1 NOTICE OF MOTION SHA Board of Directors Replace entire current 3.07 section. 7 APPEAL PROCEDURE Purpose of the SHA Appeal Committee Any registered participant or member of the SHA shall have the right to appeal to the SHA any dispute, difference or question arising from a decision by the SHA or any member where the Bylaw, Regulation, Playing Rule or Policy under which such decision was made grants such a right of appeal Structure The Chairperson of the SHA Appeals Committee shall be an officer within the Board of Directors of the SHA. The Chairperson or his designate and any two (2) others appointed from the current Board of Directors or who had previously served on the Board of Directors shall act as the Appeals Committee. Note: A member of the SHA Referee Division serves as a resource in the Appeal of any suspensions that arise from a referee s decision a) What decisions may be appealed to the SHA? i) The decision that is in conflict with the Articles, Bylaws, Rules, Regulations and/or Policies of a Member Association/League, SHA or 1

2 Hockey Canada that may have had a material impact on the decision rendered. ii) The party making the decision committed a material procedural error, or failed to provide the aggrieved party with a fair process that may have had a material impact on the decision rendered. iii) The party making the decision did not have the authority or jurisdiction to make the decision. iv) All Appeal processes, if any, have first been exhausted prior to appealing to the SHA. b) What decisions may not be appealed to the SHA? The following decisions may not be appealed unless the decision itself is contrary to Hockey Canada or SHA Constitution, Bylaws or Regulations: i) Any decision by a Member Association/League as to the outcome of any game or games. ii) Any decision of the SHA Registration Committee. iii) Any decision of a SHA protest decision concerning the SHA Provincial Playoffs. iv) Any decision where a SHA Minimum Suspension Guideline was levied Appeal Application Procedure a) An Appeal Application form must be received by the SHA office via personal delivery, fax or no later than thirty (30) days from the date the decision being appealed was sent to the person appealing. The Application fee of $300 (cash or credit card) must be received with the application form. b) The SHA Officer of Appeals will personally review the material submitted by the Appellant and determine if the application satisfies SHA regulation a) and shall render a decision to proceed to a hearing. If the decision is to proceed to a hearing, the hearing will be heard no later than fourteen (14) days from the SHA receiving the decision from the SHA Officer of Appeals. In the event that the Application does not qualify for a hearing, the application fee will be refunded and a written decision and rationale for the decision will be provided by the SHA Officer of Appeals. 2

3 Protocol a) The Presiding Appeals Committee shall at all times ensure for all Appeals: i) Process followed was fair ii) Decision rendered was reasonable and logical iii) Resulting Sanction was appropriate b) The Appellant s rights during an appeal hearing: i) The Appellant has the right to be present throughout the appeal hearing and may have someone present for support at the discretion of the Chairperson ii) The Appellant or representative has the opportunity within reason to ask questions of anyone who provides evidence. c) The Appeal hearing will be conducted as follows: i) The game sheet or on-ice officials report will be made available during the hearing. ii) The Appellant may present their case for why the decision should be overturned or altered. This may include testimony of witnesses or documentation which was presented during the initial investigation. If witnesses of the Appellant are present they will be allowed into the hearing one (1) at a time at the discretion of the Chairperson. iii) The party(ies) who made the decision on the suspension/decision would have submitted documentation to the Appeal chair prior to meeting as to the rationale for their decision. This may be done through the submission of documentation electronically or by being present through conference call. iv) Once all information has been presented, the Appeals Committee will render a decision within seven (7) days. v) The Appeals Committee will notify the General Manager of the Committee s decision. The General Manager will notify the Appellant and appropriate parties Any individual who files an appeal remains suspended and is not eligible to participate in games until such time as the appeal process is completed The decision of the Appeals Committee shall be final and binding for all parties concerned. The final decision shall be placed in writing with the copies given to the person(s) making the appeal and to the General Manager of the SHA. 5 NOTICE OF MOTION f) 106 Prairie Junior Hockey League For Junior B Hockey in Saskatchewan: Each Junior B team will be allowed to card a maximum of eleven (11) players, that are twenty (20) years old or twenty-one (21) years old. The maximum number of players that are twenty-one (21) years old will be (2). The twenty-one (21) year-old players, that are carded by any Junior B team must have been carded with that Junior B team the previous season as a twenty (20) year old and must be on that Junior B teams final February 10th roster and must have played at least a minimum of ten (10) league and/or playoff games with that Junior B team the previous season. Exception: A new Junior B team in the SHA will be permitted to card a maximum of two (2) twenty-one (21) year-old players, that were carded by any Junior B team in the SHA the previous season as a twenty (20) yearold and must have been on one of SHA s Junior B teams final February 10th roster and must have played at least a minimum of ten (10) league and/or playoff games with that Junior B team the previous season. NOTE: 1) eleven (11) - twenty (20) year-old players 2) ten (10) - twenty (20) year-old players and one(1)-twenty-one (21) year old players 3) nine (9) -twenty (20) year old players and two (2)- twenty-one (21) year old players For Junior B Hockey in Saskatchewan: 5

6 The maximum number of players that are twenty-one (21) years old will be two (2). The twenty-one (21) year old players must have been carded by any Junior B team in the SHA the previous season as a twenty (20) year-old and must have been on one of SHA s Junior B teams final February 10th roster and must have played at least a minimum of ten (10) league and/or playoff games with that Junior B team the previous season. Rationale for change: The PJHL has the Current wording in the PJHL Handbook, is it necessary to have it in both the SHA Handbook and the PJHL Handbook. The PJHL is suggesting a more stream line version for the SHA Handbook and a more detailed one in the PJHL Handbook. The above regulation was written by the North Saskatchewan Junior Hockey League (NSJHL) and the South Saskatchewan Junior Hockey League (SSJHL) many years ago to protect ourselves from each other. In the NSJHL increased the number of twenty year olds from six to ten at the NSJHL AGM due to a need for more twenty year olds to help with program for the teams in the league. In 2001 the two leagues agreed that the teams required two twenty-one year old players to help their program. This change required over six years of discussion before it was accepted. Prior to the leagues could have 21 carded players by February 10 th of which the teams could have a total of ten players that were 20 or 21 years of age, with a maximum of two 21 year olds. In Hockey Canada allowed 23 carded players per team by February 10 th and at this time the leagues agreed that teams could have a total of eleven players that were 20 or 21 years of age, with a maximum of two 21 year olds. In the NSJHL and the SSJHL decided to form one league and became the Prairie Junior Hockey League. The discussion of increasing our number of 21 year olds from two to three or four has gone on for at least twenty five years. The competition from Alberta, Manitoba and Northwestern Ontario that permit the use of four twenty one year olds continues to fuel the fire to increase the number of twenty-one year olds. The PJHL has had that discussion every year for the leagues eight years of operation. We have not reached the required majority in the PJHL to seek the permission of SHA to allow an increase in the number of twenty one year olds. 6

7 In the past eight years the PJHL has not discussed allowing more than the present number of twenty years olds, which could be nine, ten or eleven depending on the number of twenty-one year olds that are carded. I did hear a comment from one team after they had played an Alberta team with four twentyone year olds and 16 twenty year old players. The Junior A and Junior C rules and regulations do not have any stipulated number of twenty year that can be carded. The Junior A teams have regulated themselves through their league on the number of twenty year olds that are allowed to be carded. There does not seem to be an issue with the Junior C league on the number of twenty year olds. The Junior B teams should be able to regulate themselves on the number of twenty year olds that they require from year to year. The number has been 10 or 11 for the past twenty five years. Teams require a varied option to sign what they feel are their best 20 to 23 players. Many require two twenty-one year olds, most require nine or ten twenty year olds and one team this past year had eleven eighteen year olds. The question becomes is it necessary to have the rule or regulation in the SHA Handbook when it is in the PJHL Handbook. 7

8 NOTICE OF MOTION b) Prairie Junior Hockey League Junior B Teams may have nineteen (19) specifically affiliated players of whom two (2) must be goaltenders from a lower Division or category of team within the Province with the following conditions; i) A Junior B team may affiliate a maximum of five (5) Midget AAA players registered anywhere in the province. ii) City based Junior B teams may be allowed to specially affiliate players from teams in Minor Hockey that are within the city they are based with, plus a maximum of three (3) specially affiliated players whose parents reside within a 160 km radius of the teams centre. iii) Non-city based Junior B teams will be allowed to specially affiliate players from teams in Minor Hockey whose parents reside within a 160 km radius of the teams centre, if a city falls within said radius and has a city based Junior B team, then the non-city based Junior B team may be allowed a maximum of three (3) specially affiliated players whose parents reside within that city. iv) Non-city based Junior B teams will be allowed to specially affiliate a maximum of three (3) players whose parents reside in a city that falls within the 160 km radius of its centre. v) Junior B teams may be allowed to specially affiliate players from any Junior C team registered in the province. 8

PJHL teams look to the PJHL Handbook for their rules and regulations and that is why the affiliation rules and regulations are in our Handbook. The PJHL presently can affiliate AAA Midget players and Junior C players from anywhere in the province. The affiliation of Minor hockey players has some restrictions and probably will not be changed. In reality five out the seven teams in the North Division can affiliate players from either Saskatoon, Prince Albert, Humboldt and/or some of the common surrounding rural area. In the South Division five of the six teams can affiliate players from the city of Regina and all six teams have a common rural area around Regina that they can use to affiliate players. If the PJHL decided to make any changes from the present, it would require a great deal of discussion and 2/3 majority to make a change. The last two changes dealt with AAA Midgets and Junior C affiliation. The proposed wording is similar to the present Junior A wording. 9

Rationale for change: Affiliates are a big part of the recruiting process, teams in smaller centres recruit players from across the province, should be able to affiliate those players as well. The AAA players we may affiliate can be from anywhere in the Province, as well as be playing with any AAA program in the Province why can't affiliating the A and AA midget players work the same. 11

12 NOTICE OF MOTION d) i) 126 SHA Board of Directors Players wishing to play Peewee and Bantam must try out for the nearest AA team to their residence. If they are not successful in making the nearest AA team they must obtain a release from the Association of that AA team and they may then proceed to try out for the next nearest AA team and so on. Players wishing to play Peewee, Bantam and Midget must try out for the nearest AA team to their residence. If they are not successful in making the nearest AA team they must obtain a release from the Association of that AA team and they may then proceed to try out for the next nearest AA team and so on. **eliminate d) ii)** Rationale for Change: To include the Midget AA division in the same regulation that currently exists for Peewee AA and Bantam AA. 12

13 NOTICE OF MOTION h) ii) NEW 130 SHA Board of Directors None For Male Midget AA hockey, teams based in Saskatoon and Regina may only affiliate players from within their Minor Hockey Association. For other Midget AA teams, they may affiliate from their Minor Hockey Association and six (6) players whose parents reside nearest to the sponsoring center and also within a 160 km radius of their sponsoring center. If a player wishes to be AP d to a AA team that is not their nearest AA center, they must obtain a release from all the AA centers that are closer to their residence than the center they wish to AP to. Rationale for Change: To include Midget AA in the same affiliation regulation that exists in Bantam AA. 13

In Midget AA, the two (2) league champions will compete for the Provincial Championship. Rationale for Change: To ensure all four AA leagues in Peewee and both AA leagues in Midget are determining their Provincial representative the same way. 14

28 NOTICE OF MOTION old i) New h) 146 SHA Board of Directors i) Game Misconduct 1. In all hockey (with the exception of Junior A), any player or team official who is assessed a Game Misconduct penalty in the last ten (10) minutes of regular time, at any time in overtime, or after the conclusion of the game and prior to the player or team official entering the dressing room, shall automatically be suspended for the next regular scheduled game. Players receiving a game misconduct under this rule during their last game of the season must serve the suspension in their first league or sanctioned tournament game in the next season. Players will be allowed to play exhibition games prior to the start of the season. Examples h) Game Misconduct 1. In all hockey (with the exception of Junior A), any player or team official who is assessed a Game Misconduct penalty in the last ten (10) minutes of regular time, at any time in overtime, or after the conclusion of the game and prior to the player or team official entering the dressing room, shall automatically be suspended for the next regular scheduled game. Players receiving a game misconduct under this rule during their last game of the season must serve the suspension in their first league or sanctioned tournament game in the next season. Players will be allowed to play exhibition games prior to the start of the season. 2. Any Gross Misconduct in the last ten (10) minutes of a game receives an extra Game Suspension in addition to the suspension for the Gross Misconduct. 28

For Minor Hockey, All Head Coaches on a Novice to Atom Male and Female teams to complete the new online clinic HU-Online Checking by January 10 th of the current season. It is recommended that all Assistant Coaches also have the online HU-Checking Certification. All Head Coaches on a Peewee to Midget Male and Female teams, must have attended the SHA Coach Checking Certification Clinic by January 10 th of the current season. It is recommended that all Assistant Coaches also have the Checking Certification.
