3 Reason for Revision Rules are in place allowing trials Several rules regulate or prohibit training activity Much of the dog or raptor training currently occurring is unlawful

4 Reason for Revision, cont. The Department wishes to provide rules, within the scope of its authority, which allow persons to use common methods to train hunting dogs.

5 Current Rules Wildlife, as defined, includes all species which, if viewed globally, typically exist in a wild state. Includes domestically raised wildlife Does not include rock pigeons Permit needed to release wildlife (statute) Take of wildlife is regulated by the Fish and Wildlife Commission

6 Current Trial Rules Division 46 only applies to Competitive Hunting Dog Trials Permits needed from the Department when: wildlife is released trial will be held during April 1 August 14 Domestically raised or captive wildlife may be used.

7 Current Training Rules Prohibitions on timing Oregon Administrative Rule Division Dog training is considered wildlife harassment in productive wildlife habitat during the months of April July Big Game, Game Bird and Furbearer Regulations No person shall permit a dog to run at large or train dogs in game bird nesting habitat during the months of April - July

8 Current Training Rules Permit required to release wildlife Issued by Wildlife District Commission authorizes take of wildlife A release permit does not authorize take of wildlife

9 Proposed New Rules Modify current rules to remove prohibitions of running or training dogs during April July. Statutes prohibit the unauthorized harassment of wildlife.

10 Proposed New Rules, cont. Apply to training related to hunting wildlife They do not apply to inanimate devices or bird wings pet obedience, search and rescue or agility training. They do not supersede any rule regulating private hunting preserves.

Establish a Wildlife Release and Take Permit For training or trials only No cost Obtained from the Department Trial permit obtained from Wildlife District Individual training permits obtained online Allows the release and take of specific game birds for trials and training On public lands must follow rules for public use

12 Rules for Releasing Wildlife Wildlife which can be released Pheasants, California, bobwhite, and Coturnix quail, chukar, Hungarian, and red-legged partridge, and mallards Must be properly marked Toe clip Nasal scar Band approved by the Department ODA requirements for import Certificate of Veterinary Inspection NPIP certified origin

13 Rules for Taking Wildlife Hunting Licensing Requirements Per statute and administrative rule During hunting seasons Follow bag limits Take of unmarked wildlife outside of a season is prohibited Competitive shooting of live birds Prohibited by current statute

16 Proposed Rules - Trials Permit for each trial required One permit covers all participants Application for permit must be received 10 business days prior Clarifies wildlife may be taken Department may place conditions on or deny permit Written notice and opportunity for contested case hearing

18 Proposed Rules - Training Annual Permits Obtained online Valid through December 31 Holder or companion may release and take wildlife Not more than 3 birds may be released per hunting dog or raptor per day Intended to prevent circumvention of hunting season and hunting preserve regulations

19 Timeline Comments received by January 12 will be considered for incorporation into Department proposals. All comments received will be provided to the Commission Commission Rulemaking February 4, 2011 In Salem Public testimony will be taken
