REGULATION 7-3.1(A) CONDUCT VIOLATIONS AND ACCOMPANYING CONSEQUENCES 1. General 1.1. The following list of conduct violations and accompanying consequences is not meant to be all-inclusive. The School Board or appropriate school official may invoke disciplinary measures for conduct not listed, but which, by common understanding, a student would know or reasonably should have known would be conduct detrimental to the maintenance of good order and/or the academic process. The building principal or designee has the discretion to implement any administrative option for addressing misconduct listed in FCPS Policy 7-3.1 he/she deems appropriate for Tier I Tier III offenses. Additionally, the School Board may, upon the recommendation of the superintendent, approve a consequence up to and including expulsion for any offense that is so egregious in nature as to warrant a consequence greater than is specified otherwise in this code or in any case where sufficient cause exists for such discipline. Conversely, a principal may also seek to obtain a waiver with regard to the assignment of required consequences in light of extenuating circumstances in order to provide appropriate disciplinary alternatives. The waiver request shall be submitted to the superintendent in writing. 2. Offenses 2.1. Tier 1 Offenses May result in maximum of three (3) days out of school suspension Examples include, but not limited to the following: 2.1.1. Classroom disruption 2.1.2. Disrespectful behavior: 1 st offense 2.1.3. Dress code violation 2.1.4. Failure to follow school rules 2.1.5. Minor physical altercation: 1 st offense 2.1.6. Tobacco: 1 st offense 2.1.7. Minor safety violation 2.1.8. Possession of personal items banned by published school rules 2.2. Tier 2 Offenses The following misconduct may result in up to a maximum of five (5) days out of school suspension from school: 2.2.1. Classroom disruption: 3 or more incidents in a semester 2.2.2. Defiance: 1 st offense or minor 2.2.3. Disrespectful behavior: 2 nd offense 1

2.2.4. Unauthorized possession or use of personal electronic devices during school hours 2.2.5. Fighting, including kicking, shoving, pushing, and hitting 2.2.6. Medication violations (Ref policy 7-5.3) 2.2.7. Minor physical altercation: 2 nd offense 2.2.8. Misrepresentation 2.2.9. Persistent failure to follow school rules: 3 or more incidents in a semester 2.2.10. Safety violation 2.2.11. Technology violations 2.2.12. Tobacco: 2 nd offense 2.2.13. Vandalism 2.3. Tier 3 Offenses The following misconduct may result in a maximum of ten (10) days out of school suspension from school: 2.3.1. Assault and Battery 2.3.2. Bullying 2.3.3. Campus/classroom disruption (major) 2.3.4. Computer invasion of privacy 2.3.5. Computer tampering 2.3.6. Defiance: 2 nd offense or major 2.3.7. Fighting involving three or more persons 2.3.8. Tampering with fire alarm/electronic surveillance equipment/building access equipment 2.3.9. Gang-related activity 1 st offense (minor) 2.3.10. Harassment 2.3.11. Profanity/pornography 2.3.12. Sexual harassment and/or assault, unwelcome sexual advances 2.3.13. Sexual offenses without force 2

2.3.14. Stalking 2.3.15. Theft 2.3.16. Threat and/or intimidation 2.3.17. Trespassing while suspended or expelled 2.3.18. Possession of a device that does not meet the definition of a weapon or destructive device as defined herein, but which may be used as a weapon or which might present a danger to others 2.4 Repeat Offenses 10 day out of school suspension 2.4.1. Two Tier 2 offenses = Up to 10 day out of school suspension 2.5. Repeat Offenses 30 day out of school suspension 2.5.1. Three Tier 2 offenses = Up to 30 days long-term suspension 2.5.2. One Tier 2 + One Tier 3 offense = Up to 30 days long-term suspension 2.5.3. Two Tier 3 offenses = Up to 30 days long-term suspension 2.5.4. Four Tier 2 offenses = Up to 30 days long-term suspension 2.5.5. Three Tier 3 offenses = Up to 30 days long-term suspension 2.6. Other Serious Offenses 2.6.1. Drugs, Alcohol and Anabolic Steroids 2.6.1.1. Drug Distribution First Offense, Recommendation for Expulsion 2.6.1.2. Alcohol Distribution First Offense, Recommendation for Expulsion 2.6.1.3. Alcohol Use, Under the Influence and/or Possession, Solicitation of Alcohol First Offense, 10 day suspension, participation in a drug abuse program involving the student and his parents, and 45 calendar days exclusion from participation and attendance in all extracurricular and co-curricular activities; Second Offense, Recommendation for Expulsion. 2.6.1.4. Drug Use, Under the Influence and/or Possession of Dangerous or Illegal Drugs, or Paraphernalia, Solicitation of Drugs: First Offense, 10-day suspension, participation in a drug abuse program involving the student and his parents, and 45-calendar days exclusion from participation and attendance in all extracurricular and co-curricular activities; Second Offense, Recommendation for Expulsion. 2.6.1.5. Use and/or Possession of Imitation Alcohol or Imitation (look-alike) Dangerous or Illegal Drugs: First Offense, 10 day suspension, participation in a drug abuse program involving 3

the student and his parents, and 45 calendar days exclusion from participation and attendance in all extracurricular and co-curricular activities; Second Offense, Recommendation for Expulsion. 2.6.1.6. Nothing in this section shall be construed to require a student s expulsion regardless of the facts of the particular situation. 2.6.1.7 Substance Abuse Counseling and Drug Testing: Students who have been disciplined for a substance abuse infraction and subsequently long-term suspended or expelled may be required to participate in group counseling at Southeastern Alternative School and may be required by the School Board to submit to random drug testing for the duration of the discipline sanction. 2.6.1.8. Interscholastic Athletics and Anabolic Steroid Use: In addition to the consequences listed above, a student who is a member of a school athletic team will be ineligible for two years to compete in interscholastic athletic competition if the school principal and the superintendent determine that the student used anabolic steroids during the training period immediately preceding or during the sport season of the athletic team, unless such steroid was prescribed by a licensed physician for a medical condition. 2.6.2. Weapons 2.6.1.1. The carrying, use, or possession of any firearm, dangerous device, or weapon as listed below, in any school building, on school grounds, in any school vehicle or at any schoolsponsored event shall result in a recommendation for expulsion, unless special circumstances exist. Nothing in this section shall be construed to require a student s expulsion regardless of the facts of the particular situation. 2.6.1.2. The following weapons, given these statutory mandates, are prohibited and invoke mandatory recommendation for expulsion as stated above: 2.6.1.2.1. Any stun weapon; 2.6.1.2.2. Any knife having an exposed metal blade three inches in length or longer; 2.6.1.2.3. Any pistol, revolver, or other weapon designed or intended to propel a missile of any kind; 2.6.1.2.4. Any dirk, bowie knife, switchblade, ballistic knife, machete, knife or razor with a blade three (3) inches or longer; and slingshots, spring sticks, brass or metal knuckles, or blackjacks; 2.6.1.2.5. Any flailing instrument consisting of two (2) or more rigid parts connected in such a manner as to allow them to swing freely, which may be known as a nun chahka, nun chuck, nunchaku, shuriken, or fighting chain; 2.6.1.2.6. Any disc of whatever configuration, having at least two (2) points or pointed blades, and which is designed to be thrown or propelled and which may be known as a throwing star or oriental dart; 2.6.1.2.7. Any weapon of like kind as those enumerated above; 4

2.6.1.2.8. Any weapon, including a starter gun, which will, or is designed or may readily be converted to expel a projectile by the action of an explosive, or other propellant; 2.6.1.2.9. The frame or receiver of a starter gun; 2.7. Other Offenses 2.6.1.2.10. Any firearm muffler or firearm silencer; or 2.6.1.2.11. Any destructive device defined as (i) any explosive, incendiary, or poison gas, bomb, grenade, rocket having a propellant charge of more than four (4) ounces, missile having an explosive or incendiary charge of more than one- quarter (1/4) ounce, mine, or other similar device; (ii) any weapon, by whatever name known which will, or may be readily converted to, expel a projectile by the action of an explosive or other propellant, and which has any barrel with a bore of more than one-half (1/2) inch in diameter; and (iii) any combination of parts either designed or intended for use in converting any device into any destructive device described in this subsection and from which a destructive device may be readily assembled. Destructive device shall not include any device that is not designed or redesigned for use as a weapon, or any device originally designed for use as a weapon and which is redesigned for use as a signaling, pyrotechnic, line-throwing, safety or other similar device. 2.7.1. Arson First offense, Recommendation for Expulsion 2.7.2. Bomb threat or other significant threat to safety First offense, Recommendation for Expulsion 2.7.3. Making a false fire alarm, false 911 call First offense, a minimum of 20 days out of school suspension 2.7.4. Causing a computer to malfunction First offense, a minimum of 20 days out of school suspension 2.7.5. Making or causing to be made an unauthorized or illegal copy, in any form, of computer data, computer programs, or computer software residing in, communicated by, or produced by a computer or computer network that significantly compromises school or student records First offense, a minimum of 20 days out of school suspension 2.7.6. Hazing First offense, Recommendation for Expulsion 2.7.7. Gang activity of a serious nature (or 2 nd offense of minor gang related activity) First offense, Recommendation for Expulsion 2.7.8. Brandishing or threatening to use a weapon or use of a weapon not defined by the Virginia Code as a firearm or knife First offense, Recommendation for Expulsion 2.7.9. Egregious Assault and Battery (to include any assault on school personnel) First offense, Recommendation for Expulsion 5

3. Activity Suspension 2.7.10. Use and/or possession of an incendiary device to include fireworks, firecrackers, or similar First offense, a minimum of 10 days out of school suspension up to an including expulsion. 3.1 Activity Suspension is generally limited to the number of days a student is suspended from school. Building administrators have the authority to impose an activity suspension of a longer or shorter duration than the length of suspension from school. In such instances, the building administrator will provide in writing his/her rational for the modified activity suspension. 3.2. Students on suspension for the use and/or possession of alcohol and/or illegal drugs or not allowed to participate in or attend extracurricular or co-curricular activities for the period of the suspension and for a period of 45 calendar days from the time of the infraction. 3.3. Nothing in this section shall be construed to require a student s expulsion regardless of the facts of the particular situation. 6 Revised 07/14/14
