Introduction This paper provides a snapshot of the legal instruments composing the oceans management regime in New Zealand. Whilst the Institute accepts that this is by no means a comprehensive collection, it has provided an initial selection of statutes, regulations and orders to illustrate that navigating the policy landscape of oceans management is currently a difficult task. This selection is presented in two lists: (i) statutes and (ii) regulations and orders. The Institute views instruments as mechanisms or tools which strengthen and empower the links between institutions. There are a range of instruments in the public service, including statutes, regulations, guides, annual reports, four-year plans, budget documents, treaties, government priorities, ministerial priorities, environmental national standards, national policy statements, local authority long-term plans and government department strategies (GDSs). This paper focuses on instruments which are more explicitly legal in nature. 2 The characteristics of each of these distinct legal instruments are discussed in Section 4. In order for instruments to be effective, they must be supported by two other cogs in the policy system: information and institutions. Information is made up of data that has been collated and analysed. Over time this information builds a narrative, which in turn provides decision-makers with strategic knowledge. This information may be collected and reported by institutions through instruments (such as those mentioned above), but more commonly it comes from other sources such as industry organisations, international organisations, academics, statistics and others. Institutions are the entities that have the resources and the authority (and often the responsibility) to implement policy change over the short and long term. Figure 1: The machinery of government by key components Source: McGuinness Institute, 2014 3 Institutions Instruments Information The information, instruments and institutions regulating the marine estate are not currently mapped out in a way which is immediately accessible for users of the ocean, regulators of the ocean or for the wider public. This hampers the efforts of citizens, commercial entities and public institutions seeking to improve the present management regime. Effective governance of the oceans must be based on the best available policy information, and decision-making must be coordinated across all sectors, interests, and government departments. The system of oceans management must be built on a foundation (of institutions, instruments and information) that values the principles of durability and integration. Currently this is not the case. The current mismanagement and atomisation of legal instruments governing oceans arguably result in a weakened public ability to improve collective stewardship of the oceans. There must be an improvement in the information systems which map individual and collective responsibilities toward this resource. Sufficient care should be taken to manage these instruments in an effective, integrated and durable way. Instruments can then be highly effective tools which give strength to institutions and enable the public to have confidence in the management vision for New Zealand s oceans. 2. Purpose The lists have been compiled to show the volume of legal instruments concerning oceans management and to begin to illustrate the challenges this presents ocean users and ocean regulators. The information below is presented to demonstrate the complexity of, and the need for integration of, the ocean management arena. It is not intended as an exhaustive list for practical purposes. The discussion of the rudimentary method used to collate these lists (in Section 4) further demonstrates the inadequacies in the accessibility of the current oceans regulatory regime. The sheer volume of regulations and orders listed below indicates that the information systems involved in oceans governance must be highly cohesive and ordered. 3 McGuinness Institute, 2014. 3. Limitations The Institute acknowledges that Lists I and II may have captured only a small selection of statutes, regulations and orders dealing with oceans management. As mentioned in Section 2, the paper s purpose is not to provide an exhaustive list of legal instruments; the exercise has been conducted to illustrate that the information in this area is overwhelming and lacks cohesion. The Institute recognises that the method used to collate the following lists is by no means comprehensive. Another limitation of this report is that the sole source of information on these instruments was internet research. Whilst ideally this would provide a complete picture of all legal instruments, this may not be the case in this area. Contacting relevant agencies and departments and requesting information individually would benefit further analysis. Government department websites did not prove useful in setting out active regulations or orders and therefore the imprecise search method detailed in Section 4 was used. There is no comprehensive list of regulations concerning oceans management, and thus the list below is bound to have missed some regulations which may be obvious for inclusion to those familiar with them. The Institute further acknowledges that some regulations may be included on this list due to their title seemingly being relevant to the management of the marine estate, but this may be an error. 4. Methodology Statutes were found by searching for key words linked to ocean management on the New Zealand Legislation website. 4 These key words were marine, ocean, and fisheries. The results of this search were then sorted for relevance, with irrelevant statutes excluded from the final list. Further ways of obtaining statutes included searching on agency and department websites (such as that of the Ministry for Primary Industries) 5 for legislation guides or pages. Orders and regulations were found by searching the principal acts concerning oceans and looking for regulations made under these acts. An example of this is the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012, which resulted in many regulations being made. Orders and regulations were also found by using the search function of the New Zealand legislation website to find key words - marine, ocean, and fishery/ies - and by excluding acts and bills from the results. These results were then analysed for relevance, and if it was not immediately apparent that the result concerned oceans and marine management, it was investigated further. The decision was then made after a brief review of a PDF version of the regulation or order in question. An example of regulations which were captured in the initial search and then rejected are the Health and Safety in Employment Regulations 1995. These contained the word marine ; however, this is in relation to agricultural work and not marine governance - nor marine reserves or any other relevant issue. II concerning oceans management Regulations As defined in the Interpretation Act 1999, regulations are laws created by the Governor-General, ministers and other bodies which have been conferred regulation-making power by another Act of Parliament. 7 Orders An order is a legislative tool which is officially overseen by the Governor-General but is made by the Executive Council.
