CFH13-00029 Boise City Parks and Recreation Summary The Parks and Recreation Department requests approval of a Boise River System Permit for the repair of ±200 feet of river bank generally located at 5845 W. Riverbend Lane in an R-1C (Single Family Residential) Zone. Prepared By David Moser, Associate Planner Recommendation Planning team recommends approval of CFH13-00029. Reason for the Decision The proposed river bank stabilization is in compliance with the applicable standards for Class A Lands and Waters (Section 11-05-06). The development complies with all of the policies and standards of the Comprehensive Plan, Floodplain Ordinance, Boise River System Ordinance and all local, state, federal laws and regulations. The project will stop the continued riverbank erosion that threatens to damage the existing greenbelt walking and biking path (Goal ES and Policy SHCC 3.3). The natural resource functions of the Class A Lands located on this property will be improved and enhanced by the project, since it protects section of the greenbelt pathway and river bank that are dedicated to the Boise River s natural functions and values.

Current Land Use The area of the bank repair is adjacent to the Lakeharbor # Subdivision, along the north side of the Boise River. Description of Applicant s Request The applicant is requesting approval of a Boise River System Permit to repair a section of the river bank adjacent to a residential neighborhood and greenbelt pathway. This bank stabilization project extends along approximately 200 feet of the Boise River and is just south of the pedestrian bridge that crosses the river. 2. Land Use Description and Character of Surrounding Area The project is located along the Boise River,adjacent to a pedestrian bridge that crosses the river to Garden City. The recreational amenities adjacent to the site include the greenbelt bike/walking path. To the south and west across the Boise River is a residential neighborhood in Garden City. Directly to the south and west is the Boise River. Special Considerations The greenbelt pathway abuts the Boise River and is located within its floodway and 100-year floodplain. The stabilization project area is primarily located within the river s floodway. History of Previous Actions RZ-5-84 Rezone request associated with the Lake Harbor Development. Project Proposal Site Design The river bank armoring system will consist of riprapping, the construction of four river barbs, the placement of vegetative geogrids, root wads, willow cuttings, willow bundles and the planting of riparian grasses. The armoring system will occur along approximately 200 feet of river bank. These steps will prevent continued erosion that threatens the greenbelt pathway and river bank. Setbacks This project does not include any development or structures and is therefore excluded from the Boise River System Permit setbacks.

Analysis/Findings The applicant requests approval of a Boise River System Permit to install ±200 feet of bank stabilization along the Boise River. The river bank along this section of the greenbelt pathway has experienced erosion and degradation just downstream of the pedestrian bridge. The parcel containing the greenbelt pathway is zoned R-1C (Single Family Residential). The proposed river barbs and bank riprapping will extend below the high water mark (e.g. 6500 cfs line) of the river. To protect the greenbelt pathway and stabilize the river bank, the Boise City Parks and Recreation is requesting to install an armoring system to prevent further erosion. The bank armoring system consists of four river barbs, riprapping, planting of riparian grasses, and the placement of willow cuttings, willow bundles and vegetated geogrids. A majority of the stabilization project will occur in the floodway either at, or inside of the 6,500 cubic feet per second (cfs) line. This will limit the amount of existing vegetation that is removed during the project. To mitigate for the loss of vegetation that occurs during construction willow cuttings and bundles will be planted along the river bank. During the stabilization repair work the abutting section of the greenbelt will be closed.

CFH13-00029 Boise City Planning and Zoning Commission / December 2, 2013 Page 5 of To ensure continuity of the greenbelt path during the project a recommended condition of approval will require the City of Boise Parks and Recreation Department to post a pedestrian detour route around the construction. FINDINGS BOISE RIVER SYSTEM PERMIT Section 11-03-04.19 Approval Criteria i. The proposed development is in compliance with the applicable Standards for Uses in Class A, B or C land and water. The proposed development is in compliance with the applicable standards for Class A Land and Waters. The subject property is composed of a section of the greenbelt pathway directly along the Boise River. As such, the subject property is classified as Class A Lands and Waters according to the Boise River System Ordinance. The river bank stabilization project is an allowed use within Class A Lands and Waters. The criteria for Class A Lands, as defined by Section 11-05-06.01 (G), does not apply to this project since the stabilization project is not considered a structure. The installation of the bank armoring system does not include any development or subdivision of Class A Land, and emergent wetlands will not be adversely impacted by this stabilization project. The bank stabilization design will plant a number of willow cuttings and bundles. These willow cuttings are incorporated within the river bank armor design and will mitigate for the loss of existing vegetation along the river s edge. However, since a majority of this work will occur below the river s ordinary high water mark, the amount of vegetation removed during this project will be minor. To protect the abutting riparian area, a condition of approval will require the installation of construction fencing prior to the commencement of activities. The area is not located within the identified bald eagle nesting or perching section of the river. The Boise River System does require the planting of shrubs and trees to enhance fish habitat when structural stabilization measures are used. The proposed bank armoring system includes the planting of willows cuttings, willow bundles and riparian grasses. ii. The proposed development complies with all policies and standards of the Boise Comprehensive Plan, the Boise River Plan, the Flood Plain Ordinance and the Boise River System Ordinance. The proposed bank stabilization project complies with all polices and standards of the Comprehensive Plan, Floodplain Ordinance, and Boise River System Ordinance.

CFH13-00029 Boise City Planning and Zoning Commission / December 2, 2013 Page 6 of Goal ES promotes the protection and enhancement of the natural environment along the Boise River in order to provide a high quality wildlife habitat and recreational activities. The project will stop the continued riverbank erosion that threatens to damage the existing greenbelt path. The proposed bank armoring techniques include the plantings of willows cuttings, and native riparian grasses. The Comprehensive Plan encourages that the Boise River banks be protected from further erosion by enacting programs to plant native streamside vegetation, such as willow cuttings and riparian grasses (Policy SHCC 3.3). This stabilization project will protect the greenbelt pathway facility for continued use by the neighborhoods (Policy NW-NC 1.1). According to Public Works comments the installation of the bank armor system shall comply with the requirement and regulations of the Floodplain Ordinance. iii. The proposed development includes measures designed to insure that natural resources and values are preserved or enhanced and maintained. The natural resource functions of Class A Lands located on this property will be improved and enhanced by the proposed bank stabilization project. The parcel is part of the Boise City greenbelt pathway adjacent to the river and it is dedicated to the Boise River s natural functions and values. However, the existing river bank has been damaged due to erosion and the loss of vegetation caused from high spring flows and the river channel configuration. These impacts have lead to increased amounts of erosion along this section of the Boise River. In addition to the installation of rock riprapping, the project includes the planting of willow cuttings, the installation of willow bundles, and riparian grasses. These vegetative erosion control methods will restore the damaged natural resource functions and stop the continued river bank erosion. iv. The proposed development complies with or shall comply with all local State and Federal Laws and regulations. A recommended condition of approval shall require that the applicant comply with all local, state and federal laws and regulations. To date, no agencies have voiced opposition to this request.. Conditions of Approval Site Specific 1. Compliance with plans and specifications submitted to and on file in the Planning and Development Services Department dated received October 10, 2013, except as expressly modified by the following conditions:

The applicant shall install construction fencing prior to the commencement of activities to protect the abutting riparian areas. c. The Boise City Parks and Recreation Department shall post a pedestrian detour route around the closed section of greenbelt prior to commencement of the river bank repair work. Standard Conditions of Approval 3. No change in the terms and conditions of this approval shall be valid unless in writing and signed by the applicant or his authorized representative and an authorized representative of Boise City. The burden shall be upon the applicant to obtain the written confirmation of any change and not upon Boise City. 4. Any change by the applicant in the planned use of the property, which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant, or successors of interest, advise Boise City of intent to change the planned use of the property described herein, unless a variance in said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. 5. This Boise River System Permit shall be valid for a period not to exceed eighteen (18) months from the date of approval by the Planning and Zoning Commission. Within this period, the holder of the permit must acquire construction permits. 6. Failure to abide by any condition of this project shall be grounds for revocation by the Boise City Planning and Zoning Commission.. Prior to the expiration of this project, the Commission may, upon written request by the holder, grant a two-year time extension. A maximum of two (2) extensions may be granted.
