Terms and Conditions Amy s Ride Victoria Sunday 13 January 2013 Please read these carefully before completing your online registration. These Terms and Conditions of Entry ("Entry Terms") are designed to enable Amy s Ride Victoria 2013, Sunday 13 January 2013 (the "Ride") to operate smoothly and safely. By registering to participate in the Ride, you (the "Rider") accept and agree to be bound by these. Entry Requirements 1. The Rider may enter via an online process. A paper entry form will only available on Saturday 12 January and Sunday 13 January 2013 from the AGF marquee in Buninyong. 2. If the Rider is aged 16 years or younger on the day of the Ride, the Rider is deemed a child and must be accompanied on the ride by, and in the care of, a nominated adult who is responsible for that Rider throughout the duration of the Ride. 3. It is recommended that a Rider who is a child under 10 years travels on a bike with a parent or guardian in a bike seat, trailer, chariot, tag- a- long or similar child transportation devices. 4. The Amy Gillett Foundation (AGF) and/or Cycling Australia (CA) may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application for registration. 5. A Rider cannot make any changes to their registration once entered. Any change requests must be made in writing to AGF by emailing amysride@amygillett.org.au. 6. No changes can be made to registrations after Midnight (AEST) Thursday 10 January 2013. Rider categories 7. An adult is defined as a person who is 16 years or older on the Ride day. 8. A child is defined as a person who is 3 years or older on the Ride day and not yet 16 years old on the Ride day. 9. Child entries are not accepted in the 100km ride option. 10. Bike seats, trailers, chariots, tag- a- longs or any similar child transportation devices are not permitted on the 70km or 100km ride options. Cancellations and Transfers 11. The entry fee is non- refundable under any circumstances. The AGF and CA are under no obligation to refund monies or entry fees due to non- use, Ride cancellation, failure to participate or dissatisfaction by the Rider. 12. Entries are non- transferable to other events or other people. Any attempt to transfer an entry to another person will result in the cancellation of the entry concerned without refund. Rider Insurance 13. The Rider receives Insurance as part of their Ride entry which covers the Rider during their participation in the Ride. Ride communications will principally be made via email. The Rider should therefore provide a valid email address. If the Rider does not have access to an email address, the Rider should make every effort to contact the AGF and request information to be mailed. 15. It is the Rider's responsibility to read information that is provided by email, made available on the AGF's website and other communications methods concerning the Ride. Closing Dates for entries 16. Online entries for the Ride close midday (AEDST) Thursday 10 January 2013. 17. Late entries can only be made at the AGF Info/Rego Marquee, Buninyong between 9am - 5pm Saturday 12 January or between 6.30am - 7.45am Sunday 13 January 2013. 18. An additional $10 fee will be applied to entries received on Saturday 12 and Sunday 13 January 2013. Acknowledgment and Waiver 19. In consideration of AGF and CA permitting the Rider to enter and participate in the Ride, the Rider hereby releases and indemnifies the AGF, CA, the sponsors of the Ride and any of their respective representatives from and against all and any claims, suits, demands, liabilities, loss and damage (including indirect and consequential loss), costs, expenses and, interest, whether pursuant to common law or statute, that the Rider may suffer or incur arising from or connected with the Rider participation in the Ride including as a result of the negligence, breach of duty, breach of care or other fault or responsibility of the AGF, CA, the sponsors of the Ride and any of their respective representatives. 20. The Rider, including a child Rider in an adult rider s care has sufficient experience and competence to participate safely in the Ride. The Rider hereby releases and forever discharges, exempts and indemnifies the organiser, sponsors and all other person involved in the organisation, from all action, proceedings, demands and claims whatsoever taken by any participation in the ride. 21. If the Rider is acting as the guardian for a child rider, that Rider consents to the child participating in the Ride and agrees to take full and sole responsibility for the child's safety and participation in the Ride. Compliance with Laws 22. During the Ride, the Rider must comply with all traffic and road laws, all directions issued by Police and all instructions given by the AGF and CA or any employees or officials representing the AGF and CA at the Ride. Failure to do so may result in the Rider being removed from the Ride. Preparation, Training, Health and Safety 23. The Rider, or the guardian for a child Rider, is responsible for ensuring that he/she has adequately and appropriately prepared for the Ride. If the Rider has any health issues or doubts prior to the Ride, he/she/guardian should immediately seek appropriate medical advice. 24. The Rider must have a bike that is in sound mechanical order prior to undertaking the Ride. 25. If, during the Ride, the Rider becomes ill or is injured, the AGF and CA will endeavour to arrange medical transport, usually in an ambulance. Any medical transport will be at the Rider's expense. The AGF and CA recommend that Rider holds current ambulance service membership and/or health insurance to cover such costs. 26. The Rider agrees to comply with all rider safety guidelines as referenced within the Rider Safety pages on the website (insert page link), including but not limited to Ride Right, On the Day, Training and Preparation and Bunch Skills. Common Sense 27. The Rider must ride in a safe and responsible manner during the Ride and use common sense at all times. 28. The Rider must exercise caution on all public roads and other thoroughfares and ride defensively and courteously. Ride and Ride Option Variation 29. The AGF and CA reserves the right, in its absolute discretion, to change or vary the route of any of the Ride Options without notice; cancel, postpone, reschedule or change the time or place for the Ride or any of the Ride Options for any reason and at any time prior to the commencement of the Ride; and the AGF and CA are not responsible for or liable to the Rider for any loss, damage, cost or expense, whether direct, indirect, consequential or otherwise and howsoever or wheresoever incurred by the Rider resulting from any such action taken by the AGF and CA. Private support vehicles 30. Private support vehicles are not permitted on the Ride. Privacy 31. The Rider acknowledges and agrees that he/she may be photographed or filmed during the Ride and consents to the AGF and CA using the Rider's picture and likeness contained in any photographs or film for publicising the Ride and for promoting any future ride or event to be staged by the AGF and CA. 32. The AGF and CA collects, uses, discloses and otherwise handles my personal information in accordance with the terms of its Privacy Policy Statement (search Privacy on www.amygillett.org.au and www.cycling.org.au). 33. The Rider s contact details will be used by the AGF, CA and/or third parties partnering the Ride. This includes but is not limited to Continental, Subaru, TAC and Bike Exchange. Any correspondence sent from these entities would be restricted to future events, news, and promotions. These communications will include the ability to opt- out from future communications. 34. Should the Rider not wish to be contacted for any other reason other than to be provided with information about the Amy s Ride Victoria event, please advise the AGF by emailing amysride@amygillett.org.au. Amy's Ride Fundraising Rewards 35. By registering to participate in the Ride, the Rider accepts the automatic generation of a Fundraising Page. 36. All Riders that reach the following fundraising targets will receive the following rewards. These rewards will accumulate. a. $75 target - AGF A Metre Matters ICE phone wallet b. $125 target - AGF A Metre Matters Hi Viz backpack cover c. $250 target - AGF Cap & AGF Jersey d. $500 target - AGF Knicks 37. Fundraisers reaching reward targets prior to midnight on Sunday 9 December 2012 will have their rewards items posted. Fundraisers reaching reward targets between Monday 9 December 2012 and midday on Thursday 10 January 2013 will receive their rewards after the event (Applies to clothing rewards only). 38. The first Rider to reach the following fundraising targets will receive the following rewards. Fundraising riders who qualify for more than one fundraising reward will be eligible to receive only the reward for the highest fundraising tier that they reach. a. First rider to reach $750 Garmin Red 500 Bike Computer b. First rider to reach $1000 - $500 Bike Exchange Voucher c. First rider to reach $4000 Trek Madone d. First rider to reach $8000 - Entry to 2013 Share the Road Tour 39. Fundraising Rewards will close in line with the closure of online entries at midday on Thursday 10 January 2013. 40. Fundraising Reward winners will be announced at the Ride on Sunday 13 January 2013. 41. Fundraising Rewards cannot be redeemed for cash. 42. Prize values are based upon the recommended retail prices at the time of print (inclusive of GST). The AGF accepts no responsibility for change in prize value between now and the ultimate prize redemption date. Page 4 of 5
Other 43. The Ride will be held outdoors and will proceed notwithstanding poor weather conditions on the day of the Ride. The AGF and CA are not liable to the Rider for any loss, damage, cost or expense of any kind including, but not limited to, refund of entry fees, in the event of poor weather before or during the Ride. 44. The AGF and CA reserve the right, in its absolute discretion, to refuse to allow the Rider to participate in the Ride or to remove the Rider from the Ride for breach of these terms and conditions or if it otherwise determines it appropriate to do so. 45. The AGF and CA are not liable to the Rider for any loss, damage, cost or expense of any kind, including but not limited to, the refund of the entry fee, if the Rider is denied access to or removed from the Ride for any reason. 46. The Amy Gillett Foundation (ABN 46 200 981 503) and Cycling Australia (ABN 36 067 389 259) includes where appropriate the AGF and CA employees, agents, contractors and officers. Page 5 of 5
