HALLELUJAH FARMS DRESSAGE 2880 N Eagle Road Eagle, Idaho 83616 Phone (208) 939-0785 Email: info@hallelujahfarmsdressage.com BOARDING CONTRACT AND LIABILITY RELEASE This Boarding and Training Contract and Liability Release ( Agreement ) is made by and between Hallelujah Farms Dressage (Hallelujah Farms Dressage refers to any officers, agents, employees, independent contractors, and any other person acting for, by, or through Hallelujah Farms Dressage.) and (Referred to as Owner ). TERMS A. SERVICE/FEES. Attached to this Agreement is a copy of Hallelujah Farms current list of boarding services and a schedule of fees. As consideration for the boarding, and care of horse(s), Owner agrees to pay Hallelujah Farms fees each month as set forth in the Hallelujah Farms schedule of fees. Hallelujah Farms Dressage will allow a four (4) day grace period for each monthly payment of basic boarding and training fees. A $50.00/week late fee will apply to payments made after the 5th of the month. In addition to the basic boarding fees, Hallelujah Farms Dressage will invoice Owner on a monthly basis for certain other fees or charges incurred after which payment shall be due to Hallelujah Farms Dressage within fourteen (14) days after Owner s receipt of the invoice. All fees and charges are subject to change upon thirty (30) days written notice to the Owner. Owner understands and agrees that horses kept in Hallelujah Farms Dressage custody for boarding and/or training under this Agreement will not be released from Hallelujah Farms Dressage until all fees and charges have been paid in full. The fees referenced above do not include veterinary, farrier, or other services. The costs of these services must be paid exclusively by Owner, and Owner agrees to pay for them.
B. FIRST PAYMENT. Hallelujah Farms Dressage acknowledges the receipt of a payment of $, which has been paid by Owner to Hallelujah Farms Dressage upon signing of this Agreement. Hallelujah Farms Dressage will apply this payment toward the first month s fees and expenses due under this Agreement. C. INFORMATION ABOUT OWNER AND HORSE(S) 1. Owner: Owner is the owner, part owner or lessee of the horse(s) listed in Section 2, below, and is desirous of having same horses at Hallelujah Farms Dressage in boarding pursuant to this Agreement. Owner must provide Hallelujah Farms Dressage with a negative Coggins Test taken of horse(s) and issued by a licensed veterinarian within the past twelve months. 3. Receipt of Horse(s). Hallelujah Farms Dressage acknowledges the receipt of horse(s) from Owner on [Date] for boarding under this Agreement. Owner has inspected Hallelujah Farms Dressage premises and is satisfied with the conditions of same. Hallelujah Farms Dressage reserves the right to use various assistants during boarding. It is mutually understood and agreed that this Agreement shall apply to all persons selected by Hallelujah Farms Dressage to assist in providing services under this Agreement.
D. SCHEDULE OF FEES BOX STALL $650.00 per month Includes hay three times daily, daily cleaning, daily turnout as weather allows, feeding grain am and pm, and blanketing. Use of the indoor and outdoor riding arenas. PADDOCK $450.00 per month Includes hay three times daily, cleaning daily as weather permits, feeding owner provided grain. PASTURE $400.00 per month Includes feeding hay twice daily in group setting Additional a la cart fees: Grooming Package for horses in full Training $150 per month Includes grooming 5x a week and tacking up for Training ride. Catching horse for vet or farrier $5.00 Attending horse for vet or farrier $40.00 per hour Hand walking $40.00 per hour Medicating horse oral or injectable $5.00 per day Bathing: $35 covers bathing with shampoo, conditioner; mane and tail detangler. Mane Pulling & Tail Trimming: $35 Braiding for clinic or show $35 Extra shavings in stall $50 per month Trailer parking $25 per month fee waived for boarders with multiple horses. E. FINANCIAL RESPONSIBILITIES OF OWNERS: 1. Invoices will be sent out between the 1st of each month. Payment is due by the 5 th. A $50.00 late charge will apply to all late payments. 2. HFD is not an open boarding facility. All boarders must be in a lesson program with one of the trainers. A minimum of 4 lessons a month is a requirement for keeping your horse boarded here. Consideration is given for travel, illness, injury and vacation. 3. Boarding your horse here is considered a monthly commitment. Boarding fees will not be pro-rated should you need to take your horse out of the barn for any reason. If you need to take your horse out of the barn for an extended period, but want to keep your stall, there will be a nominal fee of $100 per month to hold your stall. 4. Trailer/truck parking is allowed with a $25.00 per month storage fee. Boarders with more than one horse boarded here are exempt from this fee. 5. Owners are responsible for any damage to stall or HFD facility caused by the actions of their horse, their guest or themselves; that is considered beyond normal wear and tear. The cost of repairs will be added to the monthly invoice. 6. Board includes feeding, cleaning, turnout, and blanketing. All other services are extra and will be added to your monthly invoice. 7. All farrier and veterinary fees are the sole responsibility of the owner 8. Owner shall give at least 30 days written notice to Hallelujah Farms Dressage before removing horse(s) from boarding facility and ending boarding agreement. I understand that I am responsible for all veterinary expenses related to the care of my horse. Signature Date RULES FOR BOARDING AT HALLELUJAH FARMS DRESSAGE 1. PERSONAL BELONGINGS must be marked in some way. Use tags, permanent markers, monogramed embroidery-your choice.
2. BLANKETS should be waterproof for winter turnouts. Please provide a heavy, medium and lightweight turnout. Waterproofing spray can be re-applied as needed. 3. STORAGE of blankets and coolers in a water tight tack trunk with wheels in front of stall, paddock or pasture. 4. CROSS-TIES- Boarders are responsible to pick up after their horses. This includes hair and manure in all areas of the facility; indoor and outdoor ARENAS, cross ties, parking lot and walkways. Sweep up in cross-ties after you are finished. 5. GRAIN ROOM must be kept clean to discourage rodents and disease. Be respectful of space to accommodate everyone. Boarders have one blue tub, and should keep all their grain contained in tub. At least one week s amount of grain baggies be available for staff to feed twice daily and stored in tack truck (see 3. STORAGE). 6. SUPPLEMENTS for horses that HFD will feed at am feeding must be in Smartpak daily form and kept in a Smartpak drawer in feed room because we want to keep rodents out. Also, food items such as bananas, carrots, apples etc. should be kept in fridge, not the aisle way for the same reasons. Sugar or other treats should be stored securely as well. 7. BOARDERS are responsible for damage done by their horse to stall and/or facility that is not normal wear and tear. These charges will be added to your monthly bill. 8. SECURITY is important; boarders need to inform the HFD staff if they are planning to take their horse off the property for any reason (trail rides, vet, shows, clinics, etc..). 9. SAFETY is a priority at HFD. The following rules must be followed: Hard soled fully enclosed shoes required at all times. This rule also applies to guests. Paddock Boots or tall boots with a heel are required for riding. Riding in designated areas only. No bareback or riding double. Helmets must be worn at all times while mounted. Do not leave horse in cross ties or anywhere unattended. Be aware of the many inexperienced people who visit our barn. They may not know to move when you are walking your horse through the barn. Clean up after yourself. Keep belongings in your locker or neatly organized in boarders tack room to avoid slips and falls. 10. VIEWING LOUNGE Clean up after yourself. Turn off lights, heater, fans; radio to conserve energy when done. 11. LAUNDRY only saddle pads, boots, wraps and rags are allowed in the washing machine. Absolutely NO horse blankets. There is a Laundromat in downtown Eagle that allows horse blankets to be washed there. Try to keep washing to a minimum (only full loads) as it is running into a small septic tank. Please provide your own detergent. 12. FEED & SHAVINGS please let HFD know if you have any questions or concerns in regards to feed or shavings. HFD will then communicate with workers and/or barn manager/owners. 13. DOGS Owners have dogs of their own and they are somewhat territorial. Please leave your dogs at home. 14. NO SMOKING anywhere on HFD premises. Sign to acknowledge you fully understand, accept and agree to the Rules for boarding at HFD. Signature Date
Liability Release: 1. Hallelujah Farms Dressage (HFD) shall not be liable for any injuries to equine, canine or human. 2. Owner shall indemnify, defend and hold harmless HFD, their officers, directors, owners, successors, heirs, assigns, representatives, agents, servants, employees, and insurers, together with all persons acting for, through or by HFD, from any and all bodily injuries (to any equine or human) or property damage whatsoever. 3. Owner shall give HFD at least 24 hour prior notice (except in emergency) before picking up the horse for any reason. As long as owner is current on the advance payment of the boarding fee and any other expense due to HFD pursuant to the terms of this agreement, the owner may remove the horse for purposes of personal use and return the horse during a boarding month, but there will be no abatement of the monthly boarding fee. 4. Owner acknowledges that since HFD is a farm, riding school, horse training and boarding facility that there are risks associated with being on the premises. Horses and equipment present potential risk of injury and damage to equines, humans and property. Owner acknowledges those risks and hereby agrees to release, defend, indemnify and hold harmless HFD, HFD Trainers, John Mayberry, Amy Nordstrom, David Cimino, their successors, heirs, assigns, representatives, agents, servants, employees, and insurers, together with all persons acting for, through or by them or any of them, (hereinafter HFD) from all injuries, claims, or damages to any person, equine or property that are suffered by the undersigned, which may occur on the premises. 5. This release of all claims and indemnity agreement shall be binding upon the heirs, representative, executor, administrators, assigns, and successors of the parties hereto, and no promise, inducement or agreement not herein expressed has been made. The terms of this release and indemnity agreement are contractual in nature and not mere recitals. 6. All risk of loss on the horse and or the owner s tack and equipment shall be entirely on the owner whether the loss is caused by accident, illness, injury, fire or theft, or any other similar cause. Owner understands that HFD carries no insurance whatsoever on the horses boarded and/or tack and equipment and that, if owner desires insurance on the horse, tack and equipment that the owner has the sole responsibility to obtain and pay for said insurance. 7. In the event that either party shall file a lawsuit to enforce the terms of this agreement, the prevailing party in such suit shall be entitled to an award of its costs and attorney fees incurred therein from the other party. The parties further agree that the proper jurisdiction and venue for any lawsuit filed to enforce this agreement shall be Ada County, Idaho and shall be construed and determined in accordance with the laws of the state of Idaho. 8. This agreement is a fully integrated document and contains the entire understanding of the parties hereto regarding the boarding of the horse. There are no other agreements, promises, covenants, or warranties not expressed herein. 9. Owner hereby grants Hallelujah Farms Dressage an Agister s Lien, pursuant to Idaho code 45-805, on the horse to secure payment of any unpaid fees and expenses hereunder and understands and agrees that HFD shall keep physical possession of the horse until all said fees and expenses have been paid in full.
