AND WATERWATCH OF OREGON S MOTION TO INTERVENE AND COMMENTS ON LICENSE AMDENDMENT, SURRENDER AND SETTLEMENT AND DECOMMISSIONING PLAN FOR THE BULL RUN HYDROELECTRIC PROJECT, FERC NO. 477-024 I. Introduction On November 12, 2002 (PGE) filed an Amendment of License, Surrender of License, Settlement and Decommissioning Plan with the Federal Energy Regulatory Commission (Commission) for the Bull Run Hydroelectric Project, FERC No. 477-024. On November 21, 2002 the Commission issued a Notice of Application for Amendment of License, Surrender of License, Settlement and Decommissioning Plan and Soliciting Comments, Motions to Intervene, and Protests. American Whitewater, Alder Creek Kayak Supply, Inc. and WaterWatch of Oregon move to intervene in this proceeding pursuant to 18 C.F.R. 385.214. Additionally, American Whitewater, Alder Creek Kayak Supply, Inc. and WaterWatch of Oregon appreciate the opportunity to comment on various documents. Interest of the Intervenors American Whitewater Affiliation (hereinafter known as American Whitewater) is a national non-profit 501(c)3 river conservation and recreation organization founded in 1957. We have over 8,000 members and 160 canoe club affiliates, representing approximately 180,000 whitewater paddlers across the nation. American Whitewater s mission is to conserve and restore America s whitewater resources and to enhance opportunities to enjoy them safely. As a conservation oriented paddling organization, American Whitewater has a strong interest in the future of the Sandy and Little Sandy Rivers and, therefore, the relicensing of the Bull Run Hydroelectric project. A significant percentage of our membership resides in the Oregon area. Federal actions that affect flow, access to the river and navigation may potentially adversely impact opportunities for American Whitewater members to utilize the Sandy and Little Sandy Rivers. Therefore, American Whitewater has a direct interest in the relicensing proceedings for the Bull Run Hydroelectric Project, FERC No. 477-024 on the Sandy and Little Sandy Rivers. Alder Creek Kayak Supply, Inc. is a local retail store located in Portland, Oregon. Alder Creek maintains a data base of customers in the Portland metropolitan area, which numbers over 28,000 customers. One of the unique characteristics of the Sandy and Little Sandy Rivers are their proximity to the Portland Metro region and our customer base. We specialize in whitewater recreation and a large number of our customers recreate on the Sandy and Little Sandy Rivers on a regular basis. Alder Creek provides rental of

equipment for use on the Sandy River and conducts classes, trips and safety clinics on the Sandy River. Our company name is derived from a major rapid on the Sandy River known as Alder Creek rapid. For many years the owners of Alder Creek were the owners of houses on the Sandy River, and one of us maintains a house on the Sandy to this day. For the first 8 years of our operation, our base was in Sandy, Oregon in close proximity to the affected rivers. As such, Alder Creek Kayak Supply, Inc. has a direct interest in the outcome of this proceeding. WaterWatch of Oregon (WaterWatch) is an Oregon non-profit 501(c)(3) river conservation organization established in 1985. WaterWatch s primary mission is to promote water policies for Oregon that provide the quantity and quality of water necessary to support fish, wildlife, recreation, biological diversity, ecological values, public health and a sound economy. One of the organization s primary goals is to establish rights to protect instream flows needed for fish, wildlife, recreation and other public interest values on every river system in Oregon, including the Sandy. WaterWatch has over 900 members, many of whom use and enjoy the Sandy River system. Since its inception WaterWatch has dedicated staff time and resources to the protection and restoration of streamflows in the Sandy River and its tributaries. More recently WaterWatch worked with a coalition of interests to get streamflows restored to the Sandy and Little Sandy Rivers. Federal actions that affect river flows in the Sandy Basin may potentially adversely impact WaterWatch s interests and the interests of WaterWatch s members. Therefore, WaterWatch has a direct interest in the relicensing proceedings for the Bull Run Hydroelectric Project, FERC No. 477-024 on the Sandy and Little Sandy Rivers. B. Grounds for Intervention Intervention by American Whitewater, Alder Creek Kayak Supply, Inc. and WaterWatch is in the public interest as required by 18 C.F.R. 385.214(b)(2)(iii). American Whitewater, Alder Creek Kayak Supply, Inc. and WaterWatch have significant undeniable interests in the preservation, restoration, and enhancement of the Sandy and Little Sandy rivers natural and recreational resources. No other party to the proceeding will be able to adequately represent those interests. American Whitewater, Alder Creek

Kayak Supply, Inc. and WaterWatch have a direct and substantial interest in the outcome of this process. C. Background American Whitewater, Alder Creek Kayak Supply, Inc. and WaterWatch have been integrally involved in this proceeding since Portland General Electric initiated the relicense process. We worked closely with Portland General Electric crafting the communications protocol for the alternative license process in this proceeding. American Whitewater and Alder Creek Kayak Supply Inc. filed comments on the Alternative Licensing Procedure on October 30, 1998. We were directly involved in scoping issues associated with this hydropower project, study development, implementation and analysis. American Whitewater, Alder Creek Kayak Supply, Inc. and WaterWatch have been active participants in the Settlement Group convened by Portland General Electric in December 2001. The Settlement and Decommissioning Plan submitted by Portland General Electric to the FERC is a direct byproduct from the Settlement Group. III. Comments The Settlement and Decommissioning Plan submitted by Portland General Electric as part of the Surrender Application is strongly supported by a wide array of interests. The Surrender Application encompasses the professional expertise of state and federal agency resource professionals as well as detailed analysis by non-governmental organizations and the public. As such, American Whitewater, Alder Creek Kayak Supply, Inc. and WaterWatch recommend the FERC accept the Surrender Application and the Settlement and Decommissioning Plan in its entirety. The parties to the settlement agree the Settlement and Decommissioning Plan represents the best alternative for the Sandy and Little Sandy Rivers. IV. Conclusion American Whitewater, Alder Creek Kayak Supply, Inc. and WaterWatch represent interests not represented by any other party to the proceeding. Our intervention is in the public interest as required by 18 C.F.R. 385.214(b)(2)(iii). Therefore, we respectfully request that the Commission grant this timely motion for intervention.

In addition, for the foregoing reasons, it is our view that FERC should approve the License Amendment, Surrender, and Settlement and Decommissioning Plan for the Bull Run Hydroelectric Project, FERC No. 477-024 on the Sandy and Little Sandy Rivers. The Settlement and Decommissioning Plan represents the best alternative as determined by state and federal resource professionals as well as non-governmental organizations and the public.
