A number of our companions, from Ahmad Bin Muhammad, and Sahl Bin Ziyad, from Ahmad Bin Muhammad Bin Abu Nasr, from Abdul Kareem, from Sama at, from Abu Baseer, from Abu Abdullah asws having said: Neither rent out the land with the wheat, nor with the barley, nor with the dates, nor with the canal, nor with the sprouts (of water), but with the gold and the silver, because the gold and the silver are guaranteed, and these are not with a guarantee. 1 م ح م د ب ن ي ح ي ى ع ن م ح م د ب ن ال ح س ي ن ع ن ص ف و ان ع ن إ س ح اق ب ن ع م ار ع ن أ ب ي ب ص ير ع ن أ ب ي ع ب د للا ( عليه السالم ) ق ال ل ت س ت أ ج ر ا ل ر ض ب الت م ر و ل ب ال ح ن ط ة و ل ب الش ع ير و ل ب ا ل ر ب ع اء و ل ب الن ط اف ق ل ت و م ا ا ل ر ب ع اء ق ال الش ر ب و الن ط اف ف ض ل ال م اء و ل ك ن ت ق ب ل ه ا ب الذ ه ب و ال ف ض ة و الن ص ف و الث ل ث و الر ب ع. Muhammad Bin Yahya, from Muhammad Bin Al Husayn, from Safwan, from Is haq Bin Ammar, from Abu Baseer, from Abu Abdullah asws having said: Do not rent out the land with the dates, nor with the wheat, nor with the barley, nor with the canal, nor with the (water) sprouts. I said, And what are the canals? Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Al hajjal, from Sa albat Bin Maymoun, from Bureyd, from Abu Ja far asws regarding the man who accepts (the rent for) the land with the Dinars or with the Dirhams. He asws said: There is no problem. 4 ع د ة م ن أ ص ح اب ن ا ع ن أ ح م د ب ن م ح م د و س ه ل ب ن ز ي اد ج م يعا ع ن أ ح م د ب ن م ح م د ب ن أ ب ي ن ص ر ع ن د او د ب ن س ر ح ان ع ن أ ب ي ع ب د للا ( عليه السالم ) ف ي الر ج ل ي ك ون ل ه ا ل ر ض ع ل ي ه ا خ ر اج م ع ل وم و ر ب م ا ز اد و ر ب م ا ن ق ص ف ي د ف ع ه ا إ ل ى ر ج ل ع ل ى أ ن ي ك ف ي ه خ ر اج ه ا و ي ع ط ي ه م ائ ت ي د ر ه م ف ي الس ن ة ق ال ل ب أ س. A number of our companions, from Ahmad Bin Muhammad, and Sahl Bin Ziyad, altogether from Ahmad Bin Muhammad Bin Abu Nasr, from Dawood Bin Sirham, from Abu Abdullah asws regarding the man who happened to have some land for him upon which is a known taxation, and sometimes it tends to increase and sometimes decrease. So he hands it over to a man upon a stipulation that he would pay its taxation and give him two hundred Dirhams during the year. He asws said: There is no problem. 5 ع ل ي ب ن إ ب ر اه يم ع ن ص ال ح ب ن الس ن د ي ع ن ج ع ف ر ب ن ب ش ير ع ن م وس ى ب ن ب ك ر ع ن ال ف ض ي ل عليه السالم ) ع ن إ ج ار ة ا ل ر ض ب الط ع ام ف ق ال إ ن ك ان م ن ط ع ام ه ا ف ال خ ي ر ف يه. ب ن ي س ار ق ال س أ ل ت أ ب ا ج ع ف ر ( Ali Bin Ibrahim, from Salih Bin Al Sandy, from Ja far Bin Bashir, from Musa Bin Bakr, from Al Fuzayl Bin Yasaar who said, I asked Abu Ja far asws about the rent for the land with the foodstuff, so he asws said: If it was from its foodstuff (grown in that very land), so there is no goodness in it. 6 ح م ي د ب ن ز ي اد ع ن ال ح س ن ب ن م ح م د ب ن س م اع ة ع ن غ ي ر و اح د ع ن أ ب ان ع ن إ س م اع يل ب ن ال ف ض ل ق ال س أ ل ت أ ب ا ع ب د للا ( عليه السالم ) ع ن ر ج ل اس ت أ ج ر م ن ر ج ل أ ر ضا ف ق ال أ ج ر ت ه ا ك ذ ا و ك ذ ا ع ل ى أ ن أ ز ر ع ه ا ف إ ن ل م أ ز ر ع ه ا أ عط ي ت ك ذ ل ك ف ل م ي ز ر ع ه ا ق ال ل ه أ ن ي أ خ ذ إ ن ش اء ت ر ك ه و إ ن ش اء ل م ي ت ر ك ه. Humeyd Bin Ziyad, from Al Hassan Bin Muhammad Bin Sama at, from someone else, from Aban, from Ismail Bin Al Fazl who said, I asked Abu Abdullah asws about a man who rented a land from a man, so he said, I rent it out for such and such upon a stipulation that I cultivate it. So if I do not cultivate it, I shall give you that. So he did not cultivate it. I asked Al Reza asws about a man who bought a land from a man of known experience with one hundred Kuf (unit of measurement) upon a stipulation that he would give it to him (the produce) from the (very) land. So he asws said: Prohibited. ق ال ق ل ت ل ه ف م ا ت ق ول ج ع ل ن ي للا ف د اك إ ن اش ت ر ى م ن ه ا ل ر ض ب ك ي ل م ع ل وم و ح ن ط ة م ن غ ي ر ه ا ق ال ل ب أ س. He (the narrator) said, So what are you asws saying, may Allah ajwj Make me to be sacrificed for you asws, if I were to buy from him the land with a known measurement and wheat from other than it? He asws said: There is no problem. 8 م ح م د ب ن ي ح ي ى ع ن أ ح م د ب ن م ح م د ع ن م ح م د ب ن س ه ل ع ن أ ب يه ق ال س أ ل ت أ ب ا ال ح س ن م وس ى ( عليه السالم ) ع ن الر ج ل ي ز ر ع ل ه ال ح ر اث الز ع ف ر ان و ي ض م ن ل ه أ ن ي ع ط ي ه ف ي ك ل ج ر يب أ ر ض ي م س ح ع ل ي ه و ز ن ك ذ ا و ك ذ ا د ر ه ما ف ر ب م ا ن ق ص و غ ر م و ر ب م ا اس ت ف ض ل و ز اد ق ال ل ب أ س ب ه إ ذ ا ت ر اض ي ا. Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Muhammad Bin Sahl, from his father who said, I asked Abu Al Hassan Musa asws about the man for whom the farmers cultivate the Saffron farm and guarantee for him that they would give him regarding every Jareyb (unit of measurement) of land which has been touched upon, a weight of such and such Dirhams. So sometimes it is deficient and he loses, and sometimes it is excess, and increases. He asws said: There is no problem with it when they are both pleased (with the arrangement). 9 أ ح م د ب ن م ح م د ع ن م ح م د ب ن س ه ل ع ن أ ب يه ع ن ع ب د للا ب ن ب ك ي ر ع ن أ ب ي ع ب د للا ( عليه السالم ) ق ال س أ ل ت ه ع ن ر ج ل ي ز ر ع ل ه الز ع ف ر ان ف ي ض م ن ل ه ال ح ر اث ع ل ى أ ن ي د ف ع إ ل ي ه م ن ك ل أ ر ب ع ين م ن ا ز ع ف ر ان ر ط ب م ن ا و ي ص ال ح ه ع ل ى ال ي اب س و ال ي اب س إ ذ ا ج ف ف ي ن ق ص ث ال ث ة أ ر ب اع ه و ي ب ق ى ر ب ع ه و ق د ج ر ب ق ال ل ي ص ل ح Ahmad Bin Muhammad, from Muhammad Bin Sahl, from his father, from Abdullah Bin Bukeyr, from Abu Abdullah asws, said, I asked him asws about a man who cultivates the Saffron for him, so he guarantees for him the farming upon a stipulation that he would hand over to him from every forty Mann (unit of weight) of Saffron, one Mann of fresh Saffron, and they reconcile upon the dried (Saffron); and the dried Saffron is such that when it dehydrates, it reduces by three-quarters and there remains a third of it, and it has been experienced as such. He asws said: It is not correct. ق ل ت و إ ن ك ان ع ل ي ه أ م ين ي ح ف ظ ب ه ل م ي س ت ط ع ح ف ظ ه ل ن ه ي ع ال ج ب الل ي ل و ل ي ط اق ح ف ظ ه ق ال ي ق ب ل ه ا ل ر ض أ و ل ع ل ى أ ن ل ك ف ي ك ل أ ر ب ع ين م ن ا م ن ا. I said, And if there was a trustworthy (overseer) upon it protecting it, not being able to protect it because it is worked on at night, and its protection is not endurable. Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby who said, Abu Abdullah asws informed me that his asws father asws narrated to him asws that Rasool- Allah saww gave Khyber with the half of its land and its palm trees. So when the fruits were realised, he saww sent Abdullah Bin Rawahat who evaluated upon them a price. So he said to them, Either you take it (the crops) and give me half the price, or else I give you half the price and I take it (the crops). So they said, By this (justice), stand the skies and the earth. 11 ع د ة م ن أ ص ح اب ن ا ع ن أ ح م د ب ن م ح م د و س ه ل ب ن ز ي اد ع ن ال ح س ن ب ن م ح ب وب ع ن م ع او ي ة ب ن ع م ار ع ن أ ب ي الص ب اح ق ا ل س م ع ت أ ب ا ع ب د للا ( عليه السالم ) ي ق ول إ ن الن ب ي ( صلى للا عليه وآله ) ل م ا اف ت ت ح خ ي ب ر ت ر ك ه ا ف ي أ ي د يه م ع ل ى الن ص ف ف ل م ا ب ل غ ت الث م ر ة ب ع ث ع ب د للا ب ن ر و اح ة إ ل ي ه م ف خ ر ص ع ل ي ه م ف ج اء وا إ ل ى الن ب ي ( صلى للا عليه وآله ) ف ق ال وا ل ه إ ن ه ق د ز ا د ع ل ي ن ا ف أ ر س ل إ ل ى ع ب د للا ف ق ال م ا ي ق ول ه ؤ ل ء ق ال ق د خ ر ص ت ع ل ي ه م ب ش ي ء ف إ ن ش اء وا ي أ خ ذ ون ب م ا خ ر ص ن ا و إ ن ش اء وا أ خ ذ ن ا ف ق ال ر ج ل م ن ال ي ه ود ب ه ذ ا ق ام ت الس م او ات و ا ل ر ض. A number of our companions, from Ahmad Bin Muhammad, and Sahl Bin Ziyad, from Al Hassan Bin Mahboub, from Muawiya Bin Ammar, from Abu Al Sabbah who said, I heard Abu Abdullah asws saying that when the Prophet saww conquered Khyber, he saww left it in their hands upon a stipulation that the half (would be for each party). So when the fruits reached (maturity), he saww sent Abdullah in Rawahat to them, who evaluated it upon them. So they came over to the Prophet saww and they said to him saww, He has increased (the estimation) upon us. So he saww sent a message to Abdullah, and he saww said: What are they saying? He said, I had evaluated upon them with something, so if they so desire to they can take with what we have evaluated, and if they so desire to, we take it. So a man from the Jews said, By this (justice) stand the skies and the earth. 12 ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ع م ي ر ع ن ح م اد ع ن ال ح ل ب ي ع ن أ ب ي ع ب د للا ( عليه السالم ) ق ال ل ت ق ب ل ا ل ر ب ح ن ط ة م س م اة و ل ك ن ب الن ص ف و الث ل ث و الر ب ع و ال خ م س ل ب أ س ب ه و ق ال ل ب أ س ب ال م ز ار ع ة ب الث ل ث و الر ب ع و ال خ م س. ض Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al halby, from Abu Abdullah asws having said: Do not accept the land with the specified wheat, but (accepting) with the third (of the produce), and the quarter, and the fifth, there is 11 Al Kafi V 5 The Book of Subsistence Ch 127 H 1 12 Al Kafi V 5 The Book of Subsistence Ch 127 H 2 7 out of 46

And he asws said: There is no problem with sharing the crops with the third, and the quarter, and the fifth. 13 ع د ة م ن أ ص ح اب ن ا ع ن أ ح م د ب ن م ح م د ع ن ال ح س ن ب ن م ح ب وب ع ن ال ح س ي ن ب ن س ع يد ع ن الن ض ر ب ن س و ي د ع ن ع ب د للا ب ن س ن ان أ ن ه ق ال ف ي الر ج ل ي ز ار ع ف ي ز ر ع أ ر ض غ ي ر ه ف ي ق ول ث ل ث ل ل ب ق ر و ث ل ث ل ل ب ذ ر و ث ل ث ل ل ر ض ق ال ل ي س م ي ش ي ئا م ن ال ح ب و ال ب ق ر و ل ك ن ي ق ول از ر ع ف يه ا ك ذ ا و ك ذ ا إ ن ش ئ ت ن ص فا و إ ن ش ئ ت ث ل ثا. A number of our companions, from Ahmad Bin Muhammad, from Al Hassan Bin Mahboub, from Al Husayn Bin Saeed, from Al Nazar Bin Suweyd, from Abdullah Bin Sinan having said regarding the man who cultivated on a sharing basis, so he farmed someone else s land, A third is for the oxen (ploughing), and a third for the sowing, and a third for the land. He asws said: He should not mention anything from the seeds, and the cows, but he should be saying, I shall cultivate such and such therein, if you so desire to, for a half, and if you so desire to, for a third. 14 م ح م د ب ن ي ح ي ى ع ن أ ح م د ب ن م ح م د ع ن ع ل ي ب ن الن ع م ان ع ن اب ن م س ك ان ع ن س ل ي م ان ب ن خ ال د ق ال س أ ل ت أ ب ا ع ب د للا ( عليه السالم ) ع ن الر ج ل ي ز ر ع أ ر ض آخ ر ف ي ش ت ر ط ع ل ي ه ل ل ب ذ ر ث ل ثا و ل ل ب ق ر ث ل ثا ق ال ل ي ن ب غ ي أ ن ي س م ي ب ذ را و ل ب ق را ف إ ن م ا ي ح ر م ال ك ال م. Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ali Bin Al Nu man, from Ibn Muskan, from Suleyman Bin Khalid who said, I asked Abu Abdullah asws about the man who cultivates a land of another, so he stipulates upon him, a third for the sowing, and a third for the oxen (ploughing). Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby wo said, Abu Abdullah asws was asked about the man who cultivated the land, so he stipulated a third for the sowing, and a third for the oxen (ploughing). الز ر ع ح ت ى ي ص ير ح ن ط ة و ش ع يرا و ي ك ون ال ق س م ة ف ي أ خ ذ الس ل ط ان ح ق ه و ي ب ق ى م ا ب ق ي ع ل ى أ ن ل ل ع ل ج م ن ه الث ل ث و ل ي ال ب اق ي ق ال ل ب أ س ب ذ ل ك A number of our companions, from Ahmad Bin Muhammad, and Sahl Bin Ziyad, from Al Hassan Bin Mahboub, from Ibrahim Al Karkhy who said, I said to Abu Abdullah asws, I associated with Al Ilj (the non-muslim) so there happened to be from me, the land, and the sowing, and the oxen, and there happened to be upon Al Ilj (non-muslim) the overseeing, and the irrigation, and the workers in the farming until there came to be wheat and barley, and there happened to be the distribution, so the Sultan (ruling authority) took his right (taxation), and there remained what remained upon a stipulation that for Al Ilj (the non-muslim) from it would be the third, and for me would be the remainder. He asws said: There is no problem with that. ق ل ت ف ل ي ع ل ي ه أ ن ي ر د ع ل ي م م ا أ خ ر ج ت ا ل ر ض ال ب ذ ر و ي ق س م ال ب اق ي ق ال إ ن م ا ش ار ك ت ه ع ل ى أ ن ال ب ذ ر م ن ع ن د ك و ع ل ي ه الس ق ي و ال ق ي ام I said, So would it be for me if he was to return to me from what I had brought out of the seeds, and the remainder to be divided? He asws said: But rather, you participated with him upon a stipulation that the sowing would be from you, and upon him would be the irrigation and the overseeing. 17 م ح م د ب ن ي ح ي ى ع ن م ح م د ب ن ال ح س ي ن ع ن ص ف و ان ع ن ي ع ق وب ب ن ش ع ي ب ع ن أ ب ي ع ب د للا ( عليه السالم ) ق ال س أ ل ت ه ع ن الر ج ل ي ك ون ل ه ا ل ر ض م ن أ ر ض ال خ ر اج ف ي د ف ع ه ا إ ل ى الر ج ل ع ل ى أ ن ي ع م ر ه ا و ي ص ل ح ه ا و ي ؤ د ي خ ر اج ه ا و م ا ك ان م ن ف ض ل ف ه و ب ي ن ه م ا ق ال ل ب أ س Muhammad Bin Yahya, from Muhammad Bin Al Husayn, from Safwan, from yaqoub Bin Shuayb, from Abu Abdullah asws, said, I asked him asws about the man who happened to have the land from the goverement lands. So he handed it over to the man upon a stipulation that he would work upon it and correct it, and he would pay its taxes, and whatever was from the excess, so it would be between the two of them. He asws said: There is no problem. ق ال و س أ ل ت ه ع ن الر ج ل ي ع ط ي الر ج ل أ ر ض ه و ف يه ا ر م ان أ و ن خ ل أ و ف اك ه ة ف ي ق ول اس ق ه ذ ا م ن ال م اء و اع م ر ه و ل ك ن ص ف م ا أ خ ر ج ق ال ل ب أ س He (the narrator) said, And I asked him asws about the man who gave his land to the man and therein were pomegranates, or palm trees, or fruits, so he was saying, Irrigate this from the water and work upon it, and for you would be half of what comes out. He asws said: There is no problem. ق ال و س أ ل ت ه ع ن الر ج ل ي ع ط ي الر ج ل ا ل ر ض ف ي ق ول اع م ر ه ا و ه ي ل ك ث ال ث س ن ين أ و خ م س س ن ين أ و م ا ش اء للا ق ال ل ب أ س He (the narrator) said, And I asked him asws about the man who have the land to the man, so he was saying, Work upon it and it is for you for three years, or five years, or whatever Allah ajwj so Desires. ق ال و س أ ل ت ه ع ن ال م ز ار ع ة ف ق ال الن ف ق ة م ن ك و ا ل ر ض ل ص اح ب ه ا ف م ا أ خ ر ج للا م ن ه ا م ن ش يء ق س م ع ل ى الش ط ر و ك ذ ل ك أ ع ط ى ر س ول للا ( صلى للا عليه وآله ) أ ه ل خ ي ب ر ح ين أ ت و ه ف أ ع ط اه م إ ي اه ا ع ل ى أ ن ي ع م ر وه ا و ل ه م الن ص ف م م ا أ خ ر ج ت. He (the narrator) said, And I asked him asws about the farming on a sharing basis, so he asws said: The expenditure is for you and the land is for its owner. So whatever Allah ajwj brings out from it from anything, it would be divided upon the stipulation; and such is how Rasool-Allah saww gave the people of Khyber when they came to him saww. So he saww have it (land) to them upon a stipulation that they would work upon it and for them would be the half from whatever comes out. 18 ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ع م ي ر ع ن ح م اد ع ن ال ح ل ب ي ع ن أ ب ي ع ب د للا ( عليه السالم ) ق ال ق ال ال ق ب ال ة أ ن ت أ ت ي ا ل ر ض ال خ ر ب ة ف ت ق ب ل ه ا م ن أ ه ل ه ا ع ش ر ين س ن ة أ و أ ق ل م ن ذ ل ك أ و أ ك ث ر ف ت ع م ر ه ا و ت ؤ د ي م ا خ ر ج ع ل ي ه ا ف ال ب أ س ب ه. Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, from Abu Abdullah asws having said: The leasing whereby you are given the barren land, so you accept it from its owners for twenty years, or less from that or more. So you work upon it and you pay whatever the taxes are upon it, so there is no problem with it. 19 ع د ة م ن أ ص ح اب ن ا ع ن أ ح م د ب ن م ح م د ع ن ع ث م ان ب ن ع يس ى ع ن س م اع ة ق ال س أ ل ت ه ع ن م ز ار ع ة ال م س ل م ال م ش ر ك ف ي ك ون م ن ع ن د ال م س ل م ال ب ذ ر و ال ب ق ر و ت ك ون ا ل ر ض و ال م اء و ال خ ر اج و ال ع م ل ع ل ى ال ع ل ج ق ال ل ب أ س ب ه A number of our companions, from Ahmad Bin Muhammad, from Usman Bin Isa, from Sama at who said, I asked about the farming on a sharing basis of the Muslim with the Polytheist. So there happened to be with the Muslim, the seeds and the oxen, and the land, and the water, and the taxation, and the work was upon Al Ilj (the Polytheist). He asws said: There is no problem with it. ق ال و س أ ل ت ه ع ن ال م ز ار ع ة ق ل ت الر ج ل ي ب ذ ر ف ي ا ل ر ض م ائ ة ج ر يب أ و أ ق ل أ و أ ك ث ر ط ع اما أ و غ ي ر ه ف ي أ ت يه ر ج ل ف ي ق ول خ ذ م ن ي ن ص ف ث م ن ه ذ ا ال ب ذ ر ال ذ ي ز ر ع ت ه ف ي ا ل ر ض و ن ص ف ن ف ق ت ك ع ل ي و أ ش ر ك ن ي ف يه ق ال ل ب أ س He (the narrator) said, And I asked him asws about the crop sharing. I said, The man sowed one hundred Jareyb (unit of measurement) in the land, or less or more, foodstuff or something else. So a man came to him saying, Take from me half the price of the sowing which you have cultivated in the land, and half of your expenditure incurred and participate me in it. He said, There is no problem. ق ل ت و إ ن ك ان ال ذ ي ي ب ذ ر ف يه ل م الث م ن و ن ص ف الن ف ق ة و ي ش ار ك ه. ي ش ت ر ه ب ث م ن و إ ن م ا ه و ش يء ك ان ع ن د ه ق ال ف ل ي ق و م ه ق يم ة ك م ا ي ب اع ي و م ئ ذ ف ل ي أ خ ذ ن ص ف I said, And if it was such that the one who sowed in it had not bought it with a price, and rather it was something which was with him (from beforehand)? let him evaluate its price just as he had bought it on that day, and let him take half the price, and half the expenditure, and participate him. 20 باب ق ب ال ة أ ر ض أ ه ل الذ م ة و ج ز ي ة ر ء وس ه م و م ن ي ت ق ب ل ا ل ر ض م ن الس ل ط ان ف ي ق ب ل ه ا م ن غي ر ه Chapter 129 Renting the land of the Ahl Al Zimma and the taxation of their heads (personal tax), and the one who leases the land from the Sultan (ruling authority) so he leases is out to someone else ع د ة م ن أ ص ح اب ن ا ع ن س ه ل ب ن ز ي اد و أ ح م د ب ن م ح م د ع ن اب ن م ح ب وب ع ن إ ب ر اه يم ال ك ر خ ي ق ال س أ ل ت أ ب ا ع ب د للا ( عليه السالم ) ع ن ر ج ل ك ان ت ل ه ق ر ي ة ع ظ يم ة و ل ه ف يه ا ع ل وج ذ م ي ون ي أ خ ذ م ن ه م الس ل ط ان ال ج ز ي ة ف ي ع ط يه م ي ؤ خ ذ م ن أ ح د ه م خ م س ون و م ن ب ع ض ه م ث ال ث ون و أ ق ل و أ ك ث ر ف ي ص ال ح ع ن ه م ص اح ب ال ق ر ي ة الس ل ط ان ث م ي أ خ ذ ه و م ن ه م أ ك ث ر م م ا ي ع ط ي الس ل ط ان ق ال ه ذ ا ح ر ام. A number of our companions, from Sahl Bin Ziyad and Ahmad Bin Muhammad, from Ibn Mahboub, from Ibrahim Al Karkhy who said, I asked Abu Abdullah asws about a man who had a great town for him, and for him therein were the people under the responsibility (Zimmy), and the Sultan (ruling authority) would take the tax from them. So he (government representative) would come to them and take fifty from one of them, and thirty from one of them, and less and more. So the owner of the town would reconcile on their behalf with the Sultan, then he would take from them more that what he had given to the Sultan. He asws said: This is Prohibited. 21 ح م ي د ب ن ز ي اد ع ن ال ح س ن ب ن م ح م د ع ن أ ح م د ب ن ال ح س ن ال م يث م ي ق ال ح د ث ن ي أ ب و ن ج يح ال م س م ع ي ع ن ال ف ي ض ب ن ال م خ ت ا ر ق ال ق ل ت ل ب ي ع ب د للا ( عليه السالم ) ج ع ل ت ف د اك م ا ت ق ول ف ي أ ر ض أ ت ق ب ل ه ا م ن الس ل ط ان ث م أ ؤ اج ر ه ا أ ك ر ت ي ع ل ى أ ن م ا أ خ ر ج للا م ن ه ا م ن ش ي ء ك ان ل ي م ن ذ ل ك الن ص ف و الث ل ث ب ع د ح ق الس ل ط ان ق ال ل ب أ س ب ه ك ذ ل ك أ ع ام ل أ ك ر ت ي. Humeyd Bin Ziyad, from Al Hassan Bin Muhammad, from Ahmad Bin Al Hassan Al Maysami who said, Abu Najeeh Al Mimai narrated to me from Al Qayz Bin Al Mukhtar who said, I said to Abu Abdullah asws, May I be sacrificed for you asws! What are you asws saying regarding a land I lease from the Sultan (ruling authority), then I rent it out to my lessees upon a stipulation that whatever Allah ajwj Brings out from it from anything, what would be for me from that is the half, and the third, after the right (land tax) of the Sultan? He asws said: There is no problem with it. That is how I asws deal with my asws lessees. 22 ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ع م ي ر ع ن ح م اد ع ن ال ح ل ب ي ع ن أ ب ي ع ب د للا ( عليه السالم ) ق ال ل ب أ س ب ق ب ال ة ا ل ر ض م ن أ ه ل ه ا ع ش ر ين س ن ة و أ ق ل م ن ذ ل ك و أ ك ث ر ف ي ع م ر ه ا و ي ؤ د ي م ا خ ر ج ع ل ي ه ا و ل ي د خ ل ال ع ل وج ف ي ش يء م ن ال ق ب ال ة ل ن ه ل ي ح ل. from Abu Abdullah(a.s.) having said: There is no problem with leasing the land from its owner for twenty years, and less from that and more. So work on it and pay whatever taxes that are upon it, and do not include the non-muslims in anything from the lease, because it is not Permissible. 23 ع د ة م ن أ ص ح اب ن ا ع ن أ ح م د ب ن م ح م د ع ن ع ث م ان ب ن ع يس ى ع ن س م اع ة ق ال س أ ل ت ه ع ن الر ج ل ي ت ق ب ل ا ل ر ض ب ط يب ة ن ف س أ ه ل ه ا ع ل ى ش ر ط ي ش ار ط ه م ع ل ي ه و إ ن ه و ر م ف يه ا م ر م ة أ و ج د د ف يه ا ب ن اء ف إ ن ل ه أ ج ر ب ي وت ه ا إ ل ال ذ ي ك ان ف ي أ ي د ي د ه اق ين ه ا أ و ل ق ال إ ذ ا ك ان ق د د خ ل ف ي ق ب ال ة ا ل ر ض ع ل ى أ م ر م ع ل وم ف ال ي ع ر ض ل م ا ف ي أ ي د ي د ه اق ين ه ا إ ل أ ن ي ك ون ق د اش ت ر ط ع ل ى أ ص ح اب ا ل ر ض م ا ف ي أ ي د ي الد ه اق ين. A number of our companions, from Ahmad Bin Muhammad, from usman Bin Isa, from Sama at who said, I asked abou the man who leases the land with the agreement of its owners upon a stipulation he stipulates upon them, and if he were to do repairs therein from the repair work or a renewal a construction therein, so for him would be the rent of its building, except for that which was already in the hands of the former farmers beforehand. He asws said: When he had entered into a lease of the land upon a known matter, so he should not deal with what is in the hands of its farmers except he happened to have stipulated upon the owner of the land with regards to what is in the hands of the farmers. 24 ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ع م ي ر ع ن ح م اد ع ن إ ب ر اه يم ب ن م ي م ون ق ال س أ ل ت أ ب ا ع ب د للا ( عليه السالم ) ع ن ن اس م ن أ ه ل الذ م ة ل أ د ر ي أ ص ل ه ا ل ه م أ م ل غ ي ر أ ن ه ا ف ي أ ي د يه م و ع ل ي ه م خ ر اج ف اع ت د ى ع ل ي ه م الس ل ط ان ف ط ل ب وا إ ل ي ق ر ي ة ل ف أ ع ط و ن ي أ ر ض ه م و ق ر ي ت ه م ع ل ى أ ن أ ك ف ي ه م الس ل ط ان ب م ا ق ل أ و ك ث ر ف ف ض ل ل ي ب ع د ذ ل ك ف ض ل ب ع د م ا ق ب ض الس ل ط ان م ا ق ب ض ق ال ل ب أ س ب ذ ل ك ل ك م ا ك ان م ن ف ض ل. Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Ibrahim Bin Maymoun who said, I asked Abu Abdullah asws about a town of the people from the Ahl Al Zimma. I do not known whether its origin was for them or not, apart from that it was in their hands, and upon them was taxation. So the Sultan (ruling authority) exceeded upon them, and they sought (an alternative) with me, so they gave me their land and their town upon a stipulation that I shall suffice them against the Sultan with whatever was less or more. So the excess would be for me after that, a remainder after what the Sultan takes whatever he takes. He asws said: There is no problem with that. Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ali Bin Ahmad, from Yunus who said, I wrote to Al Rea asws asking him asws about a man who leased a land or other than that from a man for a specified number of years. Then the land owner wanted to sell his land which he had leased out before the expiration of the specified term. It is for the lessee that he prevent him from the sale before the expiration of his term which it had been lease from him to him, and what obligated the lessee for it? He asws wrote: For him is to sell when he stipulates upon the buyer that for the lessee would be from the years what were (contracted) for him. 26 ع د ة م ن أ ص ح اب ن ا ع ن س ه ل ب ن ز ي اد و أ ح م د ب ن م ح م د ع ن ع ل ي ب ن م ه ز ي ار ع ن إ ب ر اه يم ب ن م ح م د ال ه م ذ ان ي و م ح م د ب ن ج ع ف ر الر ز از ع ن م ح م د ب ن ع يس ى ع ن إ ب ر اه يم ال ه م ذ ان ي ق ال ك ت ب ت إ ل ى أ ب ي ال ح س ن ( عليه السالم ) و س أ ل ت ه ع ن ام رأ ة آج ر ت ض ي ع ت ه ا ع ش ر س ن ين ع ل ى أ ن ت ع ط ى ا ل ج ر ة ف ي ك ل س ن ة ع ن د ان ق ض ائ ه ا ل ي ق د م ل ه ا ش يء م ن ا ل ج ر ة م ا ل م ي م ض ج ار ة م ن ت ق ض ة ب م و ت ج ار ة إ ل ى ال و ق ت أ م ت ك ون ا ل ال و ق ت ف م ات ت ق ب ل ث ال ث س ن ين أ و ب ع د ه ا ه ل ي ج ب ع ل ى و ر ث ت ه ا إ ن ف اذ ا ل ال م ر أ ة A number of our companions, from Sahl Bin Ziyad and Ahmad Bin Muhammad, from Ali Bin Mahziyar, from Ibrahim Bin Muhammad Al Hamdany and Muhammad Bin Ja far Al Raaz, from Muhammad Bin Isa, from Ibrahim Al Hamdany who said, I wrote to Abu Al Hassan asws and asked him asws about a woman who rented out her place for twenty years upon a stipulation that she would be given the rent during every year of its term, nothing would proceed to her from the rent for as long as the time has not expired. So she died three years before or after it. Is it obligated upon her inheritors for enforcing the rent up to the time, or would the rent become lapsed by the death of the woman? ف ك ت ب ( عليه السالم ) إ ن ك ان ل ه ا و ق ت م س م ى ل م ي ب ل غ ف م ات ت ف ل و ر ث ت ه ا ت ل ك ا ل ن ص ف ه أ و ش ي ئا م ن ه ف ي ع ط ى و ر ث ت ه ا ب ق د ر م ا ب ل غ ت م ن ذ ل ك ال و ق ت إ ن ش اء للا. ج ار ة ف إ ن ل م ت ب ل غ ذ ل ك ال و ق ت و ب ل غ ت ث ل ث ه أ و So he asws wrote: If it was a specified time for her which had not yet reached and she died, so that rent would be for her inheritors. So if that time had not yet reached, and a third of it had, or half of it, or something from it, so her inheritors would be given in accordance with whatever had reached from that time (onwards), Allah ajwj Willing. 27 س ه ل ب ن ز ي اد ع ن أ ح م د ب ن إ س ح اق الر از ي ق ال ك ت ب ر ج ل إ ل ى أ ب ي ال ح س ن الث ال ث ( عليه السالم ) ر ج ل اس ت أ ج ر ض ي ع ة م ن ر ج ل ف ب اع ال م ؤ اج ر ت ل ك الض ي ع ة ال ت ي آج ر ه ا ب ح ض ر ة ال م س ت أ ج ر و ل م ي ن ك ر ال م س ت أ ج ر ال ب ي ع و ك ان ح اض را ل ه ش اه دا ع ل ي ه ف م ات ال م ش ت ر ي و ل ه و ر ث ة أ ي ر ج ع ذ ل ك ف ي ال م ير اث أ و ي ب ق ى ف ي ي د ال م س ت أ ج ر إ ل ى أ ن ت ن ق ض ي إ ج ار ت ه ف ك ت ب ( عليه السالم ) إ ل ى أ ن ت ن ق ض ي إ ج ار ت ه. it. So the buyer died, and for him were inheritors, can they retract that in the inheritance or would it remain in the hand of the lessee up to the expiration of his term? A number of our companions, from Sahl Bin Ziyad and Ahmad Bin Muhammad altogether, from Ibn Mahboub, from Khalid Bin Jareer, from Abu Al Rabie Al Shamy, from Abu Abdullah asws, said, I asked him asws about the man who Leased the land from the farmers, so he sub-leased it out with more than what he had leased it with, and he undertook therein the share of the Sultan (ruling authority). He asws said: There is no problem with it. The land is not like the employee, nor like the house. Then he sub-leased it out and stipulated upon the one who cultivated it that he would distribute the half, or less than that or more, and for him in the land after that would be the excess. Is that correct for him? He (the narrator) said, And I asked him asws about the man who leases a land from a land of the government for a specified amount of Dirhams, or with a known amount of foodstuff, so he sub-leases it out piece by piece, or a Jareyba (unit of measurement) by Jareyba, with a specified thing. anything upon it, or he leases out that land in pieces upon a stipulation that he would give them the seeds and the expenditure. So there happens to be some excess for him regarding that, upon his lessees, and would there be for him the fertility of the land or would it not be for him? So he asws said: Whenever you lease a land, so you spend something therein, or do some repair work in it, so there is no problem with what you have mentioned. 30 ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ع م ي ر ع ن أ ب ي ال م غ ر اء ع ن أ ب ي ع ب د للا ( عليه السالم ) ف ي الر ج ل ي س ت أ ج ر ا ل ر ض ث م ي ؤ اج ر ه ا ب أ ك ث ر م م ا اس ت أ ج ر ه ا ف ق ال ل ب أ س إ ن ه ذ ا ل ي س ك ال ح ان وت و ل ا ل ج ير إ ن ف ض ل ا ل ج ير و ال ح ان وت ح ر ام. Ali Bin Ibrahim, from his father, from Ibn AbuUmeyr, from Abu Al Magra, from Abu Abdullah asws regarding the man who leases a land, then he sub-leases it out with more than what he had leased it for. So he asws said: There is no problem. This is not like the shops, nor like the employees (wages). Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, from Abu Abullah asws having said: If a man was to rent a house for ten Dirhams and he dwells in two-thirds of it and rents out a third of it for ten Dirhams, there would not be a problem with it, and he should not rent it out for more than what he has rented it for unless if he would to innovate something in it (Make some improvement to it). 32 ع د ة م ن أ ص ح اب ن ا ع ن س ه ل ب ن ز ي اد ع ن اب ن ف ض ال ع ن أ ب ي ال م غ ر اء ع ن إ ب ر اه يم ب ن م ي م ون أ ن إ ب ر اه يم ب ن ال م ث ن ى س أ ل أ ب ا ع ب د للا ( عليه السالم ) و ه و ي س م ع ع ن ا ل ر ض ي س ت أ ج ر ه ا الر ج ل ث م ي ؤ اج ر ه ا ب أ ك ث ر م ن ذ ل ك ق ال ل ي س ب ه ب أ س إ ن ا ل ر ض ل ي س ت ب م ن ز ل ة ال ب ي ت و ا ل ج ير إ ن ف ض ل ال ب ي ت ح ر ام و ف ض ل ا ل ج ير ح ر ام. A number of our companions, from Sahl Bin Ziyad, from Ibn Fazzal, from Abu Al Magra, from Ibrahim Bin Maymoun that, Ibrahim Bin Al Musanna asked Abu Abdullah asws and I was listening, about the land which the man leases then sub-leases it out with more than that. He asws said: There is no problem with it. The land is not at the status of the house, nor an employee s wages. I said to Abu Abdullah asws, The land is leased for a third (of the produce), or the quarter, so it is sub-leased for the half. He asws said: There is no problem with it. I said, Supposing it is leased for a thousand Dirhams and sub-leased it for two thousand? He asws said: Not allowed. I said, How come the first is allowed and the second is not allowed? He asws said: Because this is guaranteed, and that is without a guarantee. 34 م ح م د ب ن ي ح ي ى ع ن م ح م د ب ن ال ح س ي ن ع ن ص ف و ان ع ن إ س ح اق ب ن ع م ار ع ن أ ب ي ع ب د للا ( عليه السالم ) ق ال إ ذ ا ت ق ب ل ت أ ر ضا ب ذ ه ب أ و ف ض ة ف ال ت ق ب ل ه ا ب أ ك ث ر م م ا ت ق ب ل ت ه ا ب ه و إ ن ت ق ب ل ت ه ا ب الن ص ف و الث ل ث ف ل ك أ ن ت ق ب ل ه ا ب أ ك ث ر م م ا ت ق ب ل ت ه ا ب ه ل ن الذ ه ب و ال ف ض ة م ض م ون ان. Muhammad Bin Yahya, from Muhammad Bin Al Husayn, from Safwan, from Is haq Bin Ammar, from Abu Abdullah asws having said: Whenever you lease a land with gold or silver, so do not sub-lease it out with more than what you had leased it with, and if you were to sub-lease it for the half (of the produce) and the third, so for you would be that you sub-lease it out for more than what you had leased it for, because the gold and the silver are both guaranteed. 35 ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ع م ي ر ع ن ح م اد ع ن ال ح ل ب ي ع ن أ ب ي ع ب د للا ( الد ار ث م ي ؤ اج ر ه ا ب أ ك ث ر م م ا اس ت أ ج ر ه ا ق ال ل ي ص ل ح ذ ل ك إ ل أ ن ي ح د ث ف يه ا ش ي ئا. عليه السالم ) ف ي الر ج ل ي س ت أ ج ر Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, from Abu Abdullah asws regarding the man who leases the house, then he sub-leases it out for more than what had had leased it for. He asws said: That is not correct unless he innovates something in it (makes an improvement). 36 ع د ة م ن أ ص ح اب ن ا ع ن أ ح م د ب ن م ح م د ع ن ع ث م ان ب ن ع يس ى ع ن س م اع ة ع ن أ ب ي ب ص ير ق ال ق ال أ ب و ع ب د للا ( عليه السالم ) إ ن ي ل ك ر ه أ ن أ س ت أ ج ر ر ح ى و ح د ه ا ث م أ ؤ اج ر ه ا ب أ ك ث ر م م ا اس ت أ ج ر ت ه ا ب ه إ ل أ ن ي حد ث ف يه ا ح د ث أ و ت غ ر م ف يه ا غ ر ام ة. would pasture in it and take the price from him. He asws said: So let him include with him the ones who he so desires to for part of what he has given, and even if he were to include with him forty nine sheep, and there was (only one) sheep of his for one Dirham, so there is no problem. و إ ن ه و ر ع ى ف يه ق ب ل أ ن ي د خ ل ه ب ش ه ر أ و ش ه ر ي ن أ و أ ك ث ر م ن ذ ل ك ب ع د أ ن ي ب ي ن ل ه م ف ال ب أ س و ل ي س ل ه أ ن ي ب يع ه ب خ م س ي ن د ر ه ما و ي ر ع ى م ع ه م و ل ب أ ك ث ر م ن خ م س ين و ل ي ر ع ى م ع ه م إ ل أ ن ي ك ون ق د ع م ل ف ي ال م ر ع ى ع م ال ح ف ر بئ را أ و ش ق ن ه را أ و ت ع ن ى ف يه ب ر ض ا أ ص ح اب ال م ر ع ى ف ال ب أ س ب ب ي ع ه ب أ ك ث ر م م ا اش ت ر اه ب ه ل ن ه ق د ع م ل ف يه ع م ال ف ب ذ ل ك ي ص ل ح ل ه. And if he was to pasture therein before he enters (others therein) by a month, or two months, or more than that after clears it for them, so there is no problem, and it is not for him that he sells it for fifty Dirhams and he pastures along with them, nor for more than fifty Dirham and he does not pasture along with them, unless it so happens that he had worked in the pasture with a work, digging a well, or grooving a canal, or he gets exhausted therein with the agreement of the owner of the pasture, so there is no problem with him selling it for more than what he had bought it for, because he had worked therein with a work. Thus, due to that, it is correct for him. 38 باب الر ج ل ي ت ق ب ل ب ال ع م ل ث م ي ق ب ل ه م ن غ ي ر ه ب أ ك ث ر م م ا ت ق ب ل Chapter 132 The man who contracts with the work, then subcontracts if out to someone else for more than what he had contracted it for م ح م د ب ن ي ح ي ى ع ن م ح م د ب ن ال ح س ي ن ع ن ص ف و ان ع ن ال ع ال ء ع ن م ح م د ب ن م س ل م ع ن أ ح د ه م ا ( عليهما السالم ) أ ن ه س ئ ل ع ن الر ج ل ي ت ق ب ل ب ال ع م ل ف ال ي ع م ل ف يه و ي د ف ع ه إ ل ى آخ ر ف ي ر ب ح ف يه ق ال ل إ ل أ ن ي ك ون ق د ع م ل ف يه ش ي ئا. Muhammad Bin Yahya, from Muhammad Bin Al Husayn, from Safwan, from Al A ala, from Muhammad Bin Muslim, from one of the two (5 th or 6 th Imam asws having been asked about the man who contracted with the work, so he did not do the work in it, and he handed it over to another, so he profited therein. He asws said: There is no problem with it. Muhammaid Bin Yahya, from Ahmad Bin Muhammad, from Ali Bin Al Hakam, from Ali Bin Maymoun the goldsmith who said, I said to Abu Abdullah asws, I contract the work wherein is the making jewelley and in it is the engraving, so I stipulate the engraver upon a stipulation. So when the time for accounting between me and him comes up, I make him reduce from the stipulated (price). He asws said; So is that with agreement from him? I said, Yes. He asws said: There is no problem. 41 باب ب ي ع الز ر ع ا ل خ ض ر و ال ق ص يل و أ ش ب اه ه Chapter 133 Selling the green plants, and the straw, and such like ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ع م ي ر ع ن ح م اد ع ن ال ح ل ب ي ق ال ق ال أ ب و ع ب د للا ( عليه السالم ) ل ب أ س ب أ ن ت ش ت ر ي ز ر عا أ خ ض ر ث م ت ت ر ك ه ح ت ى ت ح ص د ه إ ن ش ئ ت أ و ت ع ل ف ه م ن ق ب ل أ ن ي س ن ب ل و ه و ح ش يش و ق ال ل ب أ س أ ي ضا أ ن ت ش ت ر ي ز ر عا ق د س ن ب ل و ب ل غ ب ح ن ط ة. Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby who said, Abu Abdullah asws said: There is no problem with you buying green plants, then you leave it until harvest if you so desire to, or you use it as animal feed from before it grows seeds and it is grass.
