City of Burlington By-law 85-2012 Description A by-law to amend By-law 86-2007, as amended, being a by-law for the regulation of traffic. File: 110-04-1 (TS-26-12) Preamble Whereas Section 11 of the Municipal Act, 2001, authorizes municipalities to enact bylaws respecting matters within the sphere of jurisdiction of municipal property, private property and highways, including parking and traffic on highways; And Whereas the Council of the Corporation of the City of Burlington, at its regular meeting held October 15, 2012, directed the Director of Transportation Services to amend By-law 86-2007, as amended, being a by-law for the regulation of traffic, to further regulate the riding and coasting of skateboards, in-line skates and other similar devices. Now therefore the Council of the Corporation of the City of Burlington hereby enacts as follows: Content 1. That By-law 86-2007, as amended, a by-law for the regulation of traffic, is hereby amended by deleting Section 7 Coasting in its entirety, and substituting the following therefore: 7. Coasting a) No person upon in-line skates or a skateboard, or riding in or by any means of any coaster, toy vehicle or similar device, excluding bicycles, shall go upon a highway, other than on the sidewalk, except for the purposes of crossing the highway. b) Without limiting the generality of subsection 7 a), every person who is riding a skateboard, in-line skates or other similar devices shall, at all times: i. Exercise due care and attention to his or her safety; ii. Travel in a manner and at a speed appropriate to the surface being travelled upon;

iii. Exercise due care and attention to the safety of all other users of the sidewalk and shall yield to pedestrians; and iv. Adhere to the provision of the Highway Traffic Act, R.S.O. 1990, c. H.8, where applicable. c) No person shall ride a skateboard or in-line skates or other similar devices in such a manner so as to cause any damage to public or private property. d) A person riding or coasting on a skateboard or in-line skates or other similar devices shall, at the request of a police officer or by-law enforcement officer, state his or her correct name, address and date of birth. e) Notwithstanding the above provisions, no person shall ride a skateboard, in-line skates or other similar devices on the sidewalks listed in Schedule 20. f) In addition to the Offences and Penalties section in Part VI of this By-law, the following offences may be subject to a $75 fine: i) Fail to provide correct name, address and date of birth at the request of the police officer or the by-law enforcement officer; ii) Fail to ride or coast on a skateboard or in-line skates or other similar devices in a safe manner, including: 1. obstructing traffic; 2. aggressive or dangerous riding or coasting, including, speeding, racing, jumping off steps, rails, benches or any other object. 3. endangering the welfare or property of any person, including the rider or coaster s own personal welfare or property. For example, riding on a highway while listening to music and not wearing any protective or reflective gear. 2. That By-law 86-2007, as amended, a by-law for the regulation of traffic, is hereby further amended by adding a Schedule 20, the attached Appendix A to this bylaw; 3. That in all other respects, By-law 86-2007, as amended, a by-law for the regulation of traffic, be and is hereby confirmed.

4. And that the provisions of this by-law shall become effective on the date of approval of the short form wording and set fine by the Regional Senior Justice of the Ontario Court of Justice, Central West Region.
