THE CORPORATON OF DELTA BYLAW NO. 2155 A Bylaw to regulate the discharge of Firearms i t 1. The Munic,ipal Council of The Corporation of Delta, in open meeting assembled hereby ENACTS AS FOLLOWS: This Bylaw may be cited as the "DSCHARGE OF FREARMS REGULATON BYLAW NO. 2155, 1974". 2. For the purposes of this Bylaw the word: "Firearm" means a rifle, pistol, or shotgun and includes air guns, air rifles, air pistols spring guns but does not include weapons used for the discharge of blank ammunition in connection with an athletic or sporting event. 3. "Public Highway" means highway as defined in the '''Municipal Act". Amend, BL 2286, 1975 4. 5. The provisions of this Bylaw shall not apply to Peace Officers required to use firearms in the line of duty. No person shall discharge a firearm within or into those areas prohibited to the discharge of firearms ljis shown on Schedule "A" attached hereto and as hereinafter provided. 6. No person shall discharge a firearm utilizing a single projectile within the Municipality except as specifically provided under Section 7 and Section 8 hereof. 7. A permit to allow the discharge of firearms within the Municipality shall be required: for the operation of a pistol, rifle, trap and/or skeet shooting range, and for an organized trap or skeet shooting event not located on a shooting range permitted to operate under this bylaw, and f when the discharge of firearms is to be conducted by a person who is the holder of a valid resident trapping licence and a resident hunting or firearms licence issued by the Province of British Columbia who has produced written permission from the owner or the lessee of the lands upon which he proposes to operate his trap line. A permit for the discharge of firearms may be issued providing the applicant is covered by an existing public liability and property damage insurance policy in the minimum amount of $100,000.00 validated for the duration of the permit.
Amend. BL 3074, 1980 8. Notwithstanding Sections 6 and 7 hereof, but subject to the Migratory Birds Convention Act, the Wildlife Act and regulations thereto, a person may discharge firearm within the Municipality without first obtaining a permit therefor when: he is engaged in a farm operation and the firearm is discharged for the purpose of protecting his crops or livestock from birds or animals; he is engaged in the humane destruction or slaughter of domestic livestock, or he is engaged in a commercial slaughterhouse operation, or (d) he is engaged in shooting on a pistol, rifle, trap or skeet shooting range duly authorized by a permit pursuant to Section 7 of this Bylaw. f' ; Amend. BL 2286, 1975 BL 5058, 1993 9 Notwithstanding the provisions of Section 7 hereof, a person may, subject to 11.1, outside those portions of the Municipality shown as prohibited to the discharge of firearms on Schedule "A", which said schedule is hereto annexed and made part of this Bylaw, during that period of each year when the hunting of wildlife or waterfowl may be carried out in accordance with the laws of the Province of British Columbia and where that person is a holder of a valid and subsisting licence issued by the Province of British Columbia and as required. by the laws of the said Province and of Canada for the hunting and killing of such wildlife, discharge firearms therein without the necessity of obtaining a permit therefor pursuant to this Bylaw. 10 Notwithstanding any provisions of this Bylaw, no person shall discharge, within the limits of the Municipality, any firearm within 150 yards of any school building, school yard, public park, playground, church, workshop, place of business, dwelling house, farm building, public highway, or other place where persons may be assembled or engaged in work of any kind. 11 No person shall discharge a firearm within the Municipality on a Sunday, except: 6334, 2005 when the discharge is for those purposes defined under Section 8 of this Bylaw. 5058, 1993 Paragraph (bj. deleted. Amend. BL 5058, 1993 11.1 Dykes and Littering This Section applies to any dyke and foreshore adjacent to a dyke in the Municipality, except a private dyke, and adjacent foreshore on Westham sland. No person shall discharge a firearm while on a dyke or between a foreshore dyke and the highwater mark of the adjacent foreshore for any purpose including but not limited to target shooting, shooting practice.or hunting unless, in the case of hunting, it is during the period of the year when the hunting of wildlife or waterfowl is authorized as described in Section 9.

'li Any person using a dyke or foreshore shall collect and retain any expended shells, casings and litter of any kind associated with the person using the area described in this section; or any area of the Municipality where the discharge of a firearm is authorized. 7199,2013 7199,2013 (d) No person shall discharge a firearm towards land in the areas designated as "no discharge towards land" on Schedule "A" attached hereto and forming part of this Bylaw.. The area designated as "no discharge towards land" shall be a 180 metres wide strip measured from the waterside toe of the dike towards Boundary Bay. 12 Every person who violates any of the provisions of this Bylaw, or who suffers or permits any act or thing to be done in contravention or a violation of any of the provisions of this Bylaw, who neglects to do or refrains from doing anything required to be done by any of the provisions of this Bylaw, or who does any act which violates any of the provisions of this Bylaw, shall be guilty of an infraction thereof and upon summary conviction therefor shall be liable to a fine and penalty not exceeding Five Hundred Dollars ($500.00), or in default, payment thereof, or in the alternative, to imprisonment for a period of time not exceeding sixty (60) days. 13 Bylaw No. 1816 cited as "Delta Regulation of Firearms Bylaw No. 1816, 1972" and Bylaw No. 1931 cited as "Delta Regulation of Firearms Bylaw No. 1816, 1972 Amendment Bylaw No. 1931, 1972" are hereby repealed.
