One representative of each boat will attend the mediation hearing and no witnesses will be allowed. The mediator will decide the manner in which testimony is given. 12

16 After taking testimony, the mediator will make one of the following conclusions: (a) (b) (c) (d) The protest does not comply with rule 61 and the protestor should withdraw the protest. The matter shall proceed to a protest hearing. This may be because rules not suited to mediation may be involved or because evidence is too complex or divergent or because injury, serious damage or a significant advantage may have occurred or because of the apparent severity of the alleged infringement or for any other reason decided by the mediator. No rule was broken and the protestor should withdraw the protest. A rule was broken by one or more of the boats involved, the infringing boat(s) may accept a scoring penalty equal to a finishing place mid-way between the boat s actual finishing place and the score for a disqualification and if so accepted, the protestor should withdraw the protest. In the case of a Cruiser which has a co-skipper (refer 2.7), points gained by one skipper shall be also awarded to the other skipper Points transfer under maybe requested multiple times in one season. It is at the discretion of the Race Committee to approve the request. The intent of this provision is to allow for a skipper to purchase a boat mid season. The Race Committee will prevent these provisions from being used to cherry pick the best boats for a series Points are not transferable between Sections or fleets within a Section The best 15 heat scores for each boat will count as the series total for that boat. If 15 or less races are awarded scores, then all race score will count to the boats series total. The boat with the highest total points score wins the series 20 Safety Boat Safety Boats will display a Green over White Diagonal Flag. They have right-of-way at all times. Redress does not apply to a boat disadvantaged by a safety boat which is performing a rescue. 21 Handicapping Systems for the Consistency Series 21.1 Individual handicaps used for the determination of placings in a Club Consistency race will be calculated using a system of handicapping which has been approved by the Regatta Committee. 14

18 21.2 Sections may adopt a system based either on a percentage or a time as preferred. In addition, if required, two sets of handicaps may be established to suit the following wind strengths: Wind strength up to 12 knots Wind strength 12 knots and over 21.3 The wind strength will be declared by the OOD during the race or 1 hour before the race for handicap races by the display of the following signals on the signalling yardarm: Wind strength up to 12 knots, one orange ball Wind strength 12 knots and over, two orange balls 21.4 The Section Handicapper will be responsible for assessment, arbitration and record-keeping for that Section s handicaps Appeals against handicaps or the administration of handicaps shall be made to the Section Handicapper. A member dissatisfied with the outcome of such an appeal may make a further appeal to the Regatta Committee. Such appeal shall be lodged in writing with the Club or the OOD prior to the race following the Handicapper s decision being advised. 22 Retirement 22.1 A boat that has retired during a race shall not sail through the Finish Line A boat which retires shall either enter its retirement on the Retirement Sheet in the NYC Training Centre within 15 minutes of reaching the shore or, if at a place remote from the Club, advise the OOD as soon as possible 22.3 A boat which retires after finishing shall inform the OOD of doing so and the boat shall be scored as per Sailing Instruction Safety and Responsibility 23.1 Attention is drawn to the RRS, Part 1, Fundamental Rule 4, Decision to Race, which states, The responsibility for a boat s decision to participate in a race or to continue racing is hers alone The Club and its officials are not responsible for the seaworthiness of boats or for the sufficiency or adequacy of their equipment It is a requirement that boats in the Cruiser section shall comply with the mandatory safety requirements prescribed by the RRS Addendum A, AS Special Regulations Part 1, Category 7 and boats in all other sections shall comply with the safety requirements of RRS Addendum A, AS Special Regulations Part2 Off the Beach Boats Furthermore, to be eligible to race, Skippers must lodge with the Club before the start of their season s racing, signed NYC Compliance Forms for Special Regulations Part 1 Category 7 for Cruisers and/or Special Regulations Part 2 for Off the Beach Boats. 26 Duties Roster Members have an opportunity to further contribute to club sailing activities over the winter months, although there is a roster for sailing day duties as detailed in the sailing program. The yacht club uses Dutyman, an online website which is used to send reminders for roster duties and allows people to arrange roster swaps directly with other volunteers. The volunteers for each week are named in Mainsheet Traveller, our weekly publication. If you are unable to attend to duties on your rostered day you are responsible for arranging a suitable substitute with the skills required to undertake your duty.. If you are rostered on for a duty please register your attendance with the who will be in the Hall from 1130 hrs. Once you have done this, refer to the table below for your next action. If your allocated duty means you are unable to compete in the days racing, you will be allocated average points.
