1. INTRODUCTION This By-Law is made by Bendigo Amatuer Soccer League Inc. (BASL) pursuant to rule B39 of the BASL Constitution (March 2012) 2. OBJECTIVES 2.1 To ensure that all Club Associates and Match Officials observe the Laws of the Game, the BASL Constitution, Regulations, Rules of Competition, Statutes and Regulations, By-Laws and Policies as shall be applicable from time to time (in this By-Law referred to collectively as Laws). 2.2 To ensure that the game of Football is played competitively and fairly in accordance with principles of true sportsmanship and in accordance with the Laws. 2.3 To encourage participation in the game of Football and to improve and advance the game of Football as a spectator sport, and to provide a safe and secure playing and spectator environment. 2.4 To provide a system which sets out procedures, guidelines and penalties for any Club Associate(s) who breaches the Laws. 2.5 To ensure that all charges brought against a Club Associate(s) at a Tribunal and any appeal from a Tribunal decision or any charges against a Match Official shall be conducted fairly and in accordance with the principles of Natural Justice. 3. DEFINITIONS & INTERPRETATION In this By-Law, unless the context otherwise requires, the following terms shall mean- Additional Suspension means any Suspension in addition to an Automatic Suspension. Automatic Suspension means a one match Suspension which cannot be reviewed or challenged. BASL meaning the Bendigo Amateur Soccer League BASL Committee means the BASL Committee of Management. Club means a Club registered with FFA and/or FFV and play in the BASL Competition. Club Associate(s) means one or more of the following, whether individually or collectively: Club Office Bearers; Club Officials (coach, team manager, anyone who is officially associated with the Club). Players of a Club; (d) Members of a Club; (e) Supporters of a Club including spectators at a Match who unless otherwise identified with a Club shall be deemed to be supporters of the Home Club; (f) Club(s). Competition season means any series of competitive matches determined by BASL including the interleague cup but does not include a Finals Series. Entering the Field of Play means entering the field of play without prior permission from the Senior Match Official or an Assistant Match Official but does not include participation in a melee. FFV means Football Federation Victoria. Finals Series a series of finals matches or Knockout Cup fixture as designated by BASL. BASL GDT By-Law 2017 4

Fine shall mean: where an amount is set out in Schedule 2 that amount. where an amount is not set out in Schedule 2 an amount in Penalty Units as determined by BASL or the Tribunal. Fixed Penalty Offence means anyone of the offences set out in part 3 of Schedule 1 or Schedule 2 Fixed Penalty System means the system set out in clauses 5.4-5.10. Form means any of the forms set out in Schedule 3 Instigator of a Melee means where a Player or Club Associate s conduct results in retaliatory action which leads to a Melee. The offence of Misconduct Instigator of Melee is in addition to the offence of Participating in a Melee which may have the effect of a Club Associate or Player being found guilty of both offences Match means any game of Football conducted by or under the control of BASL. Match Official includes the following: (i) Central Victorian Referees Branch appointed Senior Match Official (ii) Assistant Match Official (iii) Match Commissioner (iv) Any other person designated by BASL as a Match Official Match Official Commissioner means the person appointed by FFV or BASL under clause 14.1 Melee means a clash, confrontation, struggle, fight or altercation between 3 or more Players and or Club Associates whether on or off the field which is or is likely to be prejudicial to the interests or reputation of either the game of Football in Victoria, BASL or of any of its sponsors Misconduct shall mean any act or omission by a Club Associate or a Match Official which constitutes: a breach of the FIFA Statutes and Regulations; a breach of the FFA Statutes, Regulations, By-Law, policy or code of conduct which may be in place from time to time; (d) (e) (f) (g) a breach of the Laws of the Game; a breach of a BASL By-Law, regulation, code of conduct or policy unless such By-Law, regulation, code of conduct or policy contains a provision or provisions for dealing with any breach thereof; a breach of BASL s Rules of Competition; participating, assisting or arranging the participation or assistance of others in any match fixing, gambling or betting activities in relation to a Match; in the opinion of BASL, conduct which is or may be prejudicial to the interests of the game of Football in Victoria or to BASL or any of its sponsors. Misconduct Penalty means a penalty determined by BASL in accordance with part 3 of Schedule 2 Misconduct Penalty Offence means any one of the offences set out in Part 3 of Schedule 2 Notification can be via email, post or fax. Offence against a Match Official means one of the offences set out in R6.3- R6.6 of Part 3 of Schedule 1 Penalty Unit shall mean the amount set out in Schedule 2. Protest means a formal protest against a match result arising from an allegation that a Club has fielded an ineligible player. Red Card means either a Direct Red Card or an Indirect Red Card. Relevant Team means any team or teams which the Club Associate represents (whether formally or informally) or with which the Club Associate is connected in any way as determined by BASL. Suspension shall have the meaning set out in clause 8 and includes an Automatic Suspension and an Additional Suspension. Team Misconduct in relation to a Club s team means: BASL GDT By-Law 2017 5

(i) Where 5 or more of its Players are cautioned during the same Match (ii) Where 3 or more of its Players are sent off during the same Match Tribunal means the BASL Tribunal established pursuant to this By-Law. Headings are for convenience of reference only and do not affect interpretation 4. INVESTIGATION AND CHARGES 4.1 Subject to this By-Law, only BASL, BASL Committee of Management, FFV Chief Executive Officer (CEO) or a member of FFV staff designated by the FFV CEO may bring a charge of Misconduct against a Club Associate or a Match Official. 4.2 BASL or FFV may investigate any matter which in its opinion is relevant to whether or not a charge of Misconduct ought to be laid. Such investigation may be initiated on the basis of the report of the match official, a complaint by a Club, a report of any other person, or on the basis of any other evidence which in the opinion of BASL or FFV is credible. 4.3 A report (complaint) requesting an investigation must be submitted by a Club within 72 hours of the incident or event. 4.4 Such investigation may be carried out by BASL or FFV as it sees fit and all Club Associates and Match Officials are required to cooperate fully with BASL or FFV in the conduct of that investigation. 4.5 At any time BASL may determine whether any charge of Misconduct is to be laid and in relation such charge whether: (d) (e) (f) (g) it is to be referred to the Tribunal; or it is to be dealt with pursuant to the Fixed Penalty System or Misconduct Penalty System; or it is to be dealt with by mediation under this By-Law; or it is to be dealt with by referral to the Match Official Commissioner; or it is to be dealt with by any combination of the above, or no action is to be taken; or it is to be dealt with in any other manner which BASL or FFV deems appropriate; and such determination shall be at the absolute discretion of BASL or FFV and not be capable of review by any party. 5. ON FIELD MISCONDUCT 5.1 Any Misconduct by a Player which takes place after the players of competing teams have taken the field for a Match and before the expiry of 1 hour after such Match has been completed, (which time is referred to in this By-Law as Match Time) may result in the imposition of any or all of: BASL GDT By-Law 2017 6

a caution (Yellow Card), as defined in clause 5.2; an expulsion (Red Card) either Indirect or Direct, as defined in clauses 5.3 and ; a formal charge of Misconduct; on a Player in accordance with the provisions of this By-Law. 5.2 Yellow Card Offences (d) (e) (f) (g) (h) (i) A Yellow Card is a warning from a Match Official to a Player in respect of unsporting behaviour of a less serious nature (Law 12 of the Laws of the Game) and shall be given in respect of the conduct set out in Part 1 of Schedule 1. A Player who accumulates 5 Yellow Cards during the same Competition Season, regardless of the league or competition or Club in which those Yellow Cards are handed out (excluding junior competitions), shall receive the following sanctions which shall apply from the time at which the 5 th Yellow Card is received will incur an Automatic Suspension A Player who receives an additional 3 Yellow Cards (a total of 8 Yellow Cards in the same Competition Season), regardless of the league or competition or Club in which those Yellow Cards were handed out (excluding junior competitions), shall receive a twomatch Suspension which shall operate from the end of the game in which the last Yellow Card is received. This Suspension cannot be appealed. A Player who receives a further 3 Yellow Cards (a total of 11 Yellow Cards in the same Competition Season), regardless of the league or competition in which those Yellow Cards were handed out (excluding junior competitions), shall receive a three-match Suspension which shall operate from the end of the game in which the last Yellow Card is received. This suspension cannot be appealed. If a Player receives a third suspension for offences of this nature, that player must appear before the Tribunal. A Player who receives a further 3 Yellow Cards (a total of 14 Yellow Cards in the same competition season), regardless of the league or competition or Club in which those Yellow Cards were handed out (excluding junior competitions), shall receive a four-match Suspension which shall operate from the end of the game in which the last Yellow Card is received. This suspension cannot be appealed. If a Player receives a fourth suspension for offences of this nature, that player must appear before the Tribunal. A Player who receives 2 Yellow Cards whilst competing for the same team or Club in a Finals Series or Knockout Cup Match shall receive a 1 match Suspension which shall operate from the end of the game in which the last Yellow Card is received. This Suspension cannot be appealed. BASL will notify a Player s Club of any Suspension under this clause the two (2) days prior to the next Match in which the Player s team or Club is scheduled to play. 5.3 Red Card Offences A Direct Red Card may be issued by a Match Official against a Player who engages in any one or more of the types of conduct set out in Schedule 1 part 3. If a Player is given two Yellow Cards during Match Time in the same Match that person shall be given an Indirect Red Card which shall replace the two Yellow Cards which gave rise to it. If a Player is given a Direct Red Card during Match Time, any other Yellow Card which that Player has previously received in Match Time remains in place. (d ) Any player who has been sent off is not allowed to stand nearer than ten (10) meters from the touchline until the end of the match. Any such player is still regarded as being under the jurisdiction of the referee until the match is completed and the referee has left the field of play. Clubs will still be held responsible for the conduct of their Players in these situations. Failure to comply shall result in the player appearing before the Tribunal. (e) Subject to this By-Law, a Player who is given a Direct or Indirect Red Card: (i) (ii) must leave the field of play and its surroundings immediately, including the substitutes bench during a Match. shall receive: a) an Automatic Suspension; and b) a Fixed Penalty in accordance with clause 5.4. (iii) (iv) Any player who is given a Red Card will automatically serve the Automatic Suspension regardless if they have been notified or not; depending on the grading of the offence, the matter may be referred to the Tribunal; and (f) iii) iv) Any Player who receives a second suspension in the same Competition Season, regardless of the competition or league or Club in which it is received or in a Knockout Cup competition shall incur an Additional Suspension of 1 match. The Additional Suspension cannot be appealed and must be served immediately after the Automatic Suspension. Any Player who receives a third suspension in the same Competition Season, regardless of the competition or league or Club in which it is received or in a Knockout Cup competition shall receive an Additional Suspension of 3 weeks. This Suspension cannot be appealed and must be served immediately after the Automatic Suspension. A Players who is, for whatever reason, required to serve a fourth suspension in a given seasonwill be required to appear before the BASL Tribunal. The Tribunal reserves the right to take whatever acion it considers appropriate in such cases. Players who decline to attend will be suspended until such time as they do appear before the BASL Tribunal Fixed Penalty System 5.4 Red Cards given in a Match are governed by the Fixed Penalty System. In addition to clause 5.3 any Player who receives a Red Card in a Match shall be subject to the sanctions set out in Part 3 of Schedule 1 depending on the grading of the offence in accordance with the guidelines set out in Part 3 of Schedule 1. Tribunal Request Against Red Card 5.5 A Player who has received a Red Card may choose not to accept the Red Card in which case a completed Tribunal Request Form as set out in Schedule 3 and the Tribunal Request Fee set out in Schedule 2 (Tribunal Request Fee) must be lodged with BASL by COB on the Monday following notification in writing from BASL of the Red Card. At the time of lodging a Tribunal Request Form all monies owed by the Player s Club to BASL must be paid in full. Where the provisions of clause 5.5 and have not been complied with the Tribunal shall have no jurisdiction to hear a matter and the original Fixed Penalty shall apply. In other words and for the avoidance of doubt no Tribunal Request Form or any other appeal may be commenced unless the Appellant s Club has paid all monies due and owing to BASL. 5.6 Upon receipt of a Tribunal Request Form BASL shall convene a Tribunal to hear the matter as soon as practicable. 5.7 Subject to this clause at that hearing the Tribunal shall have no power to remove a Red Card or reduce a Fixed Penalty but may: (d) make a finding that the offence has not been proven in which case it may remove any Additional Suspension that may have been imposed. make a finding that the offence has been proven in which case the Tribunal may, in its discretion, increase the Fixed Penalty or impose any additional sanctions on the Player as it sees fit. make a finding that the Player is guilty of a different offence or the same offence but at a different grading in which case the relevant Fixed Penalty shall be applied and, if the Tribunal in its discretion sees fit, it may increase that Fixed Penalty or impose additional sanctions. Any Tribunal Request request that results in penalty which less than the relevant Fixed Penalty for the original offence, will have 50% of the Tribunal Request Fee refunded. 5.8 Notwithstanding the lodging of a Tribunal Request Form, until the Tribunal has determined the matter a Player must serve all applicable Suspensions. 6. OTHER MISCONDUCT 6.1 Misconduct Penalties BASL has adopted a system of penalties that apply to conduct by Club Associates which constitutes a Misconduct Penalty Offence (Club Associate or Player Misconduct). A Club Associate who has been issued with a Misconduct Penalty (Club Associate or Player Misconduct) by BASL can request a Tribunal hearing in which case the provisions of clauses 5.5-5.8 of this By-Law shall apply as though a reference to: (i) Red Card therein was a reference to Misconduct Penalty as the case may be (ii) Player was a reference to Club Associate and (iii) Fixed Penalty was a reference to a Misconduct Penalty under this clause 6. (d) Once a Club Associate lodges a Tribunal Request against a Misconduct Penalty, then such penalty shall be suspended while the Tribunal s decision is pending. A request against the Misconduct Penalty must be lodged with a Tribunal Request fee of $100.00. The payment of $100.00 shall be fully refundable when a Request against the Misconduct Penalty is successful. 6.2 In cases of repeated Misconduct where in a Competition Season or Finals Series a Club Associate is: found guilty of one of the following Misconduct Penalty Offences (First Offence): (i) MP1 (ii) MP2 (iii) MP3 (iv) MP10 (v) MP11 (vi) MP12 MP16 (referred to in this clause as a Serious Offence); and is subsequently found guilty of a different Serious Offence (Subsequent Offence) within 12 months of the First Offence regardless of whether that Subsequent offence takes place in a Competition Season or Finals Series for the purposes of penalty under part 3 of Schedule 2 the Subsequent Offence shall be treated as a second or subsequent offence of whichever of the Serious Offences found to have been committed carries the greater minimum penalty. By way of example only a Club Associate found guilty of first MP5 and then MFP 6 for the purposes of penalty in relation to the MP6 offence the MP5 offence shall be treated as a first offence of MP6 such that the minimum penalty shall be 2 Penalty Units and loss of 3 points. 7. BASL MAY BRING CHARGE 7.1 BASL may bring a charge of Misconduct against a Club Associate or Match Official whether pursuant to clause 4 or otherwise. BASL GDT By-Law 2017 10

7.2 In the case of a charge of Misconduct against a Match Official such charge will ordinarily be referred to the Match Official Commissioner but may, if BASL considers it necessary be referred to the Tribunal. 8. SUSPENSIONS 8.1 A Suspension from a Match is a ban on taking part in a Match in any capacity, which includes but not limited to participating in any capacity as a Club Associate, or attending in the technical/bench area. 8.2 A Suspension on a Club Associate shall be served in consecutive fixtures for which the Club Associate is eligible in the level at which the incident giving rise to the Suspension occurred (including if necessary in the following competition season and/or Finals Series) the Club Associate participates in. In the case of all Suspensions until the Suspension is served a Club Associate must not participate in any other fixture at any level in BASL competitions. A Suspension arising out of a Finals Series which is not served in full in that series shall be carried over to the following competition season in which the Club Associate participates. 8.3 If a Player plays regularly in another age group and is unable to complete the sentence imposed in the age group where the offence was incurred, for whatever reason, then on a request from the Player s club, BASL may take whatever action it deems appropriate 8.4 If a Match is postponed prior to its commencement, such Match will not be classified as a match served under a Suspension. 8.5 A Match which is abandoned after commencement, or forfeited, shall count as a Match served under a Suspension unless: any Club or team to which the suspended Club Associate belongs was responsible for the facts that led to the abandonment or forfeit. an incident leading to the abandonment or forfeit of a fixture is referred to the Tribunal. 9. MEDIATION 9.1 In relation to any alleged Misconduct, BASL may require a Club Associate to attend a meeting with BASL and an independent person who shall act as a mediator for the purpose of attempting to reach agreement as to how such allegations are to be dealt with. 9.2 Such meeting shall be conducted on a without prejudice basis and the mediator shall have no power to impose any decision on any of the parties. 9.3 A failure by a BASL Club Associate to attend such a meeting when requested without reasonable excuse shall amount to Misconduct. 9.4 Unless agreement is reached at such a meeting and recorded in writing and signed by the parties in the form set out in Schedule 3, BASL may in its complete discretion, decide to refer the allegations of Misconduct to the Tribunal. 10. PROTESTS 10.1 Lodging of Protest A Club may only lodge a Protest about the validity of a Match result based on the eligibility of a Player/s. A Protest can only be lodged by one of the Clubs which participated in the Match which is being disputed. To avoid doubt the decisions of the Senior Match Official regarding any matters connected with the field of play are final and cannot be protested or appealed by any party. 10.2. Declaration of Protest Any Club wishing to lodge a Protest must within 72 hours of the completion of the Match: (i) complete and submit to BASL a Protest Form in the form set out in Schedule 3. (ii) Pay the amount set out in Schedule 2 (Protest Fee) A failure to comply with clause 10.2 will mean that the Protest shall be invalid. 10.3 Refund of Protest Fee If the Protest is upheld by the Tribunal the Protest Fee shall be refunded by BASL. 10.4 Operation of this Clause This Clause will be administered by BASL. 11. NOTIFICATION 11.1 Subject to clause 12.12 where BASL is required under this By-Law to notify any Club or Club Associate of any matter then such requirement shall be deemed to have been satisfied by BASL publishing such matter on its website and any one of the following: sending any such notification by email to the Club or Club Associate s email address last identified to BASL by it or them. sending such notification by fax to the Club or Club Associate s fax number last identified to BASL by it or them. sending such notification to the Club or Club Associate s address by pre-paid ordinary mail last identified to BASL by it or them. 11.2 For the purpose of calculating any relevant time periods such notification will have been deemed to have taken place: in the case of notification by website the day on which it was published online. If in fact the information being notified involves the weekend s matches, then notification must be published on the website by no later then 12:00pm on Friday. in the case of notification by email or fax at the time at which such email or fax is sent. If in fact the information being notified involves the weekend s matches, then the email or fax must be sent through by no later then 12:00pm on Friday. BASL GDT By-Law 2017 12

in the case of notification by post at the expiration of 2 business days following the date on which such notification was posted. If in fact the information being notified involves the weekend s matches, then the notification must be posted by 4:00pm on Wednesday. 12. BASL TRIBUNAL Appointment & Composition of the Tribunal 12.1 (d) (e) (f) (g) BASL shall appoint a Tribunal consisting of such person or persons as BASL shall from time to time deem fit (Tribunal Members). BASL shall appoint one of the Tribunal Members to be BASL Tribunal Chairperson. Where at a particular hearing Tribunal consists of more than one Tribunal Member: (i) if the BASL Tribunal Chairperson is one of the Tribunal Members appointed for that hearing he or she shall act as Chairperson at the hearing, (ii) if the BASL Tribunal Chairperson is not one of the Tribunal Members appointed to the Tribunal for that hearing, BASL shall appoint one of the Tribunal Members to act as Chairperson at the hearing. A person shall not be appointed to the Tribunal if they: (i) are a member, officer or official of a Club, or (ii) are a BASL Committee Member or a BASL Employee, or (iii) are a party to or in any way directly or interested in a matter to be heard by the Tribunal, or (iv) otherwise have any relationship with any party to the matter such that that person is or may be seen to be not independent. Subject to this By-Law the Tribunal shall, ordinarily, consist of 1 Tribunal Member, but can sit with up to 3 Tribunal Members. A person appointed as a Tribunal Member may be removed from the Tribunal at the discretion of BASL. No Tribunal Member may represent a Club or Club Associate in any proceedings before the Tribunal whilst a Tribunal Member or within 12 months from the end of their term of appointment as a Tribunal Member. Jurisdiction of Tribunal 12.2 The Tribunal shall have jurisdiction in respect of: any matters referred to it by BASL including but not limited to a matter involving a person who has submitted to the jurisdiction of BASL. any request by a Club Associate to review an expulsion pursuant to clause 5 of this By- Law. Any other matter in respect of which the Tribunal is given jurisdiction. 12.3 To avoid doubt the Tribunal shall not have any power to hear disputes relating to player, coach or officials contracts with Clubs. Tribunal Procedure BASL GDT By-Law 2017 13

12.4 If BASL determines to refer a matter to the Tribunal it shall: notify all persons who may be affected by the Tribunal s decision of the following matters: (i) the time, date and place at which the hearing will take place (at least 48 hours prior to the hearing). (ii) sufficient details of the allegations against the party charged to enable the party to prepare a response to the allegations. (iii) details of any documents or other evidence (e.g. video evidence) which will be relied upon at the hearing in support of the charge. (iv) that the party may make written representations to the Tribunal and/or ( appear before the Tribunal to make submissions. The Tribunal may conduct the hearing in any manner as it sees fit including but not limited to by way of teleconference or video conference and may, if it considers it appropriate, allow an amendment to the charges or adjourn the hearing provided that: (i) (ii) all parties affected are given a reasonable opportunity to be heard. The hearing is conducted with as little formality and technicality and with as much expedition as proper consideration of the matters before it permits. (d) The Tribunal is not bound by the rules of evidence or by the practices or procedures applicable to courts of record but may inform itself as to any matter and in such manner it deems appropriate. The Tribunal at its sole discretion may determine a matter before it in the absence of any parties. 12.5 Subject to this By-Law the Tribunal may make guidelines with respect to practice and procedure of a hearing provided that such guidelines are not inconsistent with this By-Law. Any such guidelines are not binding on the Tribunal and any decision by the Tribunal will not be invalid by reason of a guideline not being followed. 12.6 Notwithstanding the above, the Tribunal may follow these procedures: (d) (e) (f) (g) at the commencement of a hearing the Tribunal member or chair may read out each charge. the person charged, if present, may be asked whether or not they plead guilty or not guilty. the parties may be invited to give to the Tribunal a summary of the matters on which they wish to rely. if video evidence of the match or incident is available, then the video evidence may be produced to and viewed by the Tribunal before any person has given his or her evidence. the Tribunal may require any witnesses who are not parties to the matter to go outside the hearing room until they are called upon to give evidence. where the author of a document relied upon by a party is not present to be questioned about that document, the Tribunal may attach such weight as it deems appropriate to the document. the parties may call evidence from such witnesses as are permitted by the Tribunal and all such witnesses can be subject to questioning by the other party or members of the Tribunal. (h) (i) (j) (k) evidence may be given in person or by way of a telephone or video link. if video evidence is to be relied on then the Tribunal must view all of the relevant sections of that video evidence. submissions made by the relevant parties to a hearing shall be considered by the Tribunal at its discretion. the Tribunal may either on its own motion or on an application by a party adjourn the hearing of any matter on such terms as it sees fit. 12.7 Use of Legal Representation Clubs are entitled to use legal representation at any Tribunal Hearing (including Appeals Hearings). The decision to use legal representation is at the sole discretion of the club. 12..8 Use of Video Evidence; (d) Visual aids (videos, films, etc) to support or question referee s report regarding offence punishable by expulsion can be used to verify the player s identity. Audiovisual evidence is to be used solely as additional proof in disciplinary cases. Decisions of fact made by referees are final and not subject to appeal and shall not be modified on the basis of video recordings (e.g. offside, penalty, goals, etc). Decisions must be based principally on the reports of the referee and assistant referees, as well as those other officials. Video Recordings shall not be used as a means of restricting the authority and discretionary power of the referee, but only as the most accurate way of investigating the truth when disciplinary action is required. (e) Such evidence may also be referred to, if further sanctions are to be imposed on a guilty party. 12.9 At the completion of the evidence: (d) (e) the parties shall leave the hearing room if requested by the Tribunal. the Tribunal will consider all the evidence and submissions made during the hearing and make a determination on the balance of probabilities with respect to whether or not the charge or charges or matter have been proven. the Tribunal may determine that the party charged is guilty of the offence charged but at a lesser grading or is guilty of a different offence provided that if the Tribunal considers a different offence may have been committed it must give the party charged an opportunity to put any evidence in relation to that different offence that it wishes to. where the Tribunal is constituted by 3 persons then it will be sufficient for a majority of those persons to agree on the decision. where the Tribunal is constituted by 2 persons the Chairperson shall have a casting vote. Penalties and Sanctions 12.10 If the Tribunal finds that: (i) the charge or charges have been proved; or (ii) the party charged is guilty of the offence charged but, in the case of a Fixed Penalty Offence at a different grading or guilty of a different offence BASL GDT By-Law 2017 15

then prior to imposing any penalty or sanction it may invite the parties to make submissions to the Tribunal on the question of what penalty or sanction, if any, ought to be imposed. In addition BASL or it representatives, may make submissions to the Tribunal on the question of what penalty or sanction, if any, ought to be imposed. (d) The Tribunal may then review the past tribunal and discipline history of the club and/or individual once charges have been proven. (e) The Tribunal may then review past penalties handed down by the Tribunal with similar charges. 12.11 Subject to clause 12.15-12.16 the Tribunal may have regard to any matters which it considers relevant to the question of penalty and, without limitation, may consider: (d) the seriousness of the conduct with which the party is charged or found guilty of by the Tribunal; any loss or damage sustained by any party howsoever arising from the conduct; evidence of prior proven Misconduct by the party charged; insofar as they are relevant, the objectives of the BASL Constitution. 12.12 After hearing any such submissions the parties shall leave the hearing room and the Tribunal shall consider its verdict on the question of penalty. Unless the Tribunal is unable to reach a decision within a reasonable time it shall announce such decision to the parties on the day of the hearing. Where that is not possible BASL shall advise the parties of the Tribunal s decision as soon as practicable following the Tribunal hearing. Without imposing any binding obligation on the Tribunal it is expected that in most cases the Tribunal will announce its decision on the day of the hearing. 12.13 Where, at the hearing or before or after it, a party conducts itself in a manner which the Tribunal considers is in contempt of or shows contempt for the Tribunal the Tribunal may impose a fine of up to 10 Penalty Units on such party in addition to any other penalty or sanction handed down by the Tribunal. 12.14 The Tribunal is not obliged to give reasons for any decision made by it. 12.15 BASL will publish the Tribunal s decision on its website as soon as practicable and such publication shall constitute notification of the Tribunal s decision for the purposes of the provisions of this By-Law relating to appeals from a decision of the Tribunal. 12.16 Subject to clauses 12.14-15 the Tribunal may impose, in its own absolute discretion, any one or more of the following penalties or outcomes on such terms as it sees fit: (d) (e) (f) (g) (h) Expulsion Disqualification Suspension A Fine A reprimand or caution Deduction of Championship points Compulsory attendance at a course or courses of education or rehabilitation including without limitation an anger management course approved by BASL on such terms as the Tribunal sees fit; and Any such other sanction or penalty as the Tribunal sees fit except any form of suspended penalty or a bond. 12.17 Where a Club Associate is found guilty by the Tribunal of a Fixed Penalty Offence or Misconduct Penalty Offence, the Tribunal must impose as a minimum the relevant Fixed Penalty or Misconduct Penalty in respect of such conduct and may if it see fit impose any such additional sanctions as set out in clause 12.14. Where clause 12.15 applies and the Tribunal imposes a penalty less than the relevant Fixed Penalty or Misconduct Penalty, BASL may, within 48 hours of the Tribunal decision being advised to the parties, and without the need for any further submission from any party make a determination of the appropriate penalty or sanction and for the purposes of clause 13 such determination shall stand as the determination of the Tribunal. 13. APPEALS 13.1 Subject to this By-Law a party subject to a determination of the Tribunal or the Match Official Commissioner may appeal such to the BASL Appeals Board. 13.2 BASL shall establish an Appeals Board to hear appeals under this By-Law or appeals allowed under any other BASL Regulation, By-Law or Policy. The Appeals Board shall be constituted by such persons as BASL sees fit and whom has not be involved with the earlier matter. The provisions of clause 12 shall apply to the appointment, composition and procedures of the Appeals Board with such modifications as are necessary. The provisions of clause 12 shall apply as though a reference to Tribunal therein was a reference to Appeals Board. Time and Notice of Appeal 13.3 An appeal shall be brought: no later than 5:00pm seven (7) days after the day on which the decision of the Tribunal or Match Official Commissioner was notified by BASL. by lodging with BASL a duly completed and signed Notice of Appeal in the form set out in Schedule 3 and payment of the appeal fee set out in Schedule 2 (Appeal Fee). 13.4 The Notice of Appeal shall specify: whether the appeal is against the findings made by the Tribunal or Match Official Commissioner; and/or whether the appeal is against the severity of the penalty or outcome imposed by the Tribunal or Match Official Commissioner. such other details as set out in the relevant Form BASL GDT By-Law 2017 17

13.5 The Notice of Appeal may be lodged with BASL by: delivering it; or transmitting by facsimile or email Notification 13.6 Upon receipt of the Notice of Appeal BASL shall: fix a date, time and place for the hearing of the appeal as soon as practicable after 48 hours; and advise all parties interested in the appeal in writing of these particulars at least 48 hours prior to the hearing. 13.7 The Appeals Board may vary the date, time or place specified under these rules and upon doing so BASL shall immediately provide all parties interested in the appeal written notice of any such variation provided that it shall endeavour to complete the appeal as soon as possible after 48 hours. Appeal Hearing 13.8 An appellant shall attend and appear before the Appeals Board at the date, time and place fixed for hearing of the appeal. Where an appellant fails to attend before the Appeals Board, the Appeals Board may hear and determine the appeal in the appellant s absence. (d) The Appeals Board shall: (i) provide any person whose interests would be directly and adversely affected by its decision a reasonable opportunity to be heard; (ii) determine the matter before it in an unbiased manner; and (iii) make a decision that a reasonable body could honestly arrive at. Subject to clause 13.8 (d) where the appeal is in relation to a Suspension, such Suspension shall remain in place pending the determination of the appeal. The Chairperson of the Appeals Board may, on application by a party to the appeal or of its own motion: (i) (ii) order that the appeal be adjourned; stay the execution of any sanction imposed on the appellant pending the determination of the appeal. (e) (f) (g) The Appeals Board may only make an order pursuant to clause 13.8 (d) where it is satisfied that there are exceptional and compelling circumstances that make it harsh and unconscionable if an order was not made. The Appeals Board must rehear the matter on its merits as a new hearing. Subject to the matters set out in this By-Law the Appeals Board may regulate any proceedings brought before it in such manner as it sees fit. BASL GDT By-Law 2017 18

(h) (i) (j) (k) (l) The hearing before the Appeals Board shall be: (i) inquisitorial in nature; (ii) a new hearing on the merits; and (ii) conducted with as little formality and technicality and with as much expedition as the proper consideration of the matters before it permit. The Appeals Board is not bound by the rules of evidence or by the practices or procedures applicable to courts of record but may inform itself as to any matter and in such manner it deems appropriate. The Appeals Board may confirm, reverse or modify the decision appealed from and, subject to this By Law make such orders and give such directions in such matters as it deems appropriate. If the Appeals Board in a particular matter is constituted by more than one person, the question(s) on appeal before the Appeals Board must be decided according to the opinion of the majority of the members of the Appeals Board hearing the matter. Where the Appeals Board consists of only two persons, the Chairperson shall have a deciding vote if necessary. At that hearing the Appeals Board shall have no power to reduce a Fixed Penalty or a Misconduct Penalty but may: (i) make a finding that the offence(s) has/have not been proven in which case it may order that 50% of the Appeal Fee be refunded; and, it may remove any Additional Suspension that may have been imposed. (ii) in the case of a Fixed Penalty Offence make a finding that the offence or the same offence at a different grading or a different offence has been proven provided that if the Appeals Board considers a different offence may have been committed it must give the party charged an opportunity to put any evidence in relation to that different offence that it wishes to in which case provided the provisions of clause 12.8 have been applied as if a reference to the Tribunal therein is read as a reference to the Appeals Board : the Appeals Board must impose or confirm the imposition of the relevant Fixed Penalty for that offence. In addition it may, in its discretion, increase the Fixed Penalty or impose any additional sanctions on the Club Associate as it sees fit. (iii) (iv) In the case of all other offences, conduct or omissions the Appeals Board may impose such penalty or sanction as it sees fit. make such other findings as is required by the nature of the appeal Appeals Board Decisions 13.9 The Appeals Board is not obliged to provide reasons for its findings but those findings will be notified to the parties by BASL. If the Appeals Board provides reasons then the Appeals Board may authorise BASL to publish those reasons on the BASL website. BASL GDT By-Law 2017 19

13.10 Where a party has exhausted all avenues of appeal within BASL, that party may appeal that decision via Football Federation Victoria and Football Federation Australia s National Disciplinary Regulations and Grievance Resolution Regulations. Subject to clause 13.10 a decision of the Appeals Board shall be final and binding on the parties and no party may take any action in any court or tribunal or other forum to challenge such decision or seek to have it varied in any way. 14. MATCH OFFICIAL MISCONDUCT 14.1 BASL may appoint a person to act as Match Official Commissioner to hear charges of Misconduct by a Match Official. 14.2 Clauses 12.2-12.12 shall apply to any hearing conducted by the Match Official Commissioner as if the Match Official Commissioner was the Tribunal 14.3 Where a Match Official is guilty of any act or omission, committed in his or her capacity as a player, which results in any one or more penalties set out in R6.1-R6.6 of Part 3 of Schedule 1, subject to any appeal to the Appeals Board, BASL may refer the conduct or omission to the Match Official Commissioner who shall not have any power to redetermine the question of the guilt of the Match Official but may impose such penalties as the Match Official Commissioner thinks fit in addition to any penalty or sanction imposed on the Match Official in his capacity as a player. 14.4 Clause 14.3 shall apply only after the expiry of the time for any appeal under clause 13 or the determination of any such appeal 14.5 Without limiting the generality of clause 4 a Match Official shall be guilty of Misconduct if that Match Official engages in any of the conduct set out in R6.1- R6.6 of part 3 of Schedule 1 14.6 The penalties able to be imposed by the Match Official Commissioner include but are not limited to: (i) (ii) (iii) (iv) (v) A Fine A reprimand or caution Suspension from acting as a Match Official for such period and on such terms as the Match Official Commissioner thinks fit. Disqualification from acting as a Match Official for such period and on such terms as the Match Official Commissioner thinks fit. Require the Match Official to attend such training courses at his or her own expense as the Match Official Commissioner sees fit the Match Official Commissioner sees fit. 14.7 A decision of the Match Official Commissioner may only be appealed to the Appeals Board. 15. LOAN PLAYERS 15.1 Under no circumstances are Clubs permitted to sign players on Loan agreements or any other agreements to this effect. 16. PLAYER CONTRACTS / AGREEMENTS 16.1 Clubs are not pemitted to enter into contractual agreements with players BASL GDT By-Law 2017 20

17. UNREGISTERED AND INELIGIBLE PLAYERS 17.1 Definitions For the purposes of this clause: Team means a group of players fielded by a Club to participate in an BASL fixture as defined in the 2012 BASL Rules of Competition. Unregistered player means a player who is not registered in accordance with the FFV Registration Regulations 2012. Ineligible player means a player who is one of the following; o Playing for the wrong Club or Team o Playing without an ITC (International Transfer Certificate) o Playing within a stand-down period due to; Change of Status Changing Clubs Awaiting an ITC (International Transfer Certificate) o Playing while registered for two clubs at the same time without seeking a Dual Registration exemption to do so o Playing whist under suspension o Playing whist not eligible to do so (for any other reason) due to age, division restrictions or rules of the Knockout Cup. Field means to record a player s name on the Match Record and Fields and Fielded shall have corresponding meanings Offence means when BASL has found (upon investigation, audit, processing or notification) there has been a breach of this clause regardless of the number of previous fixtures in which an Unregistered or Ineligible Player(s) has participated. Fixture means a game of Football sanctioned by BASL as part of a competition. 17.2. Scope and Penalties All Clubs and Teams must register all their players and coaches in accordance with the FFV Registration Regulations. BASL may find Unregistered or Ineligible player(s) through random audits, daily processing or upon investigation following notification of a breach of this clause or a Protest. Where a Club or Team Fields an Unregistered or Ineligible Player (Offence) the following shall apply: (i) For a first Offence in a Competition Season or Knockout Cup the Player s Club will be issued a Fine: (i) BASL may take any disciplinary action it deems necessary against the offending Club and/or Player, including imposing a fine on the offending Club (maximum of $500.00 per offence) (ii) 1.0 Penalty Units for Teams competing in Junior Competition or 2.0 Penalty Units for Teams competing in Senior competition. For any additional player Fielded in the same Fixture for the same Team, a Fine of 0.5 Penalty Units will be issued for each additional player, and BASL GDT By-Law 2017 21

In relation to each team which fields that player (i) (ii) (iii) If the Team that fields an unregistered or ineligible player(s) wins a Fixture, that fixture shall be awarded 3-0 to the opposition team. If the Team that fields an unregistered or ineligible player(s) draws a Fixture, that fixture shall be awarded 3-0 to the opposition team. If the Team that fields an unregistered or ineligible player(s) loses a Fixture, that fixture shall be adjusted to 3-0 in favor of the opposition team, unless the losing margin is greater in which case such the final score shall remain unchanged. (d) In addition in relation to each Team which Fields that Player; that Team will have 3 championship points deducted. To avoid doubt where clause 17.2(i) applies this shall not be counted as a second or subsequent Offence Subject to clause 17.2(d) (ii) (iii) (iv) For a second Offence in a competition season or Knockout Cup, the Player s Club will be fined double the applicable Fine for a first Offence referred to in Clauses 17.2 (i) and and in addition, the provisions of clause 17.2 (i) shall apply For a third or subsequent Offence in a Competition Season or Knockout Cup, the Player s Club shall be charged with Misconduct which charge shall be referred to the Tribunal and in addition to any sanctions or penalties imposed by the Tribunal the provisions of clause 17.2(i) and shall apply to all Teams in the Player s Club regardless of whether or not that Team has Fielded that Player. For any offence which occurs in a Finals Series (whether a first or subsequent offence), the above sanctions will apply with the exception of 16.2 (i) C, which will be substituted with the following sanction: If the Team that Fields an unregistered or ineligible Player(s) wins a Fixture, that fixture shall be awarded 3-0 to the opposition Team. If the Team that Fields an unregistered Player(s) draws a Fixture, that Fixture shall be awarded 3-0 to the opposition Team. If the Team that Fields an unregistered Player(s) loses a Fixture, that Fixture shall be adjusted to 3-0 in favour of the opposition Team; unless the losing margin is greater in which case the final score shall remain unchanged and BASL may refer the matter to the Tribunal. (d) Clauses 17.2(ii) and (iii) shall not apply unless BASL has notified the Player s Club of a first Offence under clause 17.2(i) prior to the Match in which the second or subsequent Offence is alleged to have occurred. (e) Subject to clause 17.3 a decision of BASL under this clause 17.2 may be appealed to the BASL Tribunal within 72 hours of notification only on the grounds that the ineligibility of a Player was due solely to a system or technical fault with the online registration system referred to in the 2011 FFV Registration Regulations. 17.3 Applicability To avoid doubt, if there is a system or technical error in processing a registration, the above sanctions will be imposed until such system or technical error proven so by the Club or team or Player save that: (i) Only those system or technical errors that occur on weekdays up until 5.00pm on a Friday, excluding Public Holidays) will be taken into account. (ii) Should a Club or Team decide to process registrations on non-business days (Weekends and/or Public Holidays) or after 5.00pm on a Friday, the Club or Team is responsible for ensuring all registrations are successfully processed and valid for all Club and team fixtures. Clause 17 of this By-Law shall only be applied to the fixture in which the Offence (as defined above) has been found. For the avoidance of doubt, Clause 17 shall not be applied to a fixture(s) prior to the fixture deemed to be the first Offence. 17.4 False or Misleading Information Providing false or misleading information on a Prescribed Registration form or document or via the on-line Registration System constitutes Misconduct and may be referred to the BASLTribunal for determination. 18. FAILURE TO RESPECT DETERMINATIONS 18.1 Subject only to the specified rights of appeal, a determination of the Tribunal or the Appeals Board (Determination) is final and binding on all parties. The parties undertake to carry out the Determination without delay. 18.2 A failure to comply with a Determination within the manner or time as prescribed by that Determination is itself a breach of the Rules of Competition/GDT By-Law and the noncompliant party may be subject to further sanction. 18.3 Without limiting the generality of clause 17.2, any party who fails to pay another party a sum of money in full as required by a Determination will be: fined ; given a time limit in which to settle the debt; and if the party the subject of the Determination is a Club, that Club will be have 3 Championship points deducted from each of its teams in BASL competitions if it has not paid by the time limit referred to in paragraph 17.3.
