5 RACE PROGRAM 2018 The 2018 Townsville Yacht Club (TYC) Racing Season will include the following series: Commodore s Cup Offshore Series Magnetic Island Series Buoy Series Fixed Mark Series Lady Skippers Series Knobel Cup The majority of races within the COMMODORE S CUP will be YA Category 5 Maritime Safety Queensland Requirements. The following races within the OFFSHORE SERIES require competitors to meet YA Category 5+ safety requirement: Easter Offshore Race 3 Rocks Race Knobel Cup Offshore YA Category 5+ definitions: Section 2 general requirements Cat 4 Section 3 part 1 & 2 Cat 4 Section inclusive Cat 3 Section Cat 4 Section Cat 5 Section Cat 4 Section Cat 5n Section 6 Cat 5 Boats must have Boat Beacon on or a registered AIS system on board and transmitting on during the race. There will be four quarterly series that will comprise of races for the Commodore s Cup. Namely the: TROPICAL SERIES AUTUMN SERIES FROSTBITE SERIES SPRING SERIES The COMMODORE S CUP will be awarded after all four series are completed, to the yacht with the lowest aggregate point score from the following races: Buoy Races best of 3 results from 5 races Fixed Mark Races best of 3 results from 5 races Lady Skippers Series best of 3 results from 4 races Round Magnetic Island best of 4 results from 5 races Offshore Races best of 4 results from 5 races The Knobel Cup will be awarded to the yacht with the lowest aggregate point score for all 3 races. 6 Similarly, the Lady Skippers Series will be awarded to the yacht with the lowest aggregate point score for the following: 1 Buoy, 2 Fixed mark and 1 Magnetic Island, with one drop. If the regular skipper is female, they are ineligible to helm for these races, and the alternate helm should be female at the discretion of the regular skipper. The Sprint Series will be 6 to 8 short Buoy Races held over 2 days with 1 dropped result. The point score for the Sprint Series will be awarded to the Commodore s Cup as 1 Bouy Race. Points for each of the quarterly series will be calculated using the entire number of races with one drop (including Lady Skipper s races and Offshore races). The series winner will be the boat with the lowest aggregate score. Points in the COMMODORE S CUP will be awarded for boats not competing in races (DNS), as the number of boats starting plus two (2). This will ensure that boats that are unable to, or do not compete are eligible for an overall result in the Commodore s Cup. Racing division will be awarded the Commodores Cup unless there are enough boats to form a cruising division for all races DNS will be awarded points equal to the number of starters plus two (2) DSQ will receive points equal to the number of starters plus two (2). DNF will receive points equal to the number of starters that finish plus one (1). RET will receive points equal to the number of starters FEES AND NOMINATIONS Yacht Registration Fee $30 for the year payable online or at the 2018 Season Briefing. Nomination fees for each race will be $25. If the nomination fee is paid no later than the Wednesday prior to the weekend event, the cost will be $20. 9 1 DEFINITIONS TOWNSVILLE YACHT CLUB SAILING INSTRUCTIONS 2018 Where words or expressions are used in these Sailing Instructions and they are defined in the Rules, those words or expressions shall have the same meaning as attributed to them in the Rules. In these Sailing Instructions:- DNF means did not finish. DSQ means disqualified. DNS means did not start. RET means retired from race. Club mean Townsville Yacht Club. "Club event" means an event conducted by TYC. GST means Goods and Services Tax. "Nomination box" means the box maintained by the Club and endorsed with those words located near the bar facility at the Club premises. "Officer of the Day" means the Race Director of TYC or some person nominated by him or her. Official notice board means the notice board maintained by the club at its premises near the nomination box or alternately on race days the White Board set up at the entry to the TYC marina, which shall display the day s race briefing. POB means the number of persons on board. "Registered yacht" means a yacht owned by a member of the Club who has completed a yacht registration form for the 2018 calendar year. "Rules" or "Rule" means the International Sailing Federation (ISAF) Rules as amended and adopted by the Yachting Australia (YA) and as may be varied by them from time to time and by Yachting Queensland (YQ). TYC means Townsville Yacht Club. 2 RULES 2.1 The Racing Rules of Sailing of the International Sailing Federation, and the prescriptions will govern all races for the 2018 season and special regulations of the Yachting Australia as varied from time to time by Australian Sailing - Queensland. Where separate instructions are issued for major offshore races, such separate instructions will be deemed to amend these sailing instructions. For the purposes of advertising, boats shall comply with ISAF Regulation 20 advertising code. 3 ENTRIES 3.1 All yachts competing in the 2018 Racing Season must be registered with the TYC, however, visiting yachts will be allowed to race in three (3) events before being required to register with the TYC. For the purposes of calculating series points, the entry and placing of any non-registered yachts will be disregarded. Visiting yachts must lodge a copy of a current safety certificate and racing insurance policy number when nominating for a club event. 3.2 Except where there is a separate notice of race, individual nominations for all club races shall be lodged in the nomination box not less than one hour before the nominated start time for the race. Each nomination shall indicate the name and sail number of the yacht, the date of the race, POB, division (either Racing or Cruising) and the race to be competed and shall be accompanied by the appropriate nomination fee specified on page 6 of these instructions. 10 3.3 All owners and skippers of yachts registered to race with the TYC must be members of Townsville Yacht Club. 3.4 Late nominations and withdrawals: (a) Late nominations up to the warning signal for the nominated start time will be accepted on inclusion of an additional fee equal to the nomination fee together with details of nomination and with the appropriate notification to the starter. The nomination fee and additional fee may be paid within three hours after the finish of the race provided that the starter is notified about the late nomination prior to the start of the race. (b) If any competitor should nominate late and fail to pay any nomination or late nomination fee, that competitor will not be entitled to nominate for any further races with the Club until those fees have been paid. 3.5 Should any owner wish to withdraw from a race his/her nomination will not be refunded unless he/she notifies the officer of the day before the closing time of nominations of that race. 4 SPECIAL NOTICES 4.1 Yacht registration is $30.00 per yacht inclusive of GST and payable before the start of the racing season, or upon the yachts first race, along with a completed registration form. *** ALL YACHTS INTENDING TO RACE IN 2018 SHALL COMPLY WITH THE FOLLOWING SAFETY INSTRUCTIONS *** 4.2 Owners of all registered yachts shall complete and sign the appropriate safety inspection sheet ( SR Equipment Audit Forms) obtained from the TYC office, the Safety Officer, or TYC Website before competing in any events in the program. The safety inspection sheet must be delivered prior to the first race undertaken by the yacht. A copy must at all times be on board the yacht. Inspections will be carried out in accordance with Rule 2.02 of the Australian Sailing Special Regulations Part 1 for Racing Boats. Visiting yachts will be required to comply with these requirements. 4.3 Perform a sail past in front of the race committee with the yacht s storm gear set prior to the start of the yacht s first race. Non compliance may result in a scoring penalty being imposed for each race until the vessels complies. 4.4 In 2018 it is recommended that at least two (2) people per yacht complete a Sea Safety Survival course to compete in any offshore event. *** ALL SKIPPERS AND COMPETITORS ARE REMINDED OF THE FOLLOWING: *** 4.5 The fundamental rules as stated in Part 1 of the Racing Rules of Sailing. 4.6 Owner s responsibility as specified in the Special Regulations Part 1 for Racing Boats. 4.7 Any crew member that sails in more than three (3) races during the sailing season must have a current Australian Sailing number. Any crew member, who is 18 years old or older that obtained an Australian Sailing number from another club, must also become a TYC member before three races are completed. Failure to comply with this requirement may result in a 2% time penalty being applied to the boats finish time. 4.8 Owners and Skippers of yachts competing in TYC Sailing organised races must be members of the Townsville Yacht Club with a current Australian Sailing number. 11 5 NOTICES TO COMPETITOR 5.1 Notices to competitors will be posted on the official Townsville Yacht Club Sailing Committee notice board, located at the Anthony Street entrance of the Townsville Yacht Club. 6 CHANGES IN SAILING INSTRUCTIONS 6.1 Any change to the Sailing Instructions will be posted two (2) hours prior to the race on the day it will take effect or, except that any change to the schedule of races will be posted by 5.00 p.m. on the day before it will take effect. 6.2 All boats on the water will be individually notified of changes to the Sailing Instructions for that day on VHF channel 77 no later than 5 minutes before the warning signal. 7 SIGNALS MADE ASHORE 7.1 Signals made ashore may be displayed on the main flagpole of the Townsville Yacht Club. 8 SCHEDULE OF RACES 8.1 The schedule of races is found on page 7 of these Sailing Instructions. 9 DIVISIONS AND DESCRIPTIONS 9.1 If there are three (3) or more Multihulls or Cruising Division Yachts starting the race, the race committee may start them separately. Otherwise, all boats shall start on one line. 10 RACING AREA 10.1 The racing area for inshore events is shown in the illustration contained in Appendix II The racing area for offshore events is delimited by the Marine Parks Central zoning plan B. 11 COURSES 11.1 The courses are described and illustrated in Appendix I For buoy courses only, no later than the warning signal, the race committee vessel may display the approximate compass bearing from the start line to the first mark. 12 MARKS 12.1 The marks for all buoy courses will be large orange or yellow marks or TYC mark G, for all other inshore events the rounding marks are described in Appendix I In the event of a change of course after the start, or for any other reason causing the non-availability of such marks, the Officer of the Day may, without notice, replace marks with orange and yellow inflatable marks. Such smaller marks may be used as start and finish marks The start and finish marks will be the Race Committee vessel and a large TYC buoy. After official sunset the finish mark will be a large TYC buoy with a white strobe light mounted on it. TYC Sailing Instructions

12 13 STARTING PROCEDURE 13.1 All races shall be started by using the starting system as per Rule 26 of YA Racing Rules of Sailing The procedure is outlined in Appendix III of these sailing instructions. If three or more Multihull or Cruising Division Yachts intend to start the race on the day, there will be a separate start for each division (Racing, Cruising and Multi-hull). In the event of the start boat being unavailable, a gate start will be conducted under the direction of the Race Director Standard starting line: The standard starting line shall be an imaginary line between the signal mast on the committee vessel displaying the TYC burgee and a TYC buoy set at approximately 90 degrees to the direction of the first mark. For buoy and round Magnetic Island events the direction of rounding the marks or island respectively will be indicated by the committee vessel displaying either a green (starboard rounding) or a red (port rounding) flag prior to and during the start sequence Gate starting line: At the discretion of the Race Director, the starter may use a gate start. The rabbit s boat name and/or sail number for the race shall be designated on the white board at the club. This boat will be the rabbit for all races on the day unless otherwise instructed by the Race Director/Officer of the Day. The rabbit will do a count down over the radio for the 5 minute signal, the 4 minute signal and may do the 1 minute signal. Within 20 seconds of the starting signal, the rabbit shall round behind the starting line pin end mark on a close-hauled port tack course and raise the Y flag or make a sound signal. The other boats shall start on starboard tack between the transom of the rabbit and the starting mark, after the starting signal. All boats starting must keep clear of the rabbit. Any boat failing to do so shall be scored DSQ for that race and any subsequent re-starts. After 2-4 minutes the rabbit will lower the Y flag or make a sound signal, this releases the rabbit that is then free to tack An inner limit mark (barging buoy) may be laid, in which case vessels are required to pass the inner limit mark to starboard. Such an inner limit mark might not be positioned exactly on the start line. Yachts will start in accordance with the definition of "starting" contained in the Rules Before actually starting, all competing yachts must notify the starter of their intention to start, the division entered and the number of persons aboard for that race by calling the starter on VHF channel 77 (before the five minute warning signal) and be acknowledged by the starter. Any yacht not complying with this requirement may be given a scoring penalty calculated as stated in Rule 44.3(c) For pursuit starts, yachts will start at times published on the official notice board and may be signalled by start boat A boat starting later than 30 minutes after her starting signal will be scored DNS unless contact has been made with the officer of the day prior to the starting signal Boats whose warning signal has not been made shall avoid the starting area The start area for Races started away from Townsville will also be designated as S in the course. 14 RECALLS 14.1 Individual recalls will be signalled in accordance with Rule General recalls will be signalled in accordance with Rule The warning signal for a new start shall be made 1 minute after the 1st substitute is removed (one sound) For both general and individual recalls, the starter may notify offending yachts on VHF Channel 77, however the onus is on the skipper to ensure he starts correctly and the absence of a radio recall for any yacht will not prevent a yacht from being scored as a premature starter. 13 15 CHANGE OF COURSE AFTER THE START 15.1 To change the position of the next mark, the race committee will lay a new mark (or move the finishing line) and remove the original mark as soon as practicable. Any mark to be rounded after rounding the new mark may be relocated to maintain the original course configuration. When, in a subsequent change, a new mark is replaced, it will be replaced by an original mark A change of course will be signalled before the leading boat has begun the leg, although the new mark may not yet be in position. The change will be signalled by an official boat or a buoy displaying code flag "C" and the approximate compass bearing to the new mark, and will be situated near the mark beginning the leg being changed. A repetitive sound signal may be made if practical (note this alters the provisions of the Rules). 16 SHORTENED COURSE 16.1 The starter may shorten any course at a rounding mark, or at any point of the course for around Magnetic Island and Offshore races, by displaying Code Flag "S" and making two sound signals. An announcement may be made on VHF Channel 77. The starter will also display the "on station" blue finish signal. Yachts will finish between the rounding mark and the finish boat in accordance with the definition of "finishing" in the Rules. 17 THE FINISH 17.1 In all races having a designated finish at X when the finish boat is in attendance the finish line will be between the signal mast of the finish boat and a TYC buoy. When the finish boat is not in attendance, yachts must take their own finish time when they cross the imaginary line between either the TYC Buoy or within 100m west of the transit line between green outer channel marker and the red outer channel marker of the Breakwater Marina. Where a yacht has taken its own finish time, it will place a declaration as to its own finish time in the nomination box within twelve (12) hours of finishing For all buoy courses the finish line will be between the signal staff on the race committee boat and a TYC buoy. Yachts will finish in accordance with the definition of "finishing" contained in rule Competitors should confirm their finish time with the finish boat. When finishing at night, crews shall illuminate the yacht s sail number with a torch while crossing the finishing line. When finishing at night, yachts shall call the finish boat on VHF Channel 77 when approximately one mile from the finish line. Similarly, when crossing the finishing line, yachts shall again call the finish boat and identify themselves as the yacht crosses the line. If the yacht is close astern or just ahead of another yacht, this information should be included in the message to the finish boat. The finish boat will monitor VHF Channels 77 and 16. Yachts finishing should attempt to call the finish boat on VHF Channel 77 first before using Channel PENALTY SYSTEM 18.1 For all Buoy, Fixed Mark, Lady Skippers and Magnetic Island races, rule 44.1 is changed so that the 720-degree penalty turn is replaced by a 360-degree penalty For all Offshore races rule 44.1 shall apply A boat that has taken a penalty or retired under rule 31 or 44.1 shall advise the committee vessel, the race director or the officer of the day within the protest time limit As provided in rule 67, the protest committee may, without a hearing penalise a boat that has broken rule 42. 14 19 TIME LIMIT 19.1 The time limit for Buoy, Magnetic, Fixed Mark, and Lady Skipper s courses will be the nautical sunset on the day of the race. This excludes Saturday Magnetic Island races, when it will be 2100 hrs. The time limit for Category 5 Offshore Races will be 18 hours after the start time. The time limit for Category 5+ Offshore races shall be as stated in the sailing instructions for that Race (if issued). If no sailing instructions issued, time limit shall for a Cat 5+ shall be 28 hours after the start time At the expiry of the time limit, the finish boat will signal the expiry of the time limit by raising the appropriate class flag and making three sound signals and signalling all participating boats individually on VHF Channel 77. If no yacht finishes within the time limit for the race the race may be abandoned or resailed at a later date. 20 PROTESTS 20.1 Protests must be lodged in writing and in accordance with Rule 61 and handed to the officer of the day (who shall be the Race Director or such person as may be nominated on the official notice board) or lodged in the nomination box (see Appendix IV). In the event of a protest being lodged in the nomination box, an independent witness certifying as to the time and date of lodgement must sign the protest form. The person lodging a protest must take all reasonable steps to notify the officer of the day that a protest has been lodged in the nomination box A fee of $5.00 must accompany the completed form Protests must be lodged within the following time limits:- (a) Inshore Races and around Magnetic Island Races; two (2) hours after the finishing time of the protesting yacht. (b) Category 5 Offshore Races; within twelve (12) hours of the finish time of the protesting yacht or within one (1) hour of the club re-opening if the club is closed during that period. (c) Category 5+ Offshore Races; as described in sub-paragraph (b) above or as stated in the sailing instructions for that Race (if issued) Notices will be posted within 72 hours of the protest time limit to inform competitors of hearings in which they are parties or named as witnesses. Hearings shall be held at the Townsville Yacht Club Board Room at a time and date notified to all parties. The protest committee will make every effort to hear the protest within fourteen (14) days from the date of lodgement Notices of protests by the Race Committee will be posted to inform boats under rule 61.1(b) A list of boats that have acknowledged breaking rule 42 or have been disqualified by the race committee will be posted before the protest time limit Decisions of the jury will be final as provided in rule SCORING 21.1 The low point scoring system referred to in Appendix A of the Rules will apply. The Club racing season is divided into four (4) series plus the Commodore s Cup. The lowest series score wins as per the table below. 15 21.2 Any yacht that does not compete in a race shall receive a score of the number of yachts started in that race plus two (2). 22 RESULTS 22.1 Every effort will be made by the race committee to calculate race results for inshore races and display the results on the official notice board at the clubhouse as soon as reasonably practicable after the race Every boat shall provide a start crew and be scored first place for that race. Once start boat crew requirements have been met, that yacht may choose to race for the day but will forfeit the first place and accept the place achieved on the day. 23 SAFETY 23.1 All yachts shall comply with MSQ and YA Special Regulations Part 1 for the category of race they intend to compete in Owners of all registered yachts shall complete and sign the appropriate Australian Sailing Special Regulations Equipment Compliance Form before competing in any events in the program. The Special Regulations Equipment Compliance Form need only be delivered once prior to the first race undertaken by the yacht. A copy should at all times be kept on the yacht. Inspections will be carried out in accordance with Rule 2.02 of the Special Safety Regulations. Visiting yachts will be required to comply with these requirements All competing yachts shall comply with Australian Sailing Special Regulations Part 1 Category 5 for all Round Magnetic Island races, Fixed Mark, Buoy Course and Lady Skippers All competing yachts shall comply with Australian Sailing Special Regulations Part 1 Category 5, Category 5+ Offshore races and Maritime Safety Queensland Requirements In all races excluding Category 5+ Offshore Races, a waterproof handheld VHF radio capable of transmitting and receiving on Channels 16, 22, 67 and 77 is a suitable replacement for fixed mount radio The committee may conduct races in a strong wind warning. They will, however, cancel should a gale warning be imminent or forecast. Owners should check their insurance coverage under these circumstances before and during the race. Competitors are reminded of the fundamental rule 4 (decisions to race) and the owner s responsibility in paragraph 26 of these Instructions No part of any anchor may project forward of the bow at any time whilst racing Any incident causing damage or serious injury to persons or vessels requires an Incident Report to be completed and submitted to the Officer of the Day and MSQ as soon as possible after racing has finished. See appendix V for report template Any contact with Aids to Navigation must be reported to MSQ Boat Beacon must be used for all Offshore races and Magnetic Island races It is strongly recommended that a lifejacket be worn by each member of the crew at times such as, but not limited to: (a) Between sunset and sunrise (b) When alone on deck (c) When the true wind speed is 25 knots or above (d) When visibility is less than 1 nautical mile A lifejacket complying with AS (minimum Level 50) or AS Type 1 or Type 2, or equivalent or more stringent overseas standard. On a boat without lifelines complying with 3.12, a lifejacket complying with (i), shall be worn by each member of the crew while on deck. TYC Sailing Instructions

16 24 RADIO SCHEDULES 24.1 For the Offshore races, a VHF radio schedule will be conducted. The Officer of the Day will nominate the vessel/person/authority to which schedule reports are to be made (Race Control). Race Control will call all yachts on Channel 77 at the times listed below. Yachts shall be called in alphabetical order. Each yacht should call Race Control for a radio check to attempt to eradicate problems in communication before they arise. Call times will be: Category 5 Offshore and Category 5+ Offshore 1603 hours; 2003 hours; 0003hours; 0403 hours; 0803 hours; and so on at four (4) hourly intervals until the race finishes Competitors are reminded to be brief and specific in their reports. The information required is the name of the yacht, the position and relevant time Yachts deriving their position from GPS should advise that the position reported was by a GPS fix. Yachts not using GPS may (if they wish) give their position as a distance and bearing to (not from) a major land feature or navigation beacon (e.g. yacht Petal Cape Cleveland light bearing 140 degrees true distance four miles at 1133 hours 24.4 If a vessel has not confirmed her position during the organised radio sked time on Channel 77, or has been unable to give her position by relaying through another boat, she will call Race Control using Repeater Channel 22 thirty (30) minutes after the nominated radio sked time If a vessel fails to communicate either directly or indirectly via relay for two (2) consecutive skeds (including via repeater Channel 22) then: (a) At the end of the second missed sked all competing vessels will be asked if they can confirm the position of the vessel. (b) If no yacht can confirm their position, the vessel closest to that vessel based on tracker position OR if the tracker is not working, the vessel closest to their calculated present position of the vessel who has missed the skeds, will be asked to try to contact them report back to Race Control via radio or mobile phone within 10 minutes. (c) If there is no response then the vessel will be deemed as being missing Yachts missing two (2) consecutive schedules may be protested by the Race Committee and may also be subject to a Search and Rescue event. In this regard, yachts that can hear another competitor attempting unsuccessfully to contact Race Control are required to relay the Competitor s position to Race Control Retired boats shall continue with the schedules until they confirm with Race Control of their arrival at a safe port or haven. 25 CREW LIMITATIONS 25.1 For Category 5+ Offshore races the minimum number of adult persons (i.e. over the age of eighteen (18) years) on board shall be four (4) except with specific exemption from the Race Director. For Category 5 Offshore races the minimum number of adult persons (i.e. over the age of eighteen (18) years) on board shall be three (3) except with specific exemption from the Race Director. 17 26 OWNER S RESPONSIBILITY 26.1 Competitors are reminded of fundamental rules (in Part 1 of the Rules) and the owner's responsibility specified in Rule 1.02 of the Special Regulations. The safety of the yacht and her crew is the sole and inescapable responsibility of the owner or owner s representative who must do his/her best to ensure the yacht is fully sound, thoroughly seaworthy and manned by an experienced crew who are physically fit to face bad weather. He/she must be satisfied as to the soundness of the hull, spars, rigging, sails and other gear. He/she must ensure that all safety equipment is properly maintained and stowed and that the crew know where it is kept and how it is to be used. 27 IDENTIFICATION 27.1 Each yacht s sail number shall be registered with the TYC Sail numbers shall be displayed at all times. Sails with the wrong sail number should not be used. Alternative sail numbers must be registered with the race committee Yachts of the TYC shall fly the TYC Club Burgee prior to and during all races as identification to the starter and other competitors Visiting yachts shall fly their Club Burgee to signify their participation in the event Yachts not complying may incur scoring penalty of 20% as described in Rule 44.3 of the Rules. 28 HANDICAPS 28.1 Performance Based Handicap (P.B.H.) system shall apply i.e. a handicap system based on past performance of each yacht. The handicapper will have the right to make any adjustment to any handicaps, which the handicapper sees fit Handicaps may be altered after each point score race using the following method - the first placed yacht on handicap will have their handicap increased by Thence handicaps are increased proportionally upwards to the middle placed yacht. The middle placed yacht s handicap will not change. From the middle to last place the handicaps will be altered proportionally downwards, in a similar manner (last boat decreased by 0.15) Yacht owners and/or skippers are reminded of their responsibility to notify the handicapper or the measurer immediately of any adjustments to their yachts, sails or rigging or ballast which may alter the yacht's performance. This includes the addition or removal of heavy objects such as spare sails and anchors and chains. Failure to do so may result in disqualification from the race. If, after a proper hearing, the committee is of the opinion that a deliberate attempt has been made to improve the boat's performance in breach of the fundamental rules, it may disqualify the owner, skipper, or crew members from sailing with the club for a period of time. The measurer or handicapper shall have the right to inspect any vessel at any time without notice in order to enforce this rule. 29 USE OF AUXILIARY POWER 29.1 Yachts must not motor under auxiliary power after the 5 minute signal, however, if a yacht is running late for the start, it may motor after that signal for the purpose of proceeding from its mooring to the start line. Before starting, the yacht must shut off its motor and make a 720-degree turn under sail. A yacht taking advantage of this concession must satisfy the starter and the race committee that it has not obtained any unfair advantage. While making the 720-degree turn the yacht shall keep clear of all other boats preparing to start. 30 YACHTS RETIRING 30.1 If a yacht abandons the race, the skipper shall be responsible for notifying the finish boat, and or Officer of the Day as soon as possible. 18 31 LONE STARTER 31.1 Subject to any further qualification concerning division or series qualification, where there is only one starter in a Division, she shall be entitled to sail the course and thereafter be declared the winner of that race subject to complying with all relevant rules. 32 GARBAGE 32.1 The disposing of non-biodegradable waste from a competing vessel is not permitted. A successful protest based on this rule will result in disqualification of the offending yacht. 33 DISCLAIMER OF LIABILITY 33.1 Competitors participate in any Club event entirely at their own risk. See rule 4 Decision to Race. The organising authority will not accept any liability for material damage or personal injury or death sustained in conjunction with, prior to, during or after the Club event. 34 INSURANCE All racing yachts shall supply a copy of their current racing insurance policy before entering any race. All boats competing in any event organised by TYC shall have race cover appropriate to the distance of race you are entering and provide at least $10 million of public liability. The insurance policy must be issued by an agency or underwriting agent that is licensed to operate in Australia under the Australian Prudential Regulation Authority (APRA). TYC Sailing Instructions

27 MARITIME INCIDENT OR ACCIDENT APPENDIX V INCIDENT AND/OR ACCIDENT REPORTING It is mandatory that any incident that causes damage to property and/or serious injury to participants must be reported to Maritime Safety Queensland and the Race Director as soon as practicably possible after that incident has occurred. In the event that the Race Director is unavailable the Handicapper must be notified. Contact details of the current Race Director and Handicapper are detailed in the current season's sailing instructions. In the event that these positions are occupied by different persons, an advisory notice will be posted on the TYC notice board. The completed incident form is to be submitted to one of these officers as soon as practicable after the Incident. What is an incident? The Marine Safety (Domestic Commercial Vessel) National Law Act 2012, Schedule 1 (National Law) defines a marine incident as: (a) a death of, or injury to, a person associated with the operation or navigation of a domestic commercial vessel; (b) the loss or presumed loss of a domestic commercial vessel; (c) a collision of a domestic commercial vessel with another vessel; (d) a collision by a domestic commercial vessel with an object; (e) the grounding, sinking, flooding or capsizing of a domestic commercial vessel; (f) a fire on board a domestic commercial vessel; (g) a loss of stability of a domestic commercial vessel that affects the safety of the vessel; (h) the structural failure of a domestic commercial vessel; (i) a close quarters situation; (j) an event that results in, or could have resulted in: i) the death of, or injury to, a person on board a domestic commercial vessel; or ii) the loss of a person from a domestic commercial vessel; or iii) a domestic commercial vessel becoming disabled and requiring assistance; (k) the fouling or damaging by a domestic commercial vessel of: i) any pipeline or submarine cable; or ii) any aid to navigation within the meaning of the Navigation Act 2012 of the Commonwealth; (l) a prescribed incident involving a domestic commercial vessel. Your responsibilities as Owner or Master (Sections 88 and 89 of Schedule 1 of the National Law) The owner and master of a domestic commercial vessel commit an offence if the vessel is involved in a marine incident as defined by the National Law and neither the owner or the master provide an initial report on any marine incident that involves: the death of a person; or serious injury to a person; or the loss of a vessel; or the loss of a person from a vessel; or significant damage to a vessel to the National Regulator as soon as reasonably practicable after becoming aware of the incident, having regard to the circumstances. 28 The owner and master of a domestic commercial vessel commit an offence if the vessel is involved in a marine incident as defined by the National Law and neither the owner or the master provide a written report of any marine incident as defined by the National Law to the National Regulator within 72 hours of becoming aware of the incident. PERSONAL INCIDENT OR ACCIDENT In the event that a participant is involved in an incident or accident that requires first aid and/or professional medical assistance the Townsville Yacht Club Competitor Incident Form is to be completed and given to either the Race Director, the Handicapper or the Townsville Yacht Club office as soon as practicable after the event. 29 APPENDIX VI TOWNSVILLE YACHT CLUB SAILING CODE OF CONDUCT This code of conduct is to be read in conjunction with and in addition to the Townsville Yacht Club (TYC) Participation Rules, Safety Declaration, release and Indemnity and Acceptance of conditions for any event. Behaviour of Skipper, Crew and Guests It is the responsibility of all Skippers to ensure that they, their crew and their guests conform to this Code of Conduct at all times during their participation in any TYC event. All participants in TYC events shall conform to the high standards of social behaviour which are customary and traditional at sailing events. The following behaviour is considered inappropriate and will not be permitted during TYC events: Participation in any illegal activity Swearing, abusive language or aggressive behaviour towards another participant or official Excessive noise which may result in the disturbance of other participants, other marine users or members of the public The display of any material, signage and/or wearing of any article of clothing bearing offensive, profane, suggestive or improper words or designs. Dangerous operation of a vessel Unsportsmanlike behaviour Responsible Service of Alcohol A legal alcohol limit applies to all skippers on the water. It is the responsibility of the skipper to maintain responsible service of alcohol on board his/her vessel and to keep crew and guest s alcohol levels at a safe and responsible level both on and off the water. Environmental Protection The environmental protection of our harbour and waterways is of vital concern to the TYC and littering or discharge of waste material from a vessel is strictly forbidden. Enforcement Complaints and/or reports associated with this Code of Conduct may be referred to the Officer of the Day for consideration and, if applicable, disciplinary action.
