Release Agreement RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE For good and valuable consideration, including without limitation the acceptance of the undersigned's entry or participation in the Jackie s Fishing Tournament (the "Event") and being permitted to participate in certain related activities, the undersigned, for herself and her personal representatives, heirs, guest, invitees, employees, and team or crew members hereby (1) RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Jackie s Brickhouse, its subsidiaries, related entities, respective members, volunteers, heirs, successors, assigns, officers, directors, employees, agents, contractors and subcontractors (collectively, the "Releasees") from any and all liability to the undersigned, her personal representatives, assigns, heirs and next of kin, and for all loss or damage, and all claims or damages therefore, on account of bodily injury, personal injury, death, property or other damage of or to the undersigned, her guests, invitees, employees, team or crew, during the Event or arising out of or in any way in connection with the Event or its Rules or related activities or while the undersigned is competing, or participating, regardless of whether caused in whole or in part by the negligence of Releasees; (2) AGREES TO INDEMNIFY AND HOLD HARMLESS Releasees and each of them from and against all claims, actions, causes of action, damages, liabilities, losses and judgments (collectively, the "Claims") of or by all guests, invitees, employees, and team or crew of the undersigned for bodily injury, personal injury, death, property or other damage which they may suffer or incur during the Event or arising out of or in any way in connection with the Event or its Rules or related activities, regardless of whether caused in whole or in part by the negligence of Releasees; and, (3) ASSUMES FULL RESPONSIBILITY for the risk or occurrence of bodily injury, personal injury, death, property or other damage of or to herself, her guests, invitees, employees, and team or crew and to her boat and equipment due to negligence of Releasees or otherwise during the Event or while participating in the Event or related activities or while in or on the Event premises, which includes but is not limited to, its common properties, recreational areas, and, if applicable, any adjacent docks, piers, and boat slips. Please sign on following page The undersigned agrees to pay all of the Releasees' costs of defending all Claims and further agrees that this Release, Hold Harmless and Agreement Not to Sue is intended to be as broad and inclusive as permitted by the laws of the State of Texas and that, if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. The undersigned also agrees to be filmed, videoed, photographed, quoted or mentioned by the tournament organizers or Jackie s Brickhouse personnel, their sponsors, other participants, and anyone affiliated with the press or tournament without compensation and that the press, tournament organizers, and anyone authorized by the Tournament has the right to use, without compensation, my name, pictures, likenesses, quotes and 3
biographical information, whether audio, visual or video recorded, before, during and after the period of my individual or team participation in this event. Tournament Rules for 2016 2017 Anyone entering this Tournament is required to abide by these Tournament Rules. Disqualifications will be determined by the Tournament Committee or a designated tournament director. Participants are responsible for knowing, understanding, and abiding by these Rules. Questions and comments concerning any Rule may be directed to the Tournament Committee. In all Tournament matters, the Tournament director decision is final. Prior to the Tournament, email any questions through the tournament web site. All participants will be required to sign a copy of these rules and return them to the tournament committee. Ladies Only- This is a woman only fishing tournament. Team A team can be up to 4 women. A guide or driver can be a male. All team members must be listed on the registration form and have paid the entry fee. A male guide or driver does not pay the entry fee. No deckhands or spectators are allowed on a boat. Release Each team member, as well as the guide or driver, must sign a Tournament Release prior to the Tournament Start Time. If the team member is a minor, a parent or legal guardian must sign a Release on behalf of the minor. Tackle Live or artificial bait is allowed in both divisions. One Pole per Angler A team member can have more than one rod and reel on the boat, but she cannot fish with more than one pole at a time. Any cast must be fully retrieved before an angler may make another cast with a different rod and reel. Assistance A team member may be assisted with baiting a hook, and netting, but the individual member must cast, set the hook and reel the fish to the boat or net herself. Fishing Boat, wade, jetty, surf, dock, or pier fishing is allowed. Eligible Fish for Team Stringer - Eligible Fish are legal size Trout, Flounder and Redfish. No over-sized fish will be weighed. Award and payout winners are determined by weight and include any bonuses. In the event of a weight tie, the first team to weigh-in will prevails. Weights determined by the Tournament Weigh Master are final. 5
Weigh-in Weigh-in opens at 2:00 pm and closes at 4:00 pm. You must be in line with your fish at 4:00 PM or your fish will not be weighed. There are no exceptions. After the Weigh Master weighs all Eligible Fish, a team member or their guide will need to sign the weigh slip indicating their approval. Maximum Five Fish Team Stringer - A maximum Team Stringer consists of no more than five fish (trout, flounder, redfish) with no more than two slot redfish (20-28 ). Only one trout over 25 may be weighed by each team. If a team has a third Redfish eligible for Most Spots, (this fish must be between 20-28 ) that fish should be presented separately to the Weigh Master. This fish could also be one of the two redfish on the 5 fish stringer. Redfish A legal Redfish (Red Drum) must be at least 20 and not greater than 28. If you catch one smaller than 20 by law you are required to release it. You cannot weigh-in a Redfish over 28 as no tagged redfish will be accepted. Your team must decide which Redfish to weigh in prior to approaching the Weigh Master. Trout A legal Trout (Spotted Sea trout) must be at least 15. If you catch one smaller than 15 by law you are required to release it. Only one trout over 25 may be weighed in by each team. Your team must decide which Trout to weigh in prior to approaching the Weigh Master. Flounder A legal Flounder must be at least 14. Tournament Fishing Waters - Contestants may fish in any public accessible waters between the Hwy 332 Bridge in Freeport and the Hwy 124 Bridge in High Island and no more than one mile offshore. Walk in fishing is allowed as long as it is accessible to the general public and not private property. Participants are not allowed to anchor within 100 yards of another anchored boat when wade fishing an area unless waved in by the anchored boat. If you wave in one boat to an area, all other boats are able to fish that same area. Wade fisherman must remain within 500 yards of their boat (250 yards in each direction) at all times. If a fishing area is in question, the boat anchored first has the right to the area. When anchored and fishing from the boat in channels, shorelines, jetties etc., boats must remain 50 yards apart unless waved in by the anchored boat. Again, if you wave in one boat to an area, all other boats are able to fish that same area. An anchored boat is a boat held in a stable position by a line attached to an anchor, a weight, push pole, power pole, etc., with the trolling motor in the up position. Launch Sites - All boats must leave from a public boat ramp at the designated time which will be safelight or 30 minutes prior to official sunrise. This time will be announced at the Captains meeting prior to the tournament. Walk in participants may not enter water until that time. You may launch your boat at any time but must remain within 50 yards of launch site until takeoff. If 6
your boat is normally stored on the water at a private residence you may leave from that location. This location has to be the private residence of a team member. You may not just tie your boat up at your residence prior to the tournament and leave from that location. Communication during tournament hours - No communication will be allowed between other tournament anglers or outside sources during tournament hours to gain an advantage over the other anglers. This also applies to Guides or drivers. Protest - A protest must be submitted, in writing, along with a $200.00 deposit per protest to a member of the Tournament Committee within 15 minutes of the last fish weighed in. All decisions will be made by the Tournament Committee and are final. If a protest is upheld, the $200.00 deposit will be refunded to the protesting party. If the protest is not upheld, the protest deposit is non-refundable. The protester agrees that by filing a protest, the protester may be subject to a polygraph test. Boating Safety - Safe boating will be observed at all times. We recommend that each contestant wear a fastened, U.S. Coast Guard approved, personal flotation device while the combustion engine is on. If the boat is equipped with a kill switch it MUST be attached to the driver of the boat when the boat is moving fast enough to raise the bow of the boat. General Safety - The tournament committee reserves the right to cancel or re-schedule the event due to inclement weather or unsafe water conditions. Applicable Laws - Federal, State and Local laws are to be obeyed by Participants at all times and will be enforced by tournament officials. Violation of any federal, state and/ or local laws can result in the disqualification of the Participant and Team from this tournament. Polygraph - Winning teams and individual award winners should be prepared to take a polygraph on site with results of the polygraph being final. Failure to take and/or pass the test will result in disqualification. The individual taking the test may be a team member or the guide/boat driver. It will be up to the Tournament Committee which member of the team will take the polygraph test. If the angler is a minor, a parent or legal guardian shall agree for the minor to submit to a polygraph test. Any team member who has had too much to drink, is not agreeable or unable to take a polygraph test will be disqualified. This determination will be made by the Tournament Committee and also the person administering the polygraph. Sportsmanship - Any angler, who displays poor sportsmanship, violates any Tournament Rule, or any state or local game laws may be disqualified without refund. 7
Refunds - A full refund will be given for a full team cancellation or withdrawal up to two weeks prior to the tournament (April June 2, 11). 2017. No refund will be given for the cancellation or withdrawal of an individual team member(s). No refunds will be given if the Tournament is postponed and rescheduled for another date.
