CLAIRIN WORLD CHAMPIONSHIP 2019 REGULATIONS Simplicity and authenticity. Contrast and colours. Vitality, joy and exuberance. Those are the feelings that will inspire all those who will enter the Clairin World Championship Season 3 - Luca Gargano. Article 1 Championship phases 1.1 Selections Participants are asked to register online for a selection phase between January 22 nd 2019 and March 11th 2019. The Organizing Company has full right to shorten or extend the duration of Selections period. The competition will take place in each of the following countries: Italy, France, Germany, UK, Belgium, Denmark, Sweden, Poland, Singapore. 1.2. Semi-Final The organizing company will choose 10 competitors per country who will be invited for the semi-final. The semi-finals will take place between March 12th and April 31 st 2019, in each countries. The Organizing Company has full right to shorten or extend the duration of Selections period. The official date will be revealed at the latest the day of the phase 1.1 results announcement. 1.3. Final The winner of each semi-final will participate in the World Final in Haiti. The Final may take place end of May 2019, the official date will be revealed at the latest the day of the phase 1.2 results announcement. One nominated bartender from Haiti and one from Singapore will join directly the competition at this stage. The Organizing Company has full right to shorten or extend the duration of above 1.1 and 1.2 periods. Article 2 Organizing Company The company La Maison & Velier is a simplified limited company registered in Nanterre (France), under the registration number 824 625 065. The registered office located at 9-11 rue Martre, 92110 Clichy-la-Garenne, France (further mentioned as the Organizing Company ), organizes the championship CLAIRIN WORLD CHAMPIONSHIP 2019 with the aim of selecting the best cocktail to represent its country of origin during the Final that will take place in Haiti. Article 3 Participants The Championship is open to anyone having the alcoholic drinking legal age in his country of residence and limited to participating countries (Italy, France, Germany, UK, Belgium, Denmark, Sweden, Poland, Singapore), further mentioned as the Participants.
The Organizing Company has all the rights reserved to verify that the Participants comply with the above mentioned requirements. Limited to one participation per participant per country. Article 4 Championship terms & conditions 4.1 Registration terms & conditions The registration can be done exclusively on the following website: http://www.thespiritofhaiti.com/clairin-world-championship-2019/ (Italian version) http://www.thespiritofhaiti.com/fr/clairin-world-championship-2019/ (French version) http://www.thespiritofhaiti.com/en/clairin-world-championship-2019/ (English version) Each Participant will have to complete and submit a full registration file online. The online registration will be open from January 21 st 2019 at 23h00 (GMT+1) until March 11 th 2019 at 23h59* (GMT+1). The registration file has to be complete and submitted online before the following deadline: March 11 th 2019 at 23h59 (GMT+1). Please note that any incomplete or unsubmitted file will not be taken into account. The Organizing Company has all rights reserved to extend this deadline if deemed necessary, therefore this regulation will be amended on the official website. 4.1.A. Registration File: 1. Full contact details are required (name, surname, date of birth, phone number, e- mail address, home address, postcode, country, and profession). 2. Full cocktail recipe description based on CLAIRIN COMMUNAL (cocktail name, ingredients and quantities and making process). Only the CLAIRIN COMMUNAL can be used. Quantities must be mentioned in Litres and Kilograms. 3. Facebook link to the Participant s video making and explaining his cocktail. The video must include a 30 seconds speech about the Participant's inspiration of Haitian culture in creating his cocktail. The video must not exceed 3 minutes. The video must be posted on the Social Network Facebook, either on the Facebook Page of the Bar employing the Participant or on the participant s personal Facebook page (if amateur), using the hashtag #ClairinWC2019. Please note that only the linked video submitted in the registration file before the official deadline (March 11th 2019 at 23.59 GMT+1) will be taken into account. The quality of the video will not be a selection criteria.
4.1.B. Recipe rules and choice of ingredients: Clairin Communal must be the main spirit used in the recipe (minimum 3cl). The use of any other Rum brands is prohibited. There is no limit as to the quantity of other ingredients. Homemade ingredients are accepted if their recipe is fully explained. According to the Haitian traditional culture the modern techniques (spherification, smoking, etc.) will not be accepted. NB : The Participant will be free to present a new Cocktail for the other phases of the Championship (Semi-Finals, Final), without any obligation to do so. This because during other phases it will be possible to use Clairin Sajous, Clairin Vaval, Clairin Casimir, Clairin Le Rocher, the range Clairin Ansyen. 4.1.C. Registration Confirmation: After completing the registration file online, the Participant will have to submit his participation by ticking the box I ve read and accepted the Terms & Conditions and by clicking on Send. Once the file is submitted, it cannot be modified. Please note that the video link is a requirement to complete the registration. Remember that the video must be posted on the Social Network Facebook, either on the Facebook Page of the Bar employing the Participant or on the participant s personal Facebook page (if amateur), using the hashtag #ClairinWC2019. Please note that only the linked video submitted in the registration file before the official deadline (March 11 th 2019 at 23h59 GMT+1)* will be taken into account. In case of any technical issues, please contact: info@thespiritofhaiti.com 4.2 Jury Selections From March 12 th 2019 at 23.59 GMT+*1, the Jury, composed of : - For France : LM&V & LMDW, - For Italy : LM&V & Velier, - For Germany : LM&V & KIRSCH Whisky, - For the U-K : LM&V & SPECIALITY BRANDS, - For Belgium : LM&V & The Nectar, - For Denmark : LM&V & JUULS, - For Sweden: LM&V & Bar Konsult, - For Poland : LM&V & The Last Port, - For Singapore : LM&V & LMDW. will deliberate in order to select from 5 to 8 semi-finalists Participants. The following selection criterias will be applied: Creativity in Cocktails name, Originality of the Cocktail, Simplicity of the Cocktail,
Making process (video), Speech (video). The Jury will strongly consider the quality of the recipe and its ingredients. The quality of the video will not be a selection criteria. The grade will be divided into 3 parts: Facebook Likes: 100 points (The most liked video = 100 points; the least = 1; other video points will be balanced out accordingly: weighted average) Jury Local Distributor : 100 points Jury LM&V : 100 points The 5 to 8 selected Semi-Finalists will be advised of their selection on the e-mail given in the registration file, and/or on social networks. The recipes and videos of the selected Semi-Finalists will be used on the official website and on social networks from the results announcement. The Organizing Company has all rights reserved to change the composition of the Jury at all times by modification of the present rules. 4.3. Semi-Final The 5 to 8 Semi-Finalists selected by the Jury of their country will be invited to the Semi-Final that will take place in each country between March 12 th 2019 and April 31 st 2019, the official date will be revealed at the latest the day of the Video Selections results announcement. The Jury of the Semi-Final will not be revealed before the official date of the Semi- Final. However, for information, the Jury will be composed of a journalist or a previous years CWC finalist, a member of the national distributing company, a representative of VELIER and/or LMDW. The 5 to 8 Semi-Finalists will be in competition against each other. The Jury will choose one (1) winner that will join Haiti for the World Final. The Participant is free to present a different Cocktail for each phase of the Championship (Selections, Semi-Final, Final), without any obligation to do so. The Semi-Finalists will produce their Clairin Cocktail in front of the Jury. The Organizing Company will provide: Clairin Communal, Clairin Casimir, Clairin Sajous, Clairin Vaval, Clairin Le Rocher and ice cubes. Participants are asked to bring their own equipment (without brand logo) and ingredients. The Semi-Final will be filmed and may be published on the official Website and
Social Networks. The date and place of the Semi-Final will be communicated at the same time as the Video Selections results. The President of the Jury is responsible of the good conduct of the selection, points counting, and the winner announcement. Also, the President s vote counts double in case of a tie. The Jury s decision is non-negotiable. The Organizing Company has all rights reserved to change the composition of the Jury at all times by modification of the present rules. 4.5. World Final in Haiti The 9 Winners of the 9 Semi-finals will travel to Haiti, where, after a week of visits and tours in the heart of the most remote distilleries and sugarcane fields, they will compete each other during the World Final. They will represent their living countries colour (Italy, France, Germany, UK, Belgium, Denmark, Sweden, Poland, Singapore) to a contest to the World best Clairin Cocktail. One directly nominated Haitian will participate to the Final, for a total of 10 World Finalists. The Jury will be composed of a journalist, a cocktail expert, a Clairin expert and/or LM&V staff. Article 5 Award The Winner of the Semi-final will win his participation to the World Final of the CLAIRIN WORLD CHAMPIONSHIP 2019, which will take place in Haiti. She/he shall be available to participate in the World Final, details shall be provided by the Organizing Company at a later date. In case of withdrawal of the Winner of the Semi-Final, the Jury will give its award to the second in rank of the Semi-Final. The participation of the Winner of the Semi-Final to the World Final will be borne by the Organizing Company in its entirety (travel, accommodation and food), limited to what s reasonable. All costs shall be upstream validated by the Organizing Company. Unless personally invited, charges of any accompanying person will in no case be borne by the Organizing Company. Other awards may come in addition. The Winner of the World Final will win a holiday in the Caribbean Island for 2 people. Dates and details will be decided and validated at a later date with the Organizing Company.
Article 6 Announcement of the Winner of the World Final Announcement of the Winner of the World Final will be made at the end of the cocktail contest, during a dinner organized by the Organizing Company, at the end of the events. Name of the Winner and the cocktails she/he created for the Championship, will be published on the Championship s website, as well as on the social networks and in specialized publications. Article 7 Intellectual Property and Image s right 7.1 Semi-Finalists The Semi-Finalists authorizes the Organizing Company and/or any affiliated person or company to: - use their name, address and image as well as any photograph from them and/or their videos of the cocktails published for the registration, or videos and/or photos realized during the Semi-Final, for advertising and/or promotional purposes, and for public relations with regard to operations linked to the CLAIRIN WORLD CHAMPIONSHIP, and/or to the products CLAIRIN, for a duration of two (2) years, as from the announcement of the Semi-Finalists list, free of any cost, right or advantage. - to publish online their cocktails recipes, and their videos on the CLAIRIN WORLD CHAMPIONSHIP s website and / or on social medias, and / or on any other media, in relation to the CLAIRIN WORLD CHAMPIONSHIP, for a duration of two (2) years, as from the announcement of the Semi-Finalists list, free of any cost, right or advantage. 7.2. Winner of the Semi-Final The Winner of the Semi-Final moreover agrees to be asked for participation to events linked to the product(s) and trademark(s) CLAIRIN, as Winner of the CLAIRIN WORLD CHAMPIONSHIP Semi-Final by the Organizing Company and/or any of its affiliate, for a duration of two (2) years. 7.3. Winner of the CLAIRIN WORLD CHAMPIONSHIP 2019 The Winner grants, free of any costs, the Organizing Company and/or its affiliate(s), an exclusive right of use of all the intellectual property rights (representation, copy, translation and adaptation) attached to its creations (recipes and cocktail names realized in the course of the CLAIRIN WORLD CHAMPIONSHIP), on any media, for the world and for the duration of said intellectual property rights. The Organizing Company and/or its affiliate(s) will be free to use or not use those creations, for the purpose of their activities. 7.4 Participants Participants through their participation and/or the videos of their cocktails shall
neither, in any way, harm the Organizing Company and/or its trademarks, nor be unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, and infringing one s dignity. Participants undertake to comply with applicable laws and regulations on advertising of spirits products. Recipes and videos shall be copyright free Participants guarantee they detain all the appropriate authorizations and rights for the commercial use of the recipes and of the videos. Participants undertake their video (i) are an original work, shooted by them, and (ii) does not contain any trademark, logo or other distinctive sign of third parties to the Organizing Company and/or their affiliate(s). Article 8 Liability The Organizing Company shall not be liable of any force majeure events, or of any event beyond its control, which would require to cancel, curtail, prorogue, report or modify in any way the CLAIRIN WORLD CHAMPIONSHIP. The Organizing Company shall not be liable of any technical problems or issues including power outages or malfunctions in Internet connectivity during the online registration of the candidate, or of any material and immaterial damages done to the Participants, their datas and of any personal, professional, commercial consequences arising in respect hereof. Following any political, sanitary and natural events, the Organizing Company undertakes to implement all necessary and proportionate security measures, in order to do its best efforts to guarantee the safety of the participants on the premises of the World Final. The Organizing Company shall however not be liable for the security of the people, for any event occurring during the transportation, the duration of the stay, and/or for any event beyond its control, and/or for any event of force majeure. Article 9 Data protection The Organizing Company shall use Participants personal data under its own responsibility, only for the purpose of organizing the CLAIRIN WORLD CHAMPIONSHIP. Subject to the Participants previous consent, such personal data may be used to send the Participants informations about the Organizing Company and/or the Products. In accordance with the European regulation 2016/679/UE, the Participants may access, rectify and delete any informations about themselves, by writing by email to info@thespiritofhaiti.com or by post letter to LM&V, CLAIRIN WORLD CHAMPIONSHIP 2019, 9-11 rue Martre, 92110 Clichy-la-Garenne, FRANCE. Article 10 Agreement to rules and regulations of CWC19
By participating in this Championship the Participant fully agrees to the rules and regulations herewith mentioned. Any failure to the rules and regulations, fraud or misconduct will lead to the Participant s immediate dismissal of the Championship. Where required, the Organizing Company has full rights to prosecute the Participant in the applicable laws. The complete rules and regulations are available on demand by email at info@thespiritofhaiti.com and at all times on the following website: http://www.thespiritofhaiti.com/en/clairin-world-championship-2019/ In the case of any clause being declared invalid, the herewith rules and regulations still remain applicable. No answer will be given to rules and regulation questioning, including interpretation and applicability of the latter. Article 11 Litigation The herewith rules and regulation are bound by the French law. Any cases not mentioned in the herewith rules and regulations will be decided by the Organizing Company. Any litigation that cannot be decided by mutual consent, will come within the competency by the Paris Court, even in the case of multiple defendants, incidental claim or a claim for contribution from a third party.
