APRIL 2014 Forty Niner Flyer Your source for neighborhood news www.49ershoa.com,hello to all fellow H.O.A. members Let me start by saying what an honor it is to serve as your association president this year. I have the good fortune to be part of a dedicated, hardworking board. It is our intent to serve this community the best way we know how. I would like to take a moment to recognize former president and treasurer Becky Rebenstorf for the amazing job she did while serving on the board. I m not quite sure how someone so petite could leave me with such a large pair of shoes to fill? Her presence at our board meeting will be greatly missed. Thanks Becky! We are nearly one quarter of the way through this year already. In this next quarter we should see some rather large neighborhood projects come to a close. The gas line repair and replacement is steadily wrapping up. We, as a board, have heard mostly positive reports on the work being done. The cooperation of South West Gas Co., and their efforts to accommodate neighbor s needs, has been exceptional. Once the gas work is complete, the county can finish paving the east end of the neighborhood. Final steps should be the resurfacing and paving of the main entrance. The improvement of our streets creates a twofold problem. The newly paved roads seem to invite more of the neighborhood kids to be out playing in them. It is one of the things that make our area unique. We want to see children out and about playing, but we do have responsibilities as parents to advise our children to be respectful neighbors. Be watchful of traffic, yield to oncoming cars, and to be respectful of other people s private property. We must also make them aware that public property (washes, streets, and the golf course) need to be used in the manner in which they were intended. As motorists, we must remind ourselves to slow down and keep a watchful eye of our neighbor s children, walkers, golf carts, and bicyclists. Looking ahead as a board, we will be discussing traffic and speed control. We will also be repairing and painting the historic street signs. Claire Place, our Neighborhood Watch president, has been working on a new means of communication between neighbors. You should see more information on that in the coming months.

It is our intent, as a board, to bring to you the best options for our communities safety and wellbeing. I remind all to be the kind of neighbor you would like to have living next door to you. GOLF CART SAFETY As some of you may have heard a 16 year old girl was killed in a golf cart accident in August in the town of San Tan Valley in Pinal County. She was one of nine teens that were riding in the golf cart when it rolled over as the driver was trying to make a right turn. We have all seen over-loaded golf carts driven by children in our neighborhood and there have been reported injuries. Only licensed drivers are allowed to drive golf carts. Please stress to your children the importance of not overloading your golf cart and going too fast. We do not want to experience a similar incident to the one that happened recently in Pinal County. STREET SAFETY Like many of you, I walk in our neighborhood on a regular basis usually with dogs so I have a chance to observe many different kinds of traffic behavior that are a real cause for concern. Traveling at 40-50 mph, talking on cell phones, texting, applying make-up, etc are all things most of us have noticed. We are fortunate that we have not had more serious accidents. For some reason, some of our residents don't think it's important to slow down and watch out for our children, walkers, joggers, bicyclists, and others when driving on our streets. Please remember these friendly reminders when using our streets: 1. Walk against traffic. 2. Jog against traffic. 3. Bicycle with traffic. 4. Observe the 25 MPH speed limit. 5. When driving a golf cart, drive with traffic. 6. At night wear colorful or reflective clothing and use a flashlight! 7. Do not walk in the middle of the street or three or four abreast. 8. Have your dog(s) on a leash. 9. Pull trashcans off the street in a reasonable time. 10.Save your texting for a later time. Thanks for being considerate of others. A note from your Architectural Review Committee: Please remember enforcement of our CC&Rs is necessary to help protect our home values. Your HOA Board has been working extremely hard to make sure our CC&Rs are upheld and in the process has spent many dollars in legal fees. This expenditure is frustrating as we have such SIMPLE rules to follow and EASY ways for everyone to get information and approval for their projects (see www.49ershoa.com). By purchasing our homes here in 49ers, we all agreed to abide by our deed restrictions and governing documents. Of course we all can make mistakes, so if you ever get a letter indicating such a mistake, we ask that you quickly contact us and help rectify the situation. This simple act will avoid unnecessary legal costs and preserve our HOA funds. Thank you for helping to make 49ers a great place to live. Reminder As stated in our CC&Rs, all trailers, no matter how great you think they look, must be stored OUT OF SIGHT in either your garage or in your backyard so as not to be seen from the street, your neighbors house, or from the golf course! If you are unable to store your trailer in the above manner, you must store it OFFSITE. Do You Look Good from Behind? Have you ever walked behind your home and looked at it from a fresh and more critical perspective? What do you really see? Remember that if you have a home along the golf course, your yard obligations don t end at just your front yard! Your obligations ALSO include the back of your home that abuts the golf course! The golf course owner has spent a tremendous amount of money making the golf course look good for you and its players - and YOU need to return the favor by having your property look good from their point of view too! Please be a good neighbor and give the portion of your landscape that is visible from the golf course proper attention. Thank you for helping to keep ALL of our property values up!

We all love fresh eggs, however chickens are NOT allowed to be kept on one s property here in 49ers. Poultry is specifically disallowed in our CC&Rs, as written in Article 14. Please understand that such an infraction, if not immediately corrected, falls under the same guidelines as any other CC&R violation and you may be held responsible for necessary legal fees-do you really want to spend hundreds of additional dollars for fresh eggs? Our CC&Rs can be viewed at www.49ershoa.com under the legal documents tab. Dear Best Friend, Please keep me on a leash while we enjoy our walk here in 49ers together - I am just too curious about people and things and you never really know what I'll do when I run-off. I have primal urges! It s only fair for us to be courteous and safe to other dog owners and children enjoying their walk. Did you know that keeping me on a leash is the LAW? In case my other urges strike and I can't wait until we get home, can you bring a pooper-scooper or similar with you? Nothing fancy - a bag will even do! Love, Fido FORTY NINER COUNTRY CLUB NEWS Members & Neighbors Spring is here... wait a minute, hasn't it been Spring since Fall?? The golf course is in spectacular condition and we have been busy. Thanks so much for your support through our busy season. We expect that the next 2-3 months will be just as busy or even busier. I wanted to take a moment to update you on the happenings here at the Club and what you can expect over the next couple of months. ********************** POOL & FITNESS ********************** I'm sure you've noticed that the Pool & Fitness Season is starting to kick into gear. The pool is heated and open for our Members to use. The deck is beautiful, the lounges have all been redone, the weather is fully cooperative and we are ready for a great pool season. Now is the perfect time to register your kids for our swim team. It's also a great time to remind you of very important safety tips to follow for the summer pool time.

********************** POOL & FITNESS ********************** *Swim Team Registration will be this coming Saturday, March 29th from 9am - 11am. If you are unable to register your child at this time, then just swing by the pool M-TH between 5pm-6pm to register. The first day of practice is April 7th. For Swim Lessons and Adult Classes you may register online at www.swaquaticsports.com or contact Patty Olstad, Director at 520-488-8996. *The Pool Use is for Members Only. Members can bring guests, for a fee of $2 per guest payable in the restaurant or golf shop. *Children under the age of 18 MUST BE ACCOMPANIED BY AN ADULT. Please do not drop your kids off at the pool and have them entertain themselves. This is for your child's safety. Unaccompanied children will be asked to leave the pool area and be picked up. *Look for exciting events at the pool this summer! Remember, we will offer our Summer Pool & Fitness Membership again this season. This membership will begin in May. Until further notice, each Monday the Member's Discount will be 25% off your food purchases after 5:00pm. It's a great night to stop by and try something new, or stick with the classics. Whatever you crave, it'll be 25% off! It is PATIO seating weather! Don't forget that you can sit out on the patio and enjoy the beautiful views. We will be getting a new shade installed at the end of the month for the west end of the patio to block the sun for those 15 or so minutes, when it's needed. We also have portable heaters if needed, and a flat screen tv to catch a game. It's a perfect spot for a night out. Easter is coming! That means it's time to book you reservations for our Annual Easter Sunday Brunch. The details will be announced very soon. This event fills up quickly, so make sure to make your reservations. It'll be great as always. Speaking of Brunch, for those of you who are not aware, we have Sunday brunch on the first and third Sunday's of the month. It's only $13.95 and we serve from 10:00am to 1:00pm. So our next regular Brunch will be on Sunday April 6th. The third Sunday of April will be our Easter Brunch. This is a special Brunch that will have a more expansive menu and be a special price. Stay tuned for the details of that. Now that it's Spring, it's not to early to book your Graduation Parties and Pool Parties! Dates are beginning to fill up so be sure to contact Alan at alan@fortyninercc.com to book your event now! **************** Golf Update **************** Junior Golf Camp information will be coming out around the middle of April. Big Derek and Brian will be running the camps again this summer. So keep this in mind while planning your kids and grandkids summer vacation time!

**************** Golf Update **************** Our Director of Golf, Brian Key, would like to thank the Members, the WGA and the MGA for their generous donations to the Tanque Verde High School Golf Team. Brian is the TVHS Boys Golf Team Coach this season and he has been doing a great job with the team. So far this season, the boys are undefeated and have qualified for State. The donations given by our great membership has helped the team with funds needed for golf balls, uniforms, and expenses to play in 2 invitational tournaments. If you wish to contribute to Brian's Team, please contact Brian at BK@fortyninercc.com. All donations are tax deductible. Thanks for supporting junior golf! We have a lot of golf course projects going on right now as well. We will be doing quite a bit of irrigation work to help our weaker areas. You may run into a portable sprinkler running here or there over the next couple months to help the turf conditions. We are also working on some beautification projects around the course as well, especially around the pump station and lake fencing on the 6th tee. We will also be doing some more tree work including the removal of a couple very dead and unsightly trees and we will be replacing them with nice new beautiful trees. So the maintenance staff will be very busy for the next several months. ************************* Membership Update ************************* There has never been a better time than now to be a Member! Forty Niner Country Club is definitely setting a New Tradition with all of the great events and happenings at the Club. The membership base continues to grow a little each month, but there is plenty of room for more great people! The Spring Member Social will be Monday, April 14th from 5:30pm to 7:30pm. This event is for Adult Members and their Spouse (or a Guest). We ask that you please RSVP by Wednesday April 9th to Casey at caseyp@fortyninercc.com so that we may be prepared for your name badges and have the proper amount of food & beverage available. Not a member yet? If you are a neighbor, join by April 15th, we will waive any initiation fees. Also, don't forget that we do offer a Member Referral Program. So if you know someone that would like to join, be sure to let us know and you will receive a Club gift certificate for your referral. Don't forget that we will be offering our Summer Pool & Fitness membership beginning in May! Info on that program will be emailed out around the middle of April. ********************************************************************************** Well, that's about it for now. Thanks so much for a great and successful winter season. We look forward to much of the same for the summer, with a little extra fun thrown in here and there!
