RECOMMENDED COUNCIL ACTION: Motion to authorize replacement of all of the Fire Department self-contained-breathing-apparatus using pricing through the Houston-Galveston Area Council (H-GAC) purchasing consortium at a cost of $592,604.74. COMMENTS: One of the key pieces of personal protective equipment for firefighters is self-contained-breathingapparatus (SCBA). This device enables firefighters to have breathing air to safely work in fire and other lethal environments. The SCBA consists of a backpack, a high pressure air cylinder, a regulator, and a face piece. Each firefighter is issued his or her own face piece and it is tested annually to ensure proper fit. The SCBA itself is carried on fire trucks, with a few spares for maintenance and training purposes. Fire service SCBA is highly regulated by several government agencies including OSHA, due to the critical training and maintenance requirements. Design standards for this equipment are prepared periodically by the National Fire Protection Association and regulated by NIOSH. The rules and standards for use, training, and maintenance are continually evolving. The high pressure air cylinders also have a fixed life span. For this reason, we have assigned a ten-year replacement cycle for this critical equipment within the City s Equipment Replacement Fund. We began periodic replacement of SCBA in the 1980 s, and initiated the ten-year cycle beginning in 1995. SCBAs were last replaced in 2005. Since 1975 when the Fire Department was first organized, we have utilized Mine Safety Appliances (MSA) brand of SCBA exclusively. It is our intent to continue use of this specific brand of equipment as its use by firefighters will be most similar to equipment they are currently using, our maintenance staff are trained to repair and calibrate this brand of equipment, and our shop facilities already have the necessary equipment to perform maintenance and calibration of this brand of equipment.

We are proposing to utilize the government bid process conducted by the Houston-Galveston Area Commission, of which the City of Maple Grove is a member. Pricing is valid until January 1, 2016. We have used H-GAC purchasing previously for a fire truck in 2012. As we prepared for replacement of the SCBA, we analyzed our inventory and have made some adjustments to reflect current operations. This will result in a decrease in the overall inventory. Other adjustments are being made by utilizing some components of our existing SCBA rescue kits as only certain components of these kits need replacement to ensure compatibility. The cost to replace this equipment, including the fees payable to H-GAC for administering the bidding is $592,604.74. This includes 84 SCBA units, 168 30-minute high pressure air cylinders to allow for one for each unit and a spare, 36 60-minute high pressure air cylinders, assorted sizes of face pieces for each firefighter and several spares, equipment to convert the rescue packs to the new model of breathing apparatus, adaptors to use filters with the face pieces for environments where compressed air is not required, and a spare parts inventory for the shop based on past repair experience. Purchase of equipment through H-GAC is handled by local equipment distributors. In the case of this SCBA, the local distributor is Emergency Response Solutions (ERS) of Linwood, MN. ARTICLE 6: PAYMENTS H-GAC will confirm each order and issue notice to contractor to proceed. Upon delivery of goods or services purchased, and presentation of a properly documented invoice, the End User shall promptly, and in any case within thirty (30) days, pay H-GACs contractor the full amount of the invoice. All payments for goods or services will be made from current revenues available to the paying party. In no event shall H-GAC have any financial liability to the End User for any goods or services End User procures from an H GAC contractor. ARTICLE 7: CHANGES AND AMENDMENTS This Contract may be amended only by a written amendment executed by both parties, except that any alterations, additions, or deletions to the terms of this Contract which are required by changes in Federal and State law or regulations are automatically incorporated into this Contract without written amendment hereto and shall become effective on the date designated by such law or regulation. H-GAC reserves the right to make changes in the scope of products and services offered through the H-GAC Cooperative Purchasing Program to be performed hereunder. ARTICLE 8: TERMINA non PROCEDURES H-GAC or the End User may cancel this Contract at any time upon thirty (30) days written notice by certified mail to the other party to this Contract. The obligations of the End User, including its obligation to pay H -GACs contractor for all costs incurred under this Contract prior to such notice shall survive such cancellation, as well as any other obligation incurred under this Contract, until performed or discharged by the End User. ARTICLE 9: SEVERABILITY All parties agree that should any provision of this Contract be determined to be invalid or unenforceable, such determination shall not affect any other term of this Contract, which shall continue in full force and effect. ARTICLE 10: FORCE MAJEURE To the extent that either party to this Contract shall be wholly or partially prevented from the performance within the term specified of any obligation or duty placed on such party by reason of or through strikes, stoppage of labor, riot, fire, flood, acts ofwa r, insurrection, accident, order of any court, act of God, or specific cause reasonably beyond the party's control and not attributable to its neglect or nonfeasance, in such event, the time for the performance of such obligation or duty shall be suspended until such disability to perform is removed; provided, however, force majeure shall not excuse an obligaion solely to pay funds. Determination of force majeure shall rest solely with H-GAC.
