charges; Operator: Attempt to Elude Felony & Misdemeanor, Hindering Prosecution, Reckless Driving, Reckless Endangerment, Unlawful Possession of a Controlled Substance (Methamphetamine), Criminal Trespass II, Fail to Register as a Sex Offender. Passenger: Outstanding Warrant - Parole Violation (Absconder), Unlawful Possession of a Controlled Substance (Methamphetamine). Suspect Bragging About Hunt/Gets Fined A suspect pled guilty and was sentenced for Taking Elk Without a Tag and Borrowing an Elk Tag. He had a second season elk tag, but hunted the first season and killed an elk. He had concerns about the elk's health and called ODFW to inspect it. He told the biologist about his hunt and how he had made a great shot. The biologist noticed his mother s tag on the elk and called OSP. The suspect claimed his mother was unable to hunt because of her health and he decided to fill her tag. He was fined $1741 and his hunting license was suspended for 2 years. Dispositions Jury Trial Finds Suspect Guilty Senior Trooper Knapp (Enterprise) cited a suspect for: Hunting Elk Without a Valid Tag, and a sentence was given after a jury trial in the Wallowa County Circuit Court: 2 Year Hunting Suspension, 120 Days in Jail (suspended), 40 Hours Community Service, $2133 Fine (suspend $1750) = $383. No 2006 Hunting Tag, Pay the Price During the 2006 hunting season, Trooper Schwartz and Sr. Trooper May (both St. Helens) conducted a daytime compliance check WED operation where an individual shot the forked-horn buck WED from the driver's window of his pickup. The individual didn't have a valid 2006 Western Deer Rifle Tag. The individual was cited for Unlawful Taking of Buck Deer-WED-No Valid Big Game Tag. On Jan 18, 2007, the individual plead guilty in the Columbia County Circuit Court and received the following sentence: $1,183 fines, $300 restitution to WED ($1,483 total financial obligation), forfeit Remington rifle to the state, 18 month probation and 1 year hunting license suspension. Jail Time for Fisherman A local tribal fisherman in The Dalles was sentenced for: Unlawful Possession of Sturgeon during the 2006 setline fishery. He received 60 days in jail and $750 restitution to ODFW. Shooter & Six Offenders Caught Senior Trooper Coggins (Enterprise) cited one suspect for: Taking Elk Closed Season and Waste of Wildlife, and cited 6 others for: Aiding in a Wildlife Violation. The below sentences were given by the Wallowa County Circuit Court: Shooter: $500 fine, $1500 Restitution ODFW, $100 to TIP Reward Fund, 5 Year Hunting Suspension. Six suspects that aided each received: $250 fine, $100 to TIP Reward Fund, 2 Year Hunting Suspension. Hunter s Anger Sends Him to Jail During the 2005 hunting season, Trooper Schwartz and Sr. Trooper May (both St. Helens) responded to a complaint where a Rainier man pointed a firearm at a couple that was on an ATV behind locked gates. The investigation revealed that the suspect was upset at the couple for driving around the gate. The suspect pointed the rifle at the chest of the operator of the ATV and told him that he had to leave the area. The suspect then lifted the rifle and fired one shot over the operator's shoulder. The couple quickly left the area and obtained a license plate number of a vehicle parked in the area. The couple provided that information to the troopers and the subsequent investigation led to the arrest of the suspect for Menacing (x2) and Pointing a Firearm at Another (x2). The suspect pled not guilty and the case went to jury trial. The suspect was found guilty of Menacing (x2) and was sentenced to: Anger Management, 24 months probation, 24 hours community service, $2,764 fines, forfeit of the rifle to state, 1 year hunting license suspension and no contact with victims. 6 P AGE 6 O REGON STATE POLICE FISH & WILDLIFE NEWSLETTER Public Relations - Interagency Cooperation Three Waterfowl Hunters Receive Citations from OR and WA Senior Trooper Gunderson (The Dalles) and Recruit Ring (Arlington) were patrolling the Columbia River near the mouth of the Deschutes River when they observed 3 men hunting waterfowl on Miller Island (WA). They watched as one of the men got in a jet boat and chased ducks and geese in an attempt to scare them into flying over the other 2 hunters. Several shots were fired, however, no birds were seen to be hit. Later, as the sun was going down, the men resorted to chasing and shooting birds from their moving boat. Washington F&W Officers were contacted as several violations had occurred in Washington. All activities were occurring in the Columbia River Refuge. The 3 men were contacted at Heritage Landing at the mouth of the Deschutes River. They discovered at that time, that, in addition to the violations that they had already observed, only 2 of the 3 hunters had Oregon hunting licenses, none had Washington licenses, and they had lead shot in their possession. The following citations and warnings were issued: Citations by Oregon F&W Officers: Hunting Prohibited Area-Columbia River refuge (3), No 2007 Resident Oregon Hunting License, Harassing Wildlife; Warnings by Oregon F&W Officers: Possession of Toxic Shot (3), No Deschutes River Boater's Pass, Violation of No Wake Zone, Unsigned Federal Bird Stamp. Citations by Washington F&W Officers: Hunting Closed Area (3), No Washington Hunting License (3), Power-boating Waterfowl (3), No Washington Migratory Bird stamp (3); Warnings by Washington F&W Officers: Possession of Toxic Shot (3). Oregon and Idaho Patrol on Snake River Fish & Wildlife Division Troopers assigned to the Baker and Ontario offices participated in a joint state waterfowl and Marine Board saturation patrol on the Snake River. The patrol consisted of Idaho Fish and Game officers, Malheur County Sheriff's Office Marine Deputy, US Fish and Wildlife Service Agents and Oregon State Police Troopers working the border waters of the Snake River upstream well into Idaho.
