Present Reeve: Councillors: Division 1 Travis Lindsay 10:28 am Division 2 Division 3 Norman Wright Division 4 Division 5 Division 6 Joe Koch CAO: Joanne Loy Call to Order Reeve Lamb called the meeting to order at 9:01 a.m. Councilor requested a recorded vote on the following motion: Councilor Joe Koch did not vote on the motion due to a conflict of interest relating to the original motion 18/228 passed at the July 5, 2018 meeting: Motion 18/235 WALDE: Whereas: The RM of Manitou Lake Public Notice Bylaw 18/228 2018-01 did not take effect as the RM of Manitou Lake Public Notice Bylaw 10-05 was not followed in changing it; Whereas: Motion18/228 issues have never been brought before full Council; And Whereas; There has never been a reasonable discussion of this issue even in the concept stage; And Whereas; Council s decisions must be made with the utmost of transparency, honesty, integrity, objectivity, and respect for Ratepayers; Be it resolved; That motion 18/228 be rescinded. Councilor suggested a friendly amendment to Motion 18/235 to replace the first clause Whereas: The RM of Manitou Lake Public Notice Bylaw 2018-01 did not take effect as the RM Public Notice Bylaw 10-05 was not followed in changing it; with Whereas: All of Council was not notified; Mover Councilor Walde accepted the friendly amendment. Financial Accounts 18/237 KOCH: That the Statement of Financial Activities for the month of July 2018, be accepted as read. 18/238 WALDE: That the list of accounts to August 9, 2018 be authorized for payment, with the addition of the council indemnities, and that a list of cheques numbered 19910 to 19965 inclusive, together with the EFT Payroll deposits and online Receiver General remittances totaling $1,080,850.22 be annexed hereto and form a part of these minutes. 454 18/239 WALDE: That Progress Payment #5 for Larry Fehr Construction Payment for 454 in the amount of $105,928.97 be authorized for payment. Council recessed from 10:02 am to 10:12 am In Camera Out of Camera Shari-Anne Dooleage, SAGE Analytics with Ian McCormack, Strategic Steps via telephone 18/240 LAMB: That the RM of Manitou Lake No 442 Council moves to an incamera session to discuss advice developed for the RM as authorized by the legislative authority of Section 120 of The Municipalities Act including the exemptions in Part III of The Local Authority Freedom of Information and Protection of Privacy Act at 10:13 am. 18/241 LAMB: That the RM of Manitou Lake No 442 Council rises from the in-camera discussion at 11:35 am. Governance 18/242 WALDE: That the RM of Manitou Lake No 442 Council accept the Review Governance Review completed by Strategic Steps Inc. as information Accept for Council s further consideration. Gov Rev Meet Dylan Smith, Pinter & Associates Inc Laura Graham, RM Resident 18/243 SWANSTROM: That the RM of Manitou Lake No 442 Council hold a special meeting on Thursday August 23, 2018 at 9:00 am for Council to discuss the Governance Review Report. Council recessed for lunch from 11:58 am to 12:54 pm. Councilor Norman Wright did not return to the meeting after lunch.

RM OF MANITOU LAKE NO. 442 3 August 9, 2018 Councilor requested a recorded vote on the following motion: Deny 18/244 LINDSAY: That the invoice presented to the RM of Manitou Lake Legal Fees No 442 Council by Bob Biensch in the amount for Lawyer s Bill - $3330.00, Mileage Bob Biensch 6 days/2174 km - $3460.00, Mileage Bill Biensch 3 days/978 km - $1630.00, Mileage Sherrie Brown 3 days/978 km - $1630.00, Mileage 2 days/274 km - $996.00, Mileage 2 days/274 km - $996.00 totalling $12,042.00 be denied as the it is a personal issue between two individuals not an RM issue. Travis Lindsay Joe Koch ABSTAINED: Councilor abstained from voting as he feels it is an RM issue not a personal issue and it will cost the RM more later. Comm 18/245 WALDE: That a letter be sent to the list of possible Commercial Assessments Properties requesting that they confirm whether there is a business operating from that location. Cancel WYWRA Colleen F Digness, Village of Marsden Administrator 18/246 LINDSAY: That the RM of Manitou Lake No 442 Council cancel the RM s Membership with the West Yellowhead Waste Resource Authority effective immediately and pay the cancellation fee of $10 per capita at 574 residents, and replace the recycle bin at the RM Office and the waste bin at the RM shop with bins from Quick Pick at a cost of $35 per month and $70 per month, respectively, with free delivery plus 5% Environmental fee and applicable taxes. Councilor requested a recorded vote on the following motion: Mar 6 18/247 LAMB: That the video recording provided by Wiley Productions of the Meeting RM of Manitou Lake No. 442 Ratepayer s Meeting held March 6, 2018 be accepted as minutes of the Ratepayer s Meeting. Travis Lindsay ABSTAINED: Joe Koch Defeated Councilor Joe Koch abstained from voting due to him being a witness for an alleged incident that occurred at the meeting. Rural Crime 18/248 WALDE: That the RM of Manitou Lake No. 442 Council place the Petition Rural Crime Petition requesting the Government of Canada to ensure that there is additional funding provided to the RCMP and the mandate includes the prevention of crime and investigation of criminal activity be top priority for the RCMP on the front counter.

RM OF MANITOU LAKE NO. 442 4 August 9, 2018 SAMA Audit Comp 18/249 KOCH: That the letter from SAMA advising that the RM of Manitou Lake is Compliant under the 2018 Primary Audit Report be acknowledged. SAMA 18/250 LINDSAY: That the 2018 SAMA Confirmation Certificate be Confirmation acknowledged. Plains 18/251 WALDE: That the RM of Manitou Lake acknowledge the letter from Midstream Plains Midstream Canada ULC regarding maintenance work within 35-44-26 their right-of-way on NE 35-44-26-W3M and further approves the use of an existing approach and the installation of a temporary approach for access with approval being valid for 12 months. Borderlands 18/252 KOCH: That the RM of Manitou Lake No 442 enter into an Agreement Mutual Aid to establish the Borderlands Emergency Management Mutual Aid Agreement. Drainage 18/253 KOCH: that the RM of Manitou Lake No 442 initiate and enter into an 46-26-3 Agreement for an Application and Approval for Drainage works on 13, 18, 24, 25-46-26-W3M with all affected landowners up to Tucker s Lake. Subdiv n 18/254 KOCH: That the Parcel Tie Removal and Subdivision out of 20-46-26 SE 20-46-26-W3M, severed by Road Plan Parcel No. 127615776 be approved with Community Planning to be advised that the RM Council is unaware of any land uses that may be incompatible. Culvert Purchase 18/255 LINDSAY: That the quote from Prairie Steel for a load of assorted culverts delivered in the amount of $30,847.19 including taxes be approved. TWP 460 18/256 LINDSAY: That the cost estimate provided by the RM of Hillsdale No 1-46-25-3 440 for the joint project to rebuild TWP 460 South of 1-46-25-W3M in the amount of $238,476 be approved for construction utilizing the same contractor as the RM of Hillsdale being Ulmer Construction. CAT Rental IPad Price N Tindall Culvert Foreman Report 18/257 LINDSAY: That the RM of Manitou Lake and the RM of Hillsdale share in the cost of using Dean Flicek s CAT for the rebuilding of the track at the Neilburg School at a rate of $120 per hour. 18/258 LINDSAY: That the RM sell the used Ipads at a cost of $50 each with the RM donating the funds to the Marsden Senior s Centre. 18/259 SWANSTROM: That the Foreman be authorized to replace the culvert in Neil Tindall s driveway SW 25-45-27-W3M as the way the road is affects the flow of water. 18/260 WALDE: That council acknowledge the August 2018 Foreman Report.
