Signs Signs Every where a sign CWMUs and No Trespass Utah s posting requirements A puzzling piece of work Todd A. Black USU/EXT CWMU Association 9 February 2012

Quiz T/F cultivated lands are to be posted on all corners and gates?

Answer FALSE While taking wildlife or engaging in wildlife-related activities, you may not do any of the following activity Enter upon privately owned land that is cultivated "Cultivated land" is land that is readily identifiable as land whose soil is loosened or broken up for the raising of crops, land used for the raising of crops, or a pasture that is artificially irrigated. In other words, cultivated land does not need to be posted to prevent trespass for wildlife-related activities. Violation of this law is a Class B misdemeanor that could result in fines and the loss of your license, tag or permit privileges.

Commentary.. It would be nice if this applied for all private lands unfortunately IT DOES NOT In other words, cultivated Private land does not need to be posted to prevent trespass. Violation of this law is a Class B misdemeanor that could result in fines and the loss of your license, tag or permit privileges.

Quiz T/F to be properly posted No-Trespassing on private property, there needs to be a no trespassing sign and or 100sq inches of paint every 300 feet?

Answer False "Properly posted" means that "No Trespassing" signs or a minimum of 100 square inches of bright yellow, bright orange, or fluorescent paint are displayed at all corners, fishing streams crossing property lines, roads, gates, and rights-of-way entering the land. If metal fence posts are used, the entire exterior side shall be painted.

Quiz T/F proper posting of a CWMU must post all fishing streams crossing property lines, road, gates, and rights-of-way entering the land must be clearly posted with signs that are a minimum of 8 1/2 by 11 inches on a bright yellow and must contain the following fine print. A CWMU is created under an agreement between private landowners and the division, and approved by the Wildlife Board. Only persons with a valid CWMU permit for the CWMU may hunt moose, deer, elk, pronghorn or turkey within the boundaries of the CWMU. The general public may use accessible public land portions of the CWMU for all legal purposes, other than hunting big game or turkey for which the CWMU is authorized.

Answer False to be properly posted, a CWMU must clearly post all boundaries of the CWMU at all corners, fishing streams crossing property lines, road, gates, and rights-of-way entering the land with signs that are a minimum of 8 1/2 by 11 inches on a bright yellow background with black lettering, and that contain the language provided in Subsection (b) A CWMU is created under an agreement between private landowners and the division, and approved by the Wildlife Board.

Quiz T/F If a CWMU is properly posted it automatically prohibits anyone from trespassing for any other purposes?

Answer False Utah s CWMU posting is only for big game or turkey hunting purposes (for species designated under section (b). THERE IS A DIFFERENCE BETWEEN A CWMU SIGN AND A NO-TRESPASSING SIGN. CWMU signs do not prohibit one from taking a hike, looking at flowers, hunting birds, hunting elk if its in a deer CWMU, or walking the dogs.

Quiz T/F if a CWMU borders or uses public land for the purpose of making a definable boundary for the CWMU then that boundary shall be posted every three hundred yards.

Answer True if a CWMU borders or uses public land for the purpose of making a definable boundary for the CWMU then that boundary shall be posted every three hundred yards.

Quiz T/F When posting right of ways such as a county road, posting also needs to be every 300 yards.

Answer False R657-21-11. Rights-of-Way. Each landowner or landowner association shall: clearly post all boundaries of the CWMU every 1,320 feet (440 yards)

Quiz T/F these pictures are valid CWMU posting signs and would allow law enforcement to cite someone for hunting on a CWMU without a proper permit?

Quiz T/F these pictures are valid CWMU posting signs and would allow law enforcement to cite someone for hunting on a CWMU without a proper permit?

Quiz T/F these pictures are valid CWMU posting signs and would allow law enforcement to cite someone for hunting on a CWMU without a proper permit?

Answer False Even though they may have been sign and posted in the proper place none of them contained the language. Note all of the above pictures/signs were taken on the same CWMU somewhere in Utah. At the time of the pictures, not one CWMU sign was posted.

Quiz T/F This picture shows a valid CWMU and No Trespassing posting that would allow law enforcement to cite someone for hunting on a CWMU without a proper permit and criminal trespass?

Answer True at least you would think! metal fence posts with the entire exterior side painted metal fence posts with the entire exterior side painted Official CWMU sign here that identifies what CWMU and what species can be hunted

Utah Code 76-6-206. Criminal trespass. As used in this section, "enter" means intrusion of the entire body. (2) A person is guilty of criminal trespass if, (b) knowing the person's entry or presence is unlawful, the person enters or remains on property as to which notice against entering is given by: (ii) fencing or other enclosure obviously designed to exclude intruders; or (iii) posting of signs reasonably likely to come to the attention of intruders;

Utah Code 23-20-14. Definitions -- Posted property (d) "Properly posted" means that "No Trespassing" signs or a minimum of 100 square inches of bright yellow, bright orange, or fluorescent paint are displayed at all corners, fishing streams crossing property lines, roads, gates, and rights-of-way entering the land. If metal fence posts are used, the entire exterior side shall be painted.

Utah Rule (CWMU rule) R657-37-7(4)(a) Each landowner association member or landowner association operator must (i) clearly post all boundaries of the CWMU at all corners, fishing streams crossing property lines, road, gates, and rights-of-way entering the land with signs that are a minimum of 8 1/2 by 11 inches on a bright yellow background with black lettering, and that contain the language provided in Subsection (b); and

Rights of way Each landowner or landowner association shall: clearly post all boundaries of the CWMU every 1,320 feet (440 yards)

Public lands If a CWMU borders or uses public land for the purpose of making a definable boundary for the CWMU then that boundary shall be posted every three hundred yards.

Todd s top 5 recommendations 1. At a minimum FOLLOW the rules! You all now know them. 2. Post the crap out of rights of ways and bordering public lands. I spray paint every 100-150 yards between signs and then some. DOCUMENT when you did it when it was completed. 3. Let law enforcement know when you have posted. They sign off on your COR, ask them to inspect a section. 4. GPS/Map where you put your signs give lawn enforcement copies of those maps/way points. 5. Document any trespass issues include dates, times, pictures, names EVERYTHING you can get. Keep a record book of these things.

Signs Big sign (type a) 5mil thick (about like cardboard) will not tear bullet holes seal up UV coating Holes punched Includes NO TRESPASSING PRIVATE PROPERTY language Over 100sq inches of bright yellow 10x11 Small sign (type b) Card stock paper thickness Best used on public land boarders and right of ways 8.5x11 not 100sq inches yellow UV coating but still tend to fade within 2 years if in direct sun light Are easier to tear.
