Inmate Jones reached over the table, grabbed food from Inmate Kuzara's tray and began to eat il Officer Street and Correctional vlu"''r attempted to confiscate the tray, without using force. At that time, Officer Street watched Inmate Jones, as Officer Velez escorted Jmnalte K~uzara tray of food. Inmate Jones then spat out the food then continued to eat. Page 2

This Inspector also checked the Fixed-Wing videotapes for the lower floor, just in case the cassettes had been labeled incorrectly, to no avail. (Exhibit B-1) In a sworn, recorded statement, dated June 1, 2009, Correctional Officer Angel Velez indicated the following: On May 30, 2009, Officer Velez was escorting (in charge of) Inmate Mark Kuzara during the time in ~n. Velez had taken Inmate Kuzara from the Wing 4 Dayroom table, on the second floor of the -after Inmate Tyrone Jones had taken Inmate Kuzara's food. Officer Velez was not present when Inmate Tyrone Jones When Inmate Jones took Inmate Kuzara's tray of food, the officer escorted Kuzara became aware of Inmate Jones' when he saw Officer Justin asked for Velez's help placing Imna1:e 1 Velez had even witnessed doing so. Staff then took Inmate Kuzara to Wing 3, on the same floor and obtained another meal for Kuzara. While Inmate Kuzara was present at the table in question, staff did nor did use force Inmate Tyrone Jones. (Inmate Kuzara Page4

In an Incident Report, dated June 15, 2009, Correctional Officer Lt. Charles Ford indicated the following: On June 15, 2009, at approximately 12:44 p.m., he was assigned as Shift Supervisor, when he Correctional Officer Marc Gadsen that Inmate Jones DC# 061708 had died The May 30, after Jones' body was then turned over to the District 5 Medical Examiner's Office for an autopsy. (Exhibit A-2) In the Cause and Manner of Death and Autopsy Report, dated June 16,2009 and July 7, 2009, respectively, Pathologist Wendy A. Lavezzi, MD, indicated the following: The Cause of Death of Inmate Tyrone Jones was due to of Death was listed as an "Accident." The Manner The autopsy was conducted at the Medical Examiner's Office, 5'h Judicial Circuit (the case number was 2009-0518), located at 809 Pine Street, Leesburg, Florida. (Exhibit B-2) (This report was delayed due the high number ofother investigations and reports.) DOWNGRADE JUSTIFICATION: Investigation revealed no suspicious actions on the part of staff or other inmates. This case was downgraded and closed per Acting Prison Inspector Supervisor Mike Spurlock.
