2 LOCAL NOTICES TO MARINERS 1/07 Valid from: 8 th August 2007 Expires on: Until withdrawn AIDS TO NAVIGATION AT HAYLE HARBOUR 1 An inspection of the navigational aids at the approach to Hayle Harbour has identified that the leading lights / day marks in position N 5 26 W do not currently mark the navigable channel as a result of sand movement. 2 On the advice of Trinity House the lower leading light / day mark has been taken out of operation until further notice and is no longer visible from seaward. 3 Visiting vessels wishing to enter the port are to contact the Harbour Master on VHF ch16 or by land line mob Peter Haddock CMIOSH Harbour Master

The work will effect marine operations, moorings, slipway launching and vehicle / trailer parking. All harbour users are requested to co-operate with the harbour authority so that disruption and inconvenience to marine operations are kept to a minimum. 4 LOCAL NOTICES TO MARINERS 08 /11 Valid from: 23rd June 2011 Expires: Until withdrawn Bathymetric Survey Hayle Harbour Recent bathymetric Surveys have been completed and compared with similar surveys carried out a year ago. Copies of the latest Survey are available at hayleharbourauthority.com and hard copies are available for inspection at the harbour office. The most recent survey indicates a reduction of depth in some parts of the harbour and the approaches. However, the tidal window during which vessels can safely enter and leave the harbour should not be affected as this is determined by the Hayle Bar. Mariners are referred to LNtM 07/10 Entrance to Hayle Harbour and the warning published on Admiralty Chart Hayle Bar ( N W) Fishing vessels and small craft with local knowledge may enter across Hayle Bar in favourable weather within 1 hour of High Water. 5 LOCAL NOTICES TO MARINERS 10/11 Valid from: 01 August 2011 Expires on: Until withdrawn KITESURFING WITHIN THE JURISDICTION OF HAYLE HARBOUR AUTHORITY Local Notice to Mariners 09/11 is withdrawn. 1. is committed to complying with the Port Marine Safety Code (PMSC). Accordingly, it will strive to manage all risks associated with marine operations to As Low As Reasonably Practicable (ALARP). 2. Having formally assessed the risks associated with kitesurfing (insofar as they relate to marine operations) kitesurfing will be permitted within the jurisdiction of provided all kitesurfers comply with the Code of Conduct for Kitesurfing at Hayle Estuary (the KKC Code) which is available at hayleharbourauthority.com. All kitesurfers must carry third party liability insurance of at least 5M.

The KKC Code prescribes: The area in which it applies: Any person kitesurfing within the jurisdiction of the Hayle Harbour Authority must be in possession of a current colour coded compliance tag purchased from the Kernow Kitesurfing Club or a recognised retail outlet. Every kitesurfer must display the tag on his/her harness. No kitesurfing at any time south of Chapel Anjou where there is a large 5 knot speed restriction sign. All kitesurfers must be at intermediate level or above; no learning or teaching.

7 LOCAL NOTICES TO MARINERS 10/11 CONTINUED All kitesurfers must comply with the International Regulations for Preventing Collisions at Sea (COLREGS). In particular, a kitesurfer must not impede the passage of a vessel which can safely navigate only within a narrow channel or fairway and a kitesurfer shall not cross a narrow channel or fairway if such crossing impedes the passage of a vessel which can navigate only within such channel or fairway. Accordingly, all kitesurfers MUST keep at least 100m away from AND turn away from all vessels using the channel. Kitesurfers involved in a near miss or any safety related incident must report it to as soon as possible by using the incident report form on hayleharbourauthority.com or in person at the harbour office. Any kitesurfer that observes another kitesurfer not complying with this Code of Conduct is requested to bring that fact to the attention of the non-compliant kitesurfer as well as suggesting to them that non-compliance may result in kitesurfing being banned for all. Members of BKSA and the Kernow Kitesurfing Club are asked to report all infringements of the Code to club officers. All kitesurfers are responsible for their own safety and for the safe conduct of their board and kite. Safety afloat is a team effort and it is in everybody s interest that all marine operations in the harbour are conducted safely. 4. Hayle Harbour Byelaw 7 imposes a 5 knot speed limit throughout the jurisdiction of the. However, the Harbour Master may grant his permission to exceed this speed

8 limit. Such permission will only be granted provided the risks can be managed in accordance with the requirements of the PMSC. 5. By this Local Notice to Mariners the Harbour Master grants permission to exceed the speed limit to all kitesurfers that comply in full with all of the requirements of the KKC Code. The Harbour Master reserves the right to revoke this permission without notice at any time. 6. Kitesurfers that do not comply with the KKC Code as amended and that exceed 5 knots may be prosecuted. The permission the Harbour Master grants under section 6 of this Notice will be revoked immediately if incident reports indicate that the risks associated with kitesurfing are not being managed to As Low as Reasonably Practicable. Consequently, the time limit may be restored or kitesurfing may be prohibited. 9. All users of the Harbour are encouraged to report all incidents involving kitesurfers to the Deputy Harbour Master whenever it is safe to do so and by whichever means are available including the telephone. 9 LOCAL NOTICES TO MARINERS 2/12 Valid from: 02/1/12 Expires on: Until withdrawn "Hazard to Navigation" 1 Vessel entering or leaving the navigable channel are warned that a large Pipe possibly concrete has become exposed at low water. 2 The Hazard is situated approximately 200 metres to the South of the entrance on the Eastern side of the channel. 3 Mariners should proceed with caution and maintain a good visual lookout. 4 When tidal conditions are suitable the hazard will be marked and removed at the earliest opportunity. 11 LOCAL NOTICES TO MARINERS 4/12 Valid from: 01/04/12 Expires on: Until withdrawn "HARBOUR DUES AND MOORING FEE" A recent Court case brought by the Harbour Authority has confirmed that all vessels using the harbour must pay Harbour Dues. The Harbour Authority also charges a small fee for a licence to use a nominated mooring. A schedule of Harbour Dues and Charges is available at the harbour office and To streamline administration and reduce costs invoices will be issued prior to 1 st April 2012 for the year April 2012 to March 2013 for all users other than Clubs. PAYMENT MUST BE MADE BY 30 APRIL Late payment will attract a penalty. Failure to pay may result in the loss of the mooring, the impounding and sale of the vessel and/or the owner being pursued in the Courts for three times the amount owing. To lay down a mooring without a licence is a criminal offence. Vessels that lay over at Lelant Saltings need to apply for a mooring licence and if granted will be invoiced from October 2011 to March 2012 and also for April 2012 to April The concession that commercial vessels laid up at Lelant Saltings will be charged Harbour Dues at the same rate as pleasure vessels will continue. If an owner has difficulty in paying Harbour Dues or if a mooring is

12 no longer required please contact the harbour office immediately. The Harbour Authority has a policy that all vessels that use the harbour should contribute to the cost of running it. Mark Capon Harbour Master

13 LOCAL NOTICES TO MARINERS 11/12 Valid from: 23 dd August 2012 Expires on: Until withdrawn. LNtM 07/10 is withdrawn ENTRANCE TO HAYLE HARBOUR 1. The entrance to Hayle Harbour involves navigation across an area of coastal sand. Sand does not provide a stable seabed and the depth and location of any channel cannot be guaranteed and is subject to change at any time, especially after gales. 2. Any evidence or history of dredging in the entrance to the harbour is not to be construed as a guarantee of a channel in a particular location or that it has a particular depth. 3. Accordingly, mariners are warned that aids to navigation in the entrance and exit to Hayle Harbour do not necessarily indicate the best water. 4. Since the suspension of dredging in April 2010 there are indications the entrance channel has migrated to the east and the channel has become curved and less well defined. The seaward extremity of the sand bar is marked with a North Cardinal buoy. This buoy indicates that the deepest water is to the north of the buoy. Mariners with local knowledge may wish to use this buoy as a reference when entering and leaving the harbour. The buoy does not mark the channel the position of which is never certain. 5. There is a sand bar at the entrance to the harbour that can generate large seas and swells. It is recommended that this bar is

14 crossed with caution and only in good weather and at, or near, high water and during the hours of daylight in good visibility. 6. does not provide a pilotage service or VTS. A copy of the latest port survey information can be obtained from the harbour office. 7. The Maritime and Coastguard Agency expects all mariners to make a careful assessment of any proposed voyage taking into account all dangers to navigation, weather forecasts, tidal predictions and other relevant factors including the competence of the crew. 8. All mariners are reminded that they should consider whether a port is safe for their vessel before deciding whether and when to use it. The contents of this Notice should be considered when planning the passage, which should be done in accordance with regulation 34 of SOLAS Chapter V; this applies to all vessels including small vessels and pleasure craft. 9. All Mariners are urged to carefully assess the risks associated with navigating the entrance channel and to take such precautions that are necessary which may include delaying departure or entry or proceeding to another port. Mariners of visiting vessels without local knowledge, wishing to enter the harbour are to contact the Harbour Master. Peter Haddock Harbourmaster
