SPRING VALLEY PROPERTY OWNERS & RECREATIONAL CORPORATION Policy Number 810 SVPORC PROPERTY RECREATIONAL REGULATIONS Effective January 1, 2010 I. GENERAL A. The Spring Valley subdivision includes four parcels of property containing bodies of water that are owned by the Spring Valley Property Owners and Recreational Corporation (SVPORC) that are held in trust for the enjoyment and recreation of eligible Spring Valley property owners in good standing. It is the responsibility of the SVPORC Board of Directors to insure the proper maintenance and preservation, as well as the legal use of these common properties for the benefit of Corporation members. The SVPORC properties are colloquially named Burgess Lake (lake, parking area, recreation area, pavilion, toilet, island), Shadow Lake (small lake), Potty Pond (small pond, small parking area), and Kiddie Pond (small pond). B. Corporation members in good standing, their Spring Valley household guests, and those renting short or long term residential properties in Spring Valley from a Corporation member in good standing may use the Corporation properties in accordance with Corporation guidelines. Individuals not included in the aforementioned list of qualifications are not eligible to use the Corporation properties and are trespassers on private property. Property owners are responsible for making sure they, as well as their guests and renters, are aware of the rules contained in this policy. II. SVPORC PROPERTIES A. SVPORC Association dues are mandatory for those wishing to access the SVPORC properties and until those are paid, no access is permitted onto any SVPORC property for owners, their guests, and/or renters. B. Individuals renting property outside of Spring Valley where the same property owner has property in Spring Valley, such individuals are NOT permitted access to any SVPORC property or permitted to fish in Spring Valley. C. Trash removal is required of all persons using SVPORC properties. D. All dogs must be leashed while on SVPORC property and droppings cleaned-up by the dog owner. E. It is the responsibility of parents to ensure the safety of their children while on SVPORC property. F. No motorized vehicles of any kind are permitted on trails, ice covered lakes/ponds, dams or SVPORC property unless otherwise specifically permitted by the Board of Directors. G. No overnight or unattended parking (including boat trailers) is permitted in the pavilion parking lot or on any other SVPORC property. Unattended parking is defined as any vehicle or trailer left in the parking areas while the owner or user is not involved in the active use of the SVPORC properties. H. No hunting, trapping or discharge of firearms is permitted on any SVPORC property unless specifically permitted by the Board of Directors. I. Any unsafe, disrespectful or disruptive activity will result in removal from SVPORC property and may result in loss of privileges. J. Swimming and wading is not permitted in any lake or pond at any time. K. No throwing of rocks, sticks or any other object on the ice/water is permitted. L. The Board of Directors may vote each year to approve to assign one individual to perform SVPORC property upkeep. That individual and one specified family member living in their household would receive free annual fishing. a. Plowing the Pavilion parking lot during the winter months but only for Board sanctioned events and only if required for said event. b. Drilling for ice thickness during the winter months and reporting to the Lakes and Fishing Committee. c. Periodic grass mowing during the summer months around the Pavilion and around Potty Pond in preparation for the Kids Fishing Derby. III. ICE SAFETY A. Before entering onto a frozen lake or pond, it's important to take safety precautions to reduce the risk of falling through the ice. Substantial risk is involved whenever traversing ice. Colorado Parks and Wildlife has general guidelines on their web site at: http://cpw.state.co.us/learn/pages/icefishingsafety.aspx B. The SVPORC Board of Directors shall appoint one individual to drill and monitor ice thickness on Burgess Lake and Potty Pond during ice-over. That appointee shall report that information to the Lakes & Fishing Committee throughout the season. C. Once the ice thickness measures a minimum of (8) eight inches, the Committee can make a recommendation to the Board that the ice exceeds the minimum safe thickness as defined by Colorado Parks and Wildlife as 4 minimum for walking, 6 minimum for ATVs and Snowmobiles and 8 minimum for cars and small pickups. D. The Board shall then vote to allow access. Once the green flag is attached to the flag pole on the island in Burgess Lake, access is permitted. However, individuals should still proceed on ice with caution as it is each individual s responsibility to decide whether it is safe to proceed. E. Once conditions are found questionable, regardless of ice thickness, the Board shall vote to close access on the ice and have the red flag attached to the flag pole below the American Flag on the island in Burgess Lake. Access is not allowed until the green flag is flown. IV. ICE SKATING A. Ice Skating varies based on depth of ice, and is only permitted on Potty Pond. The green flag below the American Flag on the island in Burgess Lake is the signal to know when skating is permitted. However, skaters should still proceed on ice with caution. B. Removal of snow from the ice for ice skating by means of an ATV with plow will only be allowed if the Board has received and approved a signed waiver of liability from the person performing such activity. This waiver shall release and hold harmless SVPORC, its Board and its members from any claim of injury to self or damage to personal or SVPORC property. Any cost associated with injury or damage resulting in such activity shall be the sole responsibility of the person performing such. V. BOATING A. All boats must be registered with SVPORC by calling 686-1825. Registration is free. Any unregistered boats will be considered abandoned and property of SVPORC. B. Boating is only permitted when there is a green flag flying under the American flag on the island (typically May 1 October 31). Boats are only permitted on Burgess Lake. C. Boating times are ½ hour before sunrise and ½ hour after sunset. No night boating is permitted. D. Paddle boats must be anchored down and locked when unattended. E. All boaters age 18 and under are required to wear the correct size USCG approved personal flotation device (PFD) at all times when in a boat. All other persons are required to have the correct size USCG PFD on board and within reach while boating, It is strongly recommended that everyone wear their PFD, and remain seated at all times while boating. F. Only electric trolling motors are permitted, no gas motors are permitted at any time. G. All boaters are required to give bank fishermen a wide berth to prevent tangling fishing lines with boats. H. Boats may only launch from the ramp near the pavilion. I. If a boat is used on other lakes or waterways, Spring Valley authorized users must help to ensure that they prevent the spread of non-native/invasive aquatic fish, animal & plant species. Boat owners are required to clean, drain and dry their vessel before transporting it between different bodies of water under Colorado law. VI. FISHING A. Residents with their annual fishing dues and association dues paid are not required to pay the daily fishing fee; however, the same rod and catch maximums apply. Refer to the Fishing Fees and Limits at the end of this policy. B. CORPORATION MEMBERS MUST ACCOMPANY THEIR GUESTS WHEN FISHING OR THE GUEST MUST HAVE A VALID ONE DAY FISHING PASS OR THE GUEST MUST HAVE THE SPECIAL ACCESS PERMIT ON THEIR PERSON AND PAY THE DAILY FISHING FEE. a. If a Fish Patrol Volunteer is not available to collect the daily fees, the Property Owner should make every effort to collect the fee and provide it to a Fish Patrol Volunteer or Board Member, even if on a later date. b. Paid Corporation Members with short-term rental properties (a residential property that is rented to a visitor for less than 30 days) in Spring Valley wishing to allow access for their renters without the property owner being present, must purchase a Special Access Permit that must be in the possession of the renter while fishing in addition to them paying the required daily fishing fees. c. Paid Corporation Members with long-term rental properties (a residential property that is rented to a visitor for 30 concurrent days or more) in Spring Valley will not be required to purchase a special access permit nor accompany their long-term renter but shall, in writing, submit proof of the duration of the long-term rental and the names of their renters. The long-term renter can then pay the annual or daily fishing fees. d. In lieu of a Special Access Permit, Paid Corporation Members can purchase One Day Fishing Passes ($10/each) from Dick Cope or Shaun Gordon in advance. Those passes can then be given to guests to use as payment for fishing without the Property Owner being present. If the Property Owner is not present and the Guest does not have a Special Access Permit every person fishing, no matter the age, must provide a One Day Fishing Pass as payment. C. Fishing is only permitted when there is a green flag flying below the American flag on the island in Burgess Lake. D. Fishing times are ½ hour before sunrise and ½ hour after sunset. Night fishing is prohibited. E. The use of minnows for bait, chumming and seining is prohibited per Colorado Law. F. No cleaning of fish in the lake, ground around the lakes or in the restroom is permitted. G. No other individual can fill another person s daily catch. H. Catch & Release will be permitted on a trial basis. Any fish released upon catch must be released alive and active. If the fish is hooked deep in the throat or stomach, cut the line as close to the hook as possible and leave the hook in the fish. If we experience floaters (fish kill), catch & release will again be prohibited. I. Ice fishing varies based on depth of ice, and is only permitted on Burgess Lake. Even if the green flag is flying below the American flag on the island users must still proceed on ice with caution and at their own risk. J. No ice fishing holes can be more than 10 inches in diameter, or 10 inches square. K. No ice fishing is permitted 50 feet from the face of the dam or 50 feet from the creek entrance on the south end of Lake Burgess. L. Ice huts may be used, but must be removed daily. M. No fires are permitted on Spring Valley lakes or ponds. VII. FISH PATROL A. Fish Patrol volunteers monitor activities within the SVPORC properties. This includes enforcing SVPORC rules and regulations as well as collecting fishing dues. B. An individual that volunteers for one day a week throughout the summer fishing season is provided the benefit of free annual fishing for that year. In addition, one family member living in their household is provided the same benefit. That additional family member must be identified when you sign up for volunteering. It is not considered a floating free fishing pass; it is specific to one family member living in their household. C. If a volunteer becomes unable to perform their duties or Lakes and Fishing Committee finds that a volunteer continues insufficient performance of their duties after one warning, the free fishing privileges described above will be revoked. If that individual wishes to continue to fish, the Lakes and Fishing Committee will make a recommendation to the Board of Directors on prorating the annual fishing fee based on the time of the year and any other pertinent circumstances. The Board of Directors will then provide their final judgment on a case by case basis. D. An individual can also volunteer to be a substitute when our regular patrol is unavailable. The substitute individual will be allowed to fish for free the day they are substituting for the fish patrol and will also receive (2) two one day fishing passes. E. The Lakes and Fishing Committee may recommend to the Board of Directors for approval each year to assign one individual to perform Fish Patrol duties during the winter (ice fishing) months. That individual and one specified family member living in their household would receive free annual fishing. F. If you are interested, contact Dick Cope at 687-8931. Annual Fishing Permit Prices for Spring Valley property owners that have paid their association dues (This eliminates property owners and their children from having to pay daily fees.) Must complete the Fishing Permit Application with all names. Adults $125 each Couples $175 each 19-21 (adult children living at home) $ 75 each 11-18 (children living at home) $ 35 each 10 & under Free with paid adult present Family Rate (2 adults & 2 children under 18) $225 * If someone is renting property outside of Spring Valley and the same owner has property in Spring Valley, they are NOT permitted access to any SVPORC property or fishing in Spring Valley. **SVPORC Association dues are mandatory for those wishing to access the common properties and until those are paid, no access is permitted onto any SVPORC property for owners, their guests, and/or renters. *** A long-term rental is defined as a property that is rented to a visitor for a minimum of 30 consecutive days. **** One Day Fishing Passes can only be purchased from Dick Cope or Shaun Gordon in advance and is not available from the Fish Patrol. III. ENFORCEMENT PROCEDURE Any violation of this Policy may result in loss of SVPORC property use, boating and/or fishing privileges. IX.
