Attachment A Conditions of Use Lompoc Valley Festival Association Spring Fest 2017 Based on the application submitted, Staff is recommending support of the activity contingent upon the following conditions being met: 1. LVFA provide a $1 million certificate of general liability insurance naming the City of Lompoc as additional insured and stating all third party vendors providing on-site services for event are covered under organization event insurance. Lompoc Recreation Division reserves the right to request a separate insurance policy from any third party vendor which may be deemed a high risk. The City shall be provided with the certificate at least 30 days in advance of the activity. The certificate shall cover set-up and takedown dates. 2. A $2,000 cleaning and damage deposit be posted with Lompoc Recreation Division to cover any expenses the City may incur from the applicant's use of Ryon Park. This deposit shall include any keys required for access to the park. Charges for lost keys will be deducted from the cleaning/damage deposit at the rate of $25 per key. All keys must be returned to the Recreation Division at the conclusion of the program. Any key that is not returned must be returned before any future facility use permit will be issued. KEYS ISSUED BY THE CITY ARE NOT TO BE DUPLICATED. 3. Pursuant to Parks and Recreation Commission Resolution No. 15-1, the applicant shall pay a daily use fee of $275 per section for LVFA S request to use the Old Section and East Side of the Tennis Court of Ryon Park. The set up fee per section is $100 each day. 4. Sales activities in City Parks are regulated by the Parks and Recreation Commission Resolution No. 94-1, Section 10. Selling of articles in the park is prohibited, except that the Parks and Recreation Director may authorize sales by "any regularly licensed concessionaire" provided that: a. Merchandising vendors shall have appropriate permits. Those permits, if necessary, should be obtained from the City Clerk. b. Sales may only be made during the time that the applicant has possession of the park. c. Sales may only be made by persons who have express approval of the applicant, or their agent. d. The applicant shall not disapprove a request to sell during the event except based upon a rational reason related to general or specific purposes and space and crowd control. e. In the event that the Director is not available authorizations may be made by the Recreation Manager.

Page 2 5. Any necessary health permits for food service should be obtained from the County Environmental Health Department by the organization providing the service. A copy of the application must be submitted to the Recreation Manager two weeks in advance of the activity. 6. Trash and cardboard dumpsters be provided as required by the Public Works Sanitation Division. Plans to deliver, locate, and dump on a routine basis must be coordinated with the City s Public Works Sanitation Division and LVFA designee. 7. Portable chemical toilets (30) and hand washing stations shall be provided as recommended by the Building Division. Any recommended units shall include at least two (2) handicap accessible units per ten (10) chemical toilets. The public restrooms will be closed for the duration of this event. LVFA has been authorized by the Recreation Manager to provide 28 regular and 2 handicap chemical toilets for this event, instead of 24 regular and 6 handicap units. 8. Any plans to drive stakes, poles, or like objects into the landscaped areas of the park be approved by the Parks Supervisor, or designee. 9. Support vehicles will be allowed on the park grounds, but may not exceed 35,000 gross vehicle weight without prior written approval of the Parks Supervisor. No moving vehicles are allowed in the park during actual event hours. Any and all traffic entering and exiting the interior of the park must do so through the Cypress Avenue gate off of R Street. A representative of the organization shall monitor this gate to ensure proper traffic control. 10. LVFA ensure that the tennis courts remain open to the public during set up days and will be closed from April 21-23, 2017. 11. That LVFA must not encumber the athletic fields as they are used by Little League and City Softball Leagues Monday through Friday from 3:00 p.m. to 10:00 p.m. and Saturday and Sunday from 7:00 a.m. to 10:00 p.m. 12. LVFA utilize the southeast corner of the park (east of tennis courts) for smaller carnival rides to ease congestion in the parking lot. 13. During the carnival ride set up, semi trucks will not access the ride area off of R Street and O Street on the fire/emergency lane during the times of 3:30 p.m. to 7:00 p.m. Monday through Friday. 14. That LVFA will not allow set-up or breakdown of carnival rides between the hours of 11:00 p.m. and 7:00 a.m. Due to problems with this condition with previous events, the City reserves the right to assign employees or a security firm to monitor the after hour activity of the carnival. LVFA will pay for expenses incurred by the City related to this condition.

Page 3 15. Specifically, referring to the use of the Lompoc Airport property located off of North O Street. a. LVFA agrees to pay $126 per day for the use of the airport grounds to support the operation of the carnival. The carnival operation shall use the area only on those dates stipulated on the facility use agreement submitted to the City by the Festival Association. The area designated for use by the carnival operation will be specifically marked and/or identified by the City. b. A representative of the City and the LVFA will inspect the grounds before the carnival operation moves into the area and after the carnival operation leaves the area. These inspections should take place one day before the carnival operation arrives and one day after they leave. c. LVFA must provide trash dumpsters, as required by the Solid Waste. LVFA plans to deliver, locate, and dump on a routine basis must be coordinated by the LVFA with the City's Public Works Sanitation Division. d. LVFA must provide portable chemical toilets, as required by the Parks Supervisor. All wastewater from the carnival operation shall be disposed of properly at the designated locations within the City. The airport grounds must be cleared of all debris when the event has concluded. e. The City will furnish no water or electricity. However, portable generators can be used for electrical power. f. No open fires are allowed on the grounds of the airport. 16. Notification of, and coordination with all proper law enforcement agencies is the responsibility of the applicant. Areas of concern include, but are not limited to, traffic flow, protection of private property, amplified sound, etc. LVFA must make all arrangements and provide a plan showing how any and all accidents, injuries and emergency matters will be handled. City must be provided proof of notifications and emergency plan at least 30 days in advance of event. 17. Any electrical service to the food booth area shall be coordinated with the City's Electrical Division. The user has the option of utilizing a private electrical contractor, or the City's Electrical Division to install/connect the required wiring. Use of Electric Division portable power pedestals shall be coordinated with the Electric Division and payment of the installation fee is payable in advance to the Electric Division. A final safety inspection shall be performed by the City's Electrical Division the day before the event commences. 18. In order to comply with City ordinances and the National Electrical Code (NEC), all carnivals, fairs and festivals must obtain permits from the City of Lompoc Building Division and have all facilities inspected before and after applying power.

LVFA shall be subject to the rules and regulations governing amplified sound, as adopted by the Parks and Recreation Commission Resolution No.02-02, which establishes a maximum noise level of 80 dba measured100-125 feet from the point of origin. 20. Pursuant to Parks and Recreation Commission Resolution No. 92-2, amplified sound will be limited from 12:00 noon until 30 minutes before dusk, or will terminate by 7:00 p.m. LVFA is requesting that the carnival will conclude by 11:00 p.m. on Friday and Saturday. On Sunday, the Carnival will conclude by 8:00 pm. Amplified sound shall be restricted to the stage area only and terminated at 10:00 p.m. 21. Consumption of alcohol is prohibited in City Parks (City Code 9.20.020), except in the cases of group area reservations and special events where an alcohol permit has been requested from, and approved by, Lompoc Recreation Division. The Beer Garden hours of operation are as follows, Friday, April 21 (12:00 p.m. 9:30 p.m.), Saturday, April 22, (10:00 a.m. - 9:30 p.m.) and Sunday, April 23 (10:00 a.m. 6:30 p.m.). The beer/wine concession must stop dispensing its product one half-hour before stage activities conclude. LVFA will provide security for the Beer Garden beginning 30 minutes prior and 30 minutes after the beer garden operation hours. Copies of the ABC permit with supporting documents must be submitted to the Recreation Manager prior to event date. 22. Specifically, referring to the sale of beer and wine, the following conditions are imposed pursuant to Parks and Recreation Commission Resolution No. 85-2: a. A license must be obtained from the California Alcoholic Beverage Control Board. b. That LVFA service and distribution of alcoholic beverages shall be limited to a designated confined area with adequate security, specifically the Old Section of Ryon Park. c. That LVFA serve beer and wine only in paper or plastic containers. LVFA will ensure that these plastic containers are clearly distinguishable to their organization. d. All consumption of alcohol must be purchased from the beer garden and is only allowed in the Old Section of Ryon Park. Glass containers will not be permitted in the park. As well, no outside alcohol will be allowed at this event. e. That LVFA post signs stating alcohol must be purchased from the beer garden as well as signs that will clearly identify no alcohol beyond this point throughout the park. f. LVFA will be responsible for providing security to ensure that alcohol will be confined within the Old Section of Ryon Park area. Additional signs will be needed that state there will be no glass containers or outside alcohol permitted in the park as reflected in the City Ordinance.

Page 5 23. LVFA shall place no restrictions on expressive activities protected by the First Amendment without the prior approval of the City Attorney. 24. As directed by the City Council, the LVFA shall pay 50% for all "direct" costs associated with requests to utilize City services (utilities, labor, and materials). The exceptions are the set-up and takedown costs of the stage. These costs will be assessed at 100%. 25. Generators need to be grounded. Hot fueling is not permitted. All extension cords shall be protected from abrasion including the use of bridges where deemed necessary. Minimize areas where foot or vehicle traffic crosses the path of cords. No pyrotechnic material is permitted to be used at the park at any time. No parking of vehicles along the South lawn against the block wall adjacent to the residential homes 75 foot buffer. 26. All tents over 400 square feet are required to obtain a temporary membrane permit and required an additional inspection. There is a Fire Fee inspection for Special Event Plan Review of $275 that will be paid at the Lompoc Recreation Division Administrative Offices.
