CITY OF BONITA SPRINGS ZONING ORDINANCE NO. 05-07 A ZONING ORDINANCE OF THE CITY OF BONITA SPRINGS, FLORIDA; APPROVING A REQUEST BY BONITA FAIRWAYS RPD/MHPD TO AMEND THE MASTER CONCEPT PLAN TO DESIGNATE 0.44 + ACRES FOR SINGLE- FAMILY RESIDENTIAL USE; AND PROVIDE PROPERTY DEVELOPMENT REGULATIONS, NOT TO EXCEED 35 FEET/TWO STORIES ON LAND LOCATED AT 26771 BONITA FAIRWAYS DRIVE, BONITA SPRINGS, FLORIDA, (STRAP NO. 27-47-25-B3-00002.0000), ON 184.18 + ACRES; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Alagold Communities, Ltd. In reference to Bonita Fairways RPD/MHPD has filed an application to amend the Master Concept Plan to designate 0.44 + acres, for single-family residential use (3 dwelling units; and provide property development regulations, not to exceed 35 feet/two stories; WHEREAS, the subject property is located at 26771 Bonita Fairways Drive, Bonita Springs, Florida, and is described more particularly as: See Exhibit A WHEREAS, a Public Hearing was advertised and heard on February 4, 205 by the City of Bonita Springs Board for Land Use Hearings and Adjustments and Zoning Board of Appeals ( Zoning Board ) on Case DCI 2004-00081 who gave full consideration to the evidence available and recommended approval (6-0); and gave full and complete consideration of the record, consisting of the City Recommendation, the Zoning Board, the documents on file with the City and the testimony of all interested parties. The January 18, 2005 Staff Report prepared by Lee County Development Services Division and evidence submitted at the Zoning Board hearing is on file with the City Clerk. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Bonita Springs, Lee County, Florida: SECTION ONE: APPROVAL OF REQUEST City Council of Bonita Springs hereby approves the amendment to the Master Concept Plan with the following conditions: 1. The development of this project must be consistent with the three page Master Concept Plan entitled "Bonita Fairways: A Country Club Community," stamped received by the permit counter on November 12, 2004, last revised 11/02/04, except as modified by the conditions below. This development must comply with all requirements of the Bonita Springs LDC at time of local Development Order Approval, except as may be FAIRWAYS-RPD-MHPD-DCI-2004-00081.doc Page 1 of 5

granted by deviation as part of this planned development. If changes to the Master Concept Plan are subsequently pursued, appropriate approvals will be necessary. 2. The schedule of uses, Resolution Z-96-063A, is hereby amended by adding language to Condition Number 3, Residential Planned Development, of Section A. Conditions. The following uses are permitted: RESIDENTIAL PLANNED DEVELOPMENT ADMINISTRATIVE OFFICE CLUB, COUNTRY AND PRIVATE CONSUMPTION ON PREMISES (in conjunction with the clubhouse) RESTAURANTS, Groups I, II, and II (only within the existing clubhouse) SPECIALTY RETAIL SHOP, Groups I and II (only within the existing club house) DWELLING UNIT: Single-family, Duplex, Two-Family Attached, Multiple Family, and Townhouse ESSENTIAL SERVICE FACILITIES, Group I ENTRANCE GATE AND GATEHOUSE EXCAVATION, water retention FENCE AND WALL GOLF COURSE GOLF DRIVING RANGE (only in conjunction with a golf course) MODEL: Home, Unit, Display Center RESIDENTIAL ACCESSORY USES SIGNS, in conformance with the Lee County Land Development Code TEMPORARY REAL ESTATE SALES OFFICE (limited to sales of lots or units within this planned development) The Site Development Regulations, Resolution Z-96-063A, are hereby amended by adding language to Condition Number 4.a., of Section A. These areas are limited to Single-Family, Two-Family, Duplex, and Townhouse dwelling unit types. All four (4) story residential areas may be permitted a maximum height of 48 feet. Only the Multiple Family dwelling unit type may be four (4) stories in height. The Clubhouse may have a maximum building height of 40 feet. Maximum Lot Coverage: 40% 3. Single-family residential dwelling units are limited to a maximum of three (3) dwelling units on Parcel A as depicted on the Master Concept Plan. 4. The terms and conditions of Resolution Z-96-063A and Amendments thereto remain in full force and effect except as amended herein. 5. The entire project is limited to one single direct stormwater outfall to the East Terry Street right-of-way, unless as determined by the City Manager or his designee that additional and/or alternate outfalls are necessary. Deviations No additional deviations have been requested as part of the zoning action. Deviations approved by Resolution Z-96-063A remain in full force and effect. Findings and Conclusions: Based upon an analysis of the application and the standards for approval of planned development rezonings, City makes the following findings and conclusions: 1. The applicant has proven entitlement to the rezoning by demonstrating compliance with the Bonita Springs Comprehensive Plan, the Land Development Code, and other applicable codes and regulations. 2. The requested zoning, as conditioned: a) meets or exceeds all performance and locational standards set forth for the potential uses allowed by the request; b) is consistent with the densities, intensities and general uses set forth in the Bonita Springs Comprehensive Plan; c) is compatible with existing or planned uses in the surrounding area; and d) will not adversely affect environmentally critical areas or natural resources. 3. Approval of the request will not place an undue burden upon existing transportation or planned infrastructure facilities and the site will be served by streets with the capacity to carry traffic generated by the development. 4. Urban services, as defined in the Bonita Springs Comprehensive Plan, are, or will be, available and adequate to serve the proposed land use. 5. The proposed use or mix of uses is appropriate at the subject location. 6. The recommended conditions to the concept plan and other applicable regulations provide sufficient safeguards to the public interest. 7. The recommended conditions are reasonably related to the impacts on the public s interest created by or expected from the proposed development.
