Master Fishing Lease 2018-2019 FISHING RIGHTS: The Owner grants fishing privileges on and around the seven designated lakes on the Comanche Star Ranch located in Comanche County, Texas. The Lessee may invite one guest per visit, the lessee must be present at all times. Minor children or grandchildren of the lessee do not count as a guest. Any deviations from the guest policy must be coordinated in advance. LEASE RATE/PERIOD: The Sportsman Lease is $4000. The Conservation Lease is $2000. Family and Corporate Leases are available. The lease year runs from April 1, 2018 until March 31, 2019. All Lakes are closed from November 16 thru January 31, 2019. LEASE TERMINATION / PRORATION: In the event of the sale of the ranch or owner termination of lease (for any reason); a refund will be offered based upon a linear proration. EQUIPMENT ON THE LAKE: Electric trolling motors only. One boat may be stored at the Boat Storage Area. Lessee assumes full responsibility for the boat and all equipment stored on the ranch. All property abandoned after seven days from termination of the lease becomes the property of the landowner. ACCESS TO LAKES: Access to CSR shall be through the main ranch entrance. Vehicular traffic is limited to the established designated roads leading to and from the respective lakes. No sightseeing or exploring is allowed. Leave gates as you find them in every case. In the event of rain, or when roads are wet, fishing is restricted to Super Lake. During hunting season, access restrictions apply, otherwise fishermen and guests are allowed to enter the ranch one hour prior to sunrise to be at their respective lakes near sunup and may remain on the lakes until sunset to be off the ranch within one hour after sunset. SAFETY: Safety is Paramount. Lessees and Guests are required to register at the ranch entrance showing destination lake(s), time in, and time out of the ranch. No alcohol, drugs, dogs or weapons* are allowed on the ranch. Surveillance cameras are in use on CSR. * CCL permit holders may carry and a.410 shotgun may be used as a snake gun. PROTECTION OF PROPERTY: Lessee agrees not to cut, injure or destroy any trees, crops, roads, fences, buildings or other improvements located on the property. Lessee agrees not to enter, use, or otherwise disturb any residence, building, utility, or equipment located on CSR. Lessee agrees to compensate the owner for any damages caused by lessee or guests for a breach of this paragraph. LIABILITY: A Release of Liability form is required from each lessee and guest. Annex 1 Sportsman Lease 1. Master Lease. The Master Lease Agreement is the valid controlling document. All stipulations listed on the Master Lease are valid for the Sportsman Lease holder. 2. Hunting Season Lake Access. During hunting season, the hunting schedule will be posted on the website and sent to you by email. On Scheduled hunt dates, fishermen must wait until 9:30 to leave for any lake other than Super Lake and must be off of the lakes (except Super Lake) in order to be back into the boat storage area by NLT 3:45 pm or you may stay on the lake that you are on and come off with the hunters when it is absolutely completely dark. On days with no scheduled hunting, then normal lease guidelines apply. All lakes will close to fishing of any kind from sunset November 15 until sunrise February 1. 3. Please do not mess with the fish feeders. If you notice any fish feeder in distress, please inform the Lakes Manager. 4. Proper handling of all Largemouth Bass is required. Preserve and protect the slime coat. Limit the time out of water to 2 minutes of less for each fish caught. If the fish is to be released, release ASAP. Do not place on stringer and then release at the end of the day. All Largemouth Bass over 5 pounds need to be supported with a second hand and not held with one hand at the mouth. Annex 2 The Conservation Lease 1. Master Lease. The Master Lease Agreement is the valid controlling document. In addition to the stipulations listed here in Annex 2, all stipulations listed on the Master Lease are also valid for the Conservation Lease holder. 2. Culling of small, injured, or diseased fish is required. The Slot limit for culling of individual species of fish is listed at the bottom of each Catch Report. It is absolutely vital that species caught, that fall within the specified cull limit range, be removed from the food chain. 3. Complete a Catch Report by the end of each visit to CSR. Take a blank catch report with you on the boat. Log results as you catch individual fish. Return the completed Catch Reports to the sign-in shed. List the appropriate lake at the top of the report, do not combine reports for two of more lakes 4. Document all Largemouth Bass over 7 pounds. Take a picture of all Largemouth Bass caught over 7 pounds and send to the Lakes Manager. Please photograph any unusual, injured, or diseased fish caught. 5. An accurate scale and length measuring device. All Largemouth Bass over 12 inches must be weighed and measured and the results annotated on the Catch Report. Use the Brecknell Electro Samson Scale with Clip. 6. A Rubberized Net. Please bring a rubberized dipping net to handle all fish caught. The rubber coating mitigates the loss of the slime coat during the extraction / de-hooking / release of each fish. The cheap braided nets are very bad on the fish and often result in bacterial infections and death from loss of their slime coats. 7. Hand-held fish grabber. A hand-held fish grabber will keep your hands away from the fish s mouth and/or hook and will protect the fish s slime coat by reducing the amount of contact that your hands have on the fish s body. The preservation of the individual fish s slime coat during the catch / release phase cannot be over-emphasized. 8. Please do not mess with the fish feeders. Annex 3 Rules of the Ranch 1. If the roads are wet, please do not travel on the ranch. Super Lake is available for fishing when the roads are wet. Pay attention to emails, texts, and/or the website (trophybasscsr.com) advising of road conditions. Any doubts call. 2. All guests must sign a release of liability form before entering the ranch. Parent/grandparent or legal guardian must sign for and be responsible for minors. 3. All Children under 13 must wear a U.S. Coast Guard approved personal floatation device while occupying a boat or when within 50 feet of any body of water on CSR. 4. No weapons will be carried* on the ranch. *CCL permit holders may carry their weapon and a.410 shotgun may be used as a snake gun. 5. No alcohol and no drugs are allowed on the Comanche Star Ranch. 6. Please do not leave trash on the ranch. Pick up after yourself! This includes cigarette butts. 7. Please stay on the roads and use the most direct route that is designated to the lake you plan on fishing. Do not sightsee or wander around the ranch under any circumstances. 8. All Lessees are required to sign in and out on the registration board. This includes visits to the boat storage area. 9. You may enter the ranch one hour prior to sunrise so that you can be on the lake you wish to fish at sunrise. Likewise, you may remain on any lake until sunset but be off the ranch within one hour of sunset. The intent is to leave the lake at sunset and be back in the boat storage area before complete darkness. Please leave the ranch promptly after leaving the lakes. Expect a Game Warden response if driving the ranch after complete darkness. 10. Please do not tinker with the feeders or feeding stations. 11. Please be careful. The ranch does have poisonous snakes, can have swollen streams, and does have wild animals that can be dangerous. 12. Please do not wander away from the area you have declared to visit and have signed in for. Do not attempt to pick up artifacts, fossils, arrowheads, antler sheds, or other items found on the ranch. 13. No dogs are allowed on the ranch. 4
Annex 4 The Family Lease The Family Plan is designed for families to spend time together on the Comanche Star Ranch. All guests must be immediate family members. Immediate family members are defined as Wife, Children (adult or minor), Grandchildren (minor), Nieces and Nephews (minor), Father or Mother, Brother or Sister (this includes appropriate in-laws). The Family Plan is an annex to the Master Lease and is an addendum to either the Sportsman or Conservation Lease Agreement. The Master Lease along with the respective Sportsman / Conservation Agreement remains the controlling document. When the Lessee is not exercising his Family Annex privileges, then he reverts back to an individual lease holder as specified under the Sportsman or Conservation Agreement and all individual lease rules applies. When the Lessee decides to exercise his family annex privileges, then the rules of the Family Annex are adjoined to the Master Lease and the Sportsman / Conservation Agreement. Overnight camping privileges are not included. The Family Annex is priced according to the type of Agreement specified, Sportsman or Conservation. The Sportsman Package with a Family Annex is $6,000. The Conservation Package with the Family Annex is $3,000. Family Annex Additional Benefits: 1. The Lease Holder may bring up to three (3) immediate family adults. The maximum total number of adults including the leaseholder allowed on the ranch is four (4). 2. The Lease Holder must always be present on the ranch when family members are present. 3. The maximum number allowed on the ranch at any time is eight (8). Of which no more than four (4) may be adults, this number includes the lessee. 4. The Lease Holder and his party must remain together. The Lease Holder may allow members of his party to remain at the RV / Camp Area and Super Lake. Away from the RV Camp / Super Lake Area all of the party must remain together. 5. An adult must supervise all children under the age of thirteen (13) at all times. 6. All Children under the age of thirteen (13) must wear a U.S. Coast Guard approved personal floatation device while occupying a boat, while fishing from the dock, or when within 50 feet of any body of water. 7. The Lease Holder and his party may use no more than two (2) boats on a lake. 8. The Lease Holder may store up to two (2) boats at the boat storage area of CSR. 9. Each guest must sign a Release of Liability prior to entering the ranch. Releases are available at the sign-in station at the ranch headquarters. Adults must sign for and be responsible for children that are too young to sign for themselves (under 13). 10. Lack of supervision of minors, dangerous, or unsafe activities will result in lease termination. 5
Release of Liability Signed by Lessee By signing this agreement, I hereby acknowledge that I have knowingly and willingly entered a Fishing Lease Agreement between, (angler, hereinafter the Lessee) and The Comanche Star Ranch and Robert Starks, et al (landowner, hereinafter the Lessor). I further acknowledge and understand that no warranty, either express or implied, is made by the Lessor as to the condition of the fishing lease (hereinafter the leased premise) located on the Comanche Star Ranch or of any roads, buildings, gates or other improvements located thereon. This document serves to warn me that; dangerous conditions, risks and hazards do exist. My presence and activities on the leased premises expose both me and my property and my guests to dangerous risks and hazards, including but not limited to: poisonous snakes, insects and spiders; erosion and general condition of the land, both on and off roadways, creating rough, hazardous and dangerous driving and walking conditions; animals, both wild and domestic, that may be diseased and/or potentially dangerous; deep water; persons with firearms, both on or off the leased premises; and the use of vehicles. I hereby state that I expressly assume all such dangers, risks, and hazards. I enter into this agreement on my own accord. In consideration for the right to enter the leased premises, I hereby release and agree to protect, indemnify and hold harmless the Lessor and his respective heirs, agents employees and assigns from and against any and all claims, demands, causes of action and damages, including attorneys fees, resulting from any accident, incident, or occurrence arising out of, incidental to or in any way resulting from the use of the leased premises all improvements thereon, whether or not caused by the Lessor s negligence. This release applies during the time that I am permitted on the leased premises. I hereby further covenant and agree that I my heirs, successors and assigns will not make any claim or institute any suit or action at law or in equity against the Lessor or his or her respective heirs, agents representatives, employees, successors or assigns by reason of conditions of the leased premises or activities occurring thereon. I hereby further understand and agree to abide by all the rules, provisions and terms of this Fishing Lease Agreement as set forth by the Lessor, if any, either in the body of the lease, cover letter or posted at the sign in table. It is understood that the Lessee will be in brech of this agreement in the event that the Lessee or guests fails to follow those rules and terms as set forth in the attachment. I further agree to abide by all state fishing laws as set forth by the Texas Parks and Wildlife Department. In addition to state fishing laws, Lessee agrees to abide by all local, state and federal laws while on the leased premises. As the Lessee, I understand that failing to abide by the lease covenants may void this agreement resulting in forfeiture of remaining lease rights and no refund of payment. In that event, I further agree to forfeit any and all present and future claims to the leased premises in regards to the remaining term of the original agreement. This agreement may then be cancelled at the sole discretion of the Lessor at any time. I hereby understand that the owner may terminate the lease at any time and for any reason. I further understand that if CSR is sold or the owner terminates the lease, for any reason, that a linear prorated refund will be offered. G U E S T R E L E A S E Release of Liability, and Acknowledgment & Acceptance Of Dangers, Risks & Hazards of Entry on any property owned by Robert Starks for any reason. By signing this release of liability and indemnity, I hereby acknowledge that I knowingly and willingly enter CSR of my own accord and hereby hold harmless the owner, Robert Starks, et al and his agents of any mishap, accident or incident that may occur while I m on the property. I make this agreement of my own accord. I further acknowledge and understand that no warranty, either expressed or implied is made by the owner as to the condition of the lakes, deer stands, roads, gates, buildings or any other improvements his property. This document serves to warn me that dangerous conditions, risks and hazards do exist. My presence and activities on the premises expose both me and my property to dangerous risks and hazards, including but not limited to: poisonous snakes, insects and spiders; erosion and general condition of the land, both on and off roadways or senderos, creating rough, hazardous and dangerous driving and walking conditions; animals, both wild and domestic, that may be diseased and/or potentially dangerous; deep water; persons with firearms, both on or off the premises; and the use of vehicles. I hereby state that I expressly assume all such dangers, risks and hazards of my own free will and accord. In consideration for the right to enter the CSR property, I hereby release and agree to protect, indemnify and hold harmless the owner and his respective heirs, agents, employees and assigns from and against any and all claims, demands, causes of action and damages, including attorneys fees, resulting from any accident, incident or occurrence arising out of, incidental to or in any way resulting from the use of the ranch and all improvements thereon, whether or not caused by the owner s negligence. This release applies during the time that I am permitted on the ranch. I hereby further covenant and agree that my heirs, successors and assigns will not make any claim or institute any suit or action at law or in equity against the owner or his respective heirs, agent s representatives, employees, successors or assigns by reason of conditions of the ranch or activities occurring thereon. I hereby further understand and agree to abide by all rules, provisions and terms of this Guest Release. Agreements are as set forth by the owner, if any, either in the body of a lease, cover letter or posted at the sign-in table, or verbally given. If you are not familiar with the rules and provisions, please ask the owner, agents or employees. It is understood that the Guest will be in breach of this agreement in the event that the Guest or anyone in his/her party fails to follow the rules of the ranch. I further agree to abide by all state hunting and fishing laws as set forth by the state of Texas. I also agree to abide by all local, state and federal laws while on the property. I understand that if I do not follow the rules and provisions as set forth, that my lease/visit will be terminated immediately with no monies refunded. As used in this release, the terms I, my person and myself include minors in my care while on CSR property.
