To this end, in recent years, we ve established a set of priorities that are intimately connected to our core activity, such as vocation and higher education, promotion of exercise as a necessity for a healthier lifestyle and sports leadership best practices. In all Portuguese FA does, it tries to take the approach of staying constructively discontent. We are always encouraging our partners, colleagues and ourselves to achieve more, therefore we ve launched the Portugal Football School (PFS). PFS is an integral part of Portuguese FA s Research & Development Unit - part of the investigation network at Fundação para a Ciência e Tecnologia - and aims to be a centre of excellence in education, striving to be at the forefront of training offer, in response to the current needs that the global framework of the sports evolution brought to the football world. As on the field, Portuguese FA seeks to connect hearts and minds. The Executive Course in Football Law comprises seven sessions over 3 days, which will be held from September, 28th to 3oth, 2018 at the Portuguese FA headquarters, Cidade do Futebol, each of which deals with a different key issues of football law. We welcome your suggestions as we continue our relentless pursuit for greater value creation. 3 portuguese fa Portuguese FA is a non-proffit-making private law organization with established public benefit legal status. Comprises 22 district and regional associations, one club league, associations of sports agents, clubs or sports societies, players, coaches and referees, registered or affiliated in compliance with its Statutes. It s main purposes are the representation of Portuguese football at national and international level; the competitions of the National Teams; the organisation of local, district and national competitions and guarantee the development of football in Portugal, in accordance with sportsspirit and educational, cultural and humanitarian values, through training programmes for the various sports agents. Portuguese FA ensures the management of 22 National Teams, in football, futsal and beach soccer, and organises 32 annual competitions. Currently, Portugal has registered football players. cidade do futebol, portuguese FA headquarters With a privileged location and excellent infrastructures, Cidade do Futebol is a highly versatile and innovative space, characterised by its functionality, security and technology. Portuguese FA headquarters was created to fulfil an old promise and is a result of months of hard work. After the public presentation done by the President of the Portuguese FA, Fernando Gomes, in November 2014, the drawings made it off the page, they gained life and can now be found in the higher hill of the valley of Jamor. The building is full of details containing the brand of the Portuguese spirit. Each small space is an example of that. From the pitches with a view to the Tagus to the entry doors decorated with the lyrics of the national hymn or the colours of the spaces which were inspired by the national flag. Even the façade has the typical tone of the National Team s shirt. portugal football school The Portugal Football School (PFS), launched in March 2017, is part of the research and development unit of Portuguese FA and its main activities are research in Football, Futsal and Beach Soccer, as well as the education and training of the stakeholders with responsibility in the development and promotion of Football. Thus, to achieve these purposes, several scientific research projects and educational and training programmes have been carried out, focusing on the different areas related to the universe of this sport (coaches, referees, managers, players, physicians, nurses and physiotherapists). 6 7

4 overview The Portugal Football Association, through the Portugal Football School, is coming to offer the Executive Course in Football Law to legal specialists that want to achieve in-depth knowledge on the regulation of football in Europe and beyond. Participants will learn fundamentals of FIFA s and UEFA s regulations, dispute resolution in sport, transfer of football players, licensing and financial fair play, taxation system in football and special topics of football law (integrity and match fixing, betting and gambling, doping, broadcasting of sports games and sponsoring). The course includes sessions from expert faculty members who are closely linked to the sports law sector, combined with sessions with exclusive and renowned speakers from the world of football law. programme overview The course comprises six sessions (4 hours each) over 3 days, each of which deals with a different key issues of football law. 5 1. Foundations of football law This session provides in-depth an insight about the history and evolution of legal aspects of sports and football. In parallel, it examines and discuss the structure, roles, and responsibilities of the domestic, European and International sport s governing bodies. 2. Dispute resolution in sport This session provides a legal analysis on the system of the international sports jurisdiction to those interested in the resolution of sports disputes from an international and national perspective. Participants will understand the history, structure, code and proceedings underlying the Court of Arbitration for Sport (CAS) / Tribunal Arbitral du Sport (TAD), and important national-level bodies, and their relationship with national and international-level actors such as the IOC, WADA and the European Union. 3. Transfer of football players This session provides an explanation and analysis of the regulations on the status and transfer of players. It will cover a range of contents such as status of players, registration of players, maintenance of contractual stability between professionals and clubs, third-party influence, international transfers involving minors, training compensation and solidarity mechanism and jurisdiction

6 4. Licensing and financial fair play This session provides an in-depth understanding of the of the licensing and financial fair play regulations. It will cover a range of contents such as amortisation attempt, break-even requirements, sanctions, relevant income and expenses, related part transactions, financial reports. 5. Taxation system in football This session provides an explanation and analysis of the principles underlying the design of an effective taxation system and how operate for different taxes. It will cover a range of contents such as direct and undirect taxes, tax benefits, tax planning, taxation of income from exploitation of image rights, and taxation of sponsorship. 6. Third-party ownership/third-party investment in football This session provides an understanding of basics, regulations, practices and recent developments about the third-party ownership/third-party investment in football. 7. Special topics of football law This session provides a thorough legal analysis on special topics of sports law. The legal treatment of integrity and match fixing, betting and gambling, doping, broadcasting of sports games and sponsoring is addressed to this module

7 Teaching Staff Andrea Traverso Andrea Traverso joined football s European governing body in October 2001 as Manager Club Licensing. In 2007 he became Head of Club Licensing and Financial Fair Play and in 2017, he was appointed as UEFA s Managing Director of Financial Sustainability & Research. He has taught in postgraduations and master programs in several European schools. Emilio Silvero Emilio Silvero is the UEFA Managing Director of Integrity and former Head of Disciplinary and Integrity. He is Arbitrator of CAS and Professor of Law at the University of Rey Juan Carlos. Emilio s qualification includes a Master in European Sports Governance and a Ph.D. in Labor Law/Sports Law. Fernando Seara Fernando Seara is graduate in Law from the University of Lisbon School of Law. His main areas of activity are administrative law and public procurement, sports law and entertainment, and dispute resolution, arbitration and litigation. He was University Professor, President of the Superior Council of Sports, founder of the Portuguese Association of Sports Law, Head of Cabinet of the Education Ministry, Member of the Council of Justice of the PFA, Deputy of the Assembly of Republic and Mayor of Sintra. Fernando Seara has authored several articles and books and delivered numerous lectures worldwide. José Meirim José Meirim is the President of the disciplinary board of the Portuguese FA. He is Professor of Sports Law at Catholic University of Portugal School of Law in Lisbon, at Faculty of Law at the NOVA (New) University of Lisbon and at Faculty of Human Kinetics. Meirim is also member of the Appeal Committee of the Euroleague basketball competitions. His qualifications include a graduation in Law from the Lisbon Law Faculty (1982) and a Ph.D. degree by the Faculty of Human Kinetics at University of Lisbon (2002). He has published several articles and books in national and international outlets and delivered numerous lectures across the globe. Julio Senn Julio Senn is a Graduate in Economics and Business Science from the Universidad Complutense. He began his professional career with Arthur Andersen in 1990, and 1998 he went on to join the Diario AS, following which he was appointed Managing Director of Real Madrid Club de Fútbol, in 1999 where he spearheaded the extensive reorganisation and modernisation of the Club, going on to join Garrigues in 2002 as head of the Sports & Entertainment department developing a line of business providing advice and assistance to sports personalities professionals and artists in the entertainment sector. He is now the Director of SENN, FERRERO, Asociates. Lucas Ferrer Lucas Ferrer is the Head of Sports Law Department and Partner of Pintó Ruiz & Del Valle where he currently advises a number of operators in the sports market (clubs, players, leagues, associations) in contractual and statutory matters. He also acts in proceedings with FIFA, TAS-CAS and other international and national sports institutions. Previously he worked as Legal Counsel for the Tribunal Arbitral du Sport - Court of Arbitration for Sport (TAS-CAS) in Lausanne. Marta Cruz Marta Cruz is the Legal Director of the Portuguese FA. She is graduated from the Faculty of Law at the University of Lisbon (2008), where she also received her Master s in law (2013). She is a lawyer with an extensive experience in Public Law, Sports Law and Litigation. She has taught subjects related to Portuguese Court of Arbitration for Sport s in post-graduations in several Law Schools. Miguel Caba Miguel Caba since 2018 is the Legal Director of the Real Federación Española de Fútbol (RFEF). Prior to his appointment at RFEF, was Head of the Legal Services Department of Real Madrid C.F. ( ) and Head of the Internal Legal Counsel of the Spanish Professional Football League ( ). He is Professor of Sports Law at the La Universidad CEU San Pablo and has authored several articles and books and delivered numerous lectures worldwide. Miguel s qualifications include a Master and a doctorate in Sports Law. Michele Bernasconi Michele Bernasconi is Professor at the University of Zurich where he teaches International Sports Law. He is also the Co-director of the UEFA Football Law Program and member of the Court of Arbitration for Sport (CAS). Michele Bernasconi is recognized as a leading lawyer in Chambers. In 2016 Who s Who Legal ranks him among the nine Most Highly Regarded Individuals for Sports & Entertainment worldwide. Paulo Lourenço Paulo Lourenço is the General Secretary of the Portuguese FA. He is Member of UEFA Players Status Committee, Tax Referee of the Administrative Arbitration Center and Professor of Civil Procedures Law and Rights and Obligations at the Lisbon Higher Institute of Accounting and Administration (ISCAL). Paulo s qualification includes a graduation in University of Lisbon School of Law

8 WHO CAN APPLY location This course is designed for jurists and other graduates, sports club collaborators, sports companies, professional leagues, sports federations, sports managers, intermediaries and other professionals related to sport. The participants will be selected after a preliminary interview to discuss their profiles and validate their coherence with the course. The sessions will take place at Cidade do Futebol. The infrastructure, which includes the new FPF headquarters and technical centre, is located near Estádio Nacional, in Jamor, Oeiras, close to Lisbon. Bus TEACHING METHODS Teaching methods will focus on interaction and sharing experience in order to foster a productive, stimulating and challenging environment. The course combines formal lectures and interactive presentations of the very latest concepts and case studies. Leading experts in the field of football law also provide valuable practical insights and their first-hand experience enriches the course content. 8 min min Caxias (Train Station) 11 min 108 Reboleira (Metro) 6 Algés (Train Station) 14 min 115 Praça de Espanha (Metro) Lisbon The company Vimeca runs three bus routes that go to Football City. The no. 115 departs from Praça de Espanha in Lisbon and finishes its run at Avenida das Seleções, in Oeiras. The no. 108 leaves from Reboleira Metro station, stops at Football City, and goes on to Caxias railway station. In the opposite direction, the no. 108 runs the Caxias-Football City route, heading on in the direction of Damaia. Finally bus no. 6 can be caught in Algés, with its final destination Queluz de Baixo. It stops in front of the Main Stand of the National Stadium. Choosing this bus necessitates a short walk around the complex that only has one entrance on the opposite side to the bus stop. Car A5 Cascais A9 CREL A5 Lisbon Thanks to its central location, there are plentiful road links to Football City. A junction of the A5 motorway is nearby, giving access in both directions (Lisbon-Cascais and Cascais-Lisbon), and the complex also has direct connections to the CREL, and the Avenida Marginal is a small drive away. Finally, driving along the interior roads of Caxias one can reach the Avenida das Seleções and the various links to the A5. Marginal 16 17

9 ASSESSMENT There will be a mixture of individual and group work throughout the course. Types of assessment will include report and essay writing, presentations, case studies, poster and reflective activities. language The language of instruction is English. TUITION FEES The Executive Course in Football Law costs Participants registered in football confederations, national associations, leagues and clubs are eligible to receive a 25% discount. The fee covers course materials, refreshments, daily lunches and dinners. Please note that this fee does not include travel and accommodation. In order to guarantee their place on the course, accepted participants will have to pay a 200 non-refundable enrolment fee within the period mentioned in the acceptance mail issued by the Portugal Football School.
