Terms and Conditions Definitions Audit Audit Report Hunter Water Rainwater Tank Survey Program Residential Customer Our or We or Hunter Water Program Property Service You Rainwater audit undertaken at your property to determine the condition and effectiveness of the rainwater tank system installed. The report given to you outlining the results as described in Clause 2 of Hunter Rainwater Tank Survey Audit. Rainwater audit offered to selected eligible Residential Customers. An owner occupier Residential Customer invited to participate in the Hunter Water Rainwater Tank Survey Program who accepts the Terms and Conditions of the Program. Hunter Water Corporation, its employees or contractors who perform the Service where appropriate. The Hunter Water Rainwater Tank Survey Program The property where the Service is delivered or provided. The Hunter Water Rainwater Tank Survey Audit provided to you as part of Hunter Water s Rainwater Tank Survey Program. The Residential Customer who is an owner occupier of the Property and who registers for the Service. The following terms and conditions apply to Hunter Water s Rainwater Tank Survey Program (the Program). Please read them carefully. 1 Eligibility 1.1 To be an eligible participant you must meet the following criteria: a) The property owner is occupied and located in Cameron Park or Fletcher suburbs b) The property must have a rainwater tank c) The property must have an authorised or approved connection to a water main owned by Hunter Water d) The property has not previously had a Service. 2 Hunter Water s Offer 2.1 Hunter Water will arrange for a qualified plumber to: a) Undertake an audit of the rainwater tank b) Provide an audit report detailing the results of the audit including recommended works for the Property and indicative rectification costs. 2.2 Hunter Water will conduct the Audit and the Audit Report free of charge for up to 200 registered participants. a) The Hunter Water Rainwater Tank Survey Program does not include rectification works b) Hunter Water does not warrant any works undertaken as recommended in the Audit Report 3 What You need to do to request a Hunter Water Rainwater Tank Survey Audit a) Register your request for an Audit appointment with Hunter Water by filling in the Rainwater Tank inspection form on Hunter Water s webpage or at a Hunter Water Customer Centre b) Agree to the Terms and Conditions of the Program see clause 3(d) below c) Be at the Property and accompany the plumber throughout the Audit. The time of the Audit will be arranged with you d) Sign the Audit Report Form provided to you by the plumber at the Audit to declare that: i. Permission is granted for the plumber to enter the Property ii. iii. You have read, understood and accept the Terms and Conditions of the Program You are the owner of the Property or have authority to sign the form on behalf of the owner/s of the Property in their absence. 4 Gift Cards 4.1 Gift card eligibility a) Hunter Water agrees to provide a $30 Coles Myer Gift Card to those Customers who participate in the post audit online survey conducted in late 2014. b) Only one gift card per completed Audit will be provided c) Participants are only entitled to one gift card Hunter Water Rainwater Tank Study 3
5 What your agree to do in return 5.1 Allow Hunter Water employees, contractors or representatives to a) Enter your property to carry out the necessary Audit b) Collect information at the time of the Audit and in the post Audit survey c) Use up to 200L of potable/rainwater tank water during the Audit at Your cost d) Given consent for Hunter Water employees, contractors or representatives to contact you in regard to the Audit procedure and completion for up to 12 months following the Audit being conducted. 6 Provisions and Exclusions a) Hunter Water will provide one (1) Hunter Water Rainwater Tank Audit and report per Property b) Rectification works are not included in the Audit and Hunter Water is not responsible for implementing recommendations or actions arising from the Audit Report c) Nothing in these terms and conditions will be taken to affect any statutory entitlement or any statutory obligation that we have to you for any condition or warranty implied by the Trade Practices Act 1974. In the event that we are liable for such a breach or condition, our liability to you will be limited to the supply of another Service or the payment of the cost of having another Service d) All other liability is excluded e) This document is not itself a Customer Contract as defined in the Hunter Water Act 1991. f) You indemnify and release Hunter Water from any claim that you have as a consequence of Hunter Water providing You with the Service g) Any person undertaking work under the Program will not enter any confined space (confined space has the same meaning as in the Work Health & Safety Regulation (2011) (NSW)) 7 Program Changes 7.1 Hunter Water may in its sole and absolute discretion and at any time, change any or all of these Terms and Conditions or cancel all, part or parts of the Program before 30 September 2014. 7.2 If Hunter Water cancels all, part or parts of the Program, without limiting your rights in relation to defective Service and Your obligations under clause 5, Hunter Water will have no further obligation to ensure that a Service, whether commenced or not, is carried out or completed. 8 Privacy Notice 8.1 Hunter Water in accordance with the Privacy and Personal Information Protection Act 1998 (NSW) ( PPIP Act ) collects and manages the personal information you provide. Where it is necessary to provide personal information and any additional services to you in relation to the Service, the information may be provided to contractors employed by Hunter Water. To ensure this protection of your information these contractors are also bound to comply with the requirements of PPIP Act.
