476 McCright Dr. -Victoria, TX 77901 (361) 485-3200 Tournament Reservation Confirmation Tournament Organizer Date(s) of Tournament It is hereby acknowledged that the undersigned has reserved the fields noted below on page 3 for the date(s) indicated above for the purpose of holding a softball, kickball and or baseball tournament. By signing this form, the undersigned hereby agrees to the following: 1. Tournaments may be scheduled up to six months in advance. All tournaments should be reserved at least 10 calendar days in advance of their requested date. 2. A non-refundable $50.00 deposit is required for each tournament scheduled and will be applied to the balance due if the tournament makes. The remaining balance associated with each tournament is due no later than noon on the Wednesday before a weekend tournament. Cancelation of a tournament must be received by the Parks and Recreation Office by noon on the Wednesday before a weekend tournament to receive a refund of field rental fees. 3. All additions and subtractions to the number of fields must be submitted and paid for prior to the balance due deadline of noon on the Wednesday before a weekend tournament. Refunds for subtraction of fields will be issued upon completion of tournament. 4. Refunds will be considered upon written request due to inclement weather. 5. Gate sales for all tournaments will be the responsibility of the tournament director. The tournament host will have the option to receive all proceeds from the gate. 6. Concession services for the Adult Softball Complex and Youth Sports Complex will be provided by a private concessionaire. You may contact Julie Rivera at 361-935-8021. No other food and drink concession will be allowed to be SOLD or BROUGHT onto the VYSC or Adult Softball Complex including tournaments with the exception of water and sports drinks for players only. Tournament Organizer has the right to sell concession at Riverside, Lowe and Rippamonti fields and must get approval for the location of these concession sales from the Parks and Recreation Director or designee. Other sales such as t-shirts and tournament related merchandise may be sold at the VYSC. All items to be sold are subject to approval from the Parks and Recreation Director or designee.
7. Tournament organizer must supply umpires and scorekeepers. 8. The City of Victoria will provide the following services; a) Prepare the fields for play each morning prior to the first game. (exceptions may be made by the Parks Director or his designee) b) Sanitation duties (restroom cleaning and trash pick-up) c) Turn on lights for night play. i. Lights will not be turned on before 7:30 pm during daylight savings time. ii. Lights will not be turned on before 5:30 pm during other times. *Lights may be turned on during dark conditions due to weather subject to approval from the Parks and Recreation Director or designee. d) An additional fee of $25.00 per hour will apply to all tournament play continuing past midnight. e) Any additional requirements/services must be requested at the time of reservation and may necessitate a higher fee. 9. The City of Victoria reserves the right to refuse future rentals of any complex/field for acts including but not limited to the following: a) Unethical practices by tournament organizers or their associates (i.e. changing rules during tournament or showing favoritism to specific teams). b) Deceptive practices by tournament organizers or their associates (i.e. over stating registration numbers or prizes). c) Excessive number of cancellations due to lack of team participation (more than 3 within a one year period). d) Violation of any federal, state or local laws regarding use of the premises. 10. The lessee shall provide a copy of the tournament rules, flyers, and website information to the City of Victoria personnel when scheduling tournaments. All fees and contact information with phone number shall be included. 11. The City of Victoria may require the lessee to provide the appropriate insurance certificate and list the City of Victoria as additionally insured. Only one copy will need to be on file as long as the insurance certificates are current. 12. Indemnification. Lessee hereby waives all claims and demands against City for any loss, damage or injury of any kind to any person or property arising from any use or act occurring on or upon the Premises. Lessee further agrees to protect, indemnify and hold harmless City, its directors, officers, agents and employees from and against any claims, causes of action, suits, judgments, losses, damages and liability of every kind, including all expenses of litigation, court costs and attorneys fees for injuries, death or property damages (including injuries, death or property damage suffered by Lessee s employees or the employees of its agents or contractors) resulting from the use of the Premises, which occurred, or are alleged to have occurred directly or indirectly, in whole or in part, from any act, omission, or negligence of Lessee regardless of any condition of the property.
