INDEMNITY 1.1 Proof of Liability Insurance The Owner must show proof of current liability insurance coverage on the Horse for the sum of one million dollars ($1,000,000) while the Horse is boarded at the Farm. This may include, but is not limited to, membership with the Ontario Equestrian Federation (OEF), for their insurance benefits. 3. BOARDING TERMS 3.1 Horse Board Horse board is at a rate of $ per month, on a monthly basis, commencing, 2017. Board payment is to be received in advance of the start of the Boarding Agreement and by the FIRST DAY of the month for each subsequent month (payable by cheque, cash, or email money transfer). A late fee of $5 per day will be charged for payments received after the 1 st day of each month. NSF or other returned cheques will result in a $50.00 charge per occurrence plus late payment charges. From time to time, the board rate will change. The Farm will provide written notice of board rate changes to the Owner and will post notices on the Farm premises at least sixty (60) days prior to the board rate change coming into effect. All invoices for Additional Services or veterinary/farrier care secured by the Farm for the Horse are to be paid within 30 days of the invoice date. 3.2 Description of Board Horse board consists of a box stall in the barn and daily turnout to a small, medium, or large paddock and/or pasture as determined by the Horse s temperament and needs, and at the discretion of the Farm. The Horse will be turned out will other horses of compatible temperaments and needs. Should the needs of the Horse change, the Horse may be moved to a paddock that is more suitable. The stall will be mucked once daily, and the bedding replaced as needed. The stall has rubber matting and will be bedded with ample bedding for the health and comfort of the Horse; should the Owner prefer more bedding, there will be an associated monthly fee due to the increased material and labour costs. 3.2 Proof of Ownership The Owner warrants that he/she owns the Horse, that there are no liens against the Horse, express or implied by law. If the Horse is leased, the Owner shall be able to provide proof of lease. 4. ADDITIONAL SERVICES (see Additional Services Appendix for price list and description) Requests for Additional Services are to be made to the Farm staff. 5. CARE & FEED 5.1 Care The Farm agrees to provide normal and reasonable care to maintain the health and well-being of the Horse. 5.2 Feed Quality The Owner is responsible for checking the feed (hay and/or grain) being used and satisfying himself/herself that the feed is acceptable for his/her horse prior to signing the Boarding Agreement. The Owner acknowledges that the feed provided may change due to changes in supplier or quality of the growing season, however the Farm will always strive to provide high quality feed. 5.3 Hay & Water Hay is provided to the Horse at the standard rate of approximately 1.5-2.5% of the Horse s body weight per day, depending on the Horse s individual needs. Horses will be fed hay twice daily in the paddocks and twice daily in the stalls (a total of three feedings daily). 2 P a g e

The Horse will always have access to fresh water provided by the Farm in stock tanks and/or automatic waterers in the fields and stalls. 5.4 Supplemental Feeding Indoor boarded horses may be fed, by the Farm, concentrates (grains, pellets, cubes) and/or supplements/medications, all of which are to be provided by the owner, up to two times per day. Salt will be provided to the Horse by the Farm. The Owner may choose to have the Horse fed additional feedings by the Farm for an additional fee, this also applies to outdoor boarded horses. 6. FACILITIES 6.1 Farm Hours Year Round Hours: 8:00 AM till 9:00PM (Mon-Sat) & 8:00 AM till 8:00 PM (Sun & holidays) Farm Closure/Change of Hours: special circumstances and/or major holidays. Notice will be posted in the barn prior. If the Owner needs to be at the Farm outside of the regular hours (such as if you are preparing for a show or clinic or if your horse is injured or sick), the Farm staff must be notified in advance. Please note: the Farm Hours are in place to give all of the horses residing at the Farm ample time for rest and relaxation as well as to make sure the Farm is safe and secure. 6.2 Facilities Usage The Owner has full use of the facilities including the following: Use of the barn aisles/grooming stalls for grooming/tacking up the Horse; Use of the indoor and outdoor arenas, including the viewing boxes; Use of Boarders Tack & Feed Rooms for storage of gear, feed and supplements; Use of training equipment in the rings as long as it is returned as found; Use of the land for trail riding so long as all gates are kept closed and riding is kept to the edges of all fields. The facilities are to be kept neat and tidy at all times. If the Owner makes a mess, it must be cleaned up before going home for the day. Ample manure buckets, garbage cans, and recycle bins are provided for this purpose. 7. PERSONAL BELONGINGS 7.1 Storage of Belongings The Owner will be entitled to one tack locker for storage of tack and equipment as well as one feed bin for storage of feed. The Owner may also keep their extra feed bags and supplements/medications in the Feed Rooms. Indoor boarders will have a tack locker and feed bin in the new barn and outdoor boarders will have a tack locker and feed bin in the old barn. The Tack and Feed rooms must be kept in a neat and orderly fashion. Tack and/or equipment should not be left out in the aisle ways after the boarders have left for the day; the exception to this is halters and sheets on stall doors. 7.2 Respect of Personal Belongings Boarders do not have the right to use other boarders tack and equipment or feed without permission of the owner. Stealing from the Farm or from other boarders will not be tolerated and will result in termination of this Agreement. 3 P a g e

7.3 Risk of Loss All tack and equipment (horse trailers included) of the Owner kept on the Farm premises shall be at the sole risk of the Owner; the Owner assumes all responsibility for insuring their tack and equipment while on the Farm premises. 8. HORSE HEALTH 8.1 Veterinary Records & Vaccines Upon arrival of the Horse to the Farm, the Owner must present current veterinary records for the Horse proving that the Horse is up to date with all vaccines required for residency at the Farm. Required Vaccines: Tetanus Eastern/Western Equine Encephalitis (EEE/WEE) Equine Influenza Equine Herpes Virus (EHV) Rabies Potomac Horse Fever Strangles Optional Vaccines: West Nile Virus (WNV) Botulism Uveitis (Moon-Blindness) Equine Viral Arterits (EVA) 8.2 Health on Arrival & Coggins Test The Owner warrants that the Horse is free from infectious, contagious, or transmissible disease. The Horse will be held in a separate field for the period of time upon arrival at the Farm for acclimatization and observation; the Farm reserves the right to refuse the Horse within this period if it presents symptoms of illness or disease. Note: need for a current, negative Coggins test will be at the discretion of the Barn Manager. 8.3 Vaccination & Worming Programs While the Horse is boarded at the Farm, the Owner must enlist the Horse in regular vaccination and hoof-care schedules. Proof of vaccination must be shown to the Barn Manager, unless the Horse is vaccinated at the Farm s Annual Vaccination Clinic. The Farm will host an Annual Vaccination Clinic with Dr. Peter Oddie to vaccinate and float teeth. Benefits include a group rate and a waived holding fee; however, the Owner is encouraged to be there for informative purposes. Further information will be posted in advance to this event. Deworming at Glamorgan Farm is provided by the farm and the cost is included in the board rate. Deworming will be done quarterly and following a recommended schedule from Dr. Oddie. 8.4 Veterinary & Farrier Services a) The Owner agrees to arrange for all veterinary and farrier services required for the health and well-being of the Horse; all veterinary and farrier services are at the expense and the responsibility of the Owner. b) If at any point the Farm feels that the horse is not receiving proper care for his health and well-being, every effort will first be made to encourage the Owner to perform such tasks. However, if this is unsuccessful, the Farm will arrange for the proper veterinary/farrier service for the Horse; the expenses for such tasks will be invoiced to the Owner separately. c) The Farm uses the services of St. Lawrence Veterinary Services, and particularly Dr. Peter Oddie. The Owner may use whichever veterinarian and farrier he/she chooses or may use the regular veterinarian and farrier that the Farm uses. 4 P a g e

d) If the Owner wishes to have an equine professional (ie. vet, farrier, chiropractor, massage therapist, etc.) attend to the Horse without being present themselves, the Farm will charge the Owner a handling fee for the event; such fees will be invoiced to the Owner. The Owner must ensure that payment is either arranged with the equine professional or given to the Farm staff prior to the scheduled appointment. The Farm, under no circumstance, will cover the cost for a service provided by an equine professional for remuneration by the Owner, except as stated in paragraph b). 8.5 Emergency Care of the Horse In the event of an emergency, the Farm will make every attempt to contact the Owner first, before a veterinarian/farrier is called; if the Owner cannot be reached and the situation is critical, the Farm will contact the Owner s veterinarian/farrier for emergency treatment. If the Owner s veterinarian/farrier cannot be reached in an emergency, the Farm will secure the emergency veterinary/farrier treatment required for the health and well-being of the Horse. All costs of such care secured shall be invoiced to the Owner as an additional expense. 9. LESSONS, CLINICS, & SHOWS 9.1 Lesson Instruction The Owner acknowledges that they and/or other owners may periodically invite outside instructors to the Farm to give them riding lessons. ***Proof of instructor liability insurance, with Glamorgan Farm named as an Additional Insured, as well as a signed Riding Waiver must be given to the Barn Manager before the instructor may teach on the property. If the instructor is to ride a horse on Glamorgan Farm property, they must be wearing proper footwear and a riding helmet. Under no circumstance is any horse boarded at Glamorgan Farm to be used for instruction of lessons for anyone other than Glamorgan Farm boarders without prior consent from Glamorgan Farm. 9.2 Outside Use of Facilities On rare occasions, the Farm may host and/or rent the facilities for events and equestrian competitions that may use some or all of the facilities. This may cause minor disruptions to normal access to the facility during these events. 10. VISITORS Should the Owner bring any guests to the Farm, they must ensure they are informed of and follow all of the Farm Rules and Regulations, sign a Riding Waiver (prior to riding), and wear proper footwear and a horse riding helmet when mounted. The Owner is responsible for the safety and actions of his/her guests while at the Farm. Guests should never be left unsupervised at the Farm. If the Owner has made arrangements for an outside party to ride and/or visit the Horse in their absence, prior notice must be given to the Farm. 11. RIGHT OF LIEN The Owner or agent(s) of the Horse shall be jointly and severally liable for all sums due hereunder to the Farm. The Owner is put on notice that the Farm has right of lien, as set forth under the Innkeepers Act of Ontario and any other applicable legislation in Ontario for the amount due for the board and keep of the Horse and shall have the right to retain the Horse until the amount due of such indebtedness is discharged. The Farm shall be authorized to proceed by lien and lien foreclosure, sale, legal action or otherwise in order to collect the same, or any combination of the above. Upon sale of the Horse, the Owner and/or agent of the Horse shall be responsible and liable for any deficiency in unpaid sums. 5 P a g e

12. AGREEMENTS The Owner and the Farm agree as follows: a) The Owner agrees to abide by and conform to all Farm Rules and Regulations as determined and posted from time to time by the Farm and included herein and in attached Appendices and Amendments. b) The Owner agrees to execute the Farm s Agreement for Release and Waiver (Riding Waiver) PRIOR TO RIDING. c) The Owner agrees to wear correct fitting and proper headgear and footwear, and acknowledges that the Farm requires a CSA approved horse riding helmet be worn at all times while mounted. No bicycle helmets. d) The parent/guardian of the Owner, if the Owner is a minor, agrees to supervise the Owner while at the Farm. They also agree to sign a Riding Waiver and follow the Farm Rules and Regulations. e) The Owner agrees to take full responsibility for any damage he/she and/or the Horse, and/or any of his/her guests causes to any Farm equipment, buildings, fencing, property, etc., except where reasonable use and/or normal wear and tear are the principle reasons for the damage. f) The Owner agrees to hold the Farm, its agents and/or employees completely harmless and not liable for any death or injury whatsoever caused to the Owner, the Horse, and/or any loss or damage to any personal property. g) The Owner agrees to not hold the Farm liable for any sickness, disease, astray, theft, death, or injury which may be suffered by the Horse or any other cause of action whatsoever arising out of or connected in any way with the boarding of the Horse. This includes, but is not limited to, any personal injury or disability the Horse may receive on the Farm premises. h) The Owner agrees, and fully understands, that the Farm does not carry any insurance on any horse not owned by the Farm for boarding or any other purposes, and that the Horse is not covered under any public liability, accidental injury, theft, or equine mortality insurance and that all risks connected with the boarding, or for any other reason for which the Horse is in the possession of and on the premises of the Farm, are to be borne by the Owner. i) Should the Owner desire the Farm to release the Horse to any third party, the Owner agrees to provide the Farm his/her written consent to such a release prior to the Farm giving possession of the Horse to a third party. j) The Owner agrees to make the Farm aware in advance if the Owner is temporarily removing the horse from the premises for any reason (lesson, clinic, show, equine professional appointment, etc.). 13. TERMINATION OF AGREEMENT A notice period of 30 days, from the 1 st day of the month, is required to terminate this Boarding Agreement. The Horse may not leave the Farm until the account is paid in full. If the Owner chooses to remove the Horse from the Farm in advance of month end, no refund will be given from the Farm for remaining days in the month. If notice is given partially through the month, the Boarding Agreement will terminate 30 days from the start of the succeeding month. All belongings left at the Farm, after the Horse is removed from the Farm and the Boarding Agreement is terminated, become the property of Glamorgan Farm. Please note: Glamorgan Farm reserves the right to terminate this Boarding Agreement at any time if the circumstance warrants it (ie. if the Owner is consistently in violation of any part of this Boarding Agreement or if the Horse, in the Farm s opinion, is deemed dangerous or undesirable for a boarding facility, etc.). In such a case, the Owner is responsible for removing the Horse and for all fees incurred during the Horse s stay at the Farm. Such a decision will be made at the discretion of the Farm Owners and Management. 6 P a g e

14. SIGNATURES This Boarding Agreement represents the entire agreement between the parties and there are no further agreements or promises, verbal or implied, unless specifically stated herein. When the Farm and the Owner, and/or the Owner s parent/legal guardian (if the Owner is a minor), sign this Agreement, it will be binding on both parties subject to the above terms and conditions. ***Please note: signing this agreement indicates that you have read it in full, understand it, and agree to its terms.*** OWNER (or Parent/Guardian of Owner) DATE GLAMORGAN FARM MANAGEMENT DATE 7 P a g e
