Comments: The Owner is requesting permission to maintain an existing driveway in the front yard with the variances noted above. The Planning Department has no objection to Variances #1 and #2. Zoning By-law 1-88 permits a maximum driveway width of 9.0 m for lots with frontages of 12.0 m or greater. A driveway width of 9.0 m is required to provide access to the 3-car garage. The majority of the existing driveway is 9.55 m (widening to 10.1 m at the garage), and the Owner is requesting to maintain the portion of the driveway between the street line and the street curb, as well as a curb cut, to match the existing 9.55 m wide driveway between the street line and the garage. The Development Engineering and Infrastructure Services Planning Department has indicated no objection to the increased width of the driveway at the street curb and curb cut, as well as the driveway width between the street line and street curb. - TBC The Development Planning Department has no objection to Variance #3. The requested driveway width is for the portion of the driveway at the garage. The remainder of the driveway is 9.55 m wide. On this basis, Variance #3 can be supported. The Development Planning Department has no objection with Variance #4 with regard to the reduced front yard landscape area, as there is still adequate landscaping provided in the front yard given the large size of the lot, which helps to mitigate the impact of the reduced front yard landscaped area on the streetscape. The Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. COMMENTS: PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the project or plan. All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established.
