ICC CRICKET WORLD CUP 2019 BALLOT TERMS & CONDITIONS Definitions 1. All capitalised terms used in these Ballot Terms shall have the following meanings: Alcohol-Free Ticket means any ticket giving right of entry to the alcohol-free area of any Venue for a particular Match; Applicant means any person who registers to apply to purchase Tickets through the Ticket Ballot; Application means any complete or incomplete application to purchase Tickets through the Ticket Ballot; Application Window means: (i) in respect of the Cricket Family Ballot, 10.00 GMT on 8 May 2018 to 20.00 GMT on 1 June 2018; and (ii) in respect of the Public Ballot, 10.00 GMT on 17 July 2018 to 20.00 GMT on 16 August 2018; Authorised Agents means the official corporate hospitality agents and official travel agents appointed by or on behalf of IBC and which are legally and contractually entitled to sell Tickets as part of hospitality and travel packages respectively; Authorised Person means collectively all Tournament management (being anybody acting on behalf of IBC) and all Venue management, and their respective staff, officials, representatives, officers and volunteers; Ballot Terms means these ballot terms and conditions, together with any information provided on the Website relating to the Ticket Ballot and any amendments or updates to the same issued by or on behalf of IBC from time to time; Child Ticket means any Ticket giving right of entry to a match at a particular Venue to any person aged under sixteen (16) years old on the date of the relevant Match; Cricket Family means a wide range of groups involved in cricket, including members of county cricket clubs, supporter groups, amateur players and previous purchasers of tickets to cricket matches. Individuals can join the Cricket Family by electing to receive the ICC newsletter at the following link: www.icc-cricket.com/tickets/about; Cricket Family Ballot means the Ticket Ballot organised and operated by the Host and open to members of the Cricket Family only; Guest means any person for and on whose behalf the Ticket Purchaser bought a Ticket and who has obtained such Ticket from the Ticket Purchaser in accordance with the terms of these Ballot Terms, and/or any other person using a Ticket with the prior express authorisation of IBC and/or the Host; "Host" means the England and Wales Cricket Board Limited, which has been appointed by IBC to host the Tournament; "ICC" means the International Cricket Council Limited, the international governing body for the sport of cricket, having its administrative office at Street 69, Dubai Sports City, Sheikh Mohammed Bin Zayed Road, P.O. Box 500070, Dubai, U.A.E.; "IBC" means ICC Business Corporation FZ LLC, a wholly owned subsidiary of the ICC incorporated to exploit the commercial rights to ICC events, being a company incorporated under the regulations of the Dubai Creative Clusters Authority with its registered address at Office No. 28, Second Floor, Building 2, Dubai Media City, United Arab Emirates, and having its administrative office at Street 69, Dubai Sports City, Sheikh Mohammed Bin Zayed Road, PO Box 500070, Dubai, United Arab Emirates; "Match" means a One Day International cricket match forming part of the Tournament or any other cricket match played as part of the official warm-up phase of the Tournament, the particulars of which are indicated on the Ticket; "Official Ticketing Agents" means any official ticket agent(s) appointed by or on behalf of IBC together with the ticket box offices at each of the Venues; "person" shall include natural and juristic persons;
Public Ballot means the Ticket Ballot organised and operated by the Host and open to all members of the public (subject to these Ballot Terms); "Ticket" means a ticket giving right of entry to a Match at a particular Venue in accordance with the details indicated thereon; Ticket Ballot means the random computerised ballot carried out to determine which Applicants are allocated Tickets, further details of which shall be notified to Applicants during the application process via the Website; "Ticket Holder" means any individual possessing, holding or using a Ticket, including (without limitation) the Ticket Purchaser, Guest or any person to whom the Ticket was issued or transferred; "Ticket Purchaser" means the individual with legal capacity who has purchased a Ticket or Tickets in accordance with these Ballot Terms from any Official Ticketing Agent and/or from any Authorised Agent; Ticket Terms and Conditions means the terms and conditions governing all Tickets issued for the Tournament and the subsequent admission to any Venue to attend any Match, a copy of which is available on the Website; "Tournament" means the ICC Cricket World Cup 2019, scheduled to take place in England & Wales; "Venue" means the entire premises of a ground or stadium where a Match is scheduled to take place and to which a Ticket is required to gain access, including all entrance and exit gates as well as all other official installations and areas; "Website" means the website located at tickets.cricketworldcup.com; and Wheelchair Ticket means any Ticket giving right of entry to the wheelchair-accessible area of any Venue for a particular Match. General 2. These Ballot Terms govern the operation of the Ticket Ballot and the payment for and distribution of Tickets to Ticket Purchasers. 3. The Ticket Ballot comprises two phases: (i) the Cricket Family Ballot; and (ii) the Public Ballot. 4. An Applicant must read these Ballot Terms carefully and may not begin an Application or purchase, hold, use or attempt to use a Ticket if they do not understand and agree to these Ballot Terms. Eligibility 5. The Ticket Ballot is only open to individual consumers and shall not be open to any commercial enterprise, including but not limited to any company, business or individual acting in a trading capacity (or any person acting on their behalf). Any Ticket purchased or otherwise acquired by such a commercial enterprise through the Ticket Ballot may be cancelled by IBC and/or the Host without notice and any Ticket holder seeking to use the Ticket may be refused admission to or evicted from a Venue by any Authorised Person without refund or compensation and must deliver up any and all Tickets in their possession at the request of an Authorised Person. 6. Individuals shall not be permitted to register for the Ticket Ballot more than once. Applications 7. Applicants may apply for any Match through the Ticket Ballot. Applicants acknowledge and agree that entering the Ticket Ballot does not guarantee that they will be allocated any Tickets. 8. All Applications must be received by IBC by no later than 20.00 (GMT) on the final day of the applicable Application Window. All Applications received after the closing date of each Application Window are automatically invalid.
9. There is no restriction on the number of Matches for which an Applicant may apply to purchase Tickets. However, Applicants may not apply for more than the maximum number of Tickets for an individual Match. 10. Subject to Paragraph 11 below, Applicants may apply to purchase Tickets in four price categories: (a) Platinum; (b) Gold; (c) Silver; and (d) Bronze. 11. Applicants may apply to purchase Child Tickets in Gold, Silver or Bronze price categories, but Child Tickets shall not be available for the Platinum price category. 12. Ticket Holders attempting to enter a Venue using a Child Ticket must be aged sixteen (16) years or younger on the date of the relevant Match. Child Tickets Holders must be accompanied upon admission to and subsequently within the Venue by a Ticket Holder aged eighteen (18) years or older, who shall be responsible for them and their compliance with these Ballot Terms. 13. Wheelchair Tickets and Alcohol-Free Tickets are available to purchase at all Matches within the Bronze price category. Wheelchair users who successfully purchase one Wheelchair Ticket shall receive one companion Ticket free of charge. 14. Children aged under two (2) years on the date of the relevant Match shall not require a Ticket to be granted entry into the Venue, provided that they must sit on the lap of an accompanying Ticket Holder aged eighteen (18) years or older who must be their parent/legal guardian. 15. In submitting an Application, you confirm that you are eligible to do so and eligible to attend the relevant Matches (in accordance with the Ticket Terms and Conditions). IBC may require you to provide proof that you are eligible to enter the Ticket Ballot. 16. All decisions relating to the Ticket Ballot shall be entirely at the discretion of IBC and the Host, whose decision in all matters relating to the Ticket Ballot shall be final. IBC and the Host reserve the right to suspend, cancel or modify the Ticket Ballot at any time (and for any reason) with or without notice. Powerplay 17. All Applicants shall be given the option on the checkout page of the online Ticket Ballot to tick a box to use the Powerplay feature, which increases the likelihood that Applicants shall be allocated one or more Tickets through the Ticket Ballot. If an Applicant chooses to use Powerplay and they are unsuccessful in the Ticket Ballot for one or more of the Tickets for which they have applied, they shall be deemed to have automatically applied for those Tickets in the next highest available price category. If they are also unsuccessful in the Ticket Ballot for the next highest price category (or if a higher price category is not available), the Applicant shall be deemed to have automatically applied for those Tickets in all lower price categories in descending order, subject to availability. EXAMPLE: A Powerplay Applicant applies for one Ticket to Match A in the Silver price category but is unsuccessful in the Ticket Ballot. As a result, they are automatically entered into the Ticket Ballot to purchase one Ticket for Match A in the Gold price category. If they are unsuccessful once more, they will be automatically allocated one Ticket for Match A in the Bronze price category (subject to availability). 18. Applicants who tick the Powerplay box and who are successfully allocated one or more Tickets expressly acknowledge and agree that they may be required to pay for those Tickets in higher price categories in accordance with the process set out in Paragraph 17
above, and further agree that the full cost of such Tickets may be taken from the payment card provided in order to meet this requirement. Ticket Purchase 19. Ticket Purchasers must be aged sixteen (16) years or above. Except for the permitted transfer from the Ticket Purchaser to their Guest(s) as set out in the Ticket Terms and Conditions, Tickets may only be purchased through the Official Ticketing Agents or the Authorised Agents or through any other sale or transfer mechanism authorised in writing by or on behalf of IBC. Payment Processing 20. Applicants must provide valid payment card details before submitting their Application to purchase Tickets. Applicants warrant and undertake to ensure that their payment card has sufficient funds to pay for all Tickets for which they have applied as part of their Application (including any additional sum required to pay for those Tickets in the next highest price category) and further to ensure that their payment card shall not have expired at the point at which payment is taken. 21. Applicants shall be notified in writing whether they have been successful in the Ticket Ballot within 30 days of the closure of the relevant Ticket Ballot and payment shall be taken by the Official Ticketing Agent within 48 hours thereafter. Applicants are advised that ICC CWC19 Tickets will appear on bank statements once payment is taken. In the event that payment fails, IBC shall contact Applicants to ask them to provide an alternative payment method. If the Applicant has not paid the full amount within seven days after payment was originally due to be taken, their Application shall be cancelled. 22. The total fee payable shall include a postage fee based on the Applicant s country of residence. Tickets will be posted by tracked postage, which will require recipients to sign to confirm receipt of the tickets following postage (which is scheduled to take place in around April 2019). Restrictions on Transfers and Resale 23. Tickets are non-transferable except as set out in these Ballot Terms. A Ticket Purchaser may purchase Tickets only for their own personal use and/or that of their Guest(s). It is an essential condition of the issue of each Ticket and the right of admission to a Venue that the Ticket must not be offered publicly (including by way of any promotion or competition) or transferred by any method, other than as explicitly permitted in the Ticket Terms and Conditions. Waiver & Indemnity 24. EACH APPLICANT ACKNOWLEDGES THAT THEIR PARTICIPATION IN THE TICKET BALLOT IS AT THEIR OWN RISK AND THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LOCAL LAW, NEITHER IBC NOR THE ICC NOR THE HOST NOR ANY OF THE OFFICIAL TICKETING AGENTS NOR ANY OF THE AUTHORISED AGENTS NOR ANY AUTHORISED PERSONS ARE LIABLE FOR ANY LOSS, DAMAGE AND/OR HARM, INCLUDING (WITHOUT LIMITATION) BODILY OR MENTAL HARM, PERSONAL PROPERTY DAMAGE OR ANY LOSS, LOSS OF PROFIT, BUSINESS OR OPPORTUNITY, INDIRECT OR CONSEQUENTIAL LOSS, SPECIAL DAMAGES OR ANY OTHER LOSS AND/OR HARM HOWSOEVER ARISING FROM THE OPERATION OF THE TICKET BALLOT AND/OR THE ALLOCATION AND DISTRIBUTION OF TICKETS TO TICKET HOLDERS. EACH TICKET HOLDER AGREES THAT NO CLAIM, COMPLAINT OR PROCEEDING WILL BE BROUGHT IN RELATION TO THE FOREGOING. 25. EACH APPLICANT SHALL INDEMNIFY AND HOLD IBC, THE ICC, THE HOST, THE OFFICIAL TICKETING AGENTS, THE AUTHORISED AGENTS AND ALL AUTHORISED PERSONS HARMLESS FROM AND AGAINST ALL LOSS, DAMAGES AND LIABILITIES, INCLUDING (WITHOUT LIMITATION) BODILY OR MENTAL HARM, PERSONAL PROPERTY DAMAGE OR LOSS, LOSS OF PROFIT, BUSINESS OR OPPORTUNITY, INDIRECT OR CONSEQUENTIAL LOSS,
SPECIAL DAMAGES OR ANY OTHER LOSS AND/OR HARM HOWSOEVER ARISING (INCLUDING BUT NOT LIMITED TO THE COSTS OF ENFORCEMENT OR ATTEMPTED ENFORCEMENT OF THESE BALLOT TERMS), SUFFERED OR INCURRED BY ANY OF THEM IN CONNECTION WITH, RESULTING FROM, OR ARISING OUT OF, A BREACH BY ANY APPLICANT, TICKET HOLDER OR TICKET PURCHASER OF ANY OF THESE BALLOT TERMS. Miscellaneous 26. All Applicants irrevocably and unconditionally consent to the collection, use and insertion into a database by or on behalf of IBC and/or the Host of personal information provided by the Ticket Purchaser and any other Ticket Holder in accordance with applicable law for the purposes of implementation of these Ballot Terms, including for administration, communication, enforcement and access control purposes. IBC and/or the Host may share such personal information as may be generally and reasonably required for the proper and efficient staging of the Tournament and to give effect to any of its rights in relation to these Ballot Terms and the Ticket Terms and Conditions. The Ticket Holder can access and/or correct their personal information by written request to the Host. 27. These Ballot Terms have been drafted in the English language. In the case of any conflict or ambiguity between the English version of these Ballot Terms and any translation of them into any other language, the English version of these Ballot Terms will prevail. 28. IBC and the Host reserve the right to make amendments to these Ballot Terms from time to time in their sole discretion and without notice. 29. These Ballot Terms and any dispute or claim arising out of or in connection with these Ballot Terms (including, without limitation, any dispute or claim relating to noncontractual obligations) shall be governed by and interpreted in accordance with English law and any dispute (including, without limitation, any non-contractual dispute or claim) arising from or in connection with these Ballot Terms or a Ticket Holder s attendance at a Match shall be submitted to the non-exclusive jurisdiction of the English courts. Notwithstanding the foregoing, IBC and the Host reserve the right to pursue any legal proceedings in a competent court in the defendant's domicile, which proceedings shall be governed by and interpreted in accordance with English law.
