Pool Rules Guarded Hours: Daily 10:00 am 9:00 pm (Memorial Day Weekend through start of New School Year) (note: during swim team season, Mon Fri, Guarded Hours begin at 11 am; after start of School Year Labor Day weekend: Mon Fri; 4:30 pm 6:30 pm; Sat: noon 8 pm; Sun: noon 7 pm) Unguarded Hours: Daily 7:00 am 10:00 am and 9:00 pm 10:00 pm (see note above for specifics) 1. Swim at your own risk. 2. Lifeguards and all adult members of the neighborhood have the authority and the responsibility to enforce all rules and, if necessary, to remove anyone from the pool / pool area that is not a paying FULL Member of the Association, is not compliant with the rules or, in the discretion of the lifeguard or any adult member is otherwise jeopardi zing safety. Issues should be brought to the prompt attention of the lifeguard, any board member or the management company. 3. There will be a 10 minute adult swim at the end of each hour (eg. 12:50-1:00). Children under the age of 18 must be out of the pool during adult swim. Infants 2 or under may accompany a parent during this period. 4. Questions for the lifeguard should be held until the adult break. 5. Children (of a member family) between the ages of 10 to 13 may take an annual swim test (swim two laps, tread water for 1 minute), and with parents written consent, be allowed to enter the pool alone during guarded hours only. A list will be kept by the lifeguards with the names of the children that have passed this test. 6. Children (of a member family) under the age of 10, or those 10 to 13 years who have not passed the swim test, must be accompanied by an adult or babysitter 16 years of age or older. 7. Guests under the age of 13 must be accompanied by an adult. 8. An adult swim lane will be available upon request at the discretion of the lifeguard. 9. The lifeguard s job is not to baby-sit. Lifeguards are present for the safety of the pool, pool area and pool maintenance. 10. Items left at the pool are not the responsibility of the lifeguard/hoa and periodically will be donated to charity. Unguarded Hour Rules: 1. To enter the pool during unguarded hours, you must be at least 18 years old or be accompanied by a parent or adult (18 or older). Specific written consent is required for minors (of a member family) to be supervised by anyone other than their parents. 2. Swimming under the influence of alcohol or drugs is prohibited. 3. The door to the phone room must remain unlocked. If the phone is not accessible, the pool is closed. 4. Private parties are not allowed without the supervision of a lifeguard (See private party rules). General Rules (apply during all hours of operation) 1. Violations of any of these rules by a member may result in immediate suspension of pool use and a fine(s) may be assessed. Duration of suspension (and/or amount of fine) is the discretion of the Highland Park Board of Directors per Amended Bylaws, Article V. 2. Lifeguards and all adult members of the neighborhood have the authority and the responsibility to enforce all rules and, if necess ary, to remove anyone from the pool / pool area that is not a paying FULL Member of the Association, is not compliant with the rules or, in the discretion of the lifeguard or adult member is otherwise jeopardizing safety. Issues should be brought to the prompt attention of the lifeguard, any board member or the management company. 3. Use of the pool facilities shall be restricted to the designated hours of operation. Swim at your own risk. 4. No diving, flipping or jumping backward into the pool. 5. No running, pushing, or rough-housing. 6. No tag games are allowed on the pool deck. 7. No piggy-back games, including chicken fights. 8. Non-swimmers using flotation devices other than a U.S. Coast Guard-approved life vest must be accompanied by an adult while in the water. < Continued on Next Page >

General Rules Continued: 9. Individuals who are not potty trained and children under the age of 3 are not permitted in the pool without rubber or plastic swim pants over cloth diapers. Individuals over the age of 3 that are still not fully potty trained must wear rubber pants or plastic swim pants over cloth diapers. Individual parents are responsible to use their best judgment to determine that their child is fully potty trained after the age of 3. Disposable diaper materials will harm the pool filtration system. Disposable swim diapers will only be allowed if they are completely covered by rubber or plastic swim pants. A parent of any child under 3 that does not have rubber or plastic swim pants over their child's diaper will be asked to remove their child from the pool and put on the rubber or plastic swim pants before being allowed to reenter the pool. A parent of any child with disposable diapers that are not fully covered by rubber or plastic pants, will be asked to remove their child from the pool and completely cover the disposable diapers before being allowed to reenter the pool. 10. No coins or very small objects allowed in the pool. 11. Tennis or other hard balls are not allowed for pool use. 12. No food or drinks allowed in the pool. Any food or drink items must be disposed of properly, to include washing down any spills. No glass containers are allowed in the pool area. 13. No pets/animals, skateboards or frisbees are allowed in the pool area. 14. No public intoxication. 15. Admission to the pool may be refused to anyone with an infectious disease, sores, or rashes. 16. Profanity and vulgar remarks are prohibited. 17. Calling for help when not in need of help is prohibited. 18. The pump room is off limits. The telephone room is NOT a play / hang-out area. 19. The lifeguard stand is off limits to anyone except the lifeguard. No hanging/climbing on the stand. 20. Swimming apparel will be limited to commonly accepted standards. Cut-offs and shorts are not allowed. 21. All members are expected to respect the pool facilities by helping maintain clean and sanitary conditions. 22. All members shall drive slowly when approaching the pool area and park in designated spots; please try to avoid parking in the adjoining cul-de-sac if possible (please be respectful of our nearby neighbors and their property!). 23. During pool hours, members may have a maximum of 7 non-member guests. 24. Members who have not paid all dues, assessments and related charges shall be delinquent (per the Permanent Membership Declaration 6 (c)) and rights to use the common area property will be suspended. 25. Renters of Non-Member properties may use facilities if they pay the Seasonal Member annual dues. 26. Admission to the pool is limited to members in good standing, their families and accompanied guests. Non-member residents and their families cannot be considered as guests. 27. Non-member Highland Park/Terrace homeowners, who are eligible for membership and are not Highland Park /Terrace members, may not participate on the swim team. 28. Members and their guests shall be responsible for the misuse or neglect of the pool area or for breakage other than normal wear. This includes surrounding trees and shrubs. 29. Members shall be responsible for the actions of their guests. 30. The pool may not be closed to members during normal guarded hours for private parties. 31. Only members may have parties. (See Private Party Rules) 32. Gate/Door codes may be changed at any time. Sharing the codes, propping the door open or otherwise compromising the security of the pool area is prohibited. 33. These rules are subject to revision by the Board of Directors. 34. Members are responsible for cleaning up after themselves. 35. Violations of any of these rules may result in removal from pool/pool area, suspension and/or fines.

Highland Park Recreation Association, Inc. Private Pool Party Rules 1. All parties must be scheduled through the Pool Chairperson (Board Member) and Swim Atlanta (Pool Management Company) at least two weeks prior to the party, on a first come basis. Lead time is required for scheduling of lifeguards and planning purposes. The pool party request form is attached to this document and may also be downloaded at the following link: http://sapm.net/pdf/party%20request%20form%202002.pdf 2. The member scheduling the party will be responsible for any and all costs to the association. 3. A refundable $25 security deposit to the Association is required. 4. Lifeguard rates for after hour parties for the pool are as follows: $18 per lifeguard hour ($29 minimum), except $36 per lifeguard hour for parties serving alcohol - billing will include any time spent cleaning up after party 5. The number of lifeguards required for an event is as follows: (Per our contract with SwimAtlanta Management, Inc.) Number of guests Number of Lifeguards Required 1-25 1 26-60 2 61-100 3 101 or more 4 One additional lifeguard shall be required for any teenage party, college age party, or for any party involving alcoholic beverages. Adult chaperones (1 for every 10 people) are required for teenage or college parties. Fraternity parties are not allowed. **The lifeguard on duty is not responsible for monitoring private parties and does not count toward the number of guards required. 6. There is a $25 per hour fee, payable to the association for all after hour parties. 7. Members scheduling the party assume all responsibility for the payment of all charges and liabilities (beyond lifeguard liabilities) that are incurred. 8. Only members may have parties. 9. The pool will NOT be closed to members during normal operating hours for private parties. 10. Parties do not include usage of the tennis courts. 11. After hours parties must be over by midnight. Clean up should start at 11:30 so that the pool area is vacant by 12:00am.

Pool Party request forms must be completed and must be sent to the SwimAtlanta office to be scheduled. You must contact your neighborhood homeowners board regarding your party prior to submitting this form A pool party is not confirmed until you receive a phone call from the SwimAtlanta office. The party sponsor is responsible for helping clean up after the party. All parties will be billed a week after the party if payment has not already been submitted. Due to insurance requirements, there can be absolutely no exceptions on the number of lifeguards per party. The total number of attendees includes everyone attending the party, not estimated swimmers. You must give at least 4 hours notice of a canceled party to avoid charges by calling 770-992-7665 ext. 103. Please call for any cancellation, including inclement

Rate: $18.00 per guard per hour $36.00 (if alcohol is permitted) Special Circumstances Requiring Additional Staffing/Costs: One (1) additional lifeguard is required for any party involving teenagers, college-age people, or parties involving alcohol. For a party involving children, party sponsor must have one adult chaperone for every 10 children under age of 18 If additional clean-up time is required, party sponsor is responsible for paying the lifeguards for the additional clean-up time (I.e. 2 lifeguards for 30 min. of clean-up time cost $18.00). Steps to Determine Pool Party Cost: For example, a two hour party requiring three lifeguards will cost $108.00 ($54/ hour for three lifeguards) Example: 1.
