LED/1417 FLORENCE MIDDLE SCHOOL FFE PACKAGE October 1, 2018 SECTION 12 06 40 FURNISHINGS AND ACCESSORIES PART 1 GENERAL 1.1 General Conditions: The Owner is the Florence City School System. A. The Owner reserves the right to decline all RFPs and not award the Project, or any portion thereof. The Owner may also elect to delete some items from any accepted Proposals, or to request pricing to add other items to any accepted Proposal based on the same pricing structure for bid items. B. Products are to be scheduled for delivery to the project site and for commencement of installation on Monday, January 28, 2019 unless otherwise directed by the Architect or Owner in writing. The Owner reserves the right to extend the date further into the calendar year. Work is to be completed (within fifteen (15) business days from the time the installation begins) by February 15, 2019, or as may otherwise be directed by the Owner. C. Drop shipments at the site are acceptable, but must be coordinated with the Architect and Owner and documented via written confirmation. D. Products not "drop shipped" are to be stored by the Installing Dealer, at no cost to the Owner, and delivered to the site as per Paragraph 1.1.B. E. All deliveries to the project site are subject to access restrictions as may be determined by the General Contractor for construction of the building. F. Prospective bidders must be on the "State Examiners of Public Accounts" approved list or on a "State of Alabama Purchasing Contract." G. The Owner will pay all invoices via credit card, but will not pay a credit card fee for any charges. If alternative methods of payment are required by an Installing Dealer, they must be clearly stated in the bid proposal in a cover letter addressed to the Owner. H. Prior to commencing with the installation of any items, each Installing Dealer will be required to submit an itemized list of pre-existing damage in the building, as per Paragraph 3.1.E. I. The terms "Request for Proposal," "RFP," "Bid," and the like, shall be construed to be one and the same and may be used interchangeably. J. The FFE Package "Vendor Lists" are subdivided into categories. 1. Dealers are not required to submit proposals for all categories. 2. Dealers are not limited limited to any particular category. 3. Dealers may submit proposals for any or all of the categories. 4. Dealers must submit proposals for complete categories, including all of the items in the category. Dealers are to fill out individual Vendor Lists in their entirety (dealer name/address/contact information, unit prices, extended prices, shipping and/or installation prices (where applies), order total) and submit with their proposals. 6. Dealers are to note and include on Vendor Lists any additional items required and cost for same to provide a complete installation, as per the Specification. 7. Dealers are to fill out the Vendor List Log in its entirety for the applicable Vendor Lists for which they are submitting pricing. K. Submit questions or requests for additional information to the Architect in writing. 1.2 Related Documents: Specifically reference the Vendor Lists and the Furniture, Fixtures, and Equipment Plan (FFE Plan) Drawings: FFE 1 - FFE 8, dated 10-1-18. 1.3 Description of Work: A. Provide all labor, materials, tools, equipment, accessories and incidentals to install complete in every respect the FFE Package as shown on the plans and as described herein. B. The FFE Package shall include, but is not limited to, the following Section 12 06 40 requirements, Vendor Lists, and the project Drawings relating to existing and new Furnishings and Accessories. C. The terms "Furniture, Fixtures, and Equipment" and "FFE Package" and "Furnishings and Accessories" shall all be construed to be one and the same and are used interchangeably. D. Where the terms "Contractor" and "Installing Dealer" and "Dealer" are used, any and all requirements of the one shall also apply to the others. E. Where the terms "Contractor" and "Installing Dealer" and "Dealer" are used, they shall be construed to be one and the same unless specifically distinguished from one another or specifically noted otherwise. 1.4 Contractor's Qualifications: The Contractor must have successfully completed at least five other projects of a similar nature, the dollar value of each being at least 75% of the dollar value of this project. The Contractor must also maintain a full-time service department with service contracts for work installed, from a shop within 100 miles of the work, or must provide proof of a written service agreement with a firm meeting the above qualifications. 1.5 Responsibility of Bidders: A. Bidder shall examine all drawings and specifications issued and the Site of work. Bidders should be familiar with the character of work, coordination required with other trades, and any other conditions that affect the completion of this work. No consideration will be given at a later date other than that outlined herein, for any alleged misunderstanding as to the requirements of work, materials to be furnished, or any special requirements due to the nature of the job site. B. Items obviously omitted from the plans and specifications by oversight or error shall be called to the attention of the Architect before submitting bid. C. For products specified by naming only one product and manufacturer, there may be an option of an Architect approval of a product of an equal or greater quality. D. Substitutions: Contractor's Base Bid shall be per contract documents. 1. Substitutions will not be accepted without prior written approval of the Architect. Requests for substitutions must be submitted in writing to the Architect no more than five (5) business days prior to bid date. Burden of proof of equality of product rests solely with the bidder. LED/1417 address the compliance of proposed substitute products, will be rejected by Architect without comment. 2. Submit a separate request for each substitution. Support each request with: a) Complete data substantiating compliance of proposed substitution with requirements stated in contract documents. b) Product identification, including manufacturer's name and address. c) Manufacturer's literature, identify: (1) Complete product description, listing all features included, illustration, and actual finish samples, if different from those specified. Product sizes must also be provided. (2) Reference standards. (3) Performance and test data. (4) Name and address of similar projects on which product has been used. (5) Itemized comparison of the proposed substitution with product specified; list significant variations. (6) Any effect of substitution on separate contracts. (7) List of changes required in other work or products. (8) Designation of availability of maintenance services and sources of replacement materials. (9) Provide certification of product compatibility with adjacent materials. (10) Provide the actual sample of the proposed substitute which is like, in all respects, the specified item, if requested by the Architect. 1.6 Scope of Work: The Work shall include the furnishing of furnishings, systems, accessories, equipment, and materials specified in this Division and on the Vendor Lists to include: product, supervision, operation, methods, and labor for the fabrication, installation, tests, and final adjustments for the complete Furniture, Fixture, and Equipment (FFE) installation, and instructions to the Owner for the use of all items - chair adjustment features, etc. A. Drawings for the Work are diagrammatic, intended to convey the scope of the Work and to indicate the arrangement and locations of the Work. Because of the scale and nature of the Drawings, certain basic items such as top caps, connectors, bases, and conduit may not be shown. This Contractor shall be responsible for selecting nonspecified items required for a complete installation in accordance with the Contract Documents. This Contractor shall be responsible for providing and/or modifying equipment to fit the space provided. The location and sizes for FFE items and other basic items required by code and other sections shall be coordinated and included for the proper installation of the work. B. FFE Specification may not deal individually with minute items required such as components, parts, controls, and devices which may be required to produce the product performance specified or as required to meet the product warranties. Where such items are required, they shall be included by the supplier of the product, whether or not specifically called for in the Contract Documents. C. Where the word "provide," "furnish," "include," or "install" is used in the Specifications or on the Drawings, it shall mean to furnish, install, and test complete and ready for operations, the items mentioned. If an item is indicated in the Contract Documents, it shall be considered sufficient for including same in the Work. D. Where noted on the Drawings or where called for on the Vendor Lists, the Contractor for this Division shall install equipment in coordination with items furnished by Others, and shall make required service connections where applicable. Contractor shall verify with the supplier of the equipment the requirements for the installation. FURNISHINGS AND ACCESSORIES 12 06 40-3

Where items are noted as "keyed," "keyed alike," or "with lock," all lockable items within the same space, provided from the same manufacturer, are to be keyed alike, unless specifically designated otherwise by the Architect. F. Where "felt floor protectors," "felt glides," or similar items are listed in the product description, they are to be provided and installed by the Installing Dealer, whether or not they are a standard feature for the product item and whether or not they are provided by the manufacturer. 1.7 Codes and Standards: Conform to latest edition of governing codes, ordinances, or regulations of city, county, or state having jurisdiction. Include other Codes and Standards as individually referred to in the Technical Sections of the Specification. 1.8 Site Inspection: Contractor shall inspect the site and Drawings to familiarize himself with conditions of the site and requirements of the Drawings which will affect his work and shall verify points of connection with building features, data and power, routing product through building to include required clearances from any existing structures, and obstacles, protection of floors, coordination with the General Contractor for Construction for building access, etc. A. Extra payment will not be allowed for changes in the Work required because of Contractor's failure to make this inspection. 1.9 Wiring for Equipment: Data and/or electrical connections required for a complete and operable installation shall be provided by the Owner in coordination with this Contractor where such requirements are indicated on the Drawings and/or on the Vendor Lists. 1.10 Protection: Special care shall be taken for the protection of equipment furnished and the site. Equipment and material shall be completely protected from weather elements, painting, plaster, etc. until the project is completed. Damage from rust, paint, scratches, etc. shall be repaired as required to restore equipment to original condition. A. Where the installation or connection of equipment requires work in areas previously finished by other Contractors, the area shall be protected and not marred, soiled, or otherwise damaged during the course of such work. Contractor shall arrange with the other Contractors for repairing and refinishing of such areas, which may be damaged. B. Where the installation of equipment requires the transfer of heavy items and loaded dollies over finished flooring, temporary protective underlayment to prevent face damage and 1/2" plywood to prevent stress fractures shall be provided covering the entire trafficked area. PART 2 SUBMITTALS 2.1 General: Submit to the Architect within 30 days of Letter of Intent to Award Contract: A. Submit a minimum of three copies of FFE installation schedule and project conditions required for installation. B. Submit, upon completion of the work, copies of all product warranties and maintenance instruction for delivery to the Owner. 2.2 Operating and Maintenance Manuals: A. Provide three up-to-date copies of warranties, guarantees, specific operating and maintenance instructions, and actual finishes used on the Project in manuals for each FURNISHINGS AND ACCESSORIES 12 06 40-4

LED/1417 of the manufacturer's product groups. Include names, addresses, phone and fax numbers, and contact persons for each manufacturer and the designated service provider. B. Provide legible submittals made by permanent reproduction copy equipment from typewritten or typeset originals. C. Pre-punch and assemble 8-1/2 inch x 11 inch sheets for standard three ring binders; insert in hardback binders and label binders. D. Submit larger sheets folded or in rolled and protected packages. 2.3 Substitutions and Product Options: For products specified only by reference standard, select product meeting that standard, by any manufacturer, subject to Architect's approval. Burden of proof is upon the company proposing the substitution. All relevant information must be provided to the Architect to evaluate proposed substitutions. A. For products specified by naming specific products by specific manufacturers, proposed equal substitutions will be considered, unless specifically noted otherwise. B. For products submitted as "or equal," select products and manufacturers complying with all specifications. C. Products from "Dixie Tile and Carpet," "Sam's Club," and "Commercial Millwork and Specialty Company" may not be substituted, but are available to all bidders at the same price. Products and installation services to be provided from Dixie Tile and Carpet and Commercial Millwork and Specialty Company have been worked out between the vendors and the Architect. Pricing may be obtained directly from the vendors. Products from Sam's Club are in their standard product line as posted on their website. D. See Paragraph 1.5.D. E. Substitutions must comply with all of the specified manufacturer's standard features for an item, whether or not they are specifically listed in the item description. PART 3 EXECUTION 3.1 Pre-Installation Meeting: A. Two weeks (minimum) prior to the start of FFE installation or delivery of FFE to the project site, schedule and conduct a meeting with the following persons: Architect, General Contractor's Project Manager and Job Superintendent, Owner's Representative(s), FFE Contractor's Project Manager and Job Superintendent, and any other persons whom the Architect, General Contractor, Owner, or FFE Contractor request to attend. B. Critical installation coordination issues (such as working points, elevator access, building hours, code requirements, clearances, drawing notes, grommet installation, cord management, etc.) shall be reviewed. C. "Job standards" for finished product and installation items (such as building access coordination with other dealers or subcontractors, floor protection, documenting any building damage, attaching overshelf units to desks/credenzas, trash removal, item preparation and cleaning, locks/keying, Owner training, etc.) shall be reviewed. D. Other coordination and scheduling items shall be discussed as required or requested by participants. E. Prior to commencing work, each Installing Dealer shall submit to the Architect a written list documenting any building damage which could possibly be construed to be caused by their crews. Specifically, items such as damage to floors, doors, door frames, walls, etc. in the path of travel or rooms where the Installing Dealer will be working are to be FURNISHINGS AND ACCESSORIES 12 06 40-5

LED/1417 listed. Prior damage not listed will be subject to the General Contractor for construction making repairs according to the terms of his contract and invoicing the Installing Dealer. Commencement of work by the Installing Dealer shall be construed as acceptance of the building conditions. 3.2 Finishing: General: Prior to acceptance of the installation and final payment of the Contract, the Contractor shall perform the work outlined herein. A. Cleaning: At the conclusion of the construction, the site and structure shall be cleaned thoroughly of all debris and unused materials remaining from the FFE installation. All closed off spaces shall be cleaned of all packing boxes, wood frame members, and other waste materials used in the installation. B. All labels, stickers, tags, strings, protective coverings, etc., shall be removed from all fixtures and equipment. (Do not remove permanent name plates, equipment model numbers, ratings, etc.) 3.3 Tests and Demonstrations: Equipment shall be tested and placed in proper working order prior to demonstrating systems to Owner. A. Prior to acceptance of the FFE installation, demonstrate to the Owner or his designated representatives, all essential features and functions of all systems installed, and instruct the Owner in the proper operation and maintenance of such systems. The contract shall allow for five (5) working days to perform the demonstrations. B. Provide necessary trained personnel to perform the demonstrations and instructions. Provide manufacturer's representatives for systems as required to assist with the demonstrations. C. Dates and times for performing the demonstrations shall be coordinated with the Owner. 3.4 Anchoring of Furniture: Anchor furniture items such as overshelf units to other furniture items such as desks only after Owner and Architect have approved the final room set up containing such items. Anchor furniture items in such manner that they may be removed and relocated at a future date without damaging furniture. 3.5 System Guarantee: Work required under this Division shall include a one-year guarantee, or longer, as may be provided by specific manufacturers. Guarantee by Contractor to Owner to replace for Owner any defective workmanship or material, which has been furnished under contract, at no cost to the Owner for a period of one year from date of acceptance of systems. Guarantee shall also include all reasonable adjustments of systems required for proper operation during guarantee period.
