3. The Department shall review the application, may conduct any investigation it deems appropriate and, if it approves the application, shall issue to the applicant not more than one tag for each 50 animals present on the private land owned, leased or managed by the applicant. Both deer and antelope tags may be issued to an applicant.

6. Insofar as they are consistent with this section, the provisions of this title and of the regulations adopted by the Commission apply to the issuance and use of tags pursuant to this section. The Commission:

(a) Shall by regulation establish the maximum number of tags which may be issued annually by the Department pursuant to this section, which must not exceed 2.5 percent of the total number of deer and antelope tags which are authorized for issuance annually throughout the State; and

(b) May adopt any other regulations it deems necessary to carry out the provisions of this section.

3. Owner applicant means: (a) The owner of private land, as identified in the deed of the private land which is recorded with the county recorder of the county in which the property is located, who claims that his or her private land was damaged by deer or antelope; or (b) A person who has obtained written authorization from the owner described in paragraph (a) to represent the owner regarding matters concerning damage compensation tags before the Department, including, without limitation, a lessee or manager of the private land.

325 acres 4 antelope tags

340 acres 1 antelope tag

2150 acres 1 deer tag

Distribution of deer and antelope tags is not identical Lands are variable in juxtaposition and interspersion of habitat, cultivation, and neighboring landowners

Banking tags Currently not allowed by statute Owner applicant defined in existing NAC Calculate limit on deer and antelope tags separately would become more restrictive on antelope, and limit will be reached sooner; would have exceeded limit in 2007 Eliminate statutory limit entirely requires statutory change, likely some opposition by sportsmen Increase the number of tags to qualify if statutory limit is reached essentially functions the same as the proportional math described

Method to address tag distribution should the qualification of compensation tags through field counts reach the statutory limit Provide protection for recipients of fewest tags Reward longevity in program Mathematical formula in lieu or in support of written description:

N Stat Limit owner applicants Round x antlp i + Round x md i = 1 i Where: antlp i = number of qualifying damage compensation antelope tags for i th owner applicant based on the annual count conducted by the Department md i = number of qualifying damage compensation tags mule deer for i th owner applicant based on the annual count conducted by the Department Stat Limit = the statutory limit for cumulative total antelope and mule deer landowner compensation tags as determined by the annual cumulative total quota for antelope and mule deer tags established by the Commission x = the largest proportion (0 1.0) that yields a cumulative total that does not exceed the statutory limit

Qualifying counts total 528 deer and antelope compensation tags 20,120 total deer and antelope tag quota approved in May 2.5% of approved quota yields 503 statutory limit 151 owner applicants qualify for 1 to 17 tags each Spread award of tags (503 in total, 25 less than qualifying) among applicants Mathematical model determines where tags awarded Leftover awards are determined by longevity in program by owner applicant
