General Terms and Conditions Kärnten Läuft 2018 and Graz Marathon 2018 Version 3, 02.08.2018 1. Scope of application The following general terms and conditions apply to all participants who are partaking in events or competitions of Kärnten Läuft or Graz Marathon. The organiser of Kärnten Läuft and Graz Marathon is the MJK Sport Marketing GmbH (Ltd) Burgblickweg 8, 9520 Annenheim. Austrian law is applied. Place of jurisdiction is the district court in Villach, which is responsible for the organiser. These conditions of participation regulate the legal relationship between the participants and the organiser. They are subject to occasional changes in content. They are part of the contract between the organiser and the participant in the version valid at the time of registration. Changes which take place in consideration of the legitimate interests of the participants and which are announced by the organiser on the internet or in written form become, without further agreement, part of the conditions of participation. All declarations by a participant vis-à-vis the organiser must be sent to the organiser by post (MJK Sportmarketing GmbH, Burgblickweg 8, 9520 Annenheim) or by e-mail (office@mjksportmarketing.com) only. All explanations acc. Point 24. "Use of personal data" must only be sent to the organiser by post (MJK Sportmarketing GmbH, Burgblickweg 8, 9520 Annenheim) or by e-mail only (datenschutz@mjk-sportmarketing.com) 2. Participation and security Anyone who has reached the age specified in the respective event invitation is entitled to start. Participation in running or Nordic Walking competitions using other sports equipment is not permitted. Sports equipment of any kind that may affect the safety or health of participants or visitors is not permitted when participating in the events. These include e.g. Bicycles and inline skates. Participation with wheelchairs and / or so-called "hand bikes" is not possible for safety reasons. Accompaniment by bicycles, inline skaters, and other means of transportation, as well as the transport of animals (except in Kärnthen Läuft Dogging - Running with the dog), is not allowed and will result in the disqualification of the respective participant! On the part of the organiser, vehicles (police, command vehicle, final vehicle, photographers / film crews) and bicycle spotter will accompany the field. All these vehicles and bicycles are clearly marked as organiser s vehicles. Possible emergency vehicles (rescue, police, fire) on the route have clear right of way. Organisational measures are announced by the organisers to the participants before the start of the event. The instructions of the organiser and appropriately identified staff must be obeyed. In the event of any contraventions that may disrupt the proper course of the event or jeopardize the safety of the other participants, the, organiser authorized staff are entitled to, at any time, exclude the person from the event and / or disqualify him/her. In the case of any relevant health signs, the medical services assisting the events may also, for the protection of the participant, recommend that the competitor terminates the competition. 3. Clean Sport Statement The participant assures that s/he respects the international anti-doping guidelines and that there are no grounds for exclusion of sporting events under the international anti-doping rules against him/her. S/H affirms that s/he does not take any prohibited substances to increase physical fitness for the purpose of providing athletic services, or that s/he has ever passed such substances on to other people. S/He further assures that s/he does not use any prohibited performance-enhancing methods or has applied them to other persons. 4. ONLINE registrations Registration for all events of Kärnten Läuft and Graz Marathon is possible via the ONLINE registration portal www.anmeldesystem.com. The contract is established directly between the respective applicant and the organiser, MJK Sportmarketing. The Maxfun Sports GmbH acts here solely as a mediator and service provider of the registration portals. Your account will be charged by Maxfun Sports GmbH. This is done on behalf and on account of Kärnten Läuft. On the registration portal, the registration status of the participants can be viewed at any time in real time. For inquiries in connection with the registration and / or billing, only contact the Call Centre of anmeldesystem.com / MaxFun Sports When registering via the Internet, all participants will receive a confirmation of registration with the assigned start number on the screen, immediately after the sending of the registration form. This acts as proof of the proper transmission of the data to the organiser. This registration confirmation will also be sent automatically to the e-mail address provided by the participant and must be printed by the participant her/himself for the collection of the start number. At any time the participant can access confirmation of whether the corresponding payment for the registration was made (this may take a few days, depending on the payment method), via the portals with the password and user login assigned during registration. If the payment details given by the participant are incorrect, s/he will receive a notification from the registration portal via e-mail or text message. If no payment is received, the registration of the participant is considered obsolete 5. Registration by post Registration via e-mail or post is not possible. 6. Mass Registration / Batch Registration Schools / Clubs Mass registrations / batch registrations are applications that are made using provided tools (eg Excel lists or a voucher tool). This particular form of registration is used at the Graz Junior Marathon. The contract is established directly between the respective school / club and the organiser MJK Sportmarketing GmbH. The Maxfun Sports GmbH acts here solely as a mediator and service provider of the registration portals. Registrations are submitted on part of the school (a representative) in form of an Excel list, provided by the organiser MJK Sportmarketing GmbH. The registration takes place without payment, and after the completion of the registration, the registration fees will be charged by MJK Sport Marketing GmbH in form of a collective invoice / payment in cash when picking up the bib numbers. Consent to the terms and conditions as well as the acknowledgment / approval regarding the personal data use takes place in writing and in advance. The respective school or the club appoints one or more person of contact, who are entitled to sign up for the General Terms and Conditions Kärnten Läuft 2018 and Graz Marathon 2018_V3_02082018 page: 2

registration with the MJK Sport Marketing GmbH and are also authorized to pass on personal data of participants within the context of this mass application On the registration portal, the registration status of the participants can be viewed at any time in real time. 7. Mass Registration / Batch Registration Companies / Associations Mass registrations of companies and associations are, if desired by the customer, handled via a voucher system. Upon request, the customer receives a certain number of vouchers per competition, which entitle to a one-time free registration in the registration portal anmeldesystem.com. The payment of these vouchers occurs in the form of a collective invoice from MJK Sportmarketing GmbH to the customer. The registration in the registration portal anmeldesystem.com (or the use of the voucher) is handled by the athlete her/himself. 8. Late entries at the venue Late entries for all competitions of Kärnten Läuft and Graz Marathon are possible onsite at the respective venues and is carried out electronically via so-called late-entry-terminals. Due to organisational reasons, it may also be necessary to record applications by paper rather than electronically. The contract is established directly between the respective applicant and the organiser MJK Sportmarketing GmbH. The Maxfun Sports GmbH acts here solely as service provider for late entries. The late registry fee is to be paid onsite. 9. Participants insurance Insurance is a participant s own responsibility. The organiser assumes no liability for damage to people or property. This also applies to garments or other objects lost during the transport of clothing or in the cloakroom. Within the ONLINE pre-registrations via the Internet, participants have the option to pay for a cancellation- and withdraw insurance. Respective details can be found in the corresponding section of the registration system. The insurance offer is a service of the registration portal. The filing of insurance claims is only possible via the registration portal. 10. Non-participation If a registered participant does not start or declares her/his non-participation, due to any reason, in advanced to the organiser, s/he is not entitled to any repayment of the participation fee. When registering online, participants have the option of taking out insurance, which guarantees their reimbursement in case of illness / injury. Exact conditions can be found on the registration page of MaxFun Sports www.anmeldesystem.com 11. Cancellation or termination of the event The race takes place in any weather conditions. However, the organiser reserves the right to prematurely cancel the race in the event of "Danger in default" without claiming any refund of entry fees. The reimbursement of the entry fee is only considered in case of complete cancellation of the event. If the cancellation is not justified by the organiser, only a partial refund of the registration fee will be made in the amount of the difference remaining after deduction of expenses directly attributable to the participant. If the organiser is obliged by official order due to security reasons or force majeure to make changes in the execution of the event or to cancel it, there is no obligation for the organiser to pay damages to the participant. 12. Liability for damage to property, assets and health The organiser is not liable for material and financial losses of any kind. Participants will not assert claims against the organisers, the partners and the sponsors of the organiser or their representatives for damages or injuries of any kind that might arise from their participation. The organiser assumes no liability for health risks of the participant in connection with the participation in one of the competitions and events of Kärnten Läuft or Graz Marathon. It is the responsibility of the participant to have their health checked and assessed by a doctor prior to the event. 13. Pick up of starting documents The collection of the starting documents is possible with proof of the registration confirmation or upon presentation of a photo ID. The starting documents may alternatively also be picked up by third parties upon presentation of the confirmation of registration. 14. Timing and irregular behaviour In both events, time keeping is done by MaxFun Timing. The timekeeping transponders - the socalled "RFID TAGs" - are integrated in the start numbers. Without a bib number there is no timing / ranking! At the start and finish line, there are so-called "timekeeping mats". When crossing the mats, the registered TAG is recognized. When crossing the start line the time starts to run and at the finish line the time is stopped. Additional timekeeping mats may be placed on the track at the discretion of the organiser (split times, lap times, special scores). In order to be included in the official ranking, participants must pass all relevant timekeeping mats. In the case of missing results of one or more split times and, at the same time, an implausible running time between the missing time-keeping points, the participant may be disqualified by the organiser. Each participant receives her/his bib number with integrated time measurement tag when picking up the start document. This bib number is registered exclusively to the participant and the registered competition and cannot be used elsewhere. The functionality of each issued bib number with RFID-TAG is checked by MaxFun Timing before handing them out to the participant. A warranty and / or liability of the organiser due to a defectiveness of the TAG occurring after the issue is excluded. Each participant has to ensure that s/he uses the correct bib number (registered for him / her for a specific event). When attaching the bib number to the body, ensure that the timing TAGs are not damaged by safety pins. The use of a third-party bib number (a third person eg number of the partner) means that there is no timekeeping / time assignment and that the participant does not appear in the result list. If the participant does not wear a bib number, s/he will not be included in the results list and/ or be taken out of the competition prematurely. If the officially assigned bib number is changed in any way, in particular if the advertising print is made invisible or unrecognizable, the participant will be excluded from time-keeping (disqualification). 15. Timing Graz Marathon - relay marathon Without a transponder there is no time-keeping possible Each team in the Graz Marathon relay competition receives a transponder with velcro when collecting the bib numbers. This transponder must always be worn (exclusively) at the ankle and must be forwarded to the team's next relay runner when changing. Time-keeping is exclusively done with this transponder. In addition, each relay runner has to wear her/his bib number with an integrated RFID tag. The time measurement via the bib number serves mainly for control purposes (handovers, checkpoints). A runner can also run more than one section (maximum 2). In that case the runner must wear both start numbers. If a relay participant does not wear a start number, s/he can be taken out of the race prematurely. If a Graz Marathon relay team does not wear a transponder, it will not be included in the ranking. 16. Self-catering / Meals at the Event Graz Marathon on Sunday Distributed over the route are refreshment stations provided by the organiser. In addition, each participant can deliver their own catering for the marathon, relay marathon and half marathon at the marked location near the start area before the start. The self-catering should be clearly marked. Those refreshment stations where the self-catering can and will be placed can be found on the homepage (services). The organiser assumes no liability for self-catering. 17. Health Competitions The Kärnten Läuft competitions: Nordic Ladies Walk, Family Run and Wörthersee Walk as well as the Graz Marathon competitions City Walk and Family Run are defined as so-called Health Competitions. Even though there is a timekeeping, there will be neither ranking nor award ceremony. All participants will enter a prize raffle. 18. Bambini Sprint The Bambinisprints of Carinthia Running and the Graz Marathon are not timed. When participating in the Bambinisprint is foreseen that the Bambinis run the designated route alone and without being accompanied. The Bambinis are picked up by event staff in the closedoff pre-start area and they are walked to the start. After the run, Bambinis receive refreshment as well as a medal of participation before they are handed over to their parents / companions. 19. Starting blocks For organisational reasons, some competitions start in blocks. For this purpose, participants will be allocated specific starting blocks based on their specified finishing time, the competition they entered, or their age. Which starting block a participant is assigned can be found in the registration confirmation or the start number. A start in another starting block is considered as harsh unsportsmanlike behaviour and can lead to disqualification. 20. Disqualification or event exclusion The organiser reserves the right to disqualify and / or to exclude him / her from the event a participant at any time if he / she has culpably provided false personal data, that are relevant to the evaluation of his/her athletic performance. The same applies to participants who are subject to a ban by a national sports federation or the NADA, or have already been banned because of a doping offense, or are suspected to participate in a completion/ an event after taking unauthorized substances (doping). In addition, the organiser reserves the right to reject applications without stating reasons. Participation is a highly personal right and not transferable. Bib numbers are not transferable. 21. Removal of the race The competitions take place on public roads. The safety of the participants is ensured by a timelimited official barrier of these roads and streets which will be monitored by staff employed by the organiser. If it is foreseeable that a participant will not manage to finish the route during the blocked and supervised time, agents authorized by the organiser may request the participant to terminate the run. In this case, the start number is invalidated for safety reasons. Further participation, even on his/her own risk is not permitted. a. Kärnten Läuft - Wörthersee Half Marathon For the Wörthersee Half Marathon, the following maximum throughput times apply between the measuring points defined by the organiser. If a participant does not pass the specified points within the prescribed time, authorized staff may remove the participant from the race. Measuring point Pörtschach, Start of the quarter marathon, Seepromenade, km 9.4: must be passed the latest at 10:40 am. Measuring point Krumpendorf catering station Jägerwirt, km 15.8: must be passed the latest at 11:40 am b. Graz Marathon The end of official timing for the Graz Marathon is 4:00 pm - all participants who are not at the finish line at this time will not be ranked, or employees authorized by the organiser will take participants who are still on the route out of the race. All participants must start the second round of the marathon at 12:45, the latest. If this is not the case, these participants will be taken out of the race by the organiser. If it becomes apparent that participants will not reach the finish in the prescribed time until 16:00 (end of official timing), employees authorized by the organiser may remove the participant from the race. 22. Garment transport (only Kärnten Läuft Sunday competitions) and cloakroom (Graz Marathon Sunday competitions only) The organiser assumes no liability for objects stored on behalf of the participants, which are accepted by persons appointed by the organiser. This applies especially for objects that are handed in at the start of Kärnten Läuft for the clothing transport (clothing transport from the start to the finish line) and objects handed in by the participants in the cloakrooms of the Graz Marathon. Only garment bags (starter bags) provided by the organiser as part of the bib number issue will be accepted. The bib number and the name of the participant must be clearly visible on the garment bag (adhesive label, will be issued with the starting documents). The returning of the handed-in garment bags at Kärnten Läuft is possible at the finish line until 2 pm. The bags will only be handed back to the participant against presentation of the bib number. The return of the handed-in garment bags at the Graz Marathon is possible until 4:30 pm at the cloakroom. The bags will only be handed back to the participant against presentation of the bib number. Unclaimed clothes bags will be kept by the organiser for a maximum of 3 weeks after the event and can be picked up in the office of the organiser during this period upon presentation of the bib number. Afterwards, the non-collected garment bags will be disposed of by the organiser. It is not possible to send a non-collected bag by post. 23. Image, sound and video rights By participating in the event, the organiser receives the exploitation right, exclusively and without limitation. Therefore, the organiser receives all rights to photos, film recordings, and interviews made before, during, and after the event, in whole or in parts and for multiple use in any future technical procedure, in terms of time, space and content the exploitation rights exclusively and without limitation. The finish will be filmed for eventual claim complaints from the participants. These finish videos are only used to handle timekeeper complaints. After the completion of the event (no later than 1 month) these videos will be deleted. The rights include in particular duplication (copy), distribution, processing / modification, publication / public provision (Internet), broadcasting (radio broadcasting, television in every possible way), demonstration / performance, storage and archiving in databases of all kinds, secondary use (such as special documentation), advertising (own, third-party advertising, but in connection with the competition), in every medium and social media platforms, print, online, digital, mobile, multimedia such as video, movies, print media, posters, folders, etc. Any image protection rights or rights to the vote, etc. are irreversibly granted to the organiser by the participant. The granting of rights also applies to the use of all data of the participant, such as name, gender, year of birth and place of residence for reports in any media. The organiser may transfer his rights in whole or in part to third parties. The participant is not entitled to compensation. The participant dismisses the organiser in connection with the participation in the event and the transfer of rights completely harmless and without complaint; this also comprises lawyer and court costs. 24.
