Subject to legislative approval, the promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter s control. Cricket Australia reserves the right in its absolute discretion to change or amend the KFC T20 Big Bash League fixture without notice. Neither the Promoter nor Cricket Australia accept responsibility for the cancellation or delay of any cricket match connected with this Promotion for any reason beyond the control of the Promoter or Cricket Australia. 7. By entering this promotion entrants agree to comply, and ensure that each subsequent ticket holder complies, with the ticket conditions, which accompany any tickets won in conjunction with the promotion. Entrants also agree to comply, and ensure that each subsequent ticket holder complies, with Cricket Australia s Ticket and Entry Conditions (available at www.cricket.com.au/tickets) supplemented by conditions of entry imposed by the venue operator. The Promoter will provide every person attending a match as part of the
promotion with a copy of Cricket Australia s Ticket and Entry Conditions with delivery of the prize tickets. Competition Entry Details 8. To be eligible for the Competition, entrants must: 8.1. Visit the BKT Tires activation at either Adelaide Oval on January 21 st from 3:45pm to 5:45pm, Marvel Stadium on January 30 th from 4:15pm to 6:15 pm or the GABBA on February 8 th from 4:40pm to 6:40pm (the Activities) and participate in the BKT Tires Howzat Snap Competition by taking a photograph of themselves in front of the green screen or; 8.2. Take a photo of themselves at the ground with a pair BKT Tires sunglasses on (provided) or; 8.3 Take a snap of themselves playing cricket with friends and family; 8.4 Upload the photograph to either or all of their social media accounts limited to Facebook, Twitter or Instagram; 8.5 Tag @BKTtires and @TradefaireInternational in the post; 8.6 Include in the upload the hash tags #BKTCricket 8.7 Information relating to the competition can be found at https://www.tradefaire.com.au/howzatsnap/ 9. The Competition start date is the 15 th of January 2019. The competition closes at midnight on February the 9 th 2019. 10. Entry is only open to Australian residents over the age of 18 with a social media account. Employees of the Promoter or Tradefaire International or their immediate families and anyone otherwise connected with the organisation or judging of the competition are ineligible to enter. 11. An upload of an image with the required hash tags is considered an entry. 12. All entries must be received by the Promoter or its agents by midnight on February 9 th 2019, by means of the image being uploaded to the Entrant s social media account with required tags and hash tags. The Prizes, Draw and Notifications 13. The draw for the prizes is a random selection based on chance and will be conducted by the Promoter s agent (Judge). The Judge s decision is final and no correspondence will be entered into. 14. The draw will be conducted at the offices of the Promoter, at 62 Tarnard Drive, Braeside Victoria 3195. 15. The draw will be conducted on February 10 th 2019 at 3pm. The first entry selected will be the winner of the first prize, the second selected will be the winner of the second prize, and the third entry selected will be the winner of the third prize. 16. The winners will be notified by the Promoter or its agent by phone and/or email on 10 th February 2019, and the winners details will be published on the Promoter s website on 10 th February 2019. 17. The prizewinners will have 3 months from the time of the draw in which to claim their prizes. If the prizes are not claimed by midnight on 9 th May 2019 the unclaimed prizes shall be deemed to have been abandoned.
18. The prizes are as follows: 18.1. 1st Prize: A trip to London to watch the 2 nd Test of the 2019 Ashes series at the home of cricket, Lord s Cricket Ground from 14 th 18 th August 2019. The prize includes return economy airfares for two, 6 nights accommodation, 5 days of tickets for the Lords Test, souvenir ASICS merchandise, a London travel card and entry to the official Ashes pre-test dinner. First prize is valued at an estimated $10,514.00 18.2. 2nd Prize: A Money Can t Buy experience. The winner and 5 friends get to come onto the ground during the T20 BBL Final to watch the teams warm up and observe the toss of the bat. This prize includes corporate hospitality tickets to the game, and travel and accommodation costs of up to $600. Second prize is valued at an estimated $4,200); and 18.3. 3rd Prize: An SS Cricket Bat 19. The first place prize winner and their companion (if applicable); 19.1. must ensure that they have valid documentation for the flight included in the prize, which meet the requirements of relevant government authorities; 19.2. must arrange (at their own expense) comprehensive travel and medical insurance cover for the full duration of their prize trip (including cover for participating in any activity forming part of the prize); 19.3. are responsible for all other expenses not included with the prize and unless the following are expressly included in the prize, the winner and their companion (if applicable) are liable for their spending money, meals, drinks, transfers, laundry charges, activities, incidentals, taxes, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs; 19.4. must travel at the same time, must depart from the same capital city for flight departure; and 19.5. acknowledge and agree that: 19.5.1. the air tickets are available on the regular scheduled services of the airline nominated by the Promoter and/or Cricket Australia and are subject to seasonal embargos, and the flight itinerary may have to be adjusted depending on the airline s departure city and their current flight schedule; 19.5.2. frequent flyer points (and other frequent flyer schemes) are not available from any airline and do not form part of the prize; 19.5.3. a credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges; and 19.5.4. where accommodation is included with the prize, once accommodation vouchers are issued they are non-changeable. 20. The second place prize winner and their companions (if applicable); 20.1. are responsible for all other expenses not included with the prize and unless the following are expressly included in the prize, the winner and their companions (if applicable) are liable for their spending money, meals, drinks, transfers, laundry charges, activities, incidentals, taxes, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs;
21. The prizes must be taken as stated and no compensation will be payable if a winner is unable to redeem the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. Prizes cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting a prize that the winner accepts the conditions of use of that prize. 22. If any prize is unavailable or otherwise unable to be supplied, the Promoter in its discretion, may substitute the prize with a prize of equal value and/or specification, subject to any directions from a regulatory authority. 23. Where the winner is a minor, the Promoter mat then deem the winner s entry as invalid unless the parent of guardian of the winner: 23.1. acknowledges that they are the parent or guardian of the winner; 23.2. confirms that they are over the age of 18 years old; 23.3. agrees to these terms and conditions in their own capacity and on behalf of the winner; 23.4. confirms that the winner has complied with the terms and conditions of the competition (as applicable) and will continue to comply with the terms and conditions of the competition to the extent applicable; and 23.5. indemnify the Promoter and Cricket Australia from and against any and all losses, costs, damages, expenses, liabilities and claims arising out of and to the extent that any of the terms and conditions of the competition are unenforceable against the winner or invalid because the winner is a minor. General Conditions 24. The Promoter is entitled to verify the validity of entries and the identity of entrants/winners, and to disqualify any entrant/winner who submits an entry that is contrary to these Terms and Conditions, or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage is not a waiver of those rights. 25. Incomplete, indecipherable or illegible entries will be deemed invalid. 26. Nothing in these terms and conditions limits excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees or warranties. Except for any liability that cannot be excluded by law, the Promoter and Cricket Australia (including its officers, employees and agents) excludes all liability for any personal injury, death, loss and damage; whether direct, indirect, special or consequential, arising in any way out of the Competitions, including but not limited to any liability arising from any technical difficulties or equipment malfunction; any reason beyond the Promoter s reasonable control; any variation of the prize value; any tax liability incurred by the winner or entrant; or redemption or use of a prize. 27. Subject to legislative approval, if the Competition is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter is entitled to, to the fullest extent permitted by law: disqualify any entrant; or subject to any direction from a regulatory authority, to modify, suspend, terminate or cancel the Competition. 28. The Promoter collects personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties and if required, to the Australian regulatory authorities. 29. By submitting an entry, entrants expressly consent to the Promoter and Cricket Australia using: 29.1. the entrant s entry (either in part or in full), name, likeness, image and/or voice to be reproduced and/or published in any medium for an unlimited period without remuneration for the purpose of promoting this Competition, the Promoter s business, and any products manufactured, distributed and/or supplied by the Promoter; and 29.2. their personal information for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the entrant.
