Stud Fee. a. Stallion fees are Five Hundred ($500) Dollars. This fee includes the price of the booking/office fee of $100, which is due with this contract. b. The balance of the stud fee and/or any other fees are due before semen can be shipped. Please indicate which mare you will be breeding (one contract per mare): Reg. Mares must be booked all together and at the same time with all breeding contracts mailed together in one envelope. Please list number of mares being booked at this time:. Each mare must have a separate Breeding Contract and booking fees for each mare are due at this time. $50 off each mare s balance due. Return Customer Discount, $50 off balance due (for any customer who has bred a mare the previous 2 years) Please list year booked and mare bred. *Booking/office fee of $100 must still be paid with this contract and for each mare to reserve your mare s breeding. All discounts are taken off the balance that is due before semen can be shipped to your mare. 2. Registration Papers. You must deliver to Owner of Stallion a current copy of the mare s registration papers due with this contract. A copy of the front and a copy of the back of the registration papers are required. Owner of Mare must be shown as mare s current owner. Breeding Contract must be completed at least 3 business days prior to ordering semen. Any contract received less than 7 days before ordering semen will require a $100 Rush Fee to be able to process all paperwork, complete cooled semen shipping permit, complete all payments, and to prepare for shipping semen that quickly. Permits are required before I can ship. Semen will not be shipped unless all paperwork is completed and all payments are completed. 3. Semen Shipping Fees. Page 1 Of 6
A semen collection fee of $350 will be charged for each semen collection that is shipped for each mare to cover the cost of semen collection, semen testing and evaluation, shipping costs, hauling costs, and semen processing. The semen containers are the property of Crossroads Veterinary Clinic of Victoria, Texas and must be quickly returned, all parts included. If containers are NOT returned within 10 days, in good/reusable condition, the customer will be charged $30 to replace the small 'disposable' container or $250 to replace an Equitainer. Please return containers to Crossroads Vet Clinic, 3804 Houston Highway, Victoria, Texas, 77901. 4. Ordering Semen. The deadline for ordering semen is 5PM CST the day before collection and shipment. Semen that is ordered after the deadline will likely have to be denied. If a late order is accepted, Owner of Mare will be charged a $100 Late Order Fee. Owner of Mare must also call before 8AM CST the day of collection and shipment to confirm order. Stallions are collected on a Monday, Wednesday, Friday schedule. All semen orders must be made directly by phone to Sarah Coquat at (361) 319-2733. Please have ready the following: Owner of Mare's name, your mare's registered name, and your mare's registration number. No emails, texts, or voicemails will be accepted to place orders. If there is no telephone answer, please leave a voicemail, wait a few minutes, and call back. Owner of Mare must inform their veterinarian, breeding manager, or reproduction manager of the terms of this contract, ordering deadlines, late order fees, and collection schedule. All shipments will be sent overnight. Weekend shipments are not possible. Holiday shipping and delivery is not available. In an emergency, it may not be possible to collect a stallion off schedule. Emergency collections will be handled on a case by case basis and are not guaranteed to be available. There will be a fee of $100 extra to provide an emergency collection. 5. Conditions. Mare must be inseminated the same day semen is received. Only the mare designated in this contract may be inseminated. Owner of Mare may not substitute another mare without consent and a new Breeding Contract being signed. If semen is used for a mare other than the mare listed in this Breeding Contract, Owner of Mare will be charged a $500 stud fee plus a $350 collection and shipping fee and a Breeding Contract will have to be signed for the additional mare. Registration will not be released for any foals until all fees have been paid. If Owner of Mare breeds or exposes the mare booked with this contract to any other stallion during the current year, then this contract will become null and void and no refunds will be given. A pregnancy exam must be done 14 to 18 days post-ovulation by ultrasound to determine pregnancy status. Owner of Stallion must be notified of pregnancy status within 18 days of ovulation. Failure to do so may void Live Foal Guarantee. If the mare is pregnant, an additional ultrasound is recommended at 35 to 45 days to ensure that the pregnancy is viable and to screen for twins. If the mare is not pregnant, notify Owner of Stallion that the mare did not conceive and discuss plans for rebreeding. Please do not wait too long for pregnancy exams which could cause you to miss a cycle and a chance to rebreed. Please keep stallion collection schedule in mind when scheduling pregnancy exams to allow time to order another shipment of semen if needed. Page 2 Of 6
Breeding season is scheduled from January 31, 2016 to June 15, 2016. All attempts will be made to provide semen when ordered. Owner of Mare understands that this agreement is for the 2016 breeding season only. Owner of Mare may choose anyone they want to inseminate and manage the mare. Owner of Mare should choose a veterinarian, breeding manager, or reproduction manager with experience in mare management, reproduction, ultrasound, and insemination. Mismanagement of mare could result in failure to conceive and Owner of Mare understands these risks. Owner of Mare understands that responsibility to manage mare is placed on Owner of Mare and his/her chosen veterinarian or reproduction manager. Any and all expenses arising from the care, management, insemination, and pregnancy of the mare are the responsibility of Owner of Mare. All the requirements of applicable breed registries must be fully complied with. Insemination certificates, which are sent with the semen, must be must be promptly completed with veterinarian/technician/person inseminating mare's signature and sent to American Paint Horse Association within 10 days after insemination and a copy back to Owner of Stallion after insemination. Owner of Stallion must be informed of the insemination dates for the breed association stallion breeding reports and breeding certificates. Any missed, delayed, or incomplete paperwork may delay or prevent registration of the foal. Owner of Mare must consult a veterinarian for a recommended vaccination schedule and must maintain an acceptable level of care for mare. Not doing so may void the Live Foal Guarantee. 6. Live Foal Guarantee. This contract comes with a live foal guarantee. It is the responsibility of Owner of Mare to maintain pregnancy. Your vet can instruct you of how to do that. If mare fails to conceive or does not deliver a live foal, Owner of Mare will be able to book this mare or an approved substitute mare for a breeding in 2017. Owner of Mare needs to be prepared to allow Owner of Stallion to start breeding their mare early in the 2017 breeding season. All collection, shipping, permit fees, and other applicable fees will apply however; the stud fee will be waived. Owner of Stallion shall have no further liability hereunder for servicing said mare. For the purposes of this Agreement, Live Foal means standing and nursing for a period of at least twenty-four hours after post-birth. Owner of Mare must notify Owner of Stallion within one (1) week from death and this notice must be accompanied by a statement from a licensed veterinarian. Not doing so could void the Live Foal Guarantee. 7. Stallion. Owner of Stallion is the sole owner and breeder of the stallion and retains full title to the stallion. Owner of Stallion has authority to breed stallion and to sell breedings from the stallion. The stallion has been DNA typed and stallion listed with APHA. He may also be listed with other breed associations. The collection method, sperm count, and packaging meet or exceed industry standards. Breeder assumes responsibility only to ship enough extended semen that the veterinarian, breeding manager, or reproduction manager should receive adequate viable semen within a next day delivery time. Owner of Stallion will always try to send 2 breeding doses of semen if possible, but that is not Page 3 Of 6
guaranteed. If semen arrives in poor condition, it must be reported to Owner of Stallion immediately, before mare is inseminated. If no problems are reported, then it will be accepted and agreed that semen arrived in good condition, and was used for insemination the day it arrived. 8. Substitute Mare. If prior to the breeding of the said mare or after the mare has been bred but not come in foal, said mare dies or becomes unfit for service as so declared by a licensed veterinarian, then this Agreement shall become null and void and Owner of Mare shall have no right to a refund hereunder, but shall have the option of using a substitute mare during the current breeding season. A letter from a veterinarian must be supplied verifying that the original mare is not in foal. No exceptions. All fees already paid will be applied to the approved substitute mare for the 2016 breeding season. A new contract must be completed for the substitute mare. A $50 substitute mare fee will be applied. Collection and shipping fees must still be paid. If Owner of Mare decides to terminate breeding of current mare and use a substitute mare, a $50 substitute mare fee will be charged. Owner of Mare must prove current mare is not already in-foal and Owner of Stallion must approve this substitution. In the event that multiple mares conceive, even if unintentional, then a stud fee will be due for each mare. 9. Refund Policy In the event that the selected stallion becomes unfit for breeding, dies, or is sold, before the mare has been checked in foal, then Owner of Mare may apply any unused fees paid toward breeding to a different stallion standing at the ranch if available. Refunds will not be given. 10. Color Foal Guarantee. Sparks Black Jack, 06 Black Tobiano, APHA#887,369. Homozygous black (E/E) and homozygous tobiano (T/T). If any color/pattern mare is bred and the resulting foal does not express the E gene (black points) such as bay, brown, black, buckskin, buckskin dun, smoky black, grulla, blue roan, roan with points, gray with black gene, etc., AND the T gene (tobiano) such as the tobiano pattern or tovero pattern, a re-breed will be allowed in 2017. The stud fee will be waived. *Many photos and genetic color testing will be required from Owner of Mare if he/she feels deserving of a color foal guarantee re-breed. Re-breeds are allowed for the mare or approved substitute mare to the same stallion. Collection and shipping fees must still be paid. Liability. Owner of Mare agrees to assume the risk of injury, sickness, or death to said mare Page 4 Of 6
and foal. Owner of Mare agrees to hold Owner of Stallion blameless if mare fails to settle for any reason. 12. Indemnification. Owner of Stallion is not responsible for any disease, theft, illness, accident, loss, or death to mare or foal. Owner of Stallion is not responsible for lost, delayed, or damaged semen due to delays by the deliverer, bad weather, or any other reason. Owner of Mare agrees to hold Owner of Stallion blameless if mare fails to conceive for any reason. 13. Breeding Certificate and Registration Owner of Stallion agrees to execute all necessary documents of the registration of the offspring of the breeding. Owner of Mare is responsible for foal registration fees. Owner of Mare will be solely responsible for seeking registration of the foal. All registration fees are to be paid by Owner of Mare. Owner of Mare will pay costs for DNA testing of mare and foal, registration fees, permits, or miscellaneous fees that are applicable for registration of foal. It is Owner of Mare s responsibility to register their foal. Owner of Mare will pay all registration fees, DNA tests, parentage verification, program enrollment, and any other fees applicable. 14. Termination. Either party may terminate this Agreement for failure of the other party to meet any material terms of this Agreement. In the case of any default or reach by one party, the other party shall have the right to recover attorney s fees and court costs incurred because of said default. 15. Governing Law. This Agreement is governed and shall be construed under the laws of the State of Texas. 16. Entire Agreement. This constitutes the entire Agreement between the parties. Any modifications or additions MUST be in writing and signed by all parties to this Agreement. No oral modifications or additions will be considered part of this Agreement unless reduced to writing and signed by all parties. Contract must be completed in full, is not transferable to any other party, and must be received with the booking fee and all necessary documents as described in this Agreement. Dated:, (year).
